Walter, Director of Public Works Prepared By: Barbara Lynch City Engineer$L- SUBJECT: FOOTHILL BRIDGE REPLACEMENT PROJECT, SPECIFICATION NO, 90197D CONSTRUCTION MANAGEMENT AMENDMENT CAO RECOMMENDATION Approve Amendment No. 9 to the Construction Management Services Agreement with MRO Engineers and authorize the Mayor to execute the Amendment. DISCUSSION The replacement of the Foothill Bridge is largely complete after a year and a half of construction. From the beginning, the project has required consultant services for construction. Inspection and environmental monitoring were required on a full time basis and since the City does not have a bridge inspector or a biologist to dedicate full-time to the project, this service has been provided by the designers MRO Engineers. The project budget included funding for these needs at the time of award. As the project neared completion, it became clear that additional funds would be required to provide the remaining inspection and monitoring services required. The key reason for this is that the project construction timeline changed from that originally envisioned. This occurred primarily for two reasons, each of which added over a month to the project. The first was the conversion of the project to allow the bridge to be built over the existing culverts. This extended the duration of the project but allowed the bridge to be completely open to traffic several months sooner. The second was the discovery of contaminated water and extended unstable backfill in the excavation. These conditions were unknown to the City at the time of award and also caused delays to the construction timeline. On December 6, 2005, the City Council authorized $50,000 for additional construction management and monitoring services. Through an oversight Amendment No. 9 to the Agreement with MRO Engineers was not included with the request for funding. Staff is now requesting that Council authorize the amendment to allow Finance to process the final bills. FISCAL IMPACT Current Budget Construction:. Inspection & Monitoring $576,000 Original Agreement: $576,000 Contingencies $50,000 Amendment No. 9: $30,000 Total: $626,000 Total Revised.Agreement: $606,000 Cy--I Foothill Bridge Construction Management Amendment Page 2 The bills associated with Amendment No. 9 represent approximately $30,000 of the total $50,000 requested in December. At the time of the budget augmentation request, the extent of the additional cost was not known. At this time, staff has all but a minor bill outstanding and is able to provide a much better estimate as to the final additional cost needed to complete the construction management and environmental monitoring. Of the $20,000 that appears will be remaining in the account at completion, only $4,000 are actually City funds with the remainder being grant funds. WITNESSETH: WHEREAS, on September 26, 2001 the City entered into an Agreement with Consultant for design and environmental services for the Foothill Street Bridge; and WHEREAS, additional construction services are required beyond those anticipated in Amendment 8 to inspect and provide material testing for the project; NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter contained, the parties hereto agree as follows: 1. Authorization is given for additional work to provide construction related services in an amount not to exceed $ 30,000 ; 2. All other terms and conditions of the Agreement remain in full force and effect.
