CAO RECOMMENDATION Adopt a resolution authorizing the Mayor to sign a Memorandum of Understanding with SLO Green Build and approving a one-time allocation of$2,000 from the General Fund as seed funding. DISCUSSION What's Proposed SLO Green Build (SLOGB) proposes to enter into a Memorandum of Understanding (MOU) to provide technical help with the City's Green building programs. In addition, SLOGB has requested a .one-time contribution of $2,000 to defray the non-profit's printing costs for educational materials and other program costs. A similar MOU was proposed to San Luis Obispo County and each of the six cities in the County. The City of Arroyo Grande has entered into the MOU and contributed seed funding. SLO Green Build SLOGB is a non-profit, countywide agency established to help local governments, building professionals and homeowners understand and use sustainable design and building practices. Its membership includes architects, builders and LEED-certified "Green Building" specialists who worked closely with the City, Chamber of Commerce, and local American Institute of Architects chapter on the recently-adopted Conservation and Open Space Element (COSE). Chapters 4 and 5 of that document address energy and materials conservation and include new policies and programs focusing on sustainable design, construction and operation of public and private buildings. For example, Policy 4.30.14 says the City will adopt an ordinance containing requirements and incentives for "innovative, environmentally-friendly (also known as "sustainable" or"green")development and building projects." What's Green Building? Green building is a whole systems approach using architectural design and building techniques to minimize environmental impact and reduce energy and materials consumption due to building construction, while contributing to the health of the building's occupants. It promotes sustainable development though energy efficiency, resource conservation and recycling, and use of materials and methods for healthful indoor air quality. It melds practical, proven building SLO Green Build MOU and Reque. Jr Seed Funding Page 2 technologies with conservation and environmental quality goals, and has been adopted in various forms by numerous cities throughout California and the Nation. Benefits and Terms of the MOU In developing an ordinance. to implement COSE Policy 4.30.14, the City will seek the participation of a wide range of interests, particularly those with special expertise in this field. Under the proposed MOU, SLOGB would participate in and provide consultative assistance for preparing such an ordinance, and assist with staff training and support, and in promoting green building through community events and printed material. The City's obligations under the agreement would be: 1. To provide $2,000 toward printed materials and other program costs (as described in the MOU under SLO Green Build "duties and responsibilities"). 2. Encourage voluntary green-building method's for privately owned buildings. 3. Encourage non-residential projects greater than 45,000 square feet to achieve at least a LEED Silver Certification from the Green Building Council. 4. For all future building and renovation of City buildings over 5,000 square feet, consider seeking certification under the LEED Green Building Rating System,to at least the Silver standard. 5. Provide a liaison to meet with SLO Green Build quarterly to develop an in-house green build team. With adoption of the COSE, the City has met or adopted policy intended to meet items 2, 3, and 4 above, with one exception. With SLOGB's support, the COSE was written to encourage non- residential projects over 60.000 square feet—not 45,000 square feet— to achieve at least a LEED Silver Certification. The MOU should be revised to reflect this difference. Item 1 would require a one-time contribution of$2,000 in seed funding. Item 5 calls for a City representative to meet with SLOGB quarterly as a member of a countywide team promoting green building programs. Council may wish to designate one of its members to serve in this capacity, or delegate that role to Community Development Department staff. The MOU is a five-year agreement and would be in effect until 2011. Either SLOGB or the City could modify the agreement by written amendment, or terminate the agreement upon 30-day written notice. FISCAL IMPACT The requested $2,000 seed funding is available within existing General Fund resources. Proceeding with the MOU and seed funding is appropriate course of action to implement the Conservation and Open Space Element, recently adopted by the Council. ATTACHMENTS 1. A similar MOU is being proposed to SLO County and to each of the six cities in the county. f1 a v SLO Green Build is a non-profit county-wide effort to help local governments, building s, professionals and homeowners think,plan and act sustainably about designing, constructing and remodeling homes and facilities. C� The City of San Luis Obispo has for some time been playing a leading role in the greening of our county as evidenced, for example, by its water conservation and waste management programs, its emphasis on natural resources management, its adoption of the Ahwahnee Principles,and your recent signing of the U.S. Mayors Climate Protection Agreement. Lately, as well,members of SLO Green Build's Technical Committee have been working with the City's planning commission on a draft of green-building provisions for the City's Conservation and Open Space Element. Cities throughout California and the country are re-examining current building policies and practices both to counter the adverse effects of traditional building practices on our environment and health and to reap the long-term financial benefits of green building. In August 2000, by executive order of the governor, the state of California established sustainable building as a primary goal for state construction. It then established the Sustainable Building Task Force(a partnership of 40 governmental agencies), which issued a landmark report in October 2003 entitled, "The Costs and Financial Benefits of Green Buildings." This report confirmed that`minimal increases in upfront costs of about 2%to support green design would,on average, result in life cycle savings of 20%of total construction costs—more than ten times the initial investment."In other words, an initial upfront U Attachment 1 John Ewan, Council Member February 91 2006 Page 2 investment of$100,000 to incorporate green building features into a$5 million project would result in savings of$1 million in current dollars over the life of the building. This report also contributed to the growing awareness of municipalities throughout the state that green building was a good thing to do not only for environmental and health reasons, but for economic reasons as well. Concurrent with the report's release, the California Integrated Waste Management Board undertook to coordinate the green-building efforts of communities around the state–an undertaking that has since been picked up by a non-profit organization called Build It Green, which was formed in 2003 by a group of local and regional public agencies, building industry professionals, manufacturers and suppliers. Build It Green's Public Agency Council presently consists of representatives from 70 local governments in the state. The most immediate focus of Build It Green has been on finalizing and publishing a set of green-building guidelines, a stated purpose of which is"to provide local governments with an educational tool for city staff, builders and homeowners interested in green residential construction." SLO Green Build is now disseminating the guidelines within San Luis Obispo County, and stands ready to help the City put them into practice while providing a range of related services as outlined in the MOU. These services specifically address the green-building provisions of the U.S. Mayors Climate Protection Agreement.. The City's contribution of$2,000 will help SLO Green Build, a non-profit organization, to provide the services listed in the MOU and to assist City staff in implementing the green-building measures outlined in the City's Conservation and Open Space Element Arroyo Grande has already signed one of these MOUs, and we expect other cities to follow suit. In particular, we look forward to the City of San Luis Obispo joining in this county-wide effort, building on all the steps it has already taken to green our built environment. SLO Green Build's mission is ... • to promote sustainable building techniques that minimize construction waste, build healthier indoor environments, and reduce energy use while conserving natural resources; • to provide architects, engineers, contractors, developers, and other building professionals with the proper tools to build sustainable projects; and • to support and help develop public policy which advocates for sustainable architectural, social, and building practices. To cavy out this mission, SLO Green Build will establish a green-building program that includes printed resources, educational workshops and trainings. Among the printed resources will be guidelines and a checklist for green- building certification based on standards that have been (1) established by the U.S. Green Building Council's Leadership.in Energy and Environmental Design (LEED)program and (2)adopted by more than 70 local governments in California who make up the Public Agency Council of Build It Green,the professional non-profit organization that coordinates statewide green-building efforts. It is the general purpose of this Memorandum of Understanding to describe the duties and responsibilities of the parties in agreement. (2006 Series) A RESOLUTION OF THE CITY COUNCIL OF SAN LUIS OBISPO, CALIFORNIA, APPROVING A MEMORANDUM OF UNDERSTANDING WITH SLO GREEN BUILD AND AUTHORIZING ONE-TIME SEED FUNDING WHEREAS, SLO Green Build is a non-profit agency established to assist local government, design and building professionals and homeowners understand and use sustainable building practices;and WHEREAS, SLO Green Build has proposed entering into a Memorandum of Understanding (MOU) with the City to provide technical assistance and support for the City's green building policies and programs; and WHEREAS, the City has considered the proposed MOU and determined that it would be in the public interest to enter into the MOU to secure technical assistance in implementing General Plan policies regarding sustainable development and "green building" and related conservation programs. THEREFORE, BE IT RESOLVED BY THE SAN LUIS OBISPO CITY COUNCIL AS FOLLOWS: SECTION 1. Memorandum of Understanding approved. 1. The proposed MOU, Exhibit 'A, is approved with the following amendment to the section under "Duties and Responsibilities — City of San Luis Obispo Agrees to the Following": "Encourage nonresidential projects greater than 45,000 60.000 square feet to achieve at least a LEED Silver Certification from the U.S. Green Building Council." 2. The Mayor is authorized to sign the MOU on behalf of the City, and to approve amendments to or to terminate the MOU per the terms of the agreement. SECTION 2. Seed Funding Authorized. 1 The City Administrative Officer is authorized to use $2,000 from the General Fund as one-time seed funding for SLO Green Build to help defray the cost to prepare educational materials for City staff and the public, and to defray costs for other programs that benefit the City, as more particularly described in Exhibit A. As part of the MOU, the City is to designate a liaison to meet with SLO Green Build on a quarterly basis for information sharing and to provide oversight. Staff recommends that as part of your action on the consent item, Council designate the Community Development Director or his designee as liaison. A staff member in the Department's Building Division will take training to become LEED certified, and this expertise will facilitate the Department's liaison and support role.
