SUBJECT: RESOLUTION TO AUTHORIZE THE CITY TO APPLY FOR FEDERAL.
TRANSIT FUNDS.
CAO RECOMMENDATION
Adopt a resolution authorizing the designation of the Public Works Director as the official City
applicant for federal transit funds.
DISCUSSION
The City receives federal transit funds for capital and operating assistance for the City's Transit
Program.
The Federal Transit Administration (FTA) has requested that all transit operators and other
recipient agencies recertify their staff designees who are authorized to enter into agreements.
The purpose for this recertification effort is to have current users in the system. FTA is purging
all other users from the system. As part of this effort, and, as required by 49 CFR, Chapter 53,
Title 23, transit operators and users of the grant management database are required to submit
authorizing resolutions in order to receive federal transit grants.
Attachment 1, the Federal Transit Fund Authorizing Resolution, will supersede the City's current
Authorizing Resolution.
FISCAL IMPACTS
The Federal Transit Funds Authorizing Resolution will allow the City to continue to apply, receive,
and manage its federal transit funds from FTA. There will be no impact to the General Fund by
approving the resolution.
ALTERNATIVES
The Council could not approve the resolution. The impact of this would be to eliminate the
City's ability to receive federal transit dollars. This in turn would have a detrimental impact to
the City's financial ability to provide transit service at current levels.

RESOLUTION AUTHORIZING THE FILING OF APPLICATIONS WITH THE
FEDERAL TRANSIT ADMINISTRATION,AN OPERATING ADMINISTRATION OF
THE UNITED STATES DEPARTMENT OF TRANSPORTATION,FOR FEDERAL
TRANSPORTATION ASSISTANCE AUTHORIZED BY 49 U.S.0 CHAPTER 53,TITLE
23 UNITED STATES CODE AND OTHER FEDERAL STATUTES ADMINISTERED BY
THE FEDERAL TRANSIT ADMINISTRATION.
WHEREAS,the Federal Transportation Administrator has been delegated authority to
award Federal financial assistance for a transportation project; and
WHEREAS,the City of San Luis Obispo is a Grantee and receives funds from
Urbanized Area Formula Program assistance authorized by 49 U.S.C. §5307 from the Federal
Transit Administration; and
WHEREAS, the grant or cooperative agreement for Federal Financial assistance will
impose certain obligations upon the Grantee, and may require the Grantee to provide the local
share of the project cost; and
WHEREAS,the Grantee has or will provide all annual certificationsand assurances to
the Federal Transit Administration required for the project.
NOW,THEREFORE,BE IT RESOLVED by City Council of-the City of San Luis
Obispo as follows:
SECTION 1. The Director of Public Works or his/her designee is authorized to submit,
execute and file application for Federal assistance on behalf of City of San Luis Obispo with the
Federal Transit Administration for Federal Assistance authorized by 49.U.S.C. chapter 53, Title
23, United States Code, or other Federal statutes authorizing a project administered by the
Federal Transit Administration, Grantee has received authority from the Designated Recipient to
apply for Urbanized Area Formula Program assistance.
SECTION 2.The Director of Public Works or his/her designee is authorized to execute
and file with its application the annual certification and assurances and other document the
Federal Transportation Administration requires before awarding a Federal assistance grant or
cooperative agreement.
SECTION 3. The Director of Public Works or his/her designee is authorized to execute
grant and file cooperative agreements with the Federal Transit Administration on behalf of the
City of San Luis Obispo.
