C I TY O F SAN L U I S O B I S P O FROM: Monica Irons, Director of Human Resources SUBJECT: MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS, LOCAL 3523 FOR THE PERIOD OF JANUARY 1, 2006 THROUGH DECEMBER 31, 2009. CAO RECOMMENDATION Adopt a resolution approving the Memorandum of Agreement for a four-year contract between the City of San Luis Obispo and the International Association of Firefighters, Local 3523. DISCUSSION The Memorandum of Agreement (MOA) between the City and the International Association of Firefighters, Local 3523 (Fire) expired on December 31, 2005, at the end of a four and a half year contract term. As provided in the MOA, the City entered into negotiations with Fire in October 2005, to develop a successor MOA. The City Council was briefed in closed session on November 1, 2005 regarding Fire's initial proposals. Council provided staff with economic parameters for negotiations. Rick Bolanos, Attorney with the law firm Liebert Cassidy Whitmore, represented the City as Chief Negotiator with the assistance of Monica Irons, Human Resources Director, and Karen Jenny, Risk Manager. Tony Spitaleri represented Fire as the Chief Negotiator. Members of the Fire negotiating team were: Erik Baskin, Sammy Fox, Steve Gonzalez, Ray Hais, Greg Logan, and John Madden. Fire presented their initial proposals in October and November of 2005 with the parties exchanging proposals until early April 2006. At that time, both parties believed they were still quite far apart and Fire suggested the assistance of a mediator. A mediator from State Mediation and Conciliation was assigned and the parties met with the mediator for two full days in late May and early June 2006. At the close of mediation a tentative MOA was reached which was ratified by the membership on June 22, 2006. The MOA is within the economic guidelines provided by Council and in line with economic indicators. The four year MOA is beneficial for both Fire and the City as it brings clarity and stability in labor relations; thus allowing the parties to continue to provide essential city services. With a four year contract the department is better able to budget and plan for the proposed increases. Longer term contracts are also typically indicative of effective departmental operations. The MOA includes equity adjustments for three Fire Inspectors and the Hazardous Materials Coordinator. Market data indicated these classifications are currently compensated approximately 20% below market average and the equity adjustments address this issue. The following is a summary of the key changes included in the MOA: c7-1 Council Agenda.Report—Fire MOA Page 2 Term: January 2006 through December 31, 2009 Salary: January 2006: 3% increase for all Fire employees . July 2006: 2%increase for all Fire employees July 2007: 4% increase for all Fire employees July 2008: 5%increase for all Fire employees July 2009 5%increase for all Fire employees Uniform Allowance: January 2006 $50 increase; from $750 to $800 annually Equity Adjustments: July 2006 6% equity adjustment for Fire Inspectors and Hazardous Materials Coordinator July 2008 6% equity adjustment for Fire Inspectors and Hazardous Materials Coordinator Paramedic Incentive: July 2007 increase from 9%to 12%of top step firefighter pay Paramedic Assignments: July 2007 increase number of paramedics from 20 to 22 July 2008 increase number of paramedics from 22 to 24 Education Incentive: January 2008 compensate members $100 per month for an associate's degree and $200 per month for a bachelor's degree in a related field of study Hazardous Materials Incentive: January 2009 increase from 3%to 4%of top-step firefighter pay Cafeteria Contribution: The City will continue the existing cost-sharing formula. This annually modifies the cafeteria contribution by an amount equal to one-half of the average percentage change for family coverage in the PERS health plans available in San Luis Obispo County. FISCAL IMPACT Fire represents 39 Safety and 5 Non-Safety employees with current annual total compensation of $5.4 million. The total cost for this four-year compensation package is approximately$788,000, an average of$197,000 per year. Adequate funding is available in the MOA adjustment account for the current fiscal year. Increases for subsequent years will be included in the Financial Plan. ALTERNATIVE Do not approve the resolution and direct staff to negotiate a different successor MOA. This altemative is not recommended,as the MOA is consistent with the Council's previous direction and the City's employer-employee relations policies. (2006 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS,LOCAL 3523 FOR THE PERIOD OF JANUARY 1, 2006,THROUGH DECEMBER 31, 2009 BE IT RESOLVED,by the City Council of the City of San Luis Obispo as follows: SECTION 1. The Memorandum of Agreement between the City of San Luis Obispo and the International Associations of Firefighters, Local 3523, attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby adopted and ratified. SECTION 2. The Finance Director shall adjust the Personnel Services appropriation accounts to reflect the negotiated compensation changes. SECTION 3. The City Clerk shall furnish a copy of this resolution and a copy of the executed Memorandum of Agreement approved by it to: Erik Baskin, Intemational Association of Firefighters, Local 3523, and Monica Irons, Director of Human Resources.
