SUBJECT: PUBLIC HEARING ON THE 2006-07 PROGRAM OF PROJECTS
FOR A FEDERAL TRANSIT ADMINISTRATION (FTA) GRANT
CAO RECOMMENDATION
1. Conduct a public hearing to review and approve the Program of Projects (POP).
2. Adopt a resolution authorizing the Public Works Director to file a grant application and
execute the grant agreement from the FTA in the amount of$1,546,400.
3. Amend the Fiscal Year(FY) 2006-07 Transit Fund budget to reflect revisions to the City's
allocations.
DISCUSSION
Background
Since the 1990 census, the City has been classified as an urbanized zone area (UZA) and is
eligible to receive Federal Transit Administration (FTA) formula grants for operating and capital
assistance. To apply for these grants, the Council must annually:
1. Publish the Program of Projects (POP);
2. Hold a public hearing on the proposed POP for federal transit assistance;
3. Seek approval by the San Luis Obispo Urbanized Zone Area Technical Committee;
4. Adopt a resolution authorizing the Public Works Director to file a grant application and
execute the grant agreement; and
5. Forward the approved POP to San Luis Obispo Council of Governments (SLOCOG) for
review and amendment into the Federal Transportation Improvement Program (FTIP).
The 2006-07 Program of Projects was published in the Tribune on July 1, 2006.
Funding Estimate
The planning estimate for the current year apportionment for the San Luis Obispo Urbanized
Zone Area (SLO UZA) is $1,301,697, plus the unused amount from the previous year, the total
amount available for programming in FY 2006-07 is $1,653,300. The City of San Luis Obispo
will be allocated the amount of$1,546,400, and the San Luis Obispo Regional Transit Authority
will be allocated the amount of $105,600. The balance of $1,300 will be available in the next
funding cycle.

This increase in the apportionment available to the SLO UZA is due to the passage of the new
transportation funding bill called Safe, Accountable, Flexible, and Efficient Transportation
Equity Act - A Legacy for Users (SAFETEA-LU). The new bill continues the FTA 5307 grant
program and includes two new programs that will benefit San Luis Obispo Transit. Referring to
Table 1 below, the two new programs are called Growing States (FTA Section 5340), and Small
Transit Intensive Cities (FTA Section 5336j, also called STIC). In simple terms, SAFETEA-LU
is assisting states with high growth rates by providing additional funding for their transit
programs. The Growing States program allocates funding based on population density and
growth projections. The STIC program allocates additional funding to small transit systems that
exceed the national average in six specific performance areas: 1) passenger miles per revenue
mile, 2) passenger mile per revenue hour, 3) revenue miles per capita, 4) revenue hour per capita,
5) passenger mile per capita, and 6) passengers per capita.. When a small operator exceeds the
national standard, the transit system annually receives $132,000 for each category to use in their
system. The City exceeded averages in three of the performance areas.

Development of the Program of Projects
The 2006-07 POP represents the third year that the San Luis Obispo Regional Transit Authority
(SLORTA) is an eligible recipient of FTA 5307 funding in the San Luis Obispo Urbanized Zone
Area. As required by FTA, all transit operators within an Urbanized Zone Area must execute a
memorandum of understanding (MOU) formalizing how FTA funds will be made available to
eligible transit operators within each Urbanized Zone Area.
According to the adopted MOU, the San .Luis Obispo Urbanized Zone Area Technical
Committee has reviewed and approved the proposed POP. The Committee, comprised of the
City of San Luis Obispo, SLORTA, Air Pollution Control District, and SLOCOG, has been
meeting to review, rank and approve this year's grant requests.
FTA requires a public hearing on the FY 2006-07 POP to notify the public how the UZA will
spend its FTA grants and provide the public an opportunity to comment on those
recommendations. This public hearing is a FTA requirement, and will allow the SLO UZA to
receive FTA grant reimbursements for $1,652,000 for the current fiscal year. The City of San
Luis Obispo will receive $1,546,400 of the total apportionment in the San Luis Obispo
Urbanized Zone Area. SLORTA will receive $105,600 of the apportionment, and the balance of
$1,300 will be available in the next funding cycle. The San Luis Obispo Urbanized Zone Area
Technical Committee approved the project list in Table 2 below:

Finally, the FTA grant agreement requires annual certifications of compliance regarding
regulations such as civil rights, procurement procedures, and substance abuse.
Program of Project Details
The Program of Projects include the following individual projects:
1. SLO Transit Operating Assistance for 2006-07. The federal share of this project is
$353,000. This project will help fund transit operating expenses.
2. Bus Replacement. The federal share of this project is $906,400. This project will fund three
replacement buses to comply with the California. Air Resource Board (CARB) emission
requirements. Because of this mandate, the City must replace its older transit buses in order
to reduce its emissions by 85%.
3. Capital Cost of Contracting. The federal share of this project is $120,000. This project
will pay capital costs for bus maintenance paid via the transit services contract. Capital Cost
of Contracting fluctuates annually because of the yearly priorities between capital and
operating demands on FTA Section 5307 funds in the SLO UZA Area.
4. Particulate Trap Retrofit. The federal share of this project is $127,000. This project will
fund particulate traps on buses to comply with the California Air Resources Board (CARB)
mandate. This project funds the fust year of a two-year project. This option is not available
for older buses, because these devices are specific to engine years, manufacturers, and
models.
5. Short Range Transit Plan Update (SRTP). The federal share of this project is $40,000.
This project will examine the operating and financial health of San Luis Obispo Transit, and
make recommendations to improve the current operating conditions. This project will also
include an on-board origin/destination study, and make recommendations for the City's
future circulation element. The City's SRTP will be prepared concurrently with San Luis
Obispo Regional Transit Authority's SRTP to coordinate routes and basic service levels.
6. Replacement Runabout Vehicles. The federal share of this project is $105,600. This
project will replace two Runabout vehicles. SLORTA will be responsible for securing the

remaining $26,400 dollars from its local funds.
CONCURRENCES
The San Luis Obispo Urbanized Zone Area Technical Committee approved the recommended
POP on June 26, 2006. The Mass Transportation Committee reviewed the City's Draft 2006-07
POP on July 7, 2006. There was consensus to forward the POP to Council,
FISCAL IMPACT
Budget amendments to the City's 2006-07 Budget will be necessary to reflect the changes in
grant amounts. Table 3 summarizes the changes in the Capital Improvement Program.

AUTHORIZING THE FILING OF THE 2006-07 FEDERAL CAPITAL AND
OPERATING ASSISTANCE GRANT APPLICATION WITH THE FEDERAL TRANSIT
ADMINISTRATION
WHEREAS, the Federal Transit Administration has been delegated authority to award
federal financial assistance fora transportation project; and
WHEREAS, a grant of federal assistance will impose certain obligations upon the City of
San Luis Obispo and may require the City of San Luis Obispo provide the local share of project
costs; and
WHEREAS, the City of San Luis Obispo has or will provide all annual certifications and
assurances to the Federal Transit Administration required for the project; and
WHEREAS, a grant of federal assistance will impose certain obligations upon the San Luis
Obispo Regional Transit Authority and may require the San Luis Obispo Regional Transit
Authority provide the local share of project costs; and
WHEREAS, the San Luis Obispo Regional Transit Authority has or will provide all annual
certifications and assurances to the Federal Transit.Administration required for the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Luis
Obispo as follows:
SECTION 1. The City of San Luis Obispo and San Luis Obispo Regional Transit Authority
are eligible recipients as defined by 49 U.S.C. 5307, 5336j, and 5340..
SECTION 2. The Public Works Director is authorized to execute and file an application for
federal assistance on behalf of the City of San Luis Obispo with the Federal Transit
Administration for federal assistance authorized by 49 U.S.C. Chapter 53,Title 23, United States
Code and other federal statutes authorizing a project administered by the Federal Transit
Administration.
SECTION 3. The Public Works Director is authorized to execute and file with the
application the annual certifications, assurances, and other documents the Federal Transit
Administration requires before awarding a federal assistance grant.
SECTION 4. The Public Works Director is authorized to execute grant agreements with the
Federal Transit Administration on behalf of the City of San Luis Obispo.
