Cg' CITY OF SAN LUIS OBISPO FROM: Monica Irons,Director of Human Resources SUBJECT: RESOLUTION TO ADJUST CONFIDENTIAL EMPLOYEES' COMPENSATION CAO RECOMMENDATION: Adopt a resolution adjusting compensation for the City of San Luis Obispo Confidential Employees for the period from January 1, 2006 through December 31, 2009. DISCUSSION The City's confidential employees are not represented by a collective bargaining unit in accordance with the Government Code. Therefore, they do not formally negotiate with the City in regards to their compensation and terms and conditions of employment. Typically, informal discussions between management and the four City confidential employees take place following the determination of salary and benefit changes for the San Luis Obispo City Employees' Association (SLOCEA) due to the similarity between the confidential positions and the positions represented by SLOCEA. Currently there are four confidential employees in the following positions; Executive Assistant to the City Administrative Officer, Executive Assistant to the Human Resources Director, Legal Assistant, and Human Resources Specialist. After brief discussions between management and these employees, staff recommends extending to the confidential employees the same adjustments to salary and cafeteria contribution approved by Council for SLOCEA employees. These recommendations are outlined below. Salary: January 2006: 2%wage increase July 2006: 2%wage increase July 2007: 5%wage increase July 2008: 5%wage increase July 2009 5%wage increase Cafeteria Contribution*: December 2005 increase by$65 to $635 per month December 2006 increase by$75 to $710 per month December 2007 increase by$80 to $790 per month December 2008 increase by$80 to $870 per month *Cafeteria contributions change in December due to January premium increases which are projected to increase an average of 15% a year. I Council Agenda Report—Confidential Employees' Compensation Adjustments Page 2 In addition to the above changes, staff also recommends a slight enhancement to the Long Term Disability(LTD)benefit for this group of employees. The current benefit is 60% of salary after a 90-day waiting period. The recommendation is to bring this benefit in line with the LTD benefit for SLOCEA and management employees; 66 2/3% of the first $5,000 of monthly salary after a 30-day waiting period. FISCAL IMPACT The confidential employees' total compensation is approximately $293,806. The cost of this resolution is approximately $44,500 over the course of four years, or an average of$11,125 per year. Adequate funding for the 2006-07 increase is currently available in the MOA adjustment account. Funds for subsequent years will be included in the appropriate Financial Plan. ALTERNATIVES Do not approve the resolution and direct staff to discuss a different change to the compensation for these classifications. This alternative is not recommended, as the recommended changes are consistent with the Council's previous direction and with a recent agreement approved for SLOCEA. (2006 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO ADJUSTING THE COMPENSATION FOR THE CITY'S CONFIDENTIAL EMPLOYEES FOR THE PERIOD OF JANUARY 1,2006 THROUGH DECEMBER 31,2009 WHEREAS, the City of San Luis Obispo designates the Executive Assistant to the City Administrative Officer, the Executive Assistant to the Director of Human Resources, the Legal Assistant and the Human Resources Specialist as confidential employees pursuant to the Government Code, WHEREAS, as such, confidential employees are precluded from collective bargaining and therefore are not governed by a collective bargaining agreement, WHEREAS, the wages, hours and other terms and conditions of employment for confidential employees are established by resolution, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Luis Obispo hereby resolves as follows: SECTION 1. The salaries of the confidential employees shall be increased and the confidential salary ranges adjusted according to the schedule shown in Exhibit"A". SECTION 2. The cafeteria plan contribution for confidential employees shall be increased to $635 per month effective December 1, 2005, $710 per month effective December 1, 2006, $790 per month effective December 1, 2007,and$870 per month effective December 1,2008. SECTION 3. Effective July 1, 2007, the Long Term Disability benefit shall be 66 2/3% of the first$5,000 of monthly salary with a benefit waiting period of 30 days.
