CAO RECOMMENDATION
1. Approve plans and specifications for the "Swim Center Therapy Pool, Specification No.
9009313"project and authorize staff to advertise for bids for project construction.
2. Authorize CAO to award the contract if lowest responsible bid is within the Engineer's
Estimate of$300,000.
3. Approve Addendum No. 2 in the amount of $1,500 to Rowley International, Inc. for
additional design services and increase the encumbrance an additional $1,500 to cover
estimated reimbursable expenses associated with the consultant's contract.
4. Approve the transfer of$21,785 from the completed Swim Center Sand Filtration project
account to the project budget.
5. Appropriate $124,216 from the unappropriated balance of the Parkland Development
Fund.
DISCUSSION
This project involves the construction of a small warm water pool at the San Luis Obispo Swim
Center located at Sinsheimer Park. The project fulfills the City's goal of providing recreational
opportunities to groups and individuals that the facility currently does not serve or have been
underserved in the past, such as seniors with arthritis or other disabilities, infants learning to
swim,people rehabilitating from injuries, and other special needs populations.
In 1999, Council authorized a study of the need for a therapy pool. The findings indicated a
significant level of community support for the project. As such, the therapy pool was adopted as a
Major City Goal and funded in the 2003-05 Financial Plan. Council also authorized staff to search
for a grant or donation to fund the design and construction of the pool and subsequently staff was
successful in obtaining a 2002 Proposition 40 Bond Act Per Capita grant in the amount of$220,000
to help fund this project.
In 2004, staff hired Rowley International, an aquatic design firm, to provide a feasibility study for
the Therapy Pool. The study confirmed that a small (approximately 1200 square feet) hydrotherapy
pool could be designed and built within the existing budget. The recommended design involved
demolishing the small tot pool near the existing bath house and constructing a new larger combined
therapy/children's pool in its place, taking advantage of the existing deck and using the existing
mechanical room. In the spring of 2005, upon the recommendation of the Parks and Recreation
Commission, Council approved the concept of the combined therapy/children's pool. Given this
direction, Rowley proceeded with the design of the new 1200 SF combined pool. The contract

documents for construction of the pool are now complete. Staff recommends moving forward with
advertising the project and soliciting bids.
Additional Design Cost. In March of 2005, Amendment No. 1 was executed with the consultant to
provide the design and contract documents for the new therapy pool. Their proposal for design was
$18,000 plus reimbursable expenses (travel, reproduction costs, etc). The encumbrance, however,
was created for the $18,000 and did not take into account an additional amount for estimated
reimbursable expenses. To date, the reimbursable expenses have been minor, only amounting to
$216; however, with the upcoming construction phase, the potential for reimbursable expenses will
increase as the consultant will be making 3-4 trips to San Luis Obispo to review the project at
various stages of construction. Increasing the encumbrance by$1,500 should be sufficient to cover
any forthcoming reimbursable expenses.
Furthermore, an increase to the consultant's contract is needed for additional electrical engineering.
The current scope of work includes the electrical design for the new pool and equipment based on
an assumption by both the consultant and staff that adequate power was available in the mechanical
room. Upon completion of the equipment design it was found that the current electrical system in
the bathhouse mechanical room was inadequate to handle the new pool system. The consultant
provided the City with a proposal for additional engineering in the amount of $1,500 (see
Amendment No. 2 attached) to cover the cost of the electrical engineer to travel to the Swim
Center, verify the capacity of the main building electrical service and provide additional design for
upgrades to the main building panel, a new mechanical room sub panel, and new swimming pool
panel. In order to keep the project moving forward, staff directed the consultant to go forward with
the additional design. Council approval of this amendment is required since this additional $1,500
fee places the total aggregate contract amount with Rowley International at $25,500, over the
$25,000 threshold for CAO approval.
Staff recommends approval of Amendment No. 2 in the amount of $1,500 plus increasing the
encumbrance an additional $1,500 to cover any upcoming reimbursable costs associated with the
construction phase of the project.
Construction Cost increases. Since 2004, staff has seen construction cost increases on all types of
construction projects ranging from 30% to 80%. These increases have had a corresponding effect
on the estimated pool construction cost. The engineer's cost estimate submitted with the 2004
Feasibility Study was approximately$185,000, which fit well within the budget at that time. The
current cost estimate is $300,000 or about 60%higher than originally estimated. As discussed in
the Fiscal Impact section, an increase to the project budget is needed to allow this project to go
out to bid.
CONCURRENCES
1. The Parks and Recreation Commission and the Joint Use Committee approved the design
concept at their April 2005 meetings.
2. The School District has granted the City approval to build, operate and maintain the new
therapy pool via an amendment to the existing Joint Use agreement.
3. The Community Development Department has granted this project a Categorical
Exemption in accordance with the California Environmental Quality Act (CEQA) and

reviewed and approved the plans as a Minor/Incidental Architectural Review project.
4. The Parks and Recreation Department concurs with the recommendation to cover the
increased cost with a new appropriation from the Parkland Development Fund.
FISCAL IMPACT
This project is identified in the 2003-05 Financial Plan. Funds currently allocated for this project
come from a 2002 Proposition 40 Bond Act Per Capita Grant in the amount of $220,000. As
discussed above, the project costs have substantially risen in the last few years. The grant for
$220,000 will no longer cover the full cost of the project. To cover the additional costs, staff
recommends transferring theremaining account balance of $21,784 from the completed Swim
Center Sand Filtration project along with a new appropriation from the Parkland Development
Fund, which has an unappropriated balance of$495,200. The Finance and Information Technology
Director concurs with this funding strategy. A summary of the estimated projects costs and the

ALTERNATIVES
1. Downsize the pool. The pool could be downsized to eliminate the shallow portions and
only maintain the deeper sections for therapy. However, downsizing the pool would not
significantly decrease the cost. There would be minor savings in costs due to the smaller
deck and pool; however, the bigger issue is losing the shallow water experience for the
"tots"which we currently serve with our wading pool. Staff does not support this option
as it would simply fill one unmet need by sacrificing another.

2. Defer the project. Based on past experience, costs are more likely to increase with time.
The project will become even more expensive to build as time passes.
3. Abandon the project.The goal of this project is to fill a number of recreational
opportunities not currently offered by the City. These unmet needs would not be
addressed and the Council goal unfulfilled.

Dear Bridget:
During the Design of the new Therapy Pool at Sinshiemer Park it has become apparent that
the design of the electrical panel for the Therapy Pool equipment Room will require additional
engineering. Normally a Building Electrical Engineer provides the design of the Swimming
Pool electrical panel which originates from the existing building electrical equipment.
In this case there is no Building Electrical Engineer to provide this design. The Swimming
Pool Electrical Engineer has indicated that he would accept this responsibility under the
following conditions.
The Swimming Pool Electrical Engineer would require a site visit in order to verify the existing
electrical equipment. He would also verify existing service has sufficient capacity to sustain
additional electrical loads. The Swimming Pool Electrical Engineer would gather information
necessary for the design of the swimming pool panel and its connection and conduit to
connect the swimming Pool panel with the existing building electrical equipment.
The proposed additional service cost for the field visit and design of this electrical panel would
be fifteen hundred dollars ($1,500.00).

feasibility study for the Swim Center Therapy Pool project and on March 31, 2005 amended to
provide construction documents for said project,and
WHEREAS,the City desires to amend the scope of services to include additional design
services for said project and Consultant has submitted a cost proposal and scope of work for this
purpose that is acceptable to the City.
NOW THEREFORE, in consideration of their mutual promises, obligations and
covenants hereinafter contained,the parties hereto agree as follows:
1. The scope of services and related compensation is hereby amended as set forth in
Exhibit A attached hereto.
