SUBJECT: RESULTS OF THE NOVEMBER 7, 2006, GENERAL MUNICIPAL
ELECTION
CAO RECOMMENDATION
Adopt a resolution declaring the results of the November 7, 2006, General Municipal Election.
DISCUSSION
The canvassing of the returns for the November 7, 2006, General Municipal Election is
performed by the County Clerk-Recorder in accordance with Resolution No. 9806 (2006 Series).
This year, due to the large number of provisional ballots the final canvass and certification of
results of the vote for each candidate for the offices of Mayor and Members of the City Council,
as well as the results of the vote for Measure Y-06, San Luis Obispo Essential Services Measure,
are not available for publication with the agenda report. The County Clerk-Recorder has
indicated that they will be available no later than Thursday, November 30, 2006. Preliminary
results indicate that: 1) Dave Romero received the highest number of votes and was the
candidate elected to the office of Mayor, 2) Andrew Carter and Allen K. Settle received the
highest number of votes and were elected to the offices of Council Member, and 3) Measure Y-
06 received a majority of votes in favor of the Measure and was ratified.
In accordance with California Elections Code section 10262, Council will be requested to adopt a
resolution declaring the results of the General Municipal Election and the final Certificate of the
Canvass, included as an exhibit to the resolution. A draft resolution containing the preliminary
results is provided with the agenda report. The final resolution and certification of the results
will be provided prior to the December 1, 2006, Council meeting.
FISCAL IMPACT
There are no costs associated with the adoption of this resolution. An invoice describing the
costs to conduct the election has not yet been received by the City Clerk; however, anticipated
expenses are accounted for and included in the City Clerk Elections budget.

RESOLUTION NO. (2006 Series)
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SAN LUIS OBISPO DECLARING
THE RESULTS OF THE GENERAL MUNICIPAL ELECTION
HELD TUESDAY,NOVEMBER 792006
WHEREAS, a General Municipal Election was held in the City of San Luis Obispo on
Tuesday,November 7, 2006, as required by State Law and the Charter of the City of San Luis
Obispo, for the purpose of electing one Mayor and two Members of the City Council; and
WHEREAS, one ballot measure proposing a one-half cent sales tax increase for a period
of eight years,with citizen oversight and independent annual financial audits (Measure Y-06),
was submitted to the voters on Tuesday,November 7, 2006; and
WHEREAS,the Results of the Canvass of All Votes Cast at the Consolidated General
Election held on November 7, 2006,has been certified by the County Clerk-Recorder and is
attached and made a part hereof as and are hereby entered by the City Clerk in the official records
of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Luis
Obispo that:
SECTION 1. The whole number of votes cast in said election within the City of San
Luis Obispo was (to be inserted).
SECTION 2. The names of the persons voted for at the election for Mayor were:
Donald E.Hedrick
Christine Mulholland
John R. Ewan
Dave Romero
SECTION 3. Dave Romero, the candidate receiving the highest number of votes cast at
said election for the Office of Mayor, is hereby declared elected to such office for a term ending
December 1, 2008.
SECTION 4. The names of the persons voted for at the election for Council Member
were:

Terry W. Conner
Andrew Carter
Allen K. Settle

SECTION 5. Andrew Carter and Allen K. Settle, the two candidates receiving the
highest number of votes cast at said election for the Office of City Council Member, are hereby
declared elected to such office each for terms ending December 1, 2010.
SECTION 6. That the ballot measure submitted to the voters was as follows:
San Luis Obispo Essential Services Measure: To protect and
maintain essential services—such as neighborhood street paving and Yes
pothole repair; traffic congestion relief;public safety, including restoring
eliminated traffic patrol,Fire Marshal and fire/paramedic training _ ________-
positions; flood protection; senior citizen services/facilities;
neighborhood code enforcement; open space preservation and other vital No
general purpose services—shall the sales tax be increased by one-half
cent for eight years only, with citizen oversight and independent annual
financial audits?
SECTION 7. MEASURE Y-06 did receive a majority vote in favor and is hereby
declared ratified.
SECTION 8. The City Clerk shall sign and deliver to each duly elected officer a
Certificate of Election certifying to his/her election, and further,the City Clerk is directed to
certify to the passage and adoption of this resolution and enter it into the book of original
resolutions.
SECTION 9. Pursuant to Section 9269 of the California Elections Code, the City Clerk is
hereby directed to forward to the Secretary of State a certified copy of the affidavit of publication
in connection with Measure Y-06, a copy of all ballot arguments relating to Measure Y-06 and a
certified copy of this resolution declaring the results of the election.
