SUBJECT: FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR TRACT 2419 -A
NINE LOT RESIDENTIAL SUBDIVISION ON THE SOUTH SIDE OF
MCCOLLUM STREET. (PATRICK AURIGNAC,SUBDIVIDER)
CAO RECOMMENDATION
Adopt a resolution accepting the public improvements, and certifying completion of the required
private improvements, and releasing the bonds for Tract 2419.
DISCUSSION
The required subdivision improvements approved with the tentative map for Tract 2419 (Vicinity
Map, Attachment 2), per Resolution No. 9192 (2001 Series) approved June 5, 2001, have been
completed to City standards and specifications. The final map for Tract 2419 was approved, per
Resolution No. 9327 (2002 Series).
Public improvements include frontage and street improvements along McCollum Street and
Fredericks Street, a water main extension in Leroy Court (a private street), and storm drain
improvements located within the McCollum Street and Fredericks Street rights-of-way. The
remaining subdivision improvements are private including but not limited to Leroy Court, the on-
site storm drain system, and a private sewer main located within Leroy Court. '
The public and private subdivision improvements were completed to the satisfaction of the city
and a request for acceptance of the same was received in May of 2006. Because of increased
work loads and reduced staffing during the time of the request, this item was tasked for a future
date. The task to prepare this request for acceptance was discovered in our records and the item
was subsequently scheduled.
The subdivider has requested final acceptance of the public improvements by the City and release
of the respective sureties. Included with the final map approval in 2002 was a subdivision
agreement that allowed the Subdivision Labor and Materials and.the Faithful Performance bonds
to be released upon the Council's acceptance of the subdivision improvements and receipt of a
guarantee of ten percent of the cost of the public improvements. The cost of the public
improvements was estimated to be $154,500. When the proposed resolution is approved and the
subdivider has provided a replacement security in the amount of $15,450, the Public Works
director will authorize the City Clerk to release that security. The release of the Labor and
Materials security may be processed after the 60 day waiting period referenced in Section
66499.7(h) of the Government Code of the State of California.

The replacement security of $15,450, or ten percent of the estimated construction cost, is to
insure that the subdivider will remedy any defects in the improvements arising from faulty
workmanship or materials or defective construction of said improvements occurring within
twelve (12) months after subdivision acceptance, in accordance with City Council Resolution
No. 9763 (2006 Series) and Sections 66499.7 and 66499.9 of the Government Code of the State
of California.
FISCAL IMPACT
Typical maintenance and operation of public facilities will be required for the water main and fire
hydrant in Leroy Court, and for street and storm drain improvements along McCollum Street and
Fredericks Street.
CONCURRENCES
The Community Development Director and Utilities Director concur with the recommended action.

RESOLUTION NO. (2007 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ACCEPTING THE PUBLIC IMPROVEMENTS FOR TRACT NO. 2419
WHEREAS, the City Council made certain findings concerning Tract 2419, as
prescribed in Resolution No. 9192 (2001 Series); and
WHEREAS, the City Council approved the final map for Tract 2419 per
Resolution No. 9327 (2002 Series); and
WHEREAS, the subdivider has satisfactorily completed the public improvements
for Tract 2419, in accordance with City standards, specifications and the subdivision
agreement, and has requested acceptance of the public improvements for maintenance
and operation by the City. The private improvements have been completed per plan.
WHEREAS, the subdivider has satisfactorily completed the private improvements
for Tract 2419, in accordance with City standards, specifications and the approved plans,
and has requested that the city certify completion of these private improvements.
NOW THEREFORE, BE IT RESOLVED, the City Council hereby accepts the
public improvements and certifies completion of the private improvements for Tract No.
2419. The current Faithful Performance surety is hereby reduced to $15,450, being ten
percent of the total cost of the public improvements, to be held for one year from this
date, in accordance with the subdivision agreement. The Labor & Materials surety may
be released after 60 days from this date of acceptance of the improvements in accordance
with Section 66499.7 of the California Government Code.
