SUBJECT: FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR TRACT 2726—A
168 UNIT RESIDENTIAL CONDOMINIUM (CONVERSION) SUBDIVISION

Adopt a resolution accepting the public improvements, and certifying substantial completion of
the required private improvements, and releasing the bonds for Tract 2726.
DISCUSSION
The required private subdivision improvements approved with the tentative map for Tract 2726
(Vicinity Map, Attachment 2), per Resolution No. 9781 (2006 Series) approved March 21, 2006,
are substantially complete and the code required public improvements have been completed to
City standards and specifications. The final map for Tract 2726 was approved, per Resolution
No. 9866 (2007 Series),January 23, 2007.
Public improvements included only minor sidewalk repair along Southwood Drive. The
remaining subdivision improvements were private, including but not limited to, repaving of the
onsite parking lot, modifications to the units for private open space, aesthetic improvements to
the site along with the installation of a photovoltaic system in-lieu of the originally*required
carports. While the installation of the photovoltaic system is not complete, Public Works and
Community Development concur that the release of that portion of the security used to guarantee
the other required improvements is appropriate. The estimated cost for the installation of the
photovoltaic system is $217,440 including a 20 percent contingency and this amount is the
appropriate amount that the subdivider is required to provide a guarantee.
The subdivider has requested final acceptance of the public improvements by the City and reduce
the amount of the sureties. Included with the final map approval in January 2007 was a
subdivision agreement that allowed the Subdivision Labor and Materials and the Faithful
Performance bonds to be released upon the Council's acceptance of the completed subdivision
improvements and receipt of a guarantee of ten percent of the cost of the outstanding
improvements. The total cost of the required improvements, including contingencies, was
estimated to be $750,408. The release of the Labor and Materials security may be processed after
the 60 day waiting period referenced in Section 66499.7(h) of the Government Code of the State
of California..
When the proposed resolution is approved, the required security will be reduced to the ten

percent or $75,048 for warrantee purposes, plus the amount guaranteeing the installation of the
photovoltaic system or $217,440. The total security required is $292,488. Of this security,
$214,440 will be released when the photovoltaic work is complete and $75,048 will be held for
the required 2 month warranty period, after which the Public Works Director will authorize it's
release.
The replacement security of $75,048, or ten percent of the estimated construction cost, is to
insure that the subdivider will remedy any defects in the improvements arising from .faulty
workmanship or materials or defective construction of said improvements occurring within
twelve (12) months after subdivision acceptance, in accordance with City Council Resolution
No. 9763 (2006 Series)and Sections 66499.7 and 66499.9 of the Government Code of the State
of California and will be released by the Public Works Director at the end of the warrantee
period.
FISCAL IMPACT
The required public improvements, which were repairs to existing curb, gutter and sidewalk will
have no additional financial impact to the City.
CONCURRENCES
The Community Development Director and Utilities Director concur with the recommended action.

RESOLUTION NO. (2007 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ACCEPTING THE PUBLIC IMPROVEMENTS FOR TRACT NO.2726
WHEREAS, the City Council made certain findings concerning Tract 2726, as
prescribed in Resolution No. 9781 (2006 Series); and
WHEREAS, the City Council approved the final map for Tract 2726 per
Resolution No. 9866 (2007 Series); and
WHEREAS, the subdivider has satisfactorily completed the public improvements
for Tract 2726, in accordance with City standards, specifications and the subdivision
agreement, and has requested acceptance of the public improvements for maintenance
and operation by the City. The private improvements have been substantially completed
per plan.
WHEREAS, the subdivider has substantially completed the private improvements
for Tract 2726, in accordance with City requirements, and has requested that the city
certify completion of these private improvements.
NOW THEREFORE, BE IT RESOLVED, the City Council hereby accepts the
public improvements and certifies completion of the private improvements for Tract No.
2726. The current Faithful Performance surety is hereby reduced to $292,488 being ten
percent of the total cost of required improvements, plus the cost to complete the
installation of the photovoltaic system, to be held for one year from this date, in
accordance with the subdivision agreement. The amount guarantying the installation of
the photovoltaic system may be released upon completion of said work and the Labor &
Materials surety may be released after 60 days from this date of acceptance of the
improvements in accordance with Section 66499.7 of the California Government Code.
