DEVELOPMENT IMPACT FEE WAIVERS
CAO RECOMMENDATION
Adopt a Resolution clarifying Resolution 9131 (2000) to ensure that all deed-restricted
affordable residential developments either in excess of the inclusionary requirement, or for units
of four or less, are eligible for City-wide development impact fee waivers from the City of San
Luis Obispo.
DISCUSSION
Since the inception of the City's Inclusionary Housing Ordinance in 1995, the City has developed
and applied its policies to ensure that "affordable" housing beyond the inclusionary requirement
not be subject to standard development impact fees that apply to market rate development. In this
way, the City encourages affordable housing development by lowering the overall costs to the
developer. "Affordable" is strictly defined as deed-restricted residential development reserved for
qualifying families at affordable rent or sales prices for the longest time allowed by state law.
Waivers of development review fees, meter installation fees and development impact fees were
authorized by Resolution 9131 (2000) for housing developed by non-profit housing corporations
and affordable units required of private developers through the inclusionary housing ordinance.
A recent request for fee waiver for the development of a secondary dwelling unit, an accessory
use to a primary residence, left staff in the difficult position of having to interpret whether fees
can be waived in such instances. The City's existing policies point to waiving development fees
for affordable housing beyond the inclusionary housing requirement or for government/non-
profit affordable housing development. Since residential development below the inclusionary
housing ordinance requirement (for developments of five units or greater) are not spelled out as
exempt, staff was forced to initially deny this request for fee waivers (see attached letter from
John Mandeville to Loraine Bailey).
However, since that time, staff from various departments, including Community Development,
Finance/IT, and Utilities, has conferred to discuss the intent of the fee waiver program. It was
concluded that fee waivers should apply to all affordable housing development beyond
inclusionary thresholds, regardless of the size of the development. Adopting a Resolution to
clarify the intent of the program will allow the approval of development impact fee waivers for

projects such as deed-restricted secondary dwelling units, and affordable housing developments
below the five unit inclusionary threshold.
Minor Zoning Ordinance amendments may need to follow this action for purposes of clarity in
the City's code, however, this will be considered with the next round of"clean-up" amendments
that go forward. Adoption of a Resolution stating the City Council's intent will provide direction
to staff and a public declaration of support to encourage affordable dwelling unit production.
The fee waivers are an in-kind contribution by the City to support provision of affordable
dwelling units.
CONCURRENCES
The City Attorney,Finance/TT and Utility Departments concur with the amendments.
FISCAL IMPACT
There will be a loss of revenues to the City in uncollected development fees. The level of loss is
unknown at this time and will depend on the number of small (four units or less), affordable
housing proposals the City receives. Notably, this is the first application for such a waiver in the
last 10 years. The benefit of providing greater incentives for affordable housing unit production
appears to outweigh the loss in revenue. The Utility Department Director expressed concern that
budgeting for development of water and sewer service facilities was based upon build-out
projections that assumed collection of impact fees with most housing units. Since the likely
impact to this program is unknown at this time, the Community Development Department will be
reporting on these fee waivers as part of the General Plan Annual Report beginning in 2008. The
Council can assess the effectiveness of the program, the impact to the City's resources and the
ability to provide services for the planned buildout of the community.
ALTERNATIVES
1. The City Council could choose not to amend the Resolution and continue to exclude
developments below the inclusionary threshold from fee waivers.
2. The Council could direct staff to bring back an amended proposal at a later date with
direction to gather more specific information.

as affordable housing under the criteria set forth in Section 2 of the General Plan Housing
Element that either:
1. Exceed the number required to meet the City's inclusionary housing requirements
or, in the case of developments of one to four units provide voluntary affordable housing units
2. Are built, owned and managed by the San Luis Obispo Housing Authority, other
governmental agencies or not-for-profit housing organizations.
This exclusion only applies to City-wide impact fees; it does not apply to fees,
assessments or special taxes for infrastructure improvements applicable to special benefit areas.
SECTION 1. This resolution supersedes and replaces Resolution No. 9131 (2000 Series)
adopted by this Council on November 21, 2000.

Dear Lorraine:
This is in response to your letters to the City Council dated February 21 and March 21,
2007. in these letters, you request a waiver of permit and impact fees for the secondary
dwelling unit (SDU) you are getting ready to build at 2384 Lawton. Unfortunately, the
City staff cannot approve such a request because there are no provisions in the City
Municipal Code that empower us to do so. Only the City Council can grant the fee
waiver you seek.
While secondary dwellings can provide affordable housing, the Municipal Code only
provides a fcc waiver mechanism for affordable housing in development projects
consisting of five or more dwelling units. The City's Affordable Housing Incentives are
contained in thv Municipal Code(Chapter 17.90). Your project of one accessory SDU in
conjunction with an existing single-family residence does not qualify. The intent of the
incentives in Chapter 17.90 is to encourage affordable housing in larger residential
projects - multiple family apartments, condominiums, or new neighborhoods. It should
be noted that all developments of five or more units are subject to the Inclusionary
Housing Requirements and must either build affordable housing or pay thein-lieu fees—

waiver of permit fees is only possible when a developer agrees to build more than the
minimum requirements.
A significant component of the affordable housing incentives is the density bonus.
However, sing- SDUs are an accessory use to the main house and can not be sold
separately,they are not counted as"units"in density calculations. Secondary units do not
have to be used for affordable housing if the property owner does not wish to do so.
Affordable housing takes many forms in addition to the larger projects with incentives
discussed above — SDUs are one such form. SDUs add another type of affordable
housing to the City's mix. SDUs are also "affordable-by-design" — another form of
affordable housing the City has programs to encourage. By their very nature, SDUs are
small in size and developed in infill locations in the City. Because they can provide a

limited form o f affordable housing, the City has added provisions to the Municipal Code' a
to enable them.
Obviously, therc are still substantial fees that go along with developing a secondary
dwelling unit. In time, the rent saved or rental income derived from a SDU should make
them a worthwhile investment,but the up-front costs are substantial.
I regret that under the existing Municipal Code City staff cannot do more to affect a
situation that is difficult for you;however, there is one other course of action open to you.
The City Cowicil can waive fees for development projects they find have some public
benefit. Your letters have reached the Council. If the Council wishes to act on your
request,one momber can raise the issue under the Communications portion of the agenda,
and if a majority concurs, Council will have the staff set the issue for consideration at a
future meeting. Bear in mind that if the Council grants a fee waiver based on a personal
hardship, it liki.4y will receive many similar requests. You also may make your request
in person at a City Council meeting under the part of the agenda for "Public Comment
Period For Items Not On The Agenda." In such case,if a majority of the Council wishes
to consider the matter further, it can direct staff to place the matter on a future agenda for
consideration.

The purpose of this memo is to clarify standards for eligibility for affordable housing of
the front page Tribune article on Monday (Little Granny Unit May Spur Big Rule Change), it is
appropriate to inform the Council of the standards applied to deed-restricted affordable housing units.
If item C-2 is approved, development impact fee waivers can be applied to deed-restricted affordable
housing units below the inclusionary housing threshold of 5 units. As part of the deed restriction, the
developer agrees to apply the City's income requirements listed in Chapter 17.91 to any future resident
of the unit that is for sale or for rent. Those requirements per the existing resolution specify that fee
waivers can apply to "very-low-" and "low-income" households (moderate income is not eligible for
fee waivers) according to the City's current Affordable Housing Standards. Chapter 17.91 further
defines these terms "very low income" and "low income" to meet state law definitions (California
Heath and Safety Code section 50079.5), which are tied to Section 8 of the United States Housing Act
of 1937. While the City commonly refers to "income" requirements, state and federal regulations
require that both income and assets be considered.
The purpose of the amended resolution is to make impact fee waivers available to those who
voluntarily offer deed-restricted affordable• units that are not otherwise required through the
inclusionary housing requirements. The same standards that apply to other deed-restricted units will be
placed on any units requesting the benefit of the fee waivers. In short, the subsequent tenants of the
units will need to have their income and assets verified through the Housing Authority of the City of
San Luis Obispo (HASLO) to ensure they qualify under low- or very-low income standards. HASLO
staff have provided information about the qualification process and have indicated that items such as
check stubs, tax documents, etc. (for income) and bank accounts, stocks, bonds, and home ownership
mortgage statements (for assets) are all included in determining a individual's eligibility. HASLO
typically does find homeowners with significant equity ineligible to qualify for low-income rental
housing.
It is important that the Council understand that while amending the resolution is recommended for
clarifying City policy, doing so will not, in the case of Lorraine Bailey, relieve her of the requirement
to ensure that future tenants of the deed—restricted affordable unit on the property qualify under low- or
very-low income standards.

I just read the article in the tribune regarding the granny unit and I $LO CIN CLERK
have been contemplating your comments about owner-occupied vs
non-owner occupied property. I was hoping you would be open to hearing
and considering some thoughts I had after reading your quotes. My
family and I moved to beautiful downtown SLO in 03 from Sacramento and
bought a house, we have since moved back for business/personal
reasons. I have rented out my home in SLO at a loss of approx $1000
per month because I love it hear and feel that it is such a desirable
place to live that should I be able to move back in the future I may
not be able to afford to buy again. I feel that almost any landlord of
a SFD is subsidising their renters and providing some level of
affordable housing. I feel they should be included and encouraged to
do so in the future. This brings me to the idea that agreeing to an
affordable housing deed restriction on a granny unit in lieu of the
exurbanite city fees $22,000 would have the effect of providing more
affordable housing, less environmental impacts and preservation of
city character to name a few. I do not understand how the comment "We
don't want to increase the earning potential of landlords"would in
reality have meaningful application to a granny unit addition to a
non-owner occupied SFR.That comment would seem to apply to affordable.
projects of five units or more(which the city already waves-fees for)
and the fed and state give lucrative tax credits for. I would be
encouraged to build an affordable granny unit on my property should
the fees(20-40% of cost) be waived, I would then only loose approx
$500 a month, thereby enabling me to continue to support the community (�

In addition to the"affordable"criteria how about adding "accessible"?
While what is required from individual to individual could not be reduced to a general regulation a nudge in the direction of universal design principles
would be great.
I use a power chair to get around part of the time and here is what I find necessary and would suggest:
0 no steps/hard surface from street/parking to front door
0 no/low threshold entry doorway-sliders are easier than swinging doors so at least don't demand a swinging door
0.32"entry door/dear opening OK,30"/32"interior doors inside(the often stated 36"door is a burden (takes up too much space)
0 bigger then normal bath or layout that allows for two people when needed for transfers
0 low threshold shower or tub with plenty of room for a transfer bench
0 single level or at a minimum stairs with frame structure/power stubbed out to provide a lift
All of the above do add cost but if they cost is offset by reduced fees it is a step in the right direction.

In today's paper was an article about an elderly woman asking for permit fees to be waived. I would like more information
regarding this and would like to voice my opinion regarding this proposal. It appears that the need for low income housing will
not be met as she will occupy the residence and the city will not be receiving any permitting fees. Perhaps there is a better
solution with the city creating a second trust deed in the amount of the permit fees.The unit per the article will be owner
occupied and not added to the low income housing inventory.The main house will be rented at market levels.Additionally how
does the city propose to monitor the rental of this property for the next 50 years. This is a very unnecessary complication with

Dear Mayor Romero and Council Members,
Our Chamber has a history of supporting affordable housing as the availability of
workforce housing is of great interest and concern to our members. The Chamber is a
member of the Workforce Housing Coalition and in this context has been tracking the
application of Lorraine Bailey for a secondary dwelling unit and the subsequent work of
staff in determining the intent of the fee waiver program.
The Chamber's Board of Directors wholeheartedly supports the CAO recommendation
that you have before you re Item C2. We believe that adopting a resolution clarifying
Resolution 9131 is the right step to take at this time. It ensures that all deed-restricted
affordable residential developments either in excess of the inclusionary requirement, or
for units of four or less, are eligible for City-wide development impact fee waivers from
the City of San Luis Obispo. The adoption of this resolution helps confirm to the
community the city's commitment to affordable housing.
We commend city staff. especially Housing Manager Peter Brown, for working diligently
to address the difficulties that the existing ordinance has placed upon applicants like Ms.
Bailey. It is our hope that the waiving of fees will encourage the increased production of
affordable dwelling units.

Dear City Council Members:
I humbly request action from the City Council on Item C2 (June 5, 2007 agenda).
Please direct staff to waive permit and impact fees for any low-income housing when
the property owner agrees to maintain the designated dwelling unit as affordable for a
minimum of 30 years, or otherwise required by state law.
My primary concern is the difficulty Mrs. Bailey has encountered while trying to provide
affordable housing. I humbly request you direct staff to immediately waive the fees
for SDU 166-06. The fees are the last requirement prior to issuance of her construction
permit.
Staff indicated "Only the City Council can grant the fee waiver you seek." Your council
has given clear direction to your staff on numerous occasions. The City Council adopted
Resolution No. 8415 in 1995 indicating low-income housing, "shall be exempt from all
planning, building, engineering and any other similar development review fees as well
as any water meter or sewer installation fees." The City Council also adopted
Resolution No. 9131 in 2000 stating, "City-wide development impact fees are hereby
waived on residential units qualifying as affordable housing." In addition, the Housing
Element 2004 states, "City policies already exempt very-low and low-income housing
from most development review and permit fees." (page 118)
The City and the State recognize second units as one way of providing affordable
housing. Please consider the fee waiver request as a precedent for establishing
reasonable requirements to encourage the construction of low-income units. Please do
