HomeMy WebLinkAbout06/19/2007, C4 - ADMINISTERING AGENCY-STATE MASTER AGREEMENTS FOR FEDERAL-AID PROJECTS counat '60uie 19, 2007 acEnaa Report '�" b.' cy CITY OF SAN LUIS OBISPO FROM: Department Head: Jay Walter, Public Works Directo Prepared By: Daniel Van Beveren, Senior Civil Engineer SUBJECT: ADMINISTERING AGENCY-STATE MASTER AGREEMENTS FOR FEDERAL-AID PROJECTS CAO RECOMMENDATION Adopt a resolution which provides authorization to the Director of Public Works for executing master agreements for Federal Aid projects, and any subsequent program supplements. DISCUSSION Federal funds for transportation projects are made available to local agencies through various programs under the Intermodal Surface Transportation Efficiency Act (ISTEA) and subsequent Transportation Authorization Bills. In order to receive these Federal funds on any given City project, the City must first enter into an agreement with the State of California Department of Transportation (CalTrans) which administers the funds. This agreement consists of a master agreement between the City and CalTrans, and a project-specific program supplement, each of which must be executed by the City before the funds can be made available. The City keeps an active master agreement for Federal-Aid funds with CalTrans. From time to time, this master agreement is updated by CalTrans to reflect current procedures and laws. Each modified master agreement requires an execution of the agreement by the City. The authority to execute these master agreements has historically been delegated to the Public Works Director. Program supplements are required for each individual project funded with Federal-Aid dollars. The execution of each program supplement is required for the City to receive the Federal funds. Like that of the master agreement, the execution of the program supplements has been duly performed by the Public Works Director. The previous authorization to the Director of Public Works for signing and executing the program supplements contained a reference to the now outdated master agreement. With a new master agreement in place, the recommended Council action will allow the continued execution of the program supplements, as well as future updates to the master agreement, to be performed.by the Public Works Director. This will streamline the process of gaining authorization to spend Federal-Aid funds on any project programmed with Federal money. CONCURRENCES The City Attorney's office has reviewed the new master agreement and it meets their approval. i 1 n Master Agreement for Federal-Aid Projects Page 2 FISCAL IMPACT Execution of the master agreement and subsequent program supplements is necessary for the City to receive Federal-Aid funds through any of the various Federal transportation improvement programs which provide funding to local agencies. (2007 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AUTHORIZING EXECUTION OF AGREEMENTS WITH THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION TO RECEIVE FEDERAL AID GRANT FUNDS WHEREAS, before Federal Aid will be made available for a specific projects, the Administering Agency (City of San Luis Obispo) and the State of California Department of Transportation(CalTrans) are required to enter into a Master Agreement, entitled "Administering Agency-State Agreement for Federal-Aid Projects" which is relative to prosecution of projects and maintenance of completed facilities; and WHEREAS, CalTrans periodically updates these Master Agreements and requires the Administering Agency to execute the updated Master Agreements; and WHEREAS, for each approved project,'the Administering Agency must execute a Program Supplement to the Master Agreement; and WHEREAS, the Department of Transportation requires the Master Agreement and all Program Supplements to be executed by the City Council or other city officials duly authorized. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo that the Public Works Director is hereby authorized to execute Master Administering Agency- State Agreements for Federal Aid, and all Program Supplements thereto. .
