APPOINTMENTS TO THE HOUSING AUTHORITY, JOINT USE OF RECREATIONAL FACILITIES COMMITTEE AND PARKS AND RECREATION COMMISSION. (ROMERO/HOOPER — 5 MINUTES) RECOMMENDATION: 1) By motion, make appointments to the Housing Authority, Joint Use of Recreational Facilities Committee and the Parks and Recreation Commission effective August 21, 2007, and expiring as recommended by the Council Subcommittees as indicated in the staff report. 2) Direct staff to continue to recruit for the remainder of the unfilled vacancies for these committees. ® City Council regular meetings are televised live on Charter Channel 20. For more agenda information,call 781-7100. ,I l\ i Council Agenda Tuesday,August 21, 2007 PUBLIC COMMENTS ON AGENDA ITEMS: You may address the Council on any item described in this agenda by completing a speaker slip and giving it to the City Clerk prior to the meeting. The Mayor will invite public comments before the Council takes action on each item. (Gov. Code Sec. 54954.3(a)) Your speaking time is limited to three (3) minutes. (CC&P Sec.1.3.7) CITY COUNCIL PROCEDURES FOR PUBLIC HEARINGS: The Mayor will announce each item and thereafter, the hearing will be conducted as follows: 1. City staff will present the staff report and recommendation on the proposal being heard and respond to questions from Council. 2. The Mayor will open the public hearing by first asking the project applicant/appellant(or his/her representative)to present any points necessary for the Council,as well as the public,to fully understand the proposal. 3. The Mayor will then ask other interested persons to come to the podium to present testimony either in support of or in opposition to the proposal. 4. Finally, the Mayor will invite the applicantlappellant (or his/her representative) back to the podium to respond to the public testimony, if appropriate. The Mayor will then close the public hearing and limit further discussion to the Council and staff prior to the Council taking a vote. RULES FOR PRESENTING TESTIMONY AT A PUBLIC HEARING: City Council meetings often involve highly emotional issues. It is important that all participants conduct themselves with courtesy, dignity and respect. All persons who wish to present testimony are asked to observe the following rules:. 1. Speakers are asked to submit speaker slips to the City Clerk. 2. If you have filled out a Speaker Slip,the Mayor will call you to the podium. 3. Speakers shall address the Council from the podium after giving his/her name and city of residence. Speakers shall direct their comments to the Council,not the audience. 4. Speakers shall limit comments to three minutes. The Mayor, after all others have spoken, may allow additional brief comments from speakers who have already commented on the same agenda item. 5. If testifying as paid representatives, as defined in the Municipal Code speakers shall register as a Municipal Advocate and shall preface their comments by identifying themselves as Municipal Advocates (§2.64.020 & §2.64.050&§2.64.070). 6. Applicants,appellants or applicant representatives desiring to speak shall: a. Submit speaker slips to the City Clerk (available on a plastic rack at the entrance to the Council Chamber). b. Shall be permitted to speak first during the public comment portion of the public hearing for not more than ten minutes. c. Address the Council from the podium after giving their name and address, and/or the name and address of the applicant/appellant they are representing. If the applicantlappellant's representative is a paid Municipal Advocate,they shall comply with Number 5 above. 7. If you challenge an issue in court, you may be limited to raising only those issues you or someone else raised at this public hearing as described above, or in written correspondence delivered to the City before or during the public hearing. CORRESPONDENCE TO COUNCIL: Written comments on agenda items are encouraged and are most effective if presented at least one day prior to the meeting. Note: Correspondence to Council received after 5:00 p.m. on the day of the Council meeting regarding agenda items may not be distributed until the following day. 2 Council Agenda Tuesday;August 21, 2007 PUBLIC COMMENT PERIOD FOR ITEMS NOT ON THE AGENDA(not to exceed 15 minutes total) The Council welcomes your input. You may address the Council by completing a speaker slip and giving it to the City Clerk prior to the meeting. At this time, you may address the Council on items that are not on the agenda or items on the Consent Agenda. Time limit is three minutes. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights(Gov.Code Sec.54954.2). Staff may be asked to follow up on such items. Staff reports and other written documentation relating to each item referred to on this agenda are on file in the City Clerk's Office in Room 1 of City Hall. CONSENT AGENDA The Consent Agenda is approved on one motion. Council Members may pull consent items to be considered after Business items. The public may comment on any item on the Consent Calendar. C1. MINUTES OF JULY 3 AND 17, 2007. (HOOPER) RECOMMENDATION: Waive oral reading and approve as presented. C2. TELEMETRY MAINTENANCE CONTRACT. (MOSS/HIX) RECOMMENDATION: Approve agreement with Bristol Inc., for telemetry system maintenance services in the amount of $62,600.00 and authorize the Mayor to execute agreement. C3. APPROVAL OF THE FINAL MAP FOR TRACT 2882. 2710 AUGUSTA STREET (TR/ER 104-06). (WALTER/DOSTALEK) RECOMMENDATION: Adopt a resolution approving the Final Map for Tract 2882 located at 2710 Augusta Street. C4. ADOPTION OF AN ORDINANCE AMENDING TITLE 16 OF THE.MUNICIPAL CODE, THE CITY'S SUBDIVISION-REGULATIONS). (MANDEVILLE/DUNSMORE) RECOMMENDATION: Adopt Ordinance No. 1507 (2007 Series). C5. REQUEST FOR PROPOSALS: VOICE OVER INTERNET TELEPHONE SYSTEM. (STATLER/MAA) RECOMMENDATION: 1. Approve issuing a request for proposals for a Voice over Internet telephone system. 2. Authorize the CAO to award the contract if the best overall proposal is within the approved budget of $351,00 for this project. 3 Council Agenda Tuesday, August 21, 2007 C6. 2007-08 TRUCK PROCUREMENT. (WALTER/SMITH) RECOMMENDATION: Approve a purchase order in the amount of $216,073.55 to Perry Ford for procurement of 11 trucks for several departments. C7. 2007-08 POLICE SEDAN PROCUREMENT. (WALTER/SMITH) RECOMMENDATION: Approve a purchase order in the amount of $171,653.03 to Lasher Auto Center for procurement of five police patrol sedans and two police administration sedans. C8. 2007-08 GENERAL PURPOSE SEDAN PROCUREMENT. (WALTER/SMITH) RECOMMENDATION: 1. Approve a purchase order in the amount of $75,034.70 to Toyota of San Luis Obispo for procurement of three Prius Hybrid sedans. 2. Approve transfer of $8,278 from Water Fund working capital and $14,256 from Sewer Fund working capital to fund additional purchase costs. C9. REQUEST FOR PROPOSAL REQUESTING ENVIRONMENTAL IMPACT REPORT (EIR)CONSULTANTS FOR THE PREFUMO CREEK COMMONS PROJECT, 11980 LOS OSOS VALLEY ROAD. (MANDEVILLE/DUNSMORE) RECOMMENDATION: 1. Approve the workscope for Environmental Impact Report (EIR) work consultant services for the Prefumo Creek Commons Project and authorize staff to proceed with sending out Request for Proposal (RFP) documents to qualified consulting firms. 2. Authorize the CAO to award the contract to a qualified consulting firm for the EIR, contingent upon the developer depositing with the City the amount of the contract plus a 30% administrative fee. C10. TRAFFIC SIGNAL MODIFICATION AT MARSH AND SANTA ROSA, . SPECIFICATION NO. 90677. (WALTER/HUDSON) RECOMMENDATION: 1. Approve plans and specifications for the Traffic Signal Modifications at Marsh and Santa Rosa, Specification No. 90677. 2. Authorize staff to advertise for bids and authorize the CAO to award the contract if the lowest responsible bid is within the Engineer's Estimate of $170,000. 3. Approve the transfer of $43,000 from the Traffic Safety Report Implementation account to cover cost increases for the Traffic Signal Reconstruction at Marsh and Santa Rosa. 4. Approve the transfer of $87,000 in completed projects funding to cover cost increases for the Traffic Signal Modification at Marsh and Santa Rosa. C11. CITY WIDE TRAFFIC VOLUME COUNTS, SPECIFICATION.NO. 90653. (WALTER/HUDSON) RECOMMENDATION: 1. Award a contract to City Traffic Counters, LLC. Of Pasadena, CA in the amount of $43,625 for conducting city wide traffic volume counts, 4 Council Agenda Tuesday; August 21, 2007 Specification No. 906653. 2. Approve a transfer of $2,061 from the Completed Projects account to the project account. C12. WATERLINE REPLACEMENT PROJECT, SPECIFICATION NO. 90634. (WALTER/CORNEJO) RECOMMENDATION: 1. Approve the plans and specifications for the "Waterline Replacement Project', Specification No. 90634. 2 Authorize staff to advertise for bids and authorize the CAO to award the contract if the lowest responsible bid is within the Engineer's estimate of $1,032,350.00. PUBLIC HEARINGS 1. MARGARITA AREA DEVELOPMENT IMPACT FEE UPDATE. (STATLER - 20 MINUTES) RECOMMENDATION: Adopt a resolution updating sub-area development impact fees for transportation improvements in the Margarita Area. 2. TEXT AMENDMENTS TO MUNICIPAL CODE-SECTION 17.91: INCLUSIONARY HOUSING ORDINANCE., TO CLARIFY THE PROCESS FOR SELECTING AFFORDABLE HOUSING RECIPIENTS: AND NEGATIVE. DECLARATION (TA. ER 79-07). (MAN DEVI LLE/B ROWN - 20 MINUTES) RECOMMENDATION: As recommended by the Planning Commission: 1. Introduce an ordinance approving an amendment to Municipal Code Section 17.91 to clarify the process for selecting affordable housing recipients. 2. Approve a Negative Declaration of environmental effects for the project (ER 79-07). BUSINESS ITEMS 3. 2006 ANNUAL TRAFFIC SAFETY REPORT. (WALTER/HUDSON — 1 HOUR) RECOMMENDATION: 1. Review and discuss the 2006 Annual Traffic Safety Report and associated mitigation strategies. 2. Receive an update on the realignment of Buena Vista and Garfield Street at Monterey Street. 3. Approve the transfer of $32,000 from the completed projects account to cover cost increases for signal upgrades at Marsh and Osos Streets. 4. Approve the transfer of $158,000 from the unappropriated general fund balance to cover cost increases for signal upgrades at Marsh and Osos Streets. 5 Council Agenda Tuesday, August 21, 2007 4. APPROVAL OF PUBLIC ART FOR THE SAN LUIS OBISPO LITTLE THEATRE. (KISER — 20 MINUTES) RECOMMENDATION: 1. As recommended by the Public Arts Jury, and the Architectural Review Commission (ARC), approve the public art piece entitled Bee Bee Works His Magic for San Luis Obispo Little Theatre. 2. Authorize the CAO to execute an agreement with the artist for completion of the project. COUNCIL LIAISON REPORTS (not to exceed 15 minutes) Council Members report on conferences or other City activities. Time limit-3 minutes. COMMUNICATIONS (not to exceed 15 minutes) At this time, any Council Member or the City Administrative Officer may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council Policies and Procedures, they may provide a reference to staff or other resources for factual information, request staff to report back to the Council at a subsequent meeting concerning any matter, or take action to direct staff to place a matter of business on a future agenda. The City Council Subcommittee for the Housing Authority conducted interviews on July 17th and the City Council Subcommittee for the Parks and Recreation Commission conducted interviews on August 7, 2007, both are prepared to make a recommendation for appointments to Council at the August 21, 2007, Council meeting. The City Council Subcommittee for the Joint Use of Recreational Facilities Committee will be interviewing applicants the week of August 13th. Because the interview process for the Joint Use of Recreational Facilities Committee has not yet been completed, the agenda report with the Council Subcommittees' recommendations for appointments to these Committees will be distributed as a red file item by August 16th.
