Concur that the use of San Luis Obispo Baseball Stadium (SLO Baseball Stadium) for semi-pro baseball teams is now "impacted" and that use by additional semi-pro teams, beyond the San Luis Obispo Blues and the San Luis Obispo Rattlers, be suspended indefinitely; 2. Approve amendments to the SLO Baseball Stadium Priorities for Use, to be extended until September 1, 2008; 3. Endorse the concept of a Request for Proposal (RFP) inviting the Blues and the Rattlers to bid for shared exclusive use of SLO Baseball Stadium for the 2008 semi- professional collegiate baseball season; 4. Assuming both teams meet minimum RFP requirements, return to the City Council for a) approval of recommendations from the review committee for shared use of the stadium with the number of games allocated to each team dependent upon responsiveness to the criteria set forth in the RFP; the quality of team performance during the proposal review and interview process; and past performance with the City; and b) approval of use agreements for the 2008 season; 5. Adopt a resolution amending the fee schedule for use of SLO Baseball Stadium, to become effective January 1, 2008; and As recommended by the Parks and Recreation Commission: 6. Approve the inclusion of criteria in the RFP for a food and beverage management plan, and if not adequately addressed by either organization, then approve the release of a separate RFP for an exclusive food and beverage concessionaire for the SLO Baseball Stadium from January through September. F � , Use of SLO Stadium for 2008 Page 2 REPORT IN BRIEF The SLO Baseball Stadium at Sinsheimer Park is a popular venue for both youth and adult baseball in the community. Over the years, it has been used by many organizations, including Babe Ruth Baseball, the San Luis Obispo High School baseball team, the Parks and Recreation Department, Cuesta College, Cal Poly, Hancock College, the SLO Blues, Santa Maria Indians, Men's Senior Baseball, and most recently the SLO Rattlers. Since the early 1970's, use of the stadium has been governed by a Priority For Use Policy which has enabled the Stadium to be effectively managed and shared by interested parties. When a new semi-professional team requested use of the facility for the 2007 season, competition for evenings and weekends became so fierce that it required mediation to resolve scheduling conflicts. Due to the challenges of the 2007 season, City Council directed staff to return at the end of the baseball season with a review of the uses and recommendations for improved management of the facility for future years. With input from a Joint Use Sub-committee and reviews from both the Joint Use Committee (JUC) and the Parks and Recreation Commission (PRC), the following report proposes a management system designed to prevent a repeat of the 2007 "turf wars". Included in the report are recommendations for managing the user groups, amending the Priority for Use Policy, and creating competitive use fees. DISCUSSION History of SLO Baseball Stadium* In the mid-1960's, there was strong community desire to expand sports facilities in San Luis Obispo. Representatives of Youth Baseball (now Cal Ripken Baseball) and Babe Ruth Baseball approached Council and the Parks & Recreation Commission with the request to have more fields built. George French, then the president of Babe Ruth Baseball and Reg Streeter, a radio station owner, along with other interested members of the community expressed their desire to have a regulation baseball stadium in San Luis Obispo and identified a parcel of land within the city where a facility could be built. The parcel, now known as Sinsheimer Park, was undeveloped and belonged to San Luis Coastal Unified School District (SLCUSD). The first joint use agreement between the City and SLCUSD occurred in 1965 and subsequently, the Joint Use Committee (JUC) was formed to oversee the agreement, plan for park development and establish priorities for use. The JUC determined that a regulation baseball stadium was the most urgent need of the sports community. NOTE: Much of the information provided in this section of the report came from documents from the files of past Parks& Recreation Director Bill Flory, newspaper articles written by Johnny Nettleship, long-time Telegram-Tribune.Sports Editor,and Jack Dewar,a former member of the Joint Use Committee. CA\Doctunents and Settings\belke\Local Settings\Temporary Internet Files\OLK21\CAR-SLA Stadium Use 8 01 07-3.doc _,;21 Use of SLO Stadium for 2008 Page 3 Throughout 1967, and with a great deal of community involvement, the SLO Baseball Stadium was built. Members of the local Engineering and Grading Contractors Association, led by Richard Burke, spent a Memorial Day weekend grading and preparing the site for development. Many local contractors, labor unions and service organizations donated their time, resources or funds to construct the stadium. The SLO Baseball Stadium opened in the early 1970's and became the home field for San Luis Obispo Senior High School and the local Babe Ruth league. Much of the vision for the Stadium's development was to build a venue comparable to a major league type facility to host tournaments at various levels of play. For many years, Babe Ruth Baseball hosted district and regional tournaments, drawing teams statewide as well as from other states. Parks staff consistently received praise about the venue for its appearance and the well-maintained diamond and turf. Over the forty years that the SLO Baseball Stadium has been in existence, there have been two groups that have consistently utilized the facility: San Luis Obispo High School and Babe Ruth Baseball. For many years, Cal Poly used the Stadium as its home field until 2000 when Baggett Stadium was built on campus. The San Luis Obispo Blues, a local semi-professional collegiate baseball team, was a sporadic user up until 1994 when they became a regular renter of the facility. Other groups who have used the Stadium over the years include: Cuesta College, Hancock College, Men's Senior Baseball, the Santa Maria Indians and most recently, the SLO Rattlers. Priorities for Use When the JUC was formed in the mid 1960's, one of its first tasks was to create a set of priorities for stadium use. Under the system, tournaments and special games were given priority over regular games and playoffs, followed by practice sessions. Under each of these categories, sub- categories were created. The sub-categories were further prioritized and essentially granted Babe Ruth Baseball first priority for use in recognition of its efforts to build the stadium; second priority to the SLCUSD because of its ownership of the land; third priority to the City as the owner of the facility; and finally, as fourth priority, any other users. The priorities for use have not changed significantly since 1967 and over the years have served the user groups and management of the facility well. (The current Priorities for Use are provided in legislative draft form in Attachment 1). While conflicts have surfaced each year over the past fifteen years between the groups applying to use the stadium during the period from late May through early August (Babe Ruth, SLO Blues, Men's Senior Baseball), traditionally these conflicts have been mitigated by the users themselves. The organizations would meet and confer, trade dates, share facilities and ultimately present agreed-upon schedules to City staff for processing and permitting. Last year, when a second semi-professional collegiate baseball team requested use of the stadium for the 2007 season, the team was given equal consideration per the use policy. The traditional process of working out schedules among the organizations proved unsuccessful. Technically, sufficient slots existed to accommodate all users. However, because of the fierce competition for CADocuments and SettingAbelke\Local Settings\Temporary Internet Fi1es\0LK21\CAR-SIA Stadium Use 8 01 07-3.doc 021-3 Use of SLO Stadium for 2008 Page 4 playing time on weekends and evenings, the organizations were unable, after many attempts, to resolve the scheduling conflicts on their own. Ultimately, the City hired a neutral facilitator to mediate the summer use. Although effective for the 2007 season, it became evident that the SLO Baseball Stadium was now impacted during the summer months; and that the Priorities for Use should reflect this impact to ameliorate scheduling conflicts in the future. Review of Priorities for Use by the JUC Sub-Committee. A sub-committee consisting of two JUC members and City staff met on three occasions to review the stadium uses and, as one of its tasks, develop appropriate recommendations for changes to the Priorities for Use. The sub- committee was asked to review the 2007 season in terms of its impact on the stadium (such as maintenance concerns, staff time, facility and field issues, conflicts between users and impacts on other park uses) and recommend a system that 1. honors the origins of the stadium. 2. is sensible and unbiased. 3. provides greater clarification to the sub-category"All other groups sponsored." Staff provided information to the sub-committee on the following: 1. history of the origins and development of the stadium; 2. current Priorities for Use of SLO Baseball Stadium; 3. review of stadium uses between May and July from 2003 through 2007, which provided data on number of days of use and number of games played; 4. report that subjectively reviewed the 2007 May through July baseball season, discussing compliance by the user groups with the terms of their agreements, including management and communication ethics; application for use; fees, licenses and insurance; advertising banners (standards, fees and installation); and facility use requirements. The recommendations were subsequently presented to the JUC on August 28 and the Parks and Recreation Commission (PRC) on September 5, 2007. Recommendations for Priorities for Use Policy Recommendation to Limit Use of the SLO Baseball Stadium by Semi-Professional Collegiate Baseball Teams. A review of the information revealed that the use of SLO Baseball Stadium for semi-professional collegiate baseball teams is now "impacted," particularly for those uses on nights and weekends from Memorial Day through the early part of August. Subsequently, the first recommendation is that consideration of use by additional semi-professional teams, beyond the San Luis Obispo Blues and the San Luis Obispo Rattlers, be suspended indefinitely. Recommendation to Change Priorities for Use for SLO Baseball Stadium (see Attachment 1 for legislative draft of current and proposed priorities). The following recommendations to the Priorities for Use for SLO Baseball Stadium are being proposed: CADocuments and Settings\betke\Local Settings\Temporary lntemet Fles\0LK21\CAR-SLA Stadium Use 8 0107-Moe Use of SLO Stadium for 2008 Page 5 1. Categories I and 2 remain the same (special games and tournaments remain top priority followed by regular games and playoffs). Disallow Category 3 (practice sessions) altogether. Rationale: Special games and tournaments require blocks of stadium time and are scheduled months in advance, therefore necessitating that scheduling occur prior to that of regular games and playoffs. Because the stadium is currently impacted with tournaments and games, there is no practice time available, thus the recommendation to remove that category altogether. 2. Sub-categories (a) through (c)remain the same: (a)Youth groups sponsored, (b)SLCUSD sponsored and (c) Parks and Recreation sponsored. Rationale: The stadium was conceived and developed to meet the youth baseball needs of our community, in particular Babe Ruth, SLO High School and recreation-sponsored events. Babe Ruth was a major player in the construction of the facility. It was felt that this historical precedent remains viable and should be respected.. 3. Sub-category (d) is amended to further prioritize usage among "all other groups sponsored". Specifically, the recommendation divides stadium usage into three seasons, January — May, Memorial Day Weekend — early August, and early August — September. It further defines who should have priority use during each season. a) From January— May, the primary "other" users are Cuesta College, Hancock College and Men's Senior Baseball. Because there are no conflicts with current usage during this timeframe, the recommendation reflects that compatibility. b) From Memorial Day Weekend— early August, recognizing the impact created by two equal user groups (the SLO Blues and the SLO Rattlers), the recommended priority limits "other" usage first to the two semi-professional collegiate teams and second to "other, as available". (Note: Babe Ruth plays during this season and, therefore has first priority overall.) c) From early August — September, the priority allows for all other users (primarily Men's Senior Baseball). Rationale: The stadium is impacted only during the semi-professional collegiate season (Memorial Day weekend— early August) when youth baseball is also in post-season play and Men's Senior Baseball is in the midst of its season. To ameliorate scheduling conflicts as much as possible, the recommendation is that "other" users be given permits to play during that time "only as time is available". The recommendation primarily affects Men's Senior Baseball, a private recreational league serving teams from throughout the county of which two thirds of the participants are not City residents, and which competes for stadium use during this timeframe. The rationale behind this recommendation is based on the assumption that 1) the semi- professional collegiate teams need the stadium's specialized facilities to be financially successful (such as concession stand, fan parking and seating, need for a press box, CADocuments and Settings\belke\L.ocal Settings\Temporary Internet Files\OLK21\CAR-SLA Stadium Use 8 0107-3.doc 2 �" Use of SLO Stadium for 2008 Page 6 public address system, and lights); 2) parks maintenance staff need sufficient blocks of time to properly maintain the stadium during this period of intense play, and limiting users allows an adequate amount of time to accomplish this maintenance; and 3) Men's Senior Baseball, the other user during this time frame, does not require a specialized facility and has the flexibility to schedule games and play on other fields throughout the County such as Cuesta College, School District sites and in other communities. (Note: Men's Senior Baseball will continue to have competitive use of the SLO Baseball Stadium from January through May and early August through September, and during the mid- season if time is available.) Alternative: Keep the Priorities for Use of SLO Baseball Stadium unchanged. This is not recommended because with no distinction made between users listed in the "other" category or for seasonal changes, it fails to resolve the use issues created last year with the creation of a new semi-professional collegiate team. Recommendation to Release Request For Proposals (RFP) The SLO Baseball Stadium is a unique facility on the Central Coast in that it was developed to be comparable to a major league type facility. It offers a well-manicured field, restrooms, seating for over 800 spectators, parking, field lighting, a concession stand, press box, a public address system, and an electronic score board, making it not only suitable but desirable for semi- professional collegiate baseball play. It is the belief of staff, the JUC and the PRC that it is a privilege rather than an entitlement for private, for-profit organizations to have guaranteed use of the stadium, and therefore it is recommended that a competitive process be applied to determine use privileges. The recommendation is to release a request for proposals to the SLO Blues and SLO Rattlers asking the organizations to submit their business and management plans for the 2008 season as they pertain to the use of the SLO Baseball Stadium. A panel consisting of designated JUC and PRC members and City staff will review the proposals to determine responsiveness to the criteria set forth in the RFP. Their final proposal as to how the teams will share the stadium for the 2008 season (number of games, prime days and times, etc.) will also considering the quality of team performance during the proposal review and interview process, as well as a review of past performance with the City. The RFP will request, and the committee will judge whether each team's proposal, at a minimum, consists of the following: 1. Proof of status as a semi-professional collegiate baseball team; 2. Standards that the organization will establish and use to demonstrate and measure a professional, respectful and accountable management and communication ethic; 3. Business plan as it relates to the use of the SLO Baseball Stadium, including: a) Facility needs and management plan b) Field preparation needs c) Spectator management plan d) Parking management plan CADocuments and Settings\belke\Local SettingsMnaporary Internet FilesMK2ACAR-SIA Stadium Use 8 0107-Moc Z-6 Use of SLO Stadium for 2008 Page 7 e) Signage and banner plan f) Storage needs and plan g) Special events plan h) Food and beverage concession management plan 4. Management team composition, including identification of personnel roles and responsibilities and point of contact with City staff; 5. Approximate number of games requested for the season; 6. Other pertinent information that the organization believes would support its request for use of the stadium. A weighting system will be developed by the selection committee to fairly evaluate each proposal. Proposals will be evaluated on the quality of the presentation, qualifications for play under the criteria, past performance and experience with the City, and how the organization addresses the components established in the RFP. Once the proposals have undergone the review process, recommendations from the selection committee for shared use of the stadium will be brought back to City Council for approval. Once a schedule for use is approved, staff will prepare use agreements for final approval by City Council. Alternatives: 1. Do not offer a RFP and allow staff to work with both semi-pro teams for 2008 stadium use. The process became adversarial for the 2007 season and required mediation to resolve issues prior to the season. A RFP process for shared use creates an even playing field for negotiating use, an incentive for both teams to put their best foot forward in terms of a quality proposal and future performance standards, and provides a means for both organizations to present their needs in a formalized setting. 2. Offer a RFP with only one semi-pro team to be granted exclusive use of SLO Baseball Stadium. This alternative places the RFP process in a competitive bid situation rather than allowing both local teams the opportunity to use the Stadium. It is felt that having both teams utilize the stadium will benefit the community with expanded baseball play. Recommendation to Amend the Use Fee Schedule It has been a number of years since the City conducted a facility use fee survey to determine if current fees are aligned with the rates of like facilities. Over the summer, staff surveyed ten local organizations (school districts, neighboring cities,junior colleges) that lease baseball facilities to outside groups and organizations. (The data from the survey are contained in Attachment 2.) The administrative fee was not considered in calculating the average field rental hourly costs. 2 The City charges a per-use fee of $66.50 per day and $93.00 per night for use of the SLO Baseball Stadium, rather than an hourly fee. The hourly rates used above were extrapolated by dividing the day (or night) use fee by the average hours the facility was rented per use for the 2007 season. ' Unlike other agencies, the City has a BBQ rental fee and a one-time opening fee for the concession stand. Still, the City's fees are remarkably low in comparison to the other organizations surveyed. Based on the analysis above, staff developed a more realistic facility use fee for the SLO Baseball Stadium that is competitive with 1) the other agencies and organizations surveyed, such as the City of Arroyo Grande, Cuesta College and the City of Atascadero, and 2) our current fees at Damon Garcia Sports Fields. The City has a cost recovery goal of 60-100% for facility uses. Under the current fee structure, the City is only recovering 33% of its costs to maintain and administer the Stadium. With the new structure, the percentage increases to 59% for games only and would recover 98% if the concession area is used. Recommendation to approve the inclusion of criteria in the RFP for a food and beverage management plan In reviewing the daily staff reports from the 2007 season, it became apparent was that many of the facility management concerns centered on the use of the concession stand by the semi- professional teams. Blocked fire lanes, storage disputes, improper food handling and the time needed for setup and cleanup after each game were the major issues. Few violations occurred from the actual baseball play on the field. After review of the facility use reports for each use of the Stadium, a recommendation was made to both the JUC and the PRC to support the concept of soliciting via a RFP a private concessionaire to handle all of the food and beverage services at SLO Baseball Stadium, except for alcohol sales, from the months of January through September. The rationale for an exclusive food and beverage service concessionaire centered on the following: 1) having one concessionaire would allow for a single contact point and consistent use of the concession stand rather than the current practice of having each user handle its own concessions, particularly during the tightly scheduled summer season; and 2) an independent contracted concessionaire is common practice at many of the facilities that staff surveyed for this report (San Luis Obispo High School's Holt Field, Cal Poly's Janssen Field/Baggett Stadium, Hancock College, City of Paso Robles and City of Santa Maria). The idea behind the recommendation was that all stadium users would be required to use the contracted concessionaire; the exception would be alcohol sales where the users could undertake that activity on their own. A successful concessionaire would operate the concession stand during all games within the SLO Baseball Stadium from January through September, regardless of whether the users utilized the concession stand in the past. JUC Action on Exclusive Food and Beverage Concessionaire. The JUC reviewed the SLO Baseball Stadium report at its August 28,2007 meeting. It recommended that the concept of a RFP for a seasonal food and beverage concessionaire be tabled for separate discussion at the October or November meeting. Its decision was based on comments received from the users that the sale of concessions provides essential revenue for the success of their programs and felt it should be more fully investigated (see Attachment 3 for minutes). PRC Action on Exclusive Food and Beverage Concessionaire. The PRC reviewed the SLO Baseball Stadium report at its September 5, 2007 meeting. Based on the JUC recommendation and feedback from the user groups, it recommended the inclusion of criteria in the RFP for a food and beverage management plan, and if not adequately addressed by either organization, then at that point consider the release of a separate RFP for an exclusive food and beverage concessionaire for the SLO Baseball Stadium from January through September. This is the recommendation being brought to City Council at this time (see Attachment 4 for minutes). Based on the comments from the users of the Stadium regarding the importance of the concession stand to their operations, both financially and culturally, this alternative is being recommended as a back-up in the case that proposed concession management plans are considered inadequate for proper management of the facility. CONCURRENCES The JUC and the PRC have reviewed the report and, except as noted above regarding how to manage the food and beverage concessionaire, concur with the recommendations. FISCAL IMPACT The current fees for use of SLO Baseball Stadium recover a small portion of what it costs to operate the facility. Direct costs for a typical facility use would include general maintenance, field preparation, staffing, and utilities. Under the current fee structure, only 33% of the direct costs for the three adult user groups are being recovered where the goal is to recover 60%-100%. As indicated earlier, fees for use of SLO Stadium are lower than most comparable facilities in the area. Impacts to the user groups would be significant as they would be paying more of the costs to operate the Stadium for their uses. A comparison was done to look at how the new fees will impact each organization by looking at what was paid in 2007 and how much they would pay under the new fee structure. Youth athletic organizations, such as Babe Ruth Baseball, are not charged for facility use and the School District is not charged as per the Joint Use Agreement. Review September 2007 Facility Use Grant cle Recreation Manager Fitzgerald presented t review procedure for the upcoming facility grant cycle with an explanation to new embers of the process involved in reviewing grant requests. Applications are du eptember 1 for facility use grants covering uses from January through June 2008; rrently the balance for fiscal year 2007-08 stands at $6,915.16 as some unused gr money from the previous fiscal year was added to the grant funds. Recreation M ager Fitzgerald explained to the Committee that there was $1,400 remaining in the cility Improvement fund last year, however; at the end of the year Babe Ruth had so a bills from the Stockton Field improvements that totaled $3,700. Fitzgerald used the maining $1,400 in grant money to go towards the project and asked the Committee's ardon for not formally requesting the funds due to the end of the fiscal year and that funds would not roll over into the following year. The decision on this use of facil' improvement funds was well received by the Committee. 6. Use of San Luis Obispo Baseball Stadium for 2008 Director Kiser opened the discussion and spoke regarding the staff and subcommittee's hard work involving hours of research and data collection to provide balanced and unbiased recommendations. Kiser asked the Committee to keep in mind the City is the manager of the property involved and that these recommendations must take into consideration that it is managed to its best use. Committee Member May explained the Joint Use Subcommittee that worked on the preparation of this report consisted of himself, Committee Member Jones, Director Kiser, Recreation Manager Fitzgerald and Recreation Supervisor Bremer. The subcommittee investigated other parks and their fees, reviewed extensive reports, held several meetings to review data, priorities and history. Committee Member May added comments on the following recommendations: 2) there are recommended changes to be made for Priorities for Use; 3) it was decided there is room for two semi-pro teams to play at the Stadium and the creation of an RFP which states questions and asks for input from the users. Those proposals will become part of the development of the stadium agreement for the 2008 Stadium use; 5) Fees take into consideration cost of city personnel, lights and maintenance of facilities that was gathered as part of the data collection process and that parks maintenance crews will have time scheduled each month to perform advanced maintenance tasks. Committee Member Jones agreed there is a good framework to the report but they are open to other recommendations and changes. Committee Member Jones noted that on page 5, 3 b) should perhaps say early August rather than July and 3c) mid-August to September rather than July. Committee Member May informed that the RFP will be reviewed by Staff and the JUC. He stated, regarding the "weighting system" that they hadn't seen a process for this yet and that even under that system we will watch the process for important things that may be discovered. Regarding page 8, believes a facility such as this ought to run itself. The ,2.-17 ATTACHMENT Advisory Committee on umt Use of Recreational Property -J page 3 August 28, 2007 Minutes challenges presented to the Parks and Recreation Department were numerous this year with a majority of the issues being related to the concession stand operations. Under recommendation#6 is that the Joint Use Committee recommends sending out an RFP for one concessionaire for all users. Director Kiser stated it is important to note that this concessionaire would not sell alcohol or apparel. Limiting use was the first step for the Parks and Recreation Department. May stated the hope is we clean the slate and progress in a businesslike and professional manner. As he was part of the mediation group, although what happened there is as confidential as any mediation, be it a divorce, child custody, etc., but he could state he was frustrated seeing letters to the editor and emails regarding the mediation from other attendees calling it a fiasco. May suggested some people are trying to make this work and some are not. He hopes those not interested in working things out don't get in the way of the JUC. Committee Member Cochran expressed the Committee's appreciation of the work done on this document. The Committee Members entered into discussion: Vice Chair Conner thanked the subcommittee for their hard work expressing the hope that it meets with everyone's satisfaction. Conner proposed the Committee not consider recommendations for concessions at this time as there would be too many comments on that subject alone. Conner still feels we should have one semi-pro team that exemplifies priorities and history. Conner personally feels limiting RFPs to Blues and Rattlers would be a problem and mainly wants to see the best for the facility under the City's direction. Committee Member Jones stated he agrees with the overall recommendations, that maybe it is best to offer the use up to one user, but agrees with Vice Chair Conner in that respect. Committee Member Parolini spoke regarding removing proposal to have concessions at this time and suggested keeping it in the format if for no other reason right now that to see the interest. Vice Chair Conner stated the concessionaire will have to consider slow parts of the year in the timeline suggested and perhaps adjust rates to accommodate those times. He believes the subject should not take up the rest of the meeting and hopes public speakers don't include that as part of their commentary at this time. Public Comment commenced with a three minute limit per speaker: Dan Ainsworth, Senior Men's Baseball expressed his frustration that the information was inaccurate and did not reflect the needs of his organization. Tim Golden, SLO Blues stated he feels the report is one-sided and never was asked to discuss the report with anyone. He asked that a decision not wait until February to be made. Golden asked the Committee to ask questions regarding what's going on in the community. p ,2-I0 ATTACHMENT 4 Advisory Committee on ,pint Use of Recreational Property page 4 August 28, 2007 Minutes Rich Remolds, SLO Blues and Blues Scouts - Represented the Scout team in mediation. He stated that the Blues donate everything – commended Dan Ainsworth for getting out of mediation. Stated the only difference between SLO Stadium and Cal Poly and Cuesta venues was the serving of beer. Tom Block, SLO Blues - Noted the fundraising work SLO Blues has done for Hospice and the Shelter, marketing for the Tribune and Chamber, and feels the SLO Blues are hometown team. Todd Dotem, SLO Blues - stated there should be one team next year and to consider the numbers, particularly the 40,000 fan base for the SLO Blues. He felt the Concessionaire idea is a bad idea. Bryan Shoolery, Arroyo Grande Babe Ruth expressed appreciation to the Blues for their financial support and the clinics and training they give to the County's youth who look up to the players. The SLO Blues made it possible for Arroyo Grande Babe Ruth to renovate Porter Field last spring, provided jerseys and maintenance services—theirs is a mutually supportive relationship. Shoolery sees tremendous community support and emphasized that any team that draws a crowd will cause bathroom, traffic and parking problems. Chandra Shoolery, Arroyo Grande stated her experience with the SLO Blues was as a scorekeeper last season. During that time she saw the selfless generosity by the Blues to support youth; particularly Arroyo Grande Babe Ruth. Shoolery stated that, with no disrespect intended, her feeling was that the City's facility employees were awfully young to be in their positions and would rather see seasoned staff if they were being paid –questioned how it was determined there would be room for two seasoned teams. Asked Committee to do something because it's the right thing to do rather than because it's what you can do. Joe Vergara, SLO Blues Appreciates the hard work involved in the making of the report. Vergasa asked the Committee Members for their help, knowing there are problems to be fixed. Expressed that he has invested heavily into the SLO Blues which represent family, community, baseball, youth sports and great tradition for San Luis Obispo. Feels however that since sharing with another business (team) their finances have been taken away. Feels these proposals will "kill the Blues" and that without the SLO Blues, tourism, local tradition and revenue would be lost as well as their community involvement and charity. Requested the community be asked what they think and that the Committee be partners with the Blues. Barry Yancosek, Youth Director, Babe Ruth Thanked the Committee on behalf of the 120 players in the Shell Beach, Grover Beach, Arroyo Grande and Nipomo areas. Expressed to the Committee Members all the SLO Blues have done for their teams such as provide children's camps to focus on increasing skills, learning the rules and regulations of the game, and becoming better players. The SLO Blues also sponsors a Scout team to go to the Counties – for all these things he feels they should be publicly appreciated. Public Comment closed and no further comments were accepted from the Community. /9 r 7 ATTACHMENT Advisory Committee on:,.,int Use of Recreational Property - page 5 August 28, 2007 Minutes Committee Member Jones expressed his apologies to Mr. Ainsworth for not working closer with him and stated he would never support something that he felt would be the end of Senior Men's Baseball. Then asked Mr. Ainsworth to elaborate on the points of the proposal he disagreed with. Mr. Ainsworth stated that his teams need to play twice a week requiring nights and weekends July through September in order to accumulate the necessary 10 weeks of play. Currently Senior Men's Baseball doesn't get June and July in the Stadium so their season is effectively cut in half to 5 weeks. Ainsworth stated they have no option to play other than in that timeframe. Also, he feels the costs per game in the staff report are wrong and that they can't depend on a grant from the Committee for next year. Committee Member Jones asked further about problems with playing in June and July to which Mr. Ainsworth stated the proposal says that time is exclusive to the two semi-pro teams. Ainsworth's concern with going out of business also comes from the fact that it is the only time the coaches themselves get to play the game and that virtually every baseball coach plays in his league. Committee Member May addressed Mr. Vergara acknowledging that San Luis Obispo is fortunate to have the SLO Blues and clarified his wording to mean "stepping out of the document" rather than "biased." It was not the subcommittee's intention that the Senior Men's Baseball League be out of the facility completely, only that the two semi- professional teams work things out and the rest to fall into place. He would rather see the teams sit down and coordinate nights and weekends to lessen the challenge on the field. There should still be time for two teams to play without harming the field. Would like to see that the concession topic not be debated at this time but to go forward with the two RFPs and schedule as amended. Vice Chair Conner agreed with most of the public comment and commented on the RFP for stadium use. If it is not determined that two teams can occupy the same space at the same time, then may the best team win. Historically in the business, that's the team who will get the bid—the "best package gets the goodies." Chair Cochran asked Mr. Vergara if there was anything else item-wise that would "Kill the Blues" to which he replied the main item is the possibility of not being able to play and the concessions item. Chair Cochran then asked the Rattlers if they were planning on continuing to play as no one had spoken from their group. A representative of the SLO Rattlers, Rob Olson acknowledged they had a great season and that they feel there is more to baseball in San Luis Obispo than the SLO Blues. The response from the community, he felt, was great. Mr. Olson also noted the Tribune's results from an online poll asking the community if there was room for more than one team in town indicated 70% said yes and also indicated they'd like to see the two teams play each other. He felt the professional jealousy would not make that possible but if there was only one RFP they would consider it. Committee Member Conner stated if use an RFP would see that it says the Users contribute toward the improvement of our field situation, installing synthetic sports turf ��� � 1 ATTACHMENT - Advisory Committee on`xoint Use of Recreational Property - page 6 August 28, 2007 Minutes for example. Conner added it would be better for the teams and the Joint Use Committee's situation to allow other activities at the Stadium. The purpose of the RFP is to have those teams present proposals in a professional manner to be reviewed by City staff to determine how the Stadium will be shared.. Chair Lemieux opened up the floor to public comment. Tim Golden, SLO Blues, spoke of the realization that it is a privilege to play at Sinsheimer. Understands the field is too big for Babe Ruth and was built to entice a high level of baseball. Feels entitlement must be granted and the situation worked well until the introduction of the new team. Believes in taking care of the fans and children with affordable family entertainment — has spent $20k to clean up two trailers. Does not disagree with the analysis. Feels it is unfortunate for the.Men's Senior Baseball to be considered as "Other" and regrets they could not be represented tonight—fears they will have to disband. Pointed out that the Blues and Rattlers will only play 20 games even if play every night when 40 is needed. Trying to bring money into the community. Believes there is room for all users. Stated Men's Senior Baseball attended mediation and were accommodating but they need the stadium and its lighting. Stated only one concession was needed in the past and does not understand the rationale in needing more. Dave Hite, SLO Rattlers, said they had a great season although realizes they don't have the fan base of the SLO Blues. They did not have logistical problems. Carlton Brown, SLO Blues, feels that past performance and history of use of the stadium should set the precedent for stadium use and a new team does not have a "past performance". Ask that consideration be given to the 40,000 fans and that it is clear the Blues have the community at heart. The merits of a team are produced over years. Michael Lara, SLO Blues, stated he had been with the SLO Blues for seven years. Understands the predicament with the JUC. Shared his fear that if proposals were being judged by number of pages that the use would be granted to the team with the most money to hire a good writer. Halfway through the season there was a change representing an effort toward making this a viable program. In the past stadium use was grandfathered in; when someone new came in they went to the bottom of the list. Stated there have been two teams since 1994 — does not understand the process that would allow a new team to be equal right away. Public comment was closed at 8:20 pm by Chair Lemieux. The Commissioners discussed each recommendation, and sought additional input from the stadium users in attendance on the idea of issuing a RFP for an exclusive food and beverage concessionaire for the stadium. The consensus was that each user wished to maintain and manage their "signature" offerings. The Commission suggested that the teams might want to collaborate on the concession stand to make the operations more efficient and effective. The Commission discussed the idea of not going out for an exclusive food and beverage concessionaire at this time but adding the criteria "business plan for concession use" to the RFP released to the two semi-professional teams to see what the teams propose. If the proposal review committee does not feel that the concessionaire concerns are adequately addressed by the users, then an exclusive concessionaire could be sought at that time. I am in Michigan for a family reunion and will not be returning until Thursday, October 4th. I did however want to address the council on the matter of SLO Stadium. I have attended numerous committee meetings and have been very vocal through the entire process. There has not been a time, at either the JUC or the Parks Commission meeting, where there has been an exchange of information. The users of SLO Stadium simply get 3 minutes to speak and then the committee rubber stamps whatever recommendation the Parks & Recreation department has made through the JUC sub-committee. We came close to an exchange of information at the Parks Commission meeting, but.when a question was asked by a committee member to the users as to the availability of the stadium, the JUC representative on the committee answered the question with false information, and that was that. I sent an email to the council on February 15, 2007 addressing the MiSS-management of the stadium for the 2007 season. I still stand by those statements (the original email is attached). There never was available space for an additional user without displacing one of the other users. For the 2007 season,the JUC (under the direction of a city employee) gave a $4,500 grant to the Men's Senior Baseball League (MSBL)to help pay for facilities other than SLO Stadium. The money they used is a public grant program that is for a)501-c (3) non- profit organizations, and b)to rent facilities other than SLO City or San Luis Coastal Unified School District (SLCUSD)facilities. Not only is the MSBL not a non-profit, but they needed the funds to secure the high school field in Morro Bay, a SLCUSD facility. So if there was plenty of room for all the users in 2007, as the City has stated, why the need to misappropriate public funds? The Recreation Department also says they have no preference in who plays at the stadium and therefore their report is unbiased. I find this hard to believell The JUC sub-committee added in their recommendation for priority of use at SLO Stadium that there be an increase in rates. I don't think that is an issue with any of the users. However, in the analysis it's mentioned that with the increase in rates they should cover 59%of operating costs by renting the field only and 98%with the addition of renting the concession area. I should point out that City staff produced this analysis and report. This analysis is only accurate if both the Blues and the Rattlers rent the field and concession area. Sounds like the reason that the MSBL is getting Squeezed out of the stadium is all about revenue, since they rent the field only. There is so much more to this issue than meets the eye. Some people want you to believe what they tell you without researching fact. There is so much information here it is sometimes overwhelming. I urge the Council to not just rubber stamp a recommendation that comes to you because it appears that committees have worked long and hard to come to a decision. Dig a little deeper and find the real truth. My new question to you is that when a city a mployee makes a false or misleading statement, is it the city's policy to work diligently to make that statement true? It's hard to find any other reason for the City to be working this hard to get the Rattlers into the Stadium at Sinsheimer. If the viepoint of the city is that it is a public facility and everyone that wants to use it must receive equal opportunity to do so, I'm ok with that. But when a new user calls the Rec Department today, they would be told that there was no room and that they would be put on a waiting list.Why the double standard? It sounds like a hard viewpoint to enforce (as you can see by the process we are now in) but I can swallow that as policy. But when the question of usage in 2006 is asked and the response is not supported by the facts (as provided by the Recreation Department) but rather given to support the current viewpoint of the Recreation Department, shouldn't someone question that response? This is because the item was not on the agenda (the agenda referred only to an update on the report being submitted to Council regarding use of the baseball stadium). Accordingly, the agenda language did not provide the public and other interested parties sufficient notice of the fact that the JUC would be reconsidering its earlier recommendation, thereby not giving them an opportunity to comment. Future Practice for Agendizing Items of Discussion The wiser practice, and one to use for the future, would have been to ask if a majority of the JUC would be interested in setting the matter on an agenda for discussion at a future meeting (or, a special meeting, if necessary to meet before the next regular meeting). In light of the motion failing, there is no need for corrective action to be taken by the JUC at its October meeting. The Commit e members discussed other typical grant requests such as Girl's Softball ($1,000-2,100 previous years) and SLO Soccer which may ask for August 2008 tournament funds $6,300 last year) in the March 2008 grant cycle. There may be more money available in arch if SLO Soccer doesn't use the full $6,300 allocation from last year. Vice Chair Conner reque ed more input from Mr. Ainsworth and asked if he had tried to establish non-profit status efore. The only financial impact operating and their current for-profit status is that Men's Baseball spends their funding on the higher ees for them to use Morro Bay High School. Recreation Manager Fitzgerald will t quire about a break in fees if filing under a non- profit status with the School District at a request of Vice Chair Conner. Mr. Ainsworth requested and was grante comment period regarding the staff report. Said he was aware the "request exceeds allo tion" and wouldn't have to request funding if there were only one team using the stadi . In September, he played 13 days this current year. Will pay a massive increase bec se of hourly rates to the City's Stadium fees. Said he could raise team fees but is li 'ted to what he can raise the fees on. Responded to Chair Cochran's question on fees ting last year was the last time they raised fees (from $2,450 to $3,000 a team) but hat raising fees still didn't cover corresponding hike in costs, such as umpires, gas, et . Mr. Ainsworth also pointed out that Cuesta field has no lighting and Paso Robles, oyo Grande, and Atascadero's fields are completely full in June due to use by Babe Ru Baseball. Parks Maintenance has a small window perform herbicide, pesticide, rodenticide, fertilizer and seeding activities that even a two eek delay may mean missing the rainy season necessary for seeding. Because of the the 'cals used or processes involved, these functions must be done when no one is occupying a stadium during the season. Also noted that Parks Maintenance may have asked for to three days a month for maintenance during the next season, but would have to see w t was actually granted. Notwithstanding what Mr. Ainsworth has presented today would take a lot of grief off the field and allow other established users to have the dates they will be comfortable with. Recreation Manager Fitzgerald reiterated that Council has the recommendations of the Committee already and that it is too late to change their actions. Vice Chair Conner wished to reiterate his earlier statement and have known his objections to a shared RFP which he finds absurd. Committee Member Jones agreed and also feels the stadium should have only one semi- pro team. Vice Chair Conner added 3a through 3h are criteria we are asking each semi-pro team to address and his feeling is, if there is an RFP, the team with the best answers to those criteria get the use of the stadium. Chair Cochran pointed out the wording says "will review RFP and past performance" to which Recreation Manager Fitzgerald explained the SLO Blues and the SLO Rattlers both have agreements with the City. The City wants to know what the plan is for handling concessions, fans and parking as there have been issues in the past with managing these areas. Committee Member Parolini discussed negotiations that would be involved. He indicated that going to a single exclusive user could remove a long-time user from the facility. i I Advisory Committee on Joint Use of Recreational Property page 5 September 25, 2007 Minutes Vice Chair Conner added that after November 8, the Joint Use Committee can determine if it wants to forward one recommendation or two to the City Council. His feelings would be that the group forward one RFP, that being the one with the best answers that best meets the criteria. Recreation Manager Fitzgerald reminded the Committee that this was not the recommendation they sent to Council, but that the Council could make their own recommendation. Commissioner Conner stated he didn't feel they had made an objective decision at the last meeting, that he felt rushed at the last meeting to make a decision and that after serious consideration in the last month he has changed his mind which at the committee level he feels they have a right to do. Recreation Manager Fitzgerald informed the Committee they could create a red file item to Council noting opposition by some Joint Use Committee members; however the initial staff report is finished and cannot be changed. Committee Member May expressed he still believes in use of the stadium by both teams. Vice Chair Conner commented on the issue of comparing past experience, and that the SLO Blues would lend more credence in the Last few months than in the last few years. Committee Member Parolini theorized that since the Rattlers haven't been here long enough to compare, it would not be quite fair to pair one year versus the 15 years of growing pains of the other team. Perhaps the comparison then could be of just the last year for both teams. Recreation Manager Fitzgerald responded that each item will be weighted, that if the group decides to weigh past performance higher than other components, it will be up to the selection group and the Director. Vice Chair Conner stated it was his personal opinion the new team came in this year because they didn't like what the existing team was doing and felt they could do better. The Committee allowed this to happen and doesn't feel they should have. Recreation Manager Fitzgerald inquired if the situation was different than any other types of organizations as they establish themselves in the community such as Girl's Softball and Little League when they asked for field space that was in competition with Youth Baseball. That everyone has growing pains. The City tries to accommodate everyone in the best way but we have reached a situation with the stadium where we can't. Assumes the weighting system may determine who gets more games than others. Committee Members May and Cochran wouldn't mind looking at it but believes it is too late. Committee Member May stated he will vote against a motion of this nature and that if it passes he will personally discuss it with the Council. Commissioner Jones passed out copies of a signed petition supporting lighting at the Sinsheimer Park tennis courts. Would like staff to update the committee at the next meeting. Recreation Manager Fitzgerald explained there unfortunately is nothing in the works at this time for lighting the Sinsheimer tennis courts. Lighting could be added to the Capital Improvement List for the next budget cycle. If the Committee supports it, it can be added to Council goal list next year. Added that the 2°d court at Islay is approved and funded.
