Award a contract to Brough Construction in the amount of$95,295 for construction of the Laguna Lake Golf Course Hole No. 3 Relocation, Specification No. 90657. 2. Approve the transfer of$5,295 from the Completed Projects account to the project account. DISCUSSION On July 17, 2007, the City Council authorized staff to advertise for bids for the relocation work and improvements of Hole No. 3 at Laguna Lake Golf Course. Three bids were submitted and opened on September 13, 2007 with Brough Construction of Arroyo Grande being the low bidder at $95,295. This bid amount'is $5,295 over the Engineer's Estimate of$90,000 which represents less than 6% of the construction cost. The bid results are as shown below: Engineer's Estimate $90,000 Brough Construction 95,295 Gecko Golf Construction 129,300 John Madonna Construction 133,630 As a requirement for this project the Contractor had to provide at least three references of installation of golf course landscaping or modifications in order to be considered for award of the contract. When contacted, all three references for Brough Construction gave high praise for their performance and landscaping experience but indicated they had not done any golf course landscaping work. Brough Construction was contacted and admitted they had not performed any golf course work but were very confident in their ability to perform the contract work for Hole No. 3. Staff recommends waiving the golf course landscaping experience requirement and awarding the contract to Brough Construction. All three of their references indicated that Brough Construction had done landscaping work of complexity similar to golf course landscaping in an efficient and timely manner, and expressed confidence in their ability to perform this work. Waiving the experience requirement does not affect the Contractor's bid amount and does not give them an unfair advantage over the other bidders. FISCAL IMPACT This project is identified in the 2005 —07 Financial Plan Supplement, pages E39—E44. Engineer's Construction Estimate: $90,000 Construction Bid: $95,295 Construction Contingency: 9,000 Construction Contingency: 9,000 TOTAL: $99,000 TOTAL: $104,295 Currently, the Completed Projects Account has $8,323 in funds, a sufficient amount to transfer $5,295 to the project account. ALTERNATIVES 1. Award the project to the second-lowest bidder. Gecko Golf Construction specializes in golf course landscaping and has a multitude of experience in constructing portions of and entire golf courses. Awarding the contract to Gecko would require additional funding of $39,300 plus $4,000 to maintain a ten percent construction contingency for a total of$43,300. 2. Reject all bids. This is not recommended as it will delay construction until next year and costs may increase, resulting in an even more expensive project.
