SUBJECT: FORMATION OF A CITYWIDE TOURISM BUSINESS IMPROVEMENT
DISTRICT
CAO RECOMMENDATION
As recommended by the Promotional Coordinating Committee (PCC), approve a Resolution of
Intention to form a citywide tourism improvement district (TBID)for the purpose of increasing
industry investment in tourism marketing in San Luis Obispo.
DISCUSSION
Background
On January 9, 2007 staff presented to Council a report and PCC recommendation to approve a
Resolution of Consent to allow the City hoteliers to participate in a countywide tourism business
improvement district (attachment 3). This initiative had been launched by the San Luis Obispo
Visitors and Conference Bureau (SLOVCB) and proposed the collection of one percent of gross
room rent in each city and the County's unincorporated area for regional tourism marketing.
At that time, Council requested that the SLOVCB provide documentation of at least a two third
support from the City hoteliers and the participation of one other major city in the County: When
Council considered the request, 19 city properties had signaled support through signed petitions
and Morro Bay and Atascadero had passed a resolution of consent to allow their lodging
establishments to participate in the SLOTBID discussion before the County Board of
Supervisors. As discussed later in this report, this initiative has neither gained further momentum
nor the kind of support desired by Council.
However, on August 30, 2007 a group of 24 city hoteliers delivered signed petitions (attachment
1) to the City Council supporting the formation of a citywide TBID and requested the opportunity
to present their proposal to Council. On September 18, 2007 Council heard the proposed
initiative and referred the matter to the PCC and staff for further evaluation and recommended
action.
The TBID initiative was launched by city hoteliers who believe that increased marketing and
promotional efforts are needed in order for San Luis Obispo to succeed in an increasingly
competitive environment and a growing room inventory within and outside the county. They
propose to levy a two percent assessment of gross room rent which is estimated to result in
approximately $950,000 annually to support marketing and promotional efforts to attract tourism
to the City of San Luis Obispo.

Competitive Outlook
The competition for tourism dollars appears to be increasingly fierce as more and more cities and
counties establish business improvement districts to raise money for tourism specific marketing.
In terms of regional competition, Monterey County has established a BID and its marketing
power to support a consistent promotional presence has grown from$2.6 million to almost $5.0
million dollars annually. The increase in room occupancy in Sonoma County is believed to be a
direct result of the boost in marketing revenue generated by the BID and Santa Barbara is
considering the formation of a tourism related BID to keep pace with the growing, statewide
competition.
Considering that the tourism industry has seen little growth over the past few years and
government allocations and countywide tourism marketing contribution continue to be
vulnerable to budget constraints and various priorities, the willingness of the industry to self-
assess for promotional purposes seems paramount. The City of San Luis Obispo—like many
cities—has long encouraged the hotel industry to be less reliant on governmental assistance and
bring more of their own resources to the promotion of the industry.The proposed local TBID is
an opportunity for the lodging industry to do so and signals a major step in this direction.
Purpose and Legal Form of Business Improvement District
Simply put the purpose of forming a.district as a business improvement area (under the Parking
and Business Improvement Area Law of 1989) is to raise revenue to be used for specific
purposes as defined by state law and incorporated into the City ordinance..In the case of a
tourism or hotel improvement district, the increase in revenue will defray the costs of services,
activities and programs promoting scenic, recreational, cultural and other attractions in the
district to drive tourism and directly benefit the operators of hotels in the established district.
The state law states specifically that the businesses and the properties within the business and
improvement area will be benefited by the improvements and activities funded by the
assessments proposed to be levied. In the case of an area formed to promote tourism, only
businesses that benefit from tourist visits may be assessed.
Implementation of a TBID depends upon a negative protest model. The ordinance (and thus the
TBID) can be revoked, if property owners representing 50 percent of the assessment amount
"protest" the establishment or continuation of the TBID in the yearly review required by law.
Mechanics of the BID
The formation of a business improvement district is a multi-step process mandated by state law.
It provides an opportunity for affected businesses to pool their resources for a common purpose—
or to protest doing so. The following outlines the steps necessary in the process which also
applies to the formation of a tourism-only BID:
1. Petition: Business owners petition the City or local agency to establish a BID on
their behalf.
2. Resolution of Intention: The City must adopt a resolution of intention signaling
intent to form a business improvement district, to levy an assessment,and to allow

those to be subject to such assessment to voice their support or opposition in a public
hearing.
3. Notification & Publication: The City has to mail a complete copy of the resolution
of intention by first-class mail to each affected business owner in the area within
seven days of the City Council's adoption. The resolution must also be published in a
newspaper of general circulation in the City once, for at least seven days before the
public hearing.
4. Public Hearing: Within 20 but no later than 30 days after the adoption of the
resolution of intention, the City must hold a public hearing and allow for a protest in
opposition to happen. In order for the negative protest to be successful, properties
that would represent 50 percent or more of the assessment total have to oppose the
proposed district. In that case, no further proceedings to create the TBID can be
undertaken for at least one year.
5. Adoption: If no or insufficient protest is received, the City Council can then pass an
ordinance establishing the TBID.
If approved, the TBID would be in effect for the period of one year. After one year, the lodging
industry is given the opportunity to comment again. If there is a protest equal to 50 percent or
more of the assessment total at the anniversary date, the TBID will dissolve and no further
proceedings to continue the TBID can be undertaken for at least one year.
Once the BID is established, the City Council, by law, must appoint an advisory board which
shall make recommendations to the City Council on the expenditure of revenues derived from the
assessment. The hoteliers petitioning for the proposed TBID requested that the advisory body be
composed of industry members representing the different hotel establishments in the City and
include a Council representative and a staff member to oversee the administration of the TBID
assessment funds. However, in their meeting on October 24, 2007 the PCC suggested that
Council consider utilizing this committee as the advisory board for the district and direct staff to
bring before a resolution modifying the PCC structure to make it a nine (9) member body with at
least three (3) members appointed from the hotel industry. The PCC shall be aided by a City
Council liaison and a staff member
Current Support for a Tourism Business Improvement District
24 hotel owners and/or managers have submitted their written support for a two percent
assessment for tourism marketing. As there are 36* lodging properties in the City of San Luis
Obispo, these properties represent a two third majority of the properties. Further breaking down
the numbers, these establishments represent 60 percent of the room inventory and 63 percent of
the assessment amount..
*These calculations did not include the newly opened Marriot Courtyard hotel, since the assessment
amount is not known and difficult to estimate until it has been in operation for one year.
Potential Advantages of a Business Improvement District
Historically, tourism promotion in the City and the County has heavily relied on public funding
and the advertising dollars of individual hotels. The TBID formation is an opportunity for the

lodging industry to assess itself and—in a coordinated and strategic way—to invest funds directly
into marketing efforts benefiting that industry.
By assessing two percent of the gross room rate, the San Luis Obispo City TBID would collect
almost one million dollars per year based on 2006/07 transient occupancy tax (TOT) numbers.
The Current Status of the Countywide Tourism Improvement District (SLOTBID)
With little enthusiasm from the incorporated areas, the countywide concept has evolved into a
two percent assessment with a split of the assessment to one percent regional marketing
administered by the SLOVCB and one percent returned to the individual cities for local
marketing. This would require the City of San Luis Obispo to collect these funds and allocate
staff time and resources necessary to do so. Also, the County of San Luis Obispo remains the
goveming entity and the report regarding the use of the assessment funds will have to be
submitted, in coordination with the county advisory body, to the Board of Supervisors.
The current efforts for the countywide SLOTBID are headed by a steering committee comprised
of county hoteliers. At the time of this staff report, no other city had passed a resolution of
consent, nor have petitions in support for the new initiative been received from City hoteliers.
Staff is only in possession of the initial one percent proposal petitions. The City of Pismo Beach
has clearly signaled that they will not be part of such an assessment district and Paso Robles is
not currently entertaining bringing forth a resolution of consent due to their lodging industry
being undecided.
The City Council has received a letter, dated October 3, 2007, from the countywide steering
committee addressing concerns regarding the formation of a citywide TBID only, pointing out
the limitations of the use of funds, staff time, duplication of efforts, and the exclusion of the City
as an individual member from the SLOVCB (attachment 4). It is important to point out that the
last item is not due to state law, but by decision of the SLOVCB board not to entertain individual
memberships and to solely concentrate on the countywide SLOTBID as an exclusive contractor..
Promotional Coordinating Committee (PCC) Recommendation
The PCC had originally reviewed the countywide proposal and supported this effort under the
notion that the City hoteliers should be allowed to cast their vote regarding the assessment
district. Therefore, in September 2006 the PCC voted unanimously to recommend that Council
take the steps necessary to leave the final decision to the industry.
On October 24, 2007 the PCC.met to discuss the proposed citywide TBID (attachment 5 —Draft
Minutes). After some discussion, the committee voted 4:0 (one member absent, one abstained,
and John Conner did not participate since he is heading the efforts for the hoteliers) that Council
approve the Resolution of Intention to allow those within the local industry to cast their votes.
However, the PCC also stipulated that, should Council form the TBID, only one advisory body
should be considered. They suggested that the PCC should be increased to anine-member
committee with the specific inclusion of hoteliers as members.

Collection and Management of the TBID Assessment
If a TBID were to be created, the City's Finance Division would collect the assessment of two
percent of the gross room revenue together with the monthly TOT collection. All unpaid and/or
underpaid amounts would be collected according to standard City processes. The advisory body
would then propose the use of funds to Council and it is likely a staff liaison would oversee the
administration and execution of programs in collaboration with contracted agencies.
FISCAL IMPACT
Based on 2006/07 TOT revenues, the assessment would generate approximately $950,000 per
annum for the purpose of tourism marketing and promotional efforts. Since the assessment is
directly tied to gross room revenue, the funds generated would fluctuate with the citywide room
occupancy and increase in room inventory.
NEXT STEPS
If Council decides to pass the Resolution of Intention, a public hearing would have to be held no
later than 30 days after the adoption and after proper notification to the affected properties in
accordance with State Law. This would result in a hearing at the December 4, 2007 Council
meeting. Hoteliers in opposition would have to file a written protest with the City Clerk. If the
protest amounts to 50 percent or more of the proposed assessment total, the TBID could not be
established for at least one year. If the protest does not amount to 50 percent, an ordinance
governing the TBID could be adopted at that same meeting. Given that the second reading of the
ordinance would occur on January 3, 2008, the TBID would become effective February 2008 or
at some other later time as specified in the ordinance, e.g. April 2008.
ALTERNATIVES
1. The Council could not adopt the resolution of intention. This would preclude the possibility of a
citywide TBID assessment district at this time.
I. The Council, if in its discussions determines that more information is needed, could direct staff
to return with additional information at a future date. Specific direction on the information required
should be given.

WHEREAS the Parking and Business Improvement Law of 1989, sections 35000
et seq. of the Street and Highway Code, authorizes cities to establish business
improvement districts for several purposes, one of which is promotion of tourism; and .
WHEREAS the businesses within the proposed City of San Luis Obispo Tourism
Business Improvement District have requested the City of San Luis Obispo to establish
such a self-assessment improvement district.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San
Luis Obispo as follows:
a) The San Luis Obispo City Council proposes to form a parking and business
improvement district pursuant to the 1989 California Street and Highway
Code section 36500 et seq. the proposed boundaries shall encompass the City
of San Luis Obispo.
b) The proposed improvement district shall be called the City of San Luis Obispo
Tourism Business Improvement District.
c) The assessment levied by the Tourism Business Improvement District shall be
used to promote lodging at the hotels within the district and administer
marketing programs that increase overnight lodging.
d) The assessment will be levied and allocated by the City of San Luis Obispo.
e) The assessment is proposed to be levied on all "hotels", as that term is defined
in San Luis Obispo Municipal Code section 3.04.020, to wit: any structure, or
any portion of any structure, which is occupied or intended or designed for
occupancy by transients for dwelling, lodging or sleeping purposes, and
includes any hotel, inn, tourist home or house, motel, studio hotel, bachelor
hotel, lodging house, rooming house, apartment house, dormitory, public or
private club, mobile home or house trailer at a fixed location, or other similar
structure or portion thereof. The assessment shall be based on two percent
(2%) of gross room rent.

shall be aided by a City Council liaison and a staff member.
h) The first public hearing for comments on the proposed District and
assessments is hereby set for 7 P.M. Tuesday, December 4, 2007 before the
City Council of San Luis Obispo at the City Council Chamber at 990 Palm
Street, San Luis Obispo, California.
i) At the public hearing, the testimony of all interested persons for or against the
establishment of the District, the extend of the District, or the furnishing of
specified types of improvements or activities will be heard.
j) Any protest against the City of San Luis Obispo Tourism Business
Improvement District, or any aspect, may be made in writing. To count in the
majority protest against the City of San Luis Obispo Tourism Business
Improvement District, the owner of a lodging establishment included in the
Tourism Business Improvement District must submit the protest in writing. A
written protest may be withdrawn at any time before the conclusion of the
public hearing. Any protest shall contain a written description of the business
in which the person signing the protest is not shown on the official records of
the City of San Luis Obispo as the owner of the business, then the protest shall
contain or beaccompaniedby written evidence tat the person is the owner of
the authorized representative of the business. Any written protest as to the
regularity or evidence of the proceedings shall be in writing and clearly state
the irregularity or defect to the City of San Luis Obispo at 990 Palm Street,

k) If at the conclusion of the public hearing, there are of record, written protests
by the owners of businesses within the proposed San Luis Obispo Tourism
Business Improvement District that will pay fifty percent (50%) or more of

Tourism Business Improvement District shall occur. New proceedings to form
the San Luis Obispo Tourism Business Improvement District shall not be

CAO RECOMMENDATION
As recommended by the Promotional Coordinating Committee (PCC), approve the resolution of
consent to allow the lodging industry to decide whether or not to form a countywide tourism
Business Improvement District for purposes of increasing industry investment in tourism
marketing efforts in San Luis Obispo County.
DISCUSSION
Background
In March 2006, Jonni Biaggini, Director of the County's Visitors and Conference Bureau,
presented to the Council the concept of a creating a countywide Business Improvement District
(BID) for tourism and the formation process that would need to be undertaken (Attachment 1).
During the "questions and answer" period, Council focused on two distinct areas: (1) what is the
level of support for this proposal amongst the local hotel owners and (2) what are the mechanical
aspects that need to happen on the City's end to facilitate the BID, the collection of funds, and
the associated cost to the City.
At that time, Council requested that the PCC review, analyze, and possibly make a
recommendation to the Council regarding the BID. Council also requested that the PCC obtain
feedback from each of the local hotels prior to making their recommendation. Staff was directed
to be working on a parallel track to the PCC to complete its analysis of the mechanics of the BID.
Since that time, the County Board of Supervisors has passed the resolution to request consent of
the cities of the County of San Luis Obispo to allow the industry to consider creating what is now
called the San Luis Obispo County Tourism Business Improvement District (SLOCTBID)
(Attachment 2).
The cities of Morro Bay and Atascadero have passed resolutions allowing their lodging industries
to participate in the SLOCTBID. Paso Robles has discussed the item and postponed a decision to
a date uncertain due to questions regarding the governing ordinance. Arroyo Grande has the BID
item tentatively scheduled for January 23, 2007, as does Grover Beach. At this point, the Pismo
Beach Council will not entertain the idea of a BID for its lodging industry.

Purpose and Legal Form of Business Improvement District
Simply put, the purpose of forming the district as a business improvement area (under the
Parking and Business Improvement Area Law of 1989) is to provide revenue to be used only for
certain purposes authorized by state law. This increase in revenue will defray the costs of
services, activities and programs promoting tourism which will benefit the operators of hotels in
the district through the promotion of scenic, recreational, cultural and other attractions in the
district.
The BID ordinance is based on the 1989 Parking and Business Improvement Area Law, and its
implementation ordinance depends upon a negative protest model. The ordinance (and thus the
BID) can be revoked, if enough property owners "protest" More information on the mechanics
of the process is explained in the next section, along with various accountability provisions
proposed for the SLOCTBID.
Mechanics of the BID
The formation of the BID is a multi-step process mandated by state law to provide opportunity
for affected businesses to pool their resources for a common purpose—or to protest doing so.
The following outlines the steps to be taken in the process:
1. Business owners must petition the County and cities to establish a BID on their
behalf.
2. The County must pass a resolution requesting that cities consent to the County's
formation of a BID. This resolution was passed by the County Board of Supervisors
on July 18, 2006.
3. Cities must then approve a resolution of consent to allow the County to form a BID.
4. County sends a copy of the BID proposal to affected businesses.
5. Public hearings are held to receive comment.
6. County establishes a BID by ordinance unless 50%or more of the total assessment
proposed submits a written protest.
If approved, the SLOCTBID will be in effect for the period of one year. After one year, the
lodging industry is given the opportunity to comment again, and if there is a protest equal to 50%
or more of the assessment total at the anniversary date, the BID will dissolve. In addition, the
Council can revoke the governing resolution after one year and therefore exclude its lodging
industry from participating in the countywide BID
Once the BID is established, the County Board of Supervisors, by law, must appoint an advisory
board made up of lodging businesses. As currently proposed in the draft ordinance to be
considered by the Board of Supervisors, an advisory body consisting of nine members of the
lodging industry is to be created to carry out the functions of the SLOCTBID. The advisory board
reports to the County Supervisors, maintaining accountability for the funds. The advisory board
will become members of the San Luis Obispo County Visitors and Conference Bureau (VCB)
Board of Directors, since at this time, the County Supervisors plans to contract with the VCB to
manage and implement the marketing plan. Thus, there are several accountability and oversight
provisions built into the proposal.

Potential Advantages of a Business Improvement District
Historically, tourism promotion in the County has heavily relied on public funding and the
advertising dollars of individual hotels. The BID formation is an opportunity for the lodging
establishments to assess themselves —in a coordinated and strategic way—to invest added funds
directly into marketing efforts for their industry.
The VCB argues that this new approach is essential in today's tourism environment in light of
ongoing and new challenges. The lodging inventory is projected to increase by 3,570 rooms
(+43%) countywide and by 450 rooms (+24%) in the City of San Luis Obispo alone within the
next few years (Attachment 3 —Countywide Occupancy Trend). In addition, 26 counties in the
State of California have successfully established Tourism BIDS, thus raising the competitive bar
higher in tourism promotion statewide.
Competitive Outlook
The competition for tourism dollars appears to be increasingly fierce in nature. Added
information about hotel inventory and increasing competition is provided in Attachment 1. In
terms of regional competition, Monterey County has established a BID and its marketing budget
is expected to grow from $2.6 million to almost $5.0 million dollars. Sonoma County has
increased its room occupancy, which they believe is largely due to the BID money and Santa
Barbara is currently considering a BID for the county.
Government allocations and countywide tourism marketing contribution continue to be
vulnerable to budget constraints and competing priorities as the budget distribution below
reiterates:

Our City— like many cities —has long encouraged the hotel industry to be less reliant on
governmental assistance and bring more of their own resources to the promotion of the industry.
The tourism BID is an opportunity for the industry to do so and would represent a major step in
this direction.

By assessing 1% of the room rate, the San Luis Obispo Tourism BID would collect $2.3 million
per year based on 2005/06 transient occupancy tax (TOT) numbers of all the County
jurisdictions. Together with the existing funding, the budget for countywide tourism promotion
could total $2.7 million. However, it is anticipated to be less, due to Pismo Beach's unlikely
participation in the SLOCTBID.
A Snapshot of Local Hotelier Sentiments
While staff was unable to get 100% response from the local hotels, and sentiments changed over
time (and may still be changing), we can provide some added insights for the Council in the view
of our local hotels relative to the BID idea.
Dated March 20, 2006, staff received a letter of support signed by 10 hotel property owners in
addition to individual petition letters from several local hoteliers which were received between
September and December of 2006 (Attachment 4).
Independent phone calls by staff, made between April and August 2006, to the hotel owners or
managers revealed:
• 19 properties are in support
• 10 properties are opposing
6 properties have not responded
According to the BID law, the properties not responding are automatically counted as "yes" votes
due to the negative protest clause. In terms of properties, this represents 66% in favor of the BID.
In terms of"rooms", the 19 properties in favor represent 62% of the rooms in SLO; combined
with the non responses, this would represent 70% of total rooms in the City. Thus, hotels
opposed represent approximately 30% of the rooms in San Luis Obispo. In terms of actual
rooms, the supporting properties represent 1269 rooms, non-supporting properties 614 rooms and
the ones that have not responded approximately 156 rooms.
PCC Recommendation
The PCC scheduled the BID item for discussion on several of its monthly meetings, and heard
public comment from hoteliers voicing their concerns, support, and, on occasion, opposition for
the countywide BID. They evaluated current trends, future outlook and consulted with staff on
the research conducted amongst the lodging industry.
Those hoteliers expressing opposition to a BID have expressed concern about the added financial
burden, feeling that they cannot increase the room rates to compensate for it. In addition, some
have said that BID marketing will benefit retail outlets, wineries, restaurants, and others without
any contribution on their part to the effort. Questions have also been raised regarding
governance, should a countywide BID be created.
After much consideration, the PCC concluded that the arguments in favor of a BID are
compelling enough to allow the industry itself to decide. Therefore, in September 2006 the PCC
voted unanimously to recommend that Council take the steps necessary to move the final
decision to the industry itself(Attachment 5 —PCC Minutes). Questions regarding governance

and other concerns, in the opinion of the PCC, can be discussed further between property owners
and the VCB, prior to expressing final opinions through the protest hearing.
Indeed, while this report was being drafted, further information regarding BID govemance
policies was being circulated by the VCB and considered by the hoteliers.
Collection of the BID Assessment
If a bid is created, the City's Finance Division would collect the BID assessment of 1% of the
rent charged together with the TOT collection. The amounts collected will be sent to the
County's Collectors office within 30 days of collection.
However, since this is an assessment fee administered by the County, the City proposes to refer
all unpaid and/or underpaid amounts to the County Tax Collector for follow-up and collection
action. The ordinance imposes a penalty of 10% of assessment for non-payment. There are
specific provision of the governing County ordinance (Attachment 6) regarding collection and
remittance of funds that are still being negotiated between the City and the County. The
resolution is therefore contingent on approval of the final ordinance language.
FISCAL IMPACT
Per County ordinance, the City may retain up to 2% of the amount collected as an administrative
fee for billing and passing through of the BID contribution. Based on the 2005/06 TOT collection
of$4,539,158 this would generate $9,078 in revenue to the City.
CONCURRENCE
In their monthly meeting on September 20, 2006, the PCC unanimously voted for a positive
recommendation to the City Council. The City Attorney has reviewed the draft County ordinance
(Attachment 6) to govern the SLOCTBID and addressed several concerns that will result in a new
version of the ordinance. The Chamber of Commerce is remaining neutral on the issue of whether
or not a BID should be formed, and is instead serving as "a broker of information."
ALTERNATIVES
1. The Council could not adopt the resolution. This would automatically exclude the San Luis
Obispo City lodging industry from participating in the countywide BID decision, since it does not
allow for individual membership or participation.
2. The Council, if in its discussions determines that more information is needed could direct staff to
return with additional information at a future date. Specific direction on the information required
should be given.-

Central Coast of California Hotels city and its businesses. That practice and those tools (website and visitors
guide) will not be available to promote with BID funds because 60% of the
Chamber's lodging membership is located outside the city limits. Another
website and visitor's guide will no doubt need to be produced, competing
with the Chamber's, costing tens of thousands of dollars and countless hours
in duplication.
In addition to this limitation,if a countywide BID is established and the City
is not part of it,none of the hotels or other businesses in the city will be able
to be members of the SLO County VCB, the initial contractor for the
countywide BID. Again,this is because of the requirement to show special
benefit only to those that pay into the district.

These two restrictions alone were not expressed to the City's hoteliers by the
group that wants to establish a city-only BID.
The overwhelming reason that the hotels supported the city-only BID was
because of the pledge that the district could be established more quickly than
the countywide BID. No attention has been paid to an actual marketing plan,
how the BID would interact with existing programs and how much duplication
in efforts would undoubtedly exist
The City Council in San Luis Obispo is the key to keeping tourism promotion
cohesive and collaborative. By establishing a city-only BID, the Council will
effectively open the door to allowing many BIDs to be established in the
county.—each one competing against each other for market share—and no one
having the kind of resources necessary to increase the demand we all want to
achieve.
Lastly,the city-only BID will cost the City money as the group of hoteliers has
asked for staffing support from the City. Not only would this duplicate the
efforts of the PCC,it would add more duties and requirements to staff for no
apparent remuneration.
We urge you to approve consent to form a Countywide BID promptly and not
split this county up into tiny marketing islands. The urgency with which this
needs to occur has been expressed by the city's hoteliers over and over again.

Linsey Miller presented the PR and Tourisrrf Center efforts over the last three months. In this

magazines including the New York Times travel section.
They are currently working on the upcoming Tour of California and so far 450 hotel rooms
have been booked.
The Visitors, Center saw 19,872 visitors during the last quarter and the website had 79,466
individual visits. These numbers are significantly up from 2006.

1. SAN LUIS OBISPO TOURISM IMPROVEMENT DISTRICT
John Conner showed the Committee the presentation given to Council on September 18,
2007 and reiterated the desire by the lodging industry to move forward with a citywide
Tourism Improvement District.
Brigitte Elke followed-up with the process that the State Law requires. The City Attorney
further explained the establishment of an advisory body and the possible use of the
assessment funds.
After hearing public comment from Jonni Biaggini on the current status of the countywide
tourism improvement district, the Committee discussed the proposed initiative.
All committee members where in favor of defining "the City's own destiny" and keeping
control with the City. They also felt that creating further delay in generating more marketing
funds would not be advantageous for the tourism industry. However, they strongly suggested
that the Promotional Coordinating Committee be the advisory body to avoid creating
conflicting promotional efforts for City promotions. They suggested amending the resolution
to provide for an increase in members and that at least 3 members would be from the lodging
industry.
ACTION: Moved by Nicklas/T. Conner to recommend to Council to proceed with the
Resolution of Intention to form a citywide tourism business district, given that
the PCC, in an amended form, be the appointed advisory body.

Our lodging property has been asked to support two Lodging Business Improvement Districts(BID). The first
one being formed is a City of San Luis Obispo BID(City BID). The second one is a San Luis Obispo County
BID (County BID). Both BIDS make a lot of sense to me but my main concern would be that San Luis Obispo
City be guaranteed of receiving its fair share of the County BID 2%per occupied room if we were to support it.
If there were no guarantee, then I would support a proposal to establish two BIDS if that were possible. In that
case, the assessment would be capped at I%per occupied room per BID rather than 2%per occupied room per
BID. I would not support a 4%BID proposal. I spoke to Brigitte Elke of the City of San Luis Obispo today
who verifiedwith the city attorney that legally both BIDs could be formed.
The reasons for both BIDs to succeed are two fold. First, some of the cities in our county already give fiords to
the county for promotion and San Luis Obispo City funds would be lost for promotional purposes if the City
does not approve the County BID. I was informed that the Visitor's and Conference Bureau(VCB) would no
longer promote any city that does not participate in the County BID. The VCB would refuse to promote San
Luis Obispo motels, hotels and restaurants from the current promotional funding received from the City of San
Luis Obispo. The purpose of either BID is to increase, not decrease current promotional funding.
Secondly, forming a City BID permits the city to augment the county effort and promote city-only programs as
proposed by the City BID. The funds collected could not be used for any other purpose but tourism promotion
for the City of San Luis Obispo.
In addition, the City of San Luis Obispo,nor any other individual city, is not an island. Working with the
County to promote the entire county gives each city an opportunity to sell the entire area to potential visitors
and to give them more reasons for traveling to our beautiful,diverse area. If there were a concern about how
the County or City committees might spend the BID assessment funds,parameters could be established and
audited.
With both BIDs in place, an additional funding source would be in place to promote tourism for year-round
travel. Funds collected could not be used for any other purposes but additional tourism promotion.
If there were some way to have only one BID and split the funds between the County and City with the
assurance that the funds would only be used for additional tourism promotion by each of these entities, I would
support such a proposal.

1)Page 2-35: Do you happen to know if the intent of SLOVCB is that their board becomes the advisory
board for the proposed SLOCTBID? The SLOVCB board has nine members. The BID advisory board
would have nine members? Do you happen to know how the SLOVCB board is selected?
The SLOVCB board is independent from the TBID board which will be appointed by the County Board of
Supervisors. The draft ordinance for the countywide TBID reads:
"A countywide advisory board comprised of between nine(9)and fifteen(15)members is hereby created to
carry out the functions of an advisory board under Section 36530 of the law. The members of the initial
countywide advisory board shall be appointed from a list recommended to the Board of Supervisors by the
existing BID Steering Committee."
The current SLOVCB Board is comprised of elected and appointed board members. The contributing cities and
the County have an appointed seat and the elected seats come from the lodging industry, agriculture, cultural,
and business community.

about it being the SLOVCB's decision not to entertain individual memberships: Why is there a Pismo
Beach hotelier on the SLOVCB when Pismo makes no contributions to the SLOVCB
Currently the SLOVCB allows for individual membership. If hoteliers or restaurants from a "non-supporting"
jurisdiction want to pay an individual membership, they can do so. This, however, would change with the
countywide TBID since the SLOVCB board decided to no longer support individual membership from non-
participating jurisdiction once they become the contractor for the countywide TBID.
4)Page 2-31: Apartment house,dormitory,and mobile home are defined as hotels? Are we currently
collecting TOT from these?
If these properties had transients staying less than 30 days, they would be subject to TOT. Stenner Glenn
apartments featured on our TOT list for a long time, since they used to rent apartments through the summer.
Staff is not aware of any such properties, although we do not currently audit for,such use.
5) What is PCC's reasoning on having the PCC control BID expenditures vs.the hoteliers themselves?
The PCC was concerned that two advisory bodies for the same "purpose" could create conflicting or competing
promotional messages. They wanted to assure consistency between the City's Community Promotion program
and the marketing efforts through the TBID. The idea was to add two members and gradually increase the
number of hoteliers to five,presenting a majority on the PCC. However, if this were done right away, two
current members would have to be exchanged.

Attached please find a letter from the Countywide Tourism Business Improvement District
steering committee, submitting petition letters from City of San Luis Obispo hotels indicating
support for a countywide district.
The letter states that the countywide effort, separate and distinct from the City's, is now
supported by two-thirds of the city hoteliers. Because of inconsistencies in the letter, staff felt
that several of the statements and numbers needed further clarification. For instance, petitions
have been signed by the newly opened Courtyard Marriott and the not yet opened Hampton Inn.
These two properties in particular were counted towards the two-thirds "benchmark" previously
requested by Council. Because Public Hearing Item Number 2 on November 6, 2007 — relates
specifically to the issue of a Citywide BID, these properties were not considered; the Hampton
Inn because it has yet to open or start construction,. and the Courtyard Marriott because as
indicated in the report it is too new for an assessment value to be placed.
If these properties are included in the countywide BID "count", then the total number of hotels
would be 38 and not the 36 on which the steering committee has based its representation of a
two- third support. In addition, the Apple Farm is presently one property as TOT is paid under
Apple Farm only. If the Apple Farm and Apple Farm Trellis Court were to be counted separately,
the count would then be 39 hotels within city limits.
Most of the petitions submitted were signed in April and June 2007, several months before the
citywide initiative was launched. When preparing the Council Agenda Report, staff did not
evaluate whether properties are in support of the countywide initiative because the request was
for a citywide BID requested by city properties.
At the time of the staff report, Paso Robles' City Manager was not aware of any petitions and
was under the impression that the hoteliers were undecided. No action on their part has therefore
been taken.

Dear City Council:
Our lodging property, in coordination with the San Luis Obispo County Visitors &
Conference Bureau (SLOCVCB), supports the proposal to establish a Lodging
Business Improvement District in San Luis Obispo County.
A Lodging Business Improvement District (BID) will enable us to establish an adequate
and stable funding source to promote San Luis Obispo County as a tourism destination
for year-round travel. We support the proposal of an assessment of 2% per occupied
room per night.
We understand these funds will be used exclusively for the tourism industry promotion
in San Luis Obispo County, with 1% of the 2% collected by our city lodging properties
being retained for local tourism promotion efforts. A Tourism District will provide
economic benefit to lodging establishments, tourism related businesses and the local

On Tuesday 11/6 you will be voting on the citywide tourism improvement district JBID). I want the council to
know that I support the TBID with the following stipulation..
In the Council Agenda Report dated 11/6/07 it states that the PCC is being considered as the advisory body of the
TBID. I am opposed to the PCC being the advisory body for the TBID. Since the hotels are self assessing the tax
we should control our future.
I support the TBID only if the advisory body to oversee the funds collected is made up of hotel owners or their
representatives.

On Tuesday,November 6, 2007, you will be voting on a Resolution of Intention to form a citywide
tourism improvement district (TBID) for the purpose of increasing industry investment in tourism
marketing in San Luis Obispo.
In our presentation to Council on September 18, 2007, we proposed a city BID as opposed to a County
Wide BID so that the hotel industry in San Luis Obispo may control its future. We also proposed an
advisory board made up of only hotel owners, or their representatives, who would coordinate their
efforts with the PCC; not become members of the PCC. We are totally opposed to the stipulation of the
PCC that only one advisory body should be considered, but we would be in favor of one hotel member
of the PCC also being a member of the Hotel Advisory body of the city TBID.
We know there is a protest by some of the hotels in San Luis Obispo, because they are either members
of the VCB board or it's Steering Committee, or they.might fear being alienated by The San Luis
Obispo County Visitors and Conference Bureau.
We feel that there is not a large enough protest to prevent the ordinance from proceeding and ask you for
a"Yes" vote to move to the next step. Your affirmative vote will still allow Hoteliers, that wish to
protest, do so in writing.
