FOR FEDERAL TRANSIT ADMINISTRATION (FTA) SECTION 5307
GRANTS
CAO RECOMMENDATION
1. Conduct a public hearing on the FY 2007-08 Federal Transit Administration Program of
Projects.
2. As Recommended by the Mass Transportation Committee, approve the FY 2007-08 Federal
Transit Administration Program of Projects (POP).
3. Adopt a resolution authorizing the Public Works Director to file a grant application and execute
a grant agreement with the FTA in the amount of$1,341,040.
DISCUSSION
Background
Since the 1990 census,.the City has been classified as an urbanized zone area (UZA) and is eligible
to receive Federal Transit Administration (FTA) formula grants for operating and capital assistance.
To apply for these grants, the Council must annually:
1. Publish the Program of Projects (POP);
2. Seek approval by the San Luis Obispo Urbanized Zone Area Technical Committee;
3. Hold a public hearing on the proposed POP for federal transit assistance;
4. Adopt a resolution authorizing the Public Works Director to file a grant application and
execute the grant agreement; and
5. Forward the approved POP to San Luis Obispo Council of Governments (SLOCOG) for
review and amendment into the Federal Transportation Improvement Program (FTIP).
The 2007-08 Program of Projects was published in the Tribune on October 20, 2007.
Funding Estimate
The planning estimate for the current year apportionment for the San Luis Obispo Urbanized Zone
Area (SLO UZA) is $1,292,640, plus the unused amount from the previous year. The total amount
available for programming in FY 2007-08 is $1,451,440. The City of San Luis Obispo will be
allocated the amount of $1,341,040, and the San Luis Obispo Regional Transit Authority will be
allocated the amount of$110;400.

Development of the Program of Projects
The 2007-08 POP represents the fourth year that the. San Luis Obispo Regional Transit Authority
(SLORTA) is an eligible recipient of FTA 5307 funding in the San Luis Obispo Urbanized Zone
Area. As required by FTA, all transit operators within an Urbanized Zone Area must execute a
memorandum of understanding (MOU) formalizing how FTA funds will be made available to
eligible transit operators within each Urbanized Zone Area.
According to the adopted MOU, the San Luis Obispo Urbanized Zone Area Technical Committee
has reviewed and approved the proposed POP. The Committee, comprised of the City of San Luis
Obispo, SLORTA, Air Pollution Control District, and SLOCOG, has been meeting to review, rank
and approve this year's grant requests.
FTA requires a public hearing on the FY 2007-08 POP to notify the public how the UZA will spend
its FTA grants and provide the public an opportunity to comment on those recommendations. This
public hearing is a FTA requirement, and will allow the SLO UZA to receive FTA grant
reimbursements for $1,451,440 for the current fiscal year. The City of San Luis Obispo will receive
$1,341,040 of the total apportionment in the San Luis Obispo Urbanized Zone Area. SLORTA will
receive $110,400 of the apportionment. The San Luis Obispo Urbanized Zone Area Technical
Committee approved the project list in Table 1 below on September 19, 2007:

Finally, the FTA grant agreement requires annual certifications of compliance regarding regulations
such as civil rights, procurement procedures, and substance abuse.
Program of Project Details
The Program of Projects includes the following individual projects:
1. SLO Transit Operating Assistance for 2007-08. The federal share of this project is $450,000.
This project will help fund transit operating expenses.
2. Bus Replacement. The federal share of this project is $300,000. This project will fund one
replacement bus to comply with the California Air Resource Board (CARE) emission
requirements. Because of this mandate, the City must replace its older transit buses in order to

reduce its emissions by 85%.
3. Capital Cost of Contracting. The federal share of this project is $320,000. This project will
pay capital costs for bus maintenance paid via the transit services. contract. Capital Cost of
Contracting fluctuates annually because_ of the yearly priorities between capital and operating
demands on FTA Section 5307 funds in the SLO UZA Area.
4. Particulate Trap Retrofit. The federal share of this project is $127,040. This project will fund
particulate traps on buses to comply with the California Air Resources Board (CARB) mandate.
This option is not available for older buses, because these devices are specific to engine years,
manufacturers, and models. The project was previously approved in the FY 2006-07 Program of
Projects however the project was inadvertently left off the FY2006-07 Federal Transportation
Improvement Program(FTIP) amendment.
5. Transit Facility Repairs: The federal share of this project is $144,000. This project will fund
needed repairs to the roof which leaks due to age deterioration, overhead fluid lines in the
maintenance area and a reconfigured internal employee training area or on site trailer.
6. Replacement Runabout Vehicles. The federal share of this project is $110,400. This project
will replace two Runabout vehicles. SLORTA will be responsible for securing the remaining
$27,600 dollars from its local funds.
CONCURRENCES
The San Luis Obispo Urbanized Zone Area Technical Committee approved the recommended POP
on September 19, 2007. At their regular meeting of November 07, 2007, the Mass Transportation
Committee concurred with the staff recommendation for the POP and recommended approval of the
proposed POP to the Council. Their review and draft minutes regarding the POP will be forwarded
to the Council as a red file prior to the Council meeting.
FISCAL IMPACT
As part of the FY 2007-08 POP, a small increase in the amount of FTA 5307 money to fund the
vehicle replacement project is being recommended. Staff recommends taking advantage of all
available remaining FTA 5307 for this purpose ($300,000) which will require a match of 20% from
local funds. This increase amounts to an $35,000 increase in City Transportation Development Act
(TDA) money for local match. Sufficient fund in the Transit Fund working capital exist for this
purpose. The following table indicates the budget amendment request:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO
AUTHORIZING THE FILING OF THE 2007-08 FEDERAL CAPITAL AND
OPERATING ASSISTANCE GRANT APPLICATION WITH THE FEDERAL TRANSIT
ADMINISTRATION
WHEREAS, the Federal Transit Administration has been delegated authority to award
federal financial assistance for a transportation project; and
WHEREAS, a grant of federal assistance will impose certain obligations upon the City of
San Luis Obispo and may require the City of San Luis Obispo provide the local share of project
costs; and
WHEREAS, the City of San Luis Obispo has or will provide all annual certifications and
assurances to the Federal Transit Administration required for the project; and
WHEREAS, a grant of federal assistance will impose certain obligations upon the San Luis
Obispo Regional Transit Authority and may require the San Luis Obispo Regional Transit
Authority provide the local share of project costs; and
WHEREAS, the San Luis Obispo Regional Transit Authority has or will provide all annual
certifications and assurances to the Federal Transit Administration required for the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Luis
Obispo as follows:
SECTION 1. The City of San Luis Obispo and San Luis Obispo Regional Transit Authority
are eligible recipients as defined by 49 U.S.C. 5307, 5336j, and 5340.
SECTION 2. The Public Works Director is authorized to execute and file an application for
Federal assistance on behalf of the City of San Luis Obispo with the Federal Transit
Administration for federal assistance authorized by 49 U.S.C. Chapter 53, Title 23, United States
Code and other federal statutes authorizing a project administered by the Federal Transit
Administration.
SECTION 3. The Public Works Director is authorized to execute and file with the
application the annual certifications, assurances, and other documents the Federal Transit
Administration requires before awarding a federal assistance grant.
SECTION 4. The Public Works Director is authorized to execute grant agreements with the
Federal Transit Administration on behalf of the City of San Luis Obispo.

Committee Meeting re Program of Projects
The Mass Transportation Committee (MTC) met on November 7, 2007, at which time
they approved the staff recommendation regarding the 2007-08 Program of Projects for
the Federal Transit Administration (FTA) 5307 Grant by a 6:0 vote. Member Kathy
Howard and Alternate Member Christine Matteate were not in attendance at that
meeting.
Attached for Council review is a copy of the MTC November 7, 2007, minutes
confirming the MTC's action.

times comparable with existing service rates and that all rates be posted dearly
on the interior and exterior of all cabs.
Ms. Rains seconded the motion.
The motion passed unanimously.
C-2 Review and Approve 2007-08 Program of Projects
Mr. Bochum discussed programming of federal dollars and funding sections, e.g.
5307. He noted that this year's slate of proposed projects is similar to last year's,
with increased dollar amounts. He recommended that MTC recommend to
Council that the Program of Projects be approved as presented.
Mr. Doyle moved to accept staff recommendation that Council approve the
Program of Projects as presented.
Ms. Rains seconded the motion.
The motion passed unanimously.
C-3 Review and Approve MTC Calendar for 2008
The MTC agreed to schedule the November 2008 meeting to be held on
November 5, 2008 as opposed to November 12, 2008.
Ms. Rains moved to approve the amended MTC Calendar for 2008.
Ms. Martinez seconded the motion.
The motion passed unanimously.

Mr. Webster recapped several points in the report for discussion. He noted that
Sabrina Haggie had accepted another position and that her current position was
being recruited.

Mr. Bochum reported that staff intended to carefully scrutinize the effectiveness
of Routes 2 &3 evening services.
