Walter, Director of Public Wor U�" Prepared by: Hal Hannula, Senior Civil Lineer SUBJECT: FINAL ACCEPTANCE OF SUBDIVISION IMPROVEMENTS FOR TRACT 2490 — A SIX LOT RESIDENTIAL CONDOMINIUM SUBDIVISION LOCATED ON THE WEST SIDE OF BROAD STREET (227) BETWEEN STONERIDGE DRIVE AND SWEENEY LANE. (DAVE BOLDUAN & DALE KING, SUBDIVIDER) CAO RECOMMENDATION Adopt a resolution accepting the public improvements, and certifying completion of the required private improvements, and releasing the sureties for Tract 2490. DISCUSSION The required subdivision improvements approved with the vesting tentative map for Tract 2490 (Vicinity Map, Attachment 1/Site Map, Attachment 2), per Resolution No. 9434 (2003 Series), have been completed to California Code Standards, City Engineering Standards and Standard Specifications. The final map for Tract 2490 was approved, per Resolution No. 9632 (2004 Series). Public improvements are limited to curb, gutter, and sidewalk improvements along Broad Street and Rockview Place, utility service laterals located within the respective public rights-of-way, a fire service lateral serving a private on-site fire hydrant, sidewalk underdrains, and a street light added to an existing joint utility pole. The remaining subdivision improvements are private including but not limited to the driveways, on-site utility services, a private fire hydrant, the on- site storm drain system, and private sewer mains located within the driveways off of Broad Street and Rockview Place. The public and private subdivision improvements were substantially complete to the satisfaction of the city at the time of occupancy of the final residence in December of 2006. Final inspection approval and construction verification of a portion of the private sewer main was completed in June of 2007. A final request for acceptance of the subdivision improvements was received in July of 2007. It has been the intent of the Public Works Department to recognize the December 2006 building occupancy date as a start date for the required one year warranty of the subdivision improvements. A one year follow-up warranty inspection was conducted in December of 2007 and no defects in the subdivision improvements were discovered. The subdivider has requested final acceptance of the public improvements by the City and release of the respective sureties. Included with the final map approval in 2004 was a subdivision agreement that allowed the Labor and Materials and the Faithful Performance sureties to be released upon the Council's acceptance of the subdivision improvements and receipt of a surety Com- � Council Agenda Report—acceptance of Public Improvements-TraG.4490 Page 2 of ten percent of the cost of the public improvements. The ten percent surety typically required for a one-year warranty period to insure that the subdivider will remedy any defects in the improvements arising from faulty workmanship or materials or defective construction of said improvements is deemed to not be necessary in this case as the improvements were inspected and approved by Public Works and Building Division staff in December of 2006 and were re- inspected in December of 2007. The cost of the subdivision improvements were estimated to be $37,313. The city is currently in receipt of letters of credit for $37,313 and $18,657 to guarantee the Faithful Performance of the improvements and for Labor and Materials respectively. When the proposed resolution is approved, the Public Works Director will authorize the release of the Faithful Performance security. The release of the Labor and Materials security may be processed after the 90 day waiting period referenced in Section 66499.7(h) of the Government Code of the State of California. FISCAL IMPACT Typical maintenance and operation of public facilities will be required for the water service laterals located in Broad Street and Rockview Place, and for the new street light located along the Broad Street frontage. (2008 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ACCEPTING THE PUBLIC IMPROVEMENTS FOR TRACT NO.2490 WHEREAS, the City Council made certain findings concerning Tract 2490, as prescribed in Resolution No. 9434 (2003 Series); and WHEREAS, the City Council approved the final map for Tract 2490 per Resolution No. 9632 (2004 Series); and WHEREAS, the subdivider has satisfactorily completed the public improvements for Tract 2490, in accordance with City standards, specifications and the subdivision agreement, and has requested acceptance of the public improvements for maintenance and operation by the City. The private improvements have been completed per plan. WHEREAS, the subdivider has satisfactorily completed the private improvements for Tract 2490, in accordance with City standards, specifications and the approved plans, and has requested that the city certify completion of these private improvements. NOW THEREFORE, BE IT RESOLVED, the City Council hereby accepts the public improvements and certifies completion of the private improvements for Tract No. 2490. The current Faithful Performance surety may be released at this time. The Labor & Materials surety may be released after 90 days from this date of acceptance of the improvements in accordance with Section 66499.7(h) of the California Government Code.
