SUBJECT: RESOLUTION ACCEPTING THE DONATION OF THE QUAGLINO
BRIDGE PUBLIC ART
CAO RECOMMENDATION
1. As recommended by the Public Art.Jury and the Architectural Review Commission
(ARC), adopt a resolution accepting the donation of the Quaglino bridge public art.
2. Authorize developer to proceed with installation on public property.
DISCUSSION
Background
In October 2007, Quaglino Properties approached staff with a public art proposal that would be
the first of its kind; essentially a combination of three of the City's public art programs/policies.
The proposal included a component of the Public Art in Private Development Program which
required the developer to acquire and install public art approved by a public art jury and the
Architectural Review Commission in a public place on or in the vicinity of the project site.
However, as part of Quaglino Properties new development on Ricardo Court, they were to install
a bridge railing on Sacramento Drive as it crosses Orcutt Creek. Therefore, the developer
proposed a public art bridge railing that would not only satisfy their public art requirement but
also the bridge railing obligation. Due to the location of the art, in a public right-of-way, the
guidelines of the Privately Funded Art in Public Places Program were applied. In addition, the
cost of the artistic railing exceeded the developer's mandatory public art contribution; hence they
requested a Public Art Matching Grant to complete the project.
While on January 8, 2008, City Council approved a matching grant request of$12,500 in public
art funds to match the $12,500 contribution from the developer, per the City's Donation
Acceptance Policy, donated public art projects require City Council approval.
Description of art
The artistic railings will be fabricated from steel tubing and sheet metal and then powder coated
in a trio of coordinated colors. The structural framework will be designed with over sized steel
tubing for strength and durability in a configuration that is attractive and interesting. The rail
system will be assembled using stainless steel fasteners and the posts will be anchored to the
concrete using stainless bolts in high strength epoxy. The smooth and durable surface will be
easy to clean and relatively inhospitable to graffiti. The motif will represent a riparian scene;

with the completed railing illustrating a combination of creek and wetlands scenes; similar to
those south of Damon Garcia Sports Fields. A stylistic representation of the subject matter will
be used for a more lasting artistic value (see Attachment 1 for vicinity map and architectural
drawing).
Approval Process
The Public Art Jury Review. In accordance with City policy, an art jury, consisting of a member
of the Arts Council, artists, City staff, and a local businessperson, reviewed the piece on February
12, 2008 for the following criteria:
1. Artistic excellence.
2. Appropriateness of scale, form, material, content and design relative to the immediate and
general neighborhoods.
3. Relationship to the social, cultural and historical identity of the neighborhood.
4. Appropriateness of materials in regards to structural and surface integrity, protection
against theft, vandalism, public safety and weathering.
5. Appropriateness of proposed method of installation of artwork, and safety and structural
factors involved in installation.
6. Ease of maintenance.
The work received unanimous support and was recommended to be forwarded to the ARC for the
next phase of the review process (see Attachment 2 for jury summary).
ARC Review. On March 17, 2008, the ARC evaluated the proposal using the following
Guidelines for Public Art:
1. Publicly funded public art shall be located within the public right-of-way, a public
building or otherwise shall be easily visible or accessible from a public right-of-way.
Interior locations for public art are permitted, and shall be freely open and accessible to
the public.
2. Privately funded public art shall be located on privately owned land or buildings which
are places of high visibility to the public. Such places shall be in exterior locations, and
not within buildings. If privately funded public art is donated to the City, Guideline No.l
above applies to location of art.
3. Consideration shall be given to the size, massing, location and scale of the proposed piece
and to potential conflicts with present or future vegetation or construction.

4. Public art shall be compatible with the immediate site and neighborhood in terms of
historic, social and cultural characteristics, architectural scale, materials, land use, and
geographical and environmental context.
5. The design and placement of public art shall not impede pedestrian or vehicle traffic, or
conflict with public or private easements.
6. Consideration shall be given to any public safety or public_health concerns created by the
artwork.
7. Public art shall be integrated with the site and/or building, and include landscaping,
lighting, interpretive information and other amenities where appropriate.
8. Public art shall be securely installed.
Finding that the bridge railing met the criteria for public art, the ARC unanimously approved the
project (see Attachment 3 for ARC letter of Findings and Conditions).
FISCAL IMPACT
As part of the 2007-09 Financial Plan, City Council approved the matching grant request of
$12,500 in public art funds to match the $12,500 contribution from the developer in order to
complete the bridge railings.
ALTERNATIVES
Council could reject the donation of the bridge railing. Staff does not recommend this action
because 1) the overwhelming approval received from both the jury and the ARC indicates the
public will appreciate and embrace the piece; and 2) this represents a unique opportunity to blend
public and private funds to acquire additional public art pieces.

SUBJECT: PUBLIC ART JURY REVIEW OF ART PROPOSAL FOR QUAGLINO
PROPERTIES
On February 12, 2008 a public art jury consisting of Gini Griffin, Artist; Jennifer Lawrence,
Public Works Engineering Technician; Jim Jacobson, Art in Public Places committee member
/artist; and John Huffman, Arts Council Board Member/business owner met to review and
discuss the proposed artwork for the Quaglino Properties.
The piece, artful bridge railings, is the best response in terns of scale, usefulness, symbolism
and integration with the site and its operation. The artful railings will provide an enhanced
public art element to the traditional mission style railing proposed for the site. The work is
composed of steel tubing and sheet and then powder coated in a trio of coordinated colors. The
motif represents a riparian habitat. meant to be readable from passing motorists as well as
pedestrian.
The piece is proposed to be located on the east side of Sacramento Drive at it crosses Orcutt
Creek. In a public right of way, it is easily accessible by both pedestrians and the driving public
on Sacramento Drive.
The public art jury was tasked with evaluating the artful railings using the Guidelines for Public
Art. A summary of the jury's discussion follows:
1. Evaluation of artistic excellence. The jury unanimously recommended the piece for
its artistic excellence. They felt the piece lent itself well to the area.
2. Appropriateness of scale, form, material, content and design relative to the
immediate and general neighborhoods. The jury felt the piece will fit nicely with the
property, as well as the environment. Overall, the jury felt the scale was appropriate
and that the proposed colors fit in well with the motif as well as the surrounding
environment. The jury encourages the artist to incorporate more negative space into
the railing motif creating enhanced visibility for those at a greater distance.

3. Relationship to the social, cultural and historical identity of the neighborhood. The
jury liked the connection between the motif of the piece and the creek and its
surrounding habitat.
4. Appropriateness of materials in regards to structural and surface integrity,
protection against theft, vandalism,public safety and weathering. The jury agreed
that the materials selected for the piece were appropriate (powder coated steel) and
would weather well. The jury would recommend further investigation into a less
absorbent clear coat to the powder coating and more "negative" space reducing the
amount of space for graffiti.
5. Appropriateness of proposed method of installation of artwork, and safety and
structural factors involved in installation. The jury was confident that the proposed
installation method and structural factors were appropriate and adequate. They would
recommend securing the bolts that would attach the panels to the posts on the"back
side" of the panel (the side less visible from foot and road traffic) and in addition
masking the screw holes in the front of the panels to avoid vandalism.
6. Ease of maintenance. The surface treatment and inherent nature of the materials used
will lend themselves to low maintenance requirements. Maintenance ultimately rests
with the owner of the development.
Overall, the jury approved of the piece and recommended that it be forwarded to the
Architectural Review Committee for approval.

Dear Mr. Quaglino:
The Architectural Review Commission, at its meeting of March 17, 2008, approved the
above project, finding that the public art meets the criteria for public art and approved the
art installation project, based on the following findings, and subject to the following
conditions:
Findings-
1. The proposed public art is consistent with Architectural Review Commission Public
Art Criteria as stated in the City's Public Art Manual, Appendix C, and is
compatible with the immediate site and neighborhood in terms of architectural
scale, materials, land use, and the site's historical and environmental context.
2. The proposed location of the art meets the location criteria since it is within the
public right-of-way and will be easily viewable by both motorists and pedestrians at
any time.
3. The public art application complies with the standards set forth in the Community
Design Guidelines.
4. The Art Jury approved the artwork design on February 12, 2008.
5. The project is categorically exempt from environmental review (CEQA Guidelines,
Section 15311)
Conditions:
1. The design and placement of the railing shall be consistent with the approved site
plan and concept as attached within the exhibits unless the City and the applicant
agree otherwise.

2. Final installation details shall be to the review and approval of the Community
Development Director.
3. The City's Public Works Department is responsible for providing all maintenance
necessary to preserve the public art in good condition and to protect it against
physical defacement, mutilation, or alteration.
4. The City.of San Luis Obispo shall assume full responsibility and liability for the
piece once approved, installed, and completed.
5. City-funded public art may not be removed, altered, or relocated without secure
approval of the City Council.
The decision of the Commission is final unless appealed to the City Council within 10
days of the action. Any person aggrieved by the decision may file an appeal. Appeal
forms are available in the City Clerk's office or on the City's website (slocity.org). The fee
for filing an appeal is$100 and must accompany the appeal documentation.

ACCEPTING A DONATION FROM QUAGLINO PROPERTIES OF PUBLIC
ART ON THE BRIDGE AT SACRAMENTO STREET AND ORCUTT CREEK
WHEREAS, through a Public Art Application for Privately Funded Art on City-
Owned Property (Exhibit A, attached), Quaglino Properties has offered to donate to the
City of San Luis Obispo an artistic bridge railing to be installed on the bridge on
Sacramento Street over Orcutt Creek; and
WHEREAS, pursuant to Resolution No. 8965 (1999 Series) (Exhibit B, attached)
all donations exceeding $5,000 shall be accepted through a written agreement consistent
with the guidelines set forth in such Resolution and approved by the City Council; and
WHEREAS, the artistic bridge railing is appraised at $25,000; and
WHEREAS, pursuant to Resolution No. 9656 (2005 Series) (Exhibit C, attached),
on January 8, 2008 the City Council of the City of San Luis Obispo allocated $12,500 in
matching grant funds towards this project;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
San Luis Obispo hereby accepts the public art artistic bridge railing on Sacramento Street

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ADOPTING A CITY DONATION ACCEPTANCE POLICY
WHEREAS, individuals, community groups, and businesses may wish to make
donations to the City in either cash or in-kind contributions that enhance projects, facilities, and
programs; and
WHEREAS, the need for projects, facilities, and programs exceeds the City's ability to
fund all such needed projects; and
WHEREAS, it is an acceptable and appropriate practice to accept donations, in order to
enhance City programs and/or facilities to provide a higher level of service to the public.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Luis
Obispo hereby adopts the following policy concerning the acceptance of donations:
1. The donation must have a purpose consistent with City goals and objectives
2. :The City may decline any donation without comment or cause.
3. The donation will not be in conflict with any provision of the law.
4. The donation will be aesthetically acceptable to the City.
5. The donation will not add to the City's workload unless it provides a net benefit to the
City.
6. The donation will not bring hidden costs such as starting a program the City would be
unwilling to fund when the donation was exhausted.
7. The donation places no restriction on the City,unless agreed to by the City Council.
8. The donation shall become property of the City.
9. All donations will receive recognition appropriate to the level and nature of the donation
as determined by the City. For those of a capital nature, that may be in the form of
signage, marking, or naming. Any naming of Parks and Recreation facilities shall be
consistent with City policy on the naming of such facilities as set forth in Resolution
8621 (1997 Series). Regardless of the recognition strategy selected, the intent shall be to
appropriately honor the donor for their contribution to the community. The appearance of
traditional commercial advertising shall be avoided.
10. Donations exceeding $5,000 shall be accepted through a written agreement consistent
with these guidelines and approved by the City Council. In-kind capital donations will be
subject to normal City review,permitting,inspection,and insurance requirements.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ADDING A MATCHING FUND COMPONENT TO THE CITY'S PUBLIC ART PROGRAM
WHEREAS,the City has had a Public Art Program in place since 1990;and
WHEREAS, the Program currently consists of three components, including Visual Arts in
Public Places,Privately Funded Art in Public Places and Public Art in Private Development;and
WHEREAS, the City realizes that a matching fund component to the public art program is
an excellent way to expand public art opportunities within the City beyond the three existing
components.
NOW,THEREFORE,BE IT RESOLVED by the Council of the City of San Luis Obispo
that a matching fund component is hereby added to the City's Public Art Program and shall read as
follows:
The City has established a matching grant program to encourage public art.
Projects seeking matching grant funds will require City Council approval, consistent
with the City's Donation Acceptance Policy. Public art projects receiving matching
funds should provide a clear public benefit and advance the City's public art goals.
For every request, the Council will determine an appropriate level of match, up to a
dollar-for-dollar level.
