SUBJECT: TRAFFIC SIGNAL MODIFICATION AT MARSH AND OSOS, SPECIFICATION
NO. 90792
CAO RECOMMENDATION
1. Award a contract to Ehinger Electric of Atascadero, CA in the amount of $175,000 for
modification of the traffic signal at Marsh and Osos, specification no. 90792.
2. Approve a transfer of$14,250 from the Higuera & Granada traffic signal project account to
the Marsh& Osos Traffic Signal Account.
DISCUSSION
Traffic Signal modifications at Marsh & Osos were originally identified in the 2001 Annual Traffic
Safety Report and funded out of the 2003-05 Financial Plan. This project was grouped with the signal
installation at Broad & Pacific and the signal modification at Marsh & Santa Rosa. All three signal
projects were put out to bid as a single package, however only one proposal was received which was
significantly over budget and was therefore rejected. In May of 2006, the three projects were split up
and put out to bid individually with the same results.
At that point the three locations were prioritized based on collision history and traffic volumes (#1
Broad & Pacific, #2 Marsh & Santa Rosa, and #3 Marsh & Osos), funding for all three projects was
consolidated in order to fund the highest priority signal at Broad & Pacific which is now complete. At
its August 215`, 2007 meeting, the Council approved additional funding to proceed with the second
priority project at Marsh & Santa Rosa which is near completion. At that same meeting the Council
also approved additional funding to proceed with the Marsh and Osos signal modification as the final
project of the group.
On February 12`h, 2008, the City Council authorized staff to advertise the project. Only one bid was
received and opened on March 13th, 2008. The only bid of$281,548 submitted was by Lee Wilson
Electric of Arroyo Grande, CA was 19% over the engineer's estimate of $170,000. The Council
subsequently rejected this bid on April 1",2008. The specification was modified to attract more bids
and advertised again on April 5th, 2008.Three bids were received and opened on April 24th, 2008. The
low bid of$175,000 submitted was by Ehinger Electric of Atascadero, California, and was $5,000, or
3%, over the engineer's estimate of$170,000.
FISCAL IMPACT
The Council approved a$190,000 allocation for this project at its August 21st, 2007 meeting. The low
bid for this project is $175,000. The original contingency amount was 10%, however due to
experience with the signal modification at Marsh & Santa Rosa staff recommends increasing this

contingency to 15% ($26,250) as a precaution. Staff recommends transferring the remaining funding
necessary to increase the contingency for this project from the Higuera & Granada Signal project
account, spec. 90573. The current balance of the Higuera Granada Project is $88,539.22. This project
was completed and accepted by the City on July 24th, 2007. After this transfer the balance of the
Higuera & Granada traffic signal project will be $74,289.22. The remaining balance of the Higuera
Granada Traffic Signal Project account will be transferred back to unappropriated TIF at the end of
the fiscal year.

ALTERNATIVE
The Council may defer construction until a later date. However, staff anticipates construction
costs will only continue to increase over time. This intersection has a significant recurring traffic
collision pattern; if the project does not proceed it is highly likely that traffic collisions will continue
to occur.

AGREEMENT
THIS AGREEMENT,made on this day of ,2008,by and between the City of San Luis Obispo,
a municipal corporation and charter city,San Luis Obispo County,California(hereinafter called the Owner)and
EHINGER ELECTRIC COMPANY,INC. (hereinafter called the Contractor).
WITNESSETH:
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1, SCOPE OF WORK: The Contractor shall perform everything required to be performed, shall
provide and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and
transportation services required to complete all the work of construction of
TRAFFIC SIGNAL MODIFICATION AT MARSH&OSOS,SPEC NO.90792
in strict accordance with the plans and specifications therefor, including any and all Addenda,adopted by the Owner, in
strict compliance with the Contract Documents hereinafter enumerated.
It is agreed that said labor, materials, tools, equipment, and services shall be furnished and said work performed and
completed under the direction and supervision and subject to the approval of the Owner or its authorized representatives.
ARTICLE II, CONTRACT PRICE: The Owner shall pay the Contractor as full consideration for the faithful
performance of this Contract,subject to any additions or deductions as provided in the Contract Documents,the contract
prices as follows:

Payments are to be made to the Contractor in accordance with and subject to the provisions embodied in the documents
made a part of this Contract.
Should any dispute arise respecting the true value of any work omitted,or of any extra work which the Contractor may
be required to do, or respecting the size of any payment to the Contractor,during the performance of this Contract,said
dispute shall be decided by the Owner and its decision shall be final,and conclusive.
ARTICLE III,COMPONENT PARTS OF THIS CONTRACT: The Contract consists of the following documents,
all of which are as fully a part thereof as if herein set out in full,and if not attached,as if hereto attached:
1. Notice to Bidders and information for bidders.
2. Standard Specifications,Engineering Standards and Special Provisions.
2. Accepted Proposal.
4. Public Contract code Section 10285.1 Statement and 10162 Questionnaire.

ARTICLE IV. It is further expressly agreed by and between the parties hereto that should there be any conflict between
the terms of this instrument and the bid or proposal of said Contractor, then this instrument shall control and nothing
herein shall be considered as an acceptance of the said terms of said proposal conflicting herewith.
