Hawley, Supervising Civil Engineer,) SUBJECT: Submittal of Standard Specifications for Construction of Public Works Projects CAO RECOMMENDATION: Adopt Resolution Approving Standard Specifications for Construction of Public Works Projects DISCUSSION: In 1991 the City Council adopted Resolution No. 6954 approving Standard Specifications for Construction of Public Works Projects. These current Standard Specifications are utilized in conjunction with the 1988 State Standard Specifications and the City Special Provisions which are unique to each City capital project. The City Standard Specifications follow the State Standard Specifications on a chapter by chapter basis. The Contractor is required to be totally in compliance with a particular chapter of the State Standard Specifications or as it is modified in the City Standard Specifications. Additional chapters not in the State Standard which specify construction requirements for water, sewer, storm drainage, landscaping and irrigation are included in the City Standard Specifications. The City Standard Specifications, State Standard Specifications, Special Provisions and the plans are all component parts of the overall construction contract. On July 1992 the State of California Department of Transportation adopted a new Standard Specification book, which superseded the 1988 edition. The new Standard Specification has numerous revisions that update and expand the previous specification to be consistent with current codes, contract & labor laws, industry standards, and construction techniques and materials involving public works projects throughout the State of California. Staff has now updated and expanded the City Standard specifications booklet to be consistent with the 1992 State Standard Specifications, as well as reflecting the current City policies and construction practices that affect those areas involving water, sewer, drainage and landscaping. It is important that the city Council approve all standards used in projects. The act of Council approval allows the City protection under the law from future claims of damage that may be attributed to the improvements constructed under these standards. The legal term for this protection is "Design and Plan Immunity." ALTERNATIVES: Option 1: Continue action on the Resolution to a future date. i CONCURRENCES: All of the related divisions within the Public Works and Utilities Departments have reviewed these Standard Specifications and concur with the recommendation. FISCAL MIIPACTS: The cost of preparation and printing of the Specifications is included in the Engineering Division Budget. Costs are partially offset by sales of the Specifications to contractors, designers and other interested parties. i Attachment: 1 - Resolution I RESOLUTION NO. (1993 Series) C A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING STANDARD SPECIFICATIONS FOR CONSTRUCTION OF PUBLIC WORKS PROJECTS WHEREAS, the Engineering Division of the Public Works Department is responsible for the preparation of Specifications for Public Works Projects, and WHEREAS, specifications are necessary to ensure that Contractors of Public Works facilities construct projects to minimum acceptable standards and follow existing laws to protect the health, safety and welfare of the public, and WHEREAS, legally adopted Standard Specifications are necessary to provide "design and plan immunity" thereby protecting the City from possible liability, and WHEREAS, the existing Standard Specifications are in need of updating to be consistent with current State Standard Specifications (dated July 1992) and City policies and construction techniques and materials, NOW THEREFORE, BE IT RESOLVED that the City Council of the City of San Luis Obispo, California hereby: 1. Approves a booklet prepared by the Engineering Division of the Public Works Department setting forth Standard Specifications for construction of Public Works projects, entitled "Standard Specifications," attached hereto marked Exhibit "A" and incorporated herein by reference, and 2. Authorizes the Public Works Department to prepare and maintain a supply of said booklet for distribution. 0 Resolution No. (1993 Series) 1 Page Two. 3. Directs the City Engineer to incorporate these "Standard Specifications" in all construction contracts advertised by the City.
