Consider the summer Council meeting calendar and, if necessary, provide direction related to meeting cancellation. 2. Cancel the Regular City Council Meeting of Tuesday; November 4, 2008, due to Federal, State, and Municipal Elections. DISCUSSION Summer Schedule It has often been the practice of the City Council to cancel its first regular Council meeting in the month of August. At one time, this custom allowed the Council and staff to plan summer vacations and reduce meeting absences. However, over the years, the practice lost some effectiveness because Council members had summer vacation plans and obligations that occurred during different weeks in the summer other than the first week of August. In 2006, for example, the Council cancelled the first meeting in July because that was when two Council members were planning to be gone. In 2007, Council cancelled its first meeting in August, but because of time sensitivity, scheduled a special meeting the following week to receive a water resources status report and consider matters related to the Nacimiento water project. At this time, staff is asking Council members to share their summer vacation plans and provide staff with direction regarding potential cancellation of a meeting. Staff does request that Council not cancel the July Ist meeting as it is the last meeting date prior to the expiration of the Chinatown option agreement on July 3rd. While it may be possible to bring an agreement forward prior to July 1, at this point it is more likely that we will need the time afforded by the July 1 timeframe. Election Night The date of the first regular City Council meeting for the month of November 2008 is Tuesday, November 4; however, the General Municipal Election falls on that date. Therefore, in accordance with past practice, staff is recommending that the first regular meeting of November be cancelled. The meeting occurred on January 26th, 2008 from 10:00 to 12:00 a.m. at Mitchell Park in the Senior Center. The workshop was attended by approximately 22 members of the public. The main objective of the workshop was to provide members of the public an opportunity to review and share opinions about three types of skate park materials: • Modular • Pre-Cast Concrete • In Ground Concrete The meeting began with a summary of the project by Betsy Kiser (City of San Luis Obispo Parks and Recreation Department). Following this introduction, Mike Sherrod (RRM Design Group) and Zach Wormhoudt (Wormhoudt, Inc.) presented images of the three materials, and discussed the advantages and disadvantages of each. After the presentation, members of the public were asked to vote using a dot to mark their preferred skate park material. The participants overwhelmingly chose In Ground Concrete, receiving all the votes except for one for pre-cast concrete. The meeting occurred on March 1 st, 2008 from 10:00 to 12:00 a.m. at Mitchell Park in the Senior ' Center. The workshop was attended by approximately 50 members of the public. The main objective of the workshop was to provide members of the public with an opportunity to review ' and share opinions about three types of skate park terrain: • Street (plaza and urban street elements) • Transition (pools and flow-bowls) • Signature Features (unique terrain elements) The meeting began with a summary of the first workshop by Betsy Kiser(City of San Luis Obispo Parks and Recreation Department). Following this introduction, Mike Sherrod (RRM ' Design Group) discussed the potential size range for the skate park expansion. Zach Wormhoudt (Wormhoudt, Inc.) then presented images of the three terrain types listed above, and discussed the advantages and disadvantages of each. After the presentation, members of ' the public were asked to vote using two dots to choose their preferred skate park terrain. The votes were closely divided with the most participants choosing Transition (379 , then Street ' (339Q, and finally Signature Features (30%). After the voting, potential special events and site amenities were discussed and recorded. The ' City discussed their ideas, and then the participants contributed their wishes. The report states the City Council voted to exempt SLOCOPA from the annual audit last year. That's not what produces remember from the City Council motion. Charter has the money to pay for the audit and insurance.They make over$50 million a year from kcal Franchise Agreements.They still have a Public Ams staff person almost full time to play shows,and for years shows play wrong almost every day.There is no"undue financial burden"on SLOCOPA when fundraisers are never held and donations from members are not taken. The Board admits the$50 annual membership fee is illegal but pleads with the City that Charter won't support then anymore despite Charter never having to but equipment any more to meet their Franchise Agreement requirements for Public Access,thanks to city residents. --Why does the Brown Act include nonprofits in some casim but this report state only a "legislative body"is covered?Isn't that an error? --Why is all SLOCOPA business now"confidential",not the few things the report suggests are okay for dosed meetings?It's inaccurate to state that the Board has met for"disciplinary"actions against members.They have met in secret ONLY to impose censorship on whistleblowers and Free Speech violations on members speaking out against then. It's inaccurate to state in this report that these"confidentiar meetings have to be dosed at all.Our Bylaws don't even require that But to state that"except for the parties involved,no other members or public may attend the meetings"is wrong. None of use are even told they are having meetings to attack then ban producers,then send letters to have Charter do the"dirty work"for them and Charter by pulling shows aff the air over unproven allegations. Did the City staff find ANY Public Access channel that does that? The Mediation Agreement already addresses opening meetings back up to members.That's why all members can be at the Annual Election meeting.Why doesn't the report ask why everyone couldn't run for the Board and vote in that case? The report slates staff will not respond in depth to allegations regarding the improper conduct of prior elections or the appointment of officers to positions that have been vacated since the March 2007 election.",and not even address the recent nominations and election Bylaws violations and bans? We don't have a legal nonprott anymore,so why would staff state the City should ignore any further issues and send communication back to the illegal SLOCOPA Board? The report states: "...staff believes the.March 2008 election was conducted properly." How could that be?No nominations were held as required in January and people who producer illegal and even commercial shows are allowed to run for the Board. Despite being told not to,the acting Chair and new Chair still spent the first 20 minutes of the meeting calling 911 emergency and hired prorate security guards who have never been needed and used as props to influence voting. The"disinterested 3rd partyl'there,a veteran produce's husband,admitted he wasn't"disinterested"in his wife's show,saying,"I find it interesting.",and handed out ballots only based on what the acting Chair told him to,even changing it as told during the meeting. The ballot counting took 20 minutes to count 30 or so vote,and was inaccurate as it was last year when the other Channel 2 political group,the Libertarians,counted them. The report stab that the SLOCOPA Board believed that"bemuse of confusion over past elections and appointments to unfilled vacancies,the prior Board thought it appropriate"to not follow the Bylaws and create a new Board out of new rules. Having all four"winner"of last year's illegal election resign and appoint friends is not"confusion"but carefully planned out politics by Charter and their producers they"support 100%",and is not an excuse to violate mate or federal nonprofit rules or SLOCOPA Bylaws or the contact with the City of SLO. To say that those violations were done because"the most recent Board wanted to assure that there was no question about its officers."is counter to what actually happened again, including the appointed Treasure simply saying she didn't want to run this year,just like last year's appointed Board member,Justin Purchin. The ONLY mention of"in compliance with SLOCOPA's Bylaws"was in this area,which isn'ttrue in many ways and puts the city in legal liability to be supporting what clearly must be illegal activities involving the City's Franchise Agreement with Charter and the contract with SLOODPA. It wasn't accurate to state this: "the Board asked the League of Women Voters to Investigation into Allegations re SLO County Public Access(SLOCOPA)",was it?The League was sent a list of questions about the"allegations"that the Board has been doing for at least two years,and no "investigation"seems to have taken place. Again,the League only sent two men,one the husband of a top SLOOOPA Board member and Mediation representative for the Board,and they only followed the orders of candidate fbr the Chair,acting Chair Sal Espana. This was the furthest thing from a typical League supervision of elections they are knows to do, right?When the Acting Chair is hurling vulgarities and hand gestures right next to the League representatives,and introducing candidates like Peggy Penny with biased information,and changing who can run and vote during the meeting,where was the League of Women Voters then? This part of the Staff statement is correct:"The volunteer in question is married to a producer."But as stated,he said he was NOT"disinterested"or a"3rd party." "The producer was not present at the election.",is true,but didn't he go home that night to her? The report states: "Additionally,there were sMd procedures in place to ensure that only those people who are allowed to were able to cast ballots during the election." That isn't true.Sal changed that and Sara Home's husband went along with it Also,people were allowed to come in the back door of the Ludwig Center,give their name with no ID required,vote,then leave Also, no members were allowed to comment during the annual meeting for the first time ever or even ask candidates questions.Almost all voting was over before candidates spoke.Acting Chair Espana is on Channel 2 now stating he banned questions and comments so"we wouldn't be there until midnight"but wasted 20 minutes calling 911 again. That's the fifth time 911 has been used without any need.Isn't it a crime to misuse 911 emergency,especially for political purposes? The staff report slates: "While the League volunteers did not count the ballots in the presence of the rest of the membership, neither were members of the Board present The election was conducted professionally and staff could not find evidence that the recent election was"faced"or was handled improperly." Give just the above proof,and there is more,can this Staff report now be amended for corrections?If the Channel 2 tape of the meeting gives different voting results that-the Mrs. Home's husband announced,isn't that odd? The report states about the sic to eight banned or"probation"members that"These members were allowed to attend the election, but could not run for office or cast their votes.(The matter of suspension or revocation of membership will be addressed separately below.)To allow suspended members or non-members to run for office or vote in this election would have been a direct violation of SLOOOPNs dam" Why wasn't the SLOCOPA Bylaws addressing this quoted?Where does it state that?If so,any secret meeting by only four Board members can ban any member for"life",or demoted or falsely accused,as they have done as a "quorum" last year against Board Secretary Gail Lightfoot and Chair Todd Leal. Shouldn't the Staff address that incredible power to control who runs for a nonprofit Board? And ask what crilterial Charter uses to pull local residents'shows off the air,sometimes live? Where is"equal access"then? The reports states. "In addition,the allegation that the election was"fixed"was raised by a write-in candidate who was not elected."Haven't a lot of producers raised that question? The report states: "On]anuary 22,2007,at a General Membership meeting,the members voted to Increase these dues to$50 a year."Why doesn't the Staff report state that is illegal,and the 2007 and 2008 Board members admit it is illegal,or"close.enough"to legal requirements that allow membership fees to go up only at the Annual Meetings? The report states: "SLOCOPA has implemented a process whereby membership dues can be worked off as volunteer hours."That is true, but there is no"Volunteer"work being done any more.Instead,it has been replaced by Zeke Turley who has been hired by SLOCOPA fora one year contract to do work that was well done by many volunteers to train producers. All volunteer committees were dissolved by Charger orders and SLOCOPA actions last year.Why isn't any of this in this report? The report states: "SLOCOPA has been aware since it entered into its Agreement with the City that it will have to become financially self-sufficient.Charter has set a limit on how long it will provide some of the insurance coverage or provide staff assistance. Based on what financial needs by Charter? Again, it charges between$50 million to$100 million to SLO residents for cable. It no longer has to buy hundreds of thousands of dollars worth of Public Access equipment,which it still would if it wasn't for SLO City residents paying for everyone in the County now. Again,Charter has paid for full and part time Public Access staff when producers like Anthony Bolin were being trained by Charter staff to do that job,and Charter staff are on record not playing shows correctly and even playing nothing when City equipment and even Charter equipment easily allows something to play 24 hours a day. Why isn't this in the report? This is disturbing because this is in dear violation of the Bylaws and fairness of female,qualified,experience technicians suddenly cut out of paid Charter or SLOCOPA positions,even banned from Charter and SLOCPA meetings without hearings or prior notice: The report states: "...since PEG funds do not cover operating expenses such as office supplies and facility rentals for its meetings...Additionally,a portion of these dues are applied to the training producers receive on the equipment available to them through PEG funds While there was some confusion as to the timing of the action to increase the dues,staff finds that the acral increase was aced on by the membership and the dues were implemented in accordance with its Bylaws." The all-male techicians are collecting illegal fees(by the Board's own admissions)that aren't even needed to get new producers started. In fact,the report leave outs huge point: SINCE THE:2007 BOARD MEMBERS TOOK OVER,and CHARTER STARTED BANNING PRODUCERS AND SHOWS,ALMOST NO NEW PRODUCERS HAVE MADE IT THROUGH THE NEW REGULATIONS AND BARRIERS THE NEW BOARDS AND CHARTER HAVE SET UP. THE ONLY NEW SHOWS ON THE AIR IN ALMOST A YEAR AND HALF are the THREE"SHOWS"BY THE THREE NEW 2007 BOARD MEMBERS,plus another"import" religious fundamentalist show and"Gardening For Men"local show of diverse content.And that producer, Morgan Hunt,testified before the City Council and at SLOCOPA meetings of how worthless the new"training"classes are and how unfair this new process is for new people. WHY ISNT ANY OF THIS IN THE REPORT. New shows are almost NONEXISTENT WITHOUT THE BANNED SCHEDULING COMMITTEE and the new requirements to pay Zeke Turley and other male technicians money from questionable new fees or dearly ILLEGAL fees. The sexual discrimination against experienced,qualified female techinicans is both hurtful to the women involved, and detrimental to Public Access television. If none of the serious and often legal and financial issues are officially addressed by Staff,doesn't it raise liability questions for the City C oundl at some point?In fact,if all this has been going on for years now,where was the supervision by local paid staff for the representatives of the people? Many people are grateful to the SLO City Council for the attention given this,and the staff time finally put in to looking at least a little into this now. But to tell veteran producer Patrick Germany that he has"15 minutes"to meet with staff after driving from Paso Robles with key information raises questions,despite Staff reading his report and attending meetings and talking to him and others. The report states: "Staff is unaware of inappropliate equipment purchases." It's possible the question should be is there any City equipment missing. Board member Anthony Pope has stated the Board has been told there is.A false allegation was made by the Board and emailed to all members that the former Vice Chair and Executive.Director illegal sold City equipment and took the money for themselves,all without any proof offered.Was that to cover up missing City equipment worth thousands? Why isn't that addressed?As Councilman Paul Brown suggested,maybe a Grand Jury investigation is needed for that and many of these other issues related to government contracts being fulfilled with Charter and/or SLOCOPA. The staff report goes into detail about the purcasing process.It is accurate but leaves out IF the equipment being bought was needed such as the big harddrive.system over just buying more mini-dv playback decks or DVD players.Charter staff said foryears the misplayed shows that happened almost every day was due to"old equipment", but when even all the City equipment was put in,shows still play in the wrong time periods or don't play or play black,even to the date of the Gly report. Why wasn't that mentioned in this report?If City residents are playing for equipment for the whole county and the equipment the City bought is still"broken",why is that allowed to happen? Also,the Staff report states this."Thee is a check-and-balance process in place that ensures Charter knows at all times who has checked out the equipment and whether it has been retumed by the due date." But no documentation shows if any equipment is missing,or used for"commercial purposes",is there?In the past,Charter Public Access staff did allow equipment to be missing or unaccounted for.Also,volunteer Public Access staff member Gas a Gnindh has had keys to the offices and access to equipment other tedhinicans or producers don't get to have. How is he accountable or anyone with a dose personal friendship with Charter staff? The report states: "Only members in good standing who have received the appropriate training are allowed to check out the equipment" The report should quote the SUDOOPA Bylaws that allow people who can demonstrate the ability to use cameras or other equipment NOT required to go through SLOCOPA's new training classes.To put a tape in a cameo and hit record is very easy now and easy to do shows such as air regularly on Channel 2. Why isn't that in the report? The report states something important 'The allegation has been made that the equipment has been used for personal purposes.This allegation is hard to track'... The"allegation"comes from a Board meeting attended by many producers this year in which some Board members wanted to stop the"commercial"or private use of the City's equipment The Board conclusion was to vote to ALLOW the COMMERCIAL and PRIVATE use of City equipment for up to half a year. At that point,a 30 minute tape of anything can be turned in,even something not from the use of City equipment, then another half a year of free commercial or private"birthday parties"event use would be okayed by the SLOCOPA Board. It is not"hard to track"someone checking out equipment and NOT AIRING A SHOW on Public Amen that the equipment was needed for. But them Charter and SLOCOPA for years have ignored even legitament produces shows violating SLOCOPA rules on noncommercial use of Public Access, requiring a new show be produced every 30 days or less,or 12 shows a year,copyright violations and more. In fact,it is documented over and over that Charter and the 2007 and 2008 SLOCOPA.Boards ignore almost ALL of the SLOCOPA Bylaws and current or past SLOCOPA orders or decisions EXCEPT the arbitary banning of producers raising questions ABOUT the documented VIOLATIONS of many rules and regulations. To think that valuable City equipment is used for whatever use, has no annual audit to see where moneys are going, unsupervised commercial use of equipment or running a"free rental center'for high-end equipment for "birthday parties",as the SLOCOPA Board authorized recently,shows nobody seems to care what happens to Channel 2 or Public Access overall,except the.news rnedia,the SLO City Council,the nonprofit leaders hurt by the 2007 changes and many other local people. This is simply innaaurate in the report: "Since content of the shows cannot be controlled,no further action was taken on this allegation."Violations of Free Speech and Free Assembly have been documented to be enforced by the cable company and the recent SLOCOPA Boards,but COMMERCIAL and most POLITICAL CONTENT as well as COPYRIGHT VIOLATIONS and more ARE COVERED by SLOCOPA rules. And "EQUAL ACCESS"needs to be enforced if"CONTENT'is the reason behind banning outspoken producers such as Carlton Brown, Leslie Bearce and Patrick Germany. "Further action"is required of the city on all of this, isn't it? The report states: "striking language that allowed for discrimination based on the content of a producer's programming,the Board has acknowledged that these documents still contain inconsistencies and in some instances are difficult to interpret" Remember,ALL the banned or"suspended"producers or those put on "probation"have one thing in common: they ALL spoke out professionally and politely at first at"Public Comment"or in concise reports then when asked by local media"in public"or on their shows about the violations of Bylaws,the Contract with the City of SLO and more.The"discrimination based on content'is still going on. One reason there are over 60 paid members of SLOCOPA but only about 1/3 voted for the newest Board members is bemuse marry still are afraid of losing their shows for opposing Charter staff and their few produces they"support 100%"still.One is on Channel 2 now stating that. The report states: "As a result,the Board has established a mmmrttee made up of several of its members to review"the Bylaws.But is is made up of two members who quit the Board after members and others raised questions about the Bylaws being violated and meetings dosed to input from members.One ran"dosed"meetings to write the Bylaws,and has made it dear all Bylaws Committee meetings will be dosed to members other than those invited in. A third member,Zeke Turley, is the contracted technician for SLOCOPA,creating a direct financial conflict or intermit. His wife,who hadnt been even attending meetings,was recently nominated and elected to the Board, but would have lost if the banned producers had been allowed to vote. Why isn't any of this in.this report? This is very important to many producers: "City staff is willing to serve as a resource and will provide copies of these documents that were obtained from other community access organizations. Additionally,the City Clerk's staff and City Attorney will review the final documents to ensure they are in compliance with the City's Agreement with SLOCOPA and with Federal and State regulations." That is what has been needed for several years and good news to many. The City Council asked July 3,2007 for revisions in Bylaws.The report states: "he committee has made a commitrnent to provide its recommendation to SLOCOPA within sic months. "That will be nearly 11/2 years after that July 2007 meeting, and if all decisions will be behind"dosed doors", how will anyone but a few know if the committee's work will be fair or even acceptable. So much of the 2007 and 2008 SLOCOPA new Board member'actions have resulted in long delays of real aeons needed. Why didn't the staff repots for example,state that only one member of the 2007 Board come to mediation provided for free by the City and Creative Mediation,then rejected the Mediation Agreement based on their representatives weren't authorized to sign an agreementh without the Board also going over it?Or that only one 2007 officer spoke to the SLO City Council all of last year despite being in the audience July 3? Section 6 of the report states this: "It is not uncommon for a community access organization to establish rules of conduct to ensure that its facilities and meetings provide a safe and healthy environment for its members. Provisions are often included in the Bylaws of these organizations for removal of officers for serious misconduct.In addition,sanctions may be imposed on general members who do not comply with rules of conduct..." Yet there seems to have been no effort to describe the"serious misconduct"threatening the"safe and healthy environment'of meetings"that resulted in "sanction!"(lifetime bans)on accused members who weren't even notified"dosed-door" Board meetings would take place about then and other producers All Staff needed to do was ask for copies of tapes of meetings and seen the yelling, interruptions of"Public Comment,vulgarities,even threats against producers were being done by the Board members who later banned falsely accused producers,all who used Free Speech and invoke"Roberts Rules of Order"to try to bring order to meetings and this group. Why didn't the report address the fact the Bylaws REQUIRE Roberts Rules of Order to be used if meetings can't be controlled in an informal manner?Or that a producer later banned,Ron Bearoe,called on the Board to use Roberts Rules of Order? This maybe the most serious inaccuracy in this Staff report,and it probably comes from false information provided to Staff: "Where sanctions are imposed,an appeal process is also in place. Once an appeal is heard by the Board of the organization,the Board's decision is final." LEGAL appeals have been filed with SLOCOPA through Certified Letters as well as every other means of communcations. If EVER ANY fair and open hearings are held with other produces, lawyers,city or county staff prescent,the true story will be shown out in the open for all to see. The 2007 Board who quit had to do so when the City Council forced this into an open hearing by"pulling"the "Consent Iterrr"from the agenda on July 3,2007 with three of the Board officers sitting in silence throughout that meeting. Even now,NONE of the past or present Board members dare come to ANY local government Public Comment or public meeting to speak with local elected officials.Is it because they can be asked questions as to what they are doing? The staff report is accurate that there ARE provisions of"appeals"of all Board decisions up to 90s days after the occur. Yet NO HEARING has EVER been held by the Board, another major violation of rights and the Bylaws. The staff report states bluntly, "Since its inception in 2005, many of the SLOODPA Board meetings have been contentious." ALL of the Founding Board members and other veteran producers who created SLOGDPA are now gone from the Board, mainly on unproven accusations against them. If City Staff is going to state this as a L FACT that"many" meetings have been"contentious",staff needs to look at the VIDEO TAPES and other records of meetings from 2005 until the Feb., 2007 General Meeting in which Treasure Gnthea Coleman cursed,threw an object,yelled and accused producers Patrick Germany of being "out of order"when he spoke a few words quietly during "Public Comment'at that meeting. That act was repeated by other Board members a few weeks later during"Public Gommenf at the Annual Election special meeting. One other meeting the City Clerk happened to attend was the one where the Board Chair then, Bill Rabenauld, got up and in anger left the meeting. Like other Board members,he was not"suspended"or banned from his show or from Charter for that in 2005. Yet records show PEACEFUL and PRODUCTIVE meetings from the beginning of SLOCOPA in 2005 until the Ms. Coleman incident in Feb. 2007.AND a HUGE GROWTH in NEW SHOWS coming onto Channel 2,almost all of them of greet quality of production,"diversity"of material and producers,and almost all"community-oriented"without one host talking into one camera as an'infom>eroal"for that person. WHY ISNT ANY OF THESE FACTS IN THIS REPORT? Is it because too much false information has gotten into the thinking of this report from Charter and Charters producers the cable company staff"supports 10096",despite ordering them to leave Charter's meeting rooms and banning many producers from the budding or studio and from Public Access shows? The staff report states: "Past Board members as well as general members have conducted themselves in a less than courteous manner." That is the first official statement at least IMPLYING the Board members have been"disruptive' at meetings,but why understate it? WHY DOESNT THE STAFF REPORT STATE that COPIES OF THE MEETINGS UNDER QUESTION have been given to Staff and they are on file for anyone to review,and the conclusion is producers banned or punished were being INTERUPTED during "PUBLIC COMMENT"by boor Board members and POLICE CALLED WHILE THEY WERE TRYING TO SPEAK during Public Comment,and that ANYONE reviewing the meetings will see who is cursing,interrupting,ignoring the use of Roberts Rules of Order and other rules of conduct or of the Nonprofit Bylaws? The staff report touches on when Charter staff,current and past,became involved in SLACOPA meetings again, leading to this statement: "Staff believes there were some improvements in meeting management between 2005 and 2006. However,the first half of 2007 seemed to be especially unruly." Why doesn't the staff report include WHO was at the meetings AFTER there"unruly"meetings happened and who WASN'T at meetings when they were peaceful and productive. Why not state the roles Charter staff have played in these meetings,including being the ones to make accusations"in public",at meetings and even before the SLO City Council last year that good producers are"liars"and have'big egos"and worse,all false,and often in reply to the many minority producers raising questions on their treatment by Charter and Charters producers they support? The report states: " In 2007,the prior Board took several disciplinary measures,including putting one member on probation and suspending several members for alleged violations of SLOC IPA's Bylaws." This is not accurate Many producers have been"warned"about"violating" new policies, including in emails sent to all members.At least three producers were put on announced"probation", Founding Board member Leslie Bearoe and producer of"Gong About",Elliot Gong. Mr.Gong stepped into the Feb. 2007 open Board meeting to witness long-time producer Prez Washington deliver a written report to the Board that took about 60 seconds. He was officially put on"probation"just before the annual 2007 election. He hasn't been back to a meeting since. Producer and veteran member of committees or Chair of them Anthony Bolin was also"suspended"just before that meeting and banned from running against the Board for carrying a camera into that meeting,a meeting broadcast by the Board on Channel 2 with the camera set up in the open meeting at Charter. Mr.Washington was put on"probation",then"suspention",then banned for life for that 60 second incident. Remember,all meetings were open to anyone and informal and productive for most items. At that Feb. 2007 Board meeting, producer of the religious show, Mutant Farm,actually"disrupted"the same meeting as he would do at the annual meeting and at the August 2007 General meeting when he got upset at the Board for their actions. He stood at the Charter Conference Room door and is seen on the Board's airing of that meeting interrupting them to bell them what he thought He yelled and interrupted meetings three times,yet maybe because they can't ban everyone speaking out,or has a religious believesimilar to the Matta family members who as new Board members have been key to all these bans and documented violations of the rules,cant be punished. Why wasn't this in this report to dear up the Staff's statement?Key to all this is the myth that"a few"men producers have"disrupted"meetings that are"in order"when it is the Board members disrupting producers' Public Comment periods in often loud, vulgar and scary ways, including at the 2008 Annual Election meeting behind the City Clerk's back. Again,the Staff report states this: "The Board also issued warnings that if Bylaws continued to be disobeyed,the members would be in jeopardy of having their memberships revoked.In addition,sanctioned members were advised of their rights to appeal within a specified time frame and in the manner outlined in SLOCOPA's Bylaws and Policies and Procedures." Oddy,the report doesn't state if the 2007 or 2008 Boards have actually followed any of this.As stated,they have not,and probably cannot hold open,fair hearings with the accused there because it takes only a few minutes to show what is the truth and what isn t Produces ask the SLO City Council and Staff to PLEASE help everyone FINISH getting to the whole truth. An OPEN and FAIR public meeting or forum on the future and past of Public Access would end ALL of the false and hurtful accusations. The EASIEST way to tell who has the truth and justice on their side to to give ALL sides EQUAL TIME and EQUAL REBUTTAL time—AS PROMISED at the 2007 special Annual Meeting,but never given then or since—in a fair and open way. It would liberally take just a few minutes to show what is really going on and who is right and who is not Logically, it would have to be UNPRECEDENTED ACTIONS by the accused threatened or punished producers to actually warrent a cable company to BAN "Public Access"shows from airing. Did staff find ANY cable company ANYWHERE that BANS Public Access shows if some producers send them an email accusing other producers of being so"in violation of Bylaws"or"so disruptive", that they can't PUNISH those alleged bad producers by simply BANNING them from attending meetipgs? Why didn't City Staff raise this question: "If so-called disruptive members ARE attending meetings over the last half a year without incident,then WHY is the cable company STILL BANNING THEIR SHOWS?" Or. "Why didn't SLOCOPA simply BAN or suspend certain producers from attending MEETINGS of they were allegedly so'disruptive'that business couldn't continue?Was NOT attending SLOCOPA meetings enough punishment?" More information probably from Charter or the.2007 or 2008 Board members is damaging to the reputation and characbas of many innocent and productive Public Access producers and technicians, including this: "Following mediation,the Board reviewed the circumstances of the earlier probation and several suspensions.." The 2008 Board has been on record stating the PAST Board's decisions were THOSE Board member's decisions and WOULD NOT BE REVIEWED. Without any MINUTES or records of Board meetings any more,it still shows that the 2008 Board members often make NO official MOTIONS or VOTES on hardly anything.If the acting Chairs,either former Vice Chair and Charter's former Public Access Supervisor Michael Passarelli or his long-time technican and appointee to Vice Chair after Mr. Passarelli resigned in late 2007 with the other 2007 election winners,say it is so,that seems to be the final word. Thus,there have been possibly NO official Board meetings in 2008 on the 2007 punishments of many producers. The report states "Staff does not have jurisdiction over the sanctions or rules of conduct that are put into place by SLOCOPA,except if they do not comply with the non-discriminatory,equal access requirements setforth in the Agreement." These points have been very important to many producers and members of the general public long-involved in Channel 2 Public Access.Addressing this is viewed as a major step forward,and is needed since violations of the Contact with the City are not allowed,especially when at meetings and in writing MANY reports to the SLOCOPA Boards have DOCUMENTED the violations that have been.happening but ignored by those Board members. The report states: "However,Staff does find that SLOCOPA's Bylaws and Policies and Procedures inadvertently conflict with the Agreement and in some cases, prohibit producers from appearing on shows other than their own. This is a matter that SLOCOPA must address." Other than the question of it being a fad that anis was"inadve tenf over the years,this is a huge statement from city officials. Another staff report statement: "In several instances,the reasons for these sanctions arose when members disrupted meetings In more than one case,the disruptions were severe enough that SLOCOPA was later no longer permitted to hold its meetings at two facilities where they were formerly welcome(the Grange Hall and the Charter facility)." Again, reviews of tapes from those meetings and others in 2007 show BOARD members interrupting Public Comment and allowing their supporters to do the same,especially at the Grange Hall. However, NONE of this was taking place at Charter,other than when Board Treasurer Cinthea Coleman would leave the fire"closed-doors Board meeting on Tan. 3, 2007,and yell and cry outside the Conference Room. Other than another future Board member cursing and yelling at another meeting at Charter, in front of new producers or guests,NONE of the other producers have even been ACCUSED by Charter staff of any bad conduct in the seven years of using Charter's facilities. If"severe" behavior was going on,why are the TAPED meetings after meetings that were professional and peaceful AT CHARTER for years WITH THE FULL SUPPORT OF CHARTER STAFF THERE and on the tapes until Ms.Coleman and a few other BOARD members disrupted their own meetings? Why are THEY BANNED by Charter from the building AND PUBLIC ACCESS SHOWS? If this is all made up mainly by the cable company,and if the main people hurt by all this are the new producers of"diversity"producing"quality"and"local"show,all top PRIORITY according to Charters and SLOCOPA rules,is it possible that the reason the 2007 Board members all had to suddenly resign was because the true story is the banning of"COMPETITION"for time slots from dozens of new producers who represented the FULL COMMUNITY and would get times from older producers VIOLATING the SLOCOPA and other rules? This would matt! the report statement of,"Prior to these.suspensions,the presence(Nobe:The BLACK"PRESENCE"?! Is this from CHARTER or the CITY OF SLO?!) of some of the produces had regularly disrupted Charter employees who are not involved with SLOCOPA operations..." WHEN were Charter staff"disrupted" by WHICH PRODUCERS?And WHEN?Almost ALL meetings are on RECORD.Charter staff emails are abundentbetween producers and Charter staff.WHEN did Charter staff get concerned about being"regularly disrupted"by producers? Banning their own SLOCOPA Board members from Charter's building left them"orphans",as Board Chair said after having to meeting at picnic tables in Santa Rosa Park in the cold twice. Why can't City Staff RECOMMEND that CHARTER STAFF MEET with the producers of all sides and WORK SOMETHING OUT?Why BAN producers from shows,the studio and even empty meeting rooms or Public Access offices without FIRST MEETING WITH ANYONE? Did City Staff find ANY OTHER Cable company that has done what Charter has done here? The Staff report says,"the presence of some of the producers regularly disrupted Charter employees". Yet the downstairs Cham staff who dealt regularly with producers at night are on record saying they were NOT "disrupted"by produces,and accusation made by the upstairs Public Access Charter staff in 2006 only against producers of diverse ethnic,political and religious backgrounds that started growing in numbers. Yet NOTHING EVER HAPPENED to start those accusations.In fact,Charter has made"special"rules or rulings for or against those types of producers ever since they started coming to Charter. Signs put.up by bop Charter staff banning them from entering the front door and going up the illegal fire eidt, mails sent out against them and other actions continue to today.. Since the nonminorityproducers have.NEVER been accused by Charter staff of being"disruptive" or their"presence"is"disruptive"to Charter staff,is the City Staff now also making this accusation? By stating such accusations as"fad", it endorses Charters behavior and own actions,doesn't it? The report states: "the absence of the suspended producers,the disruptions have discontinued." Again,WHAT"DISRUPTIONS"and when and by whom?That can't be left in an official City report as is, along with other allegations that are not proven and not details or records are referred to in this report. The first official accusations against producers came from Charter staff,including the first and very false f accusation in the SLO City News by three current or former Charter staff that all the Board members had"their own agendas°and that new producers couldn't get on the channel. Again,since Charter staffs'involvement and influence in SLOCOPA business since last 2006,the one Public Access channel now on(up to four more are required of Charter by County contract if enough "local"and popular shows got on this first channel)has been EMPTYING OUr of shows to air.The Charter"Bulletin Board"and'To Be Announced"silent airings or listed "shows"now dominate the channel.About 40%of what does air are religious "sermon"shows of one person talking into a camera.That is allowed, but low priority according to the rules everyone signs onto. "Diversity" is a top LEGAL priority of the rules. "Equal access"and"non-discrimination"on race and other areas is required by law and contracts. Why does the Staff report conclude with, "Staffs initial investigation does not su99est there is not evidence of unlawful discrimination to warrant further investigation by the City." A double negative on such an important issue is in contrast to dozens of minorities documenting and testifying in public about their"special"treatment by Charter and Charter's Board it supports"100%". Why wasn't it mentioned in the report that the two producers just banned were Carlton Brown and Patrick Germany from voting or running against the Board or from being at Charter now?They are the President and Vice President of the Martin Luther IGng-based"Sharing The Dream"nonprofit Why weren'tthe names of other minorities coming before the City Council in 2007 and 2008 even mentioned in this report?Or that of other producers and members of the public testifying about this important issue?Chris Matthews testified recently at Public Comment about his concerns as a producer and guest on Channel 2 for years, and is also of African descent Why didn't the report name Monique Gjeada or Anthony Bolin in the report?They've been before the Council on this recently and summitted reports to the City,as have other producers in 2007 and 2008,and still express growing concerns? Many minorities in particular want this changed from the official report, in addition to the above concerns: "The allegations of unlawful discrimination appear to be brought by people involved in disputes with SLOODPA on other grounds...: Oris the official City of SLO report that.minorities turning in reports or giving public testimony only motivated by some ongoing"disputes with SLOODPA's" 2007 and 2008 Board?The Board members defense is that"a handful" of producers just don't like the"Policies".
