SUBJECT: FINAL ACCEPTANCE OF SUBDIVISION IMPROVEMENTS FOR
TRACT 2534 — A SUBDIVISION WITH ONE LOT FOR RESIDENTIAL
CONDOMINIUM PURPOSES (82 UNITS) AND TWO COMMERCIAL
LOTS AT 3592 BROAD STREET—(BROAD STREET PARTNERS,L.P.)
CAO RECOMMENDATION
Adopt a resolution accepting the public improvements, certifying completion of the required
private improvements, and releasing the bonds for Tract 2534.
DISCUSSION
As part of the Broad Street Mixed-Use Project located at 3592 Broad Street, tentative map for
Tract 2534 (U/TR/ER 24-03) was approved by City Council on August 3, 2004, by Resolution
No. 9594 (2004 Series), authorizing creation of one lot for residential condominium purposes (82
units) and two commercial lots. (See Attachment 1 for vicinity map and Attachment 2 for site
plan.) The final map was approved by City Council on May 2, 2006, by Resolution No. 9792
(2006 Series).
The project's public improvements include frontage and street improvements along Broad Street
and Sacramento Drive, a bus turnout and shelter on Broad Street, a storm drain extension along
Sacramento Dr., and an on-site water main. The remaining subdivision improvements are private
improvements including but not limited to driveways and private streets, on-site storm drain
system, detention basin, creek improvements, a private park, pedestrian bridge, and private sewer
main. The developer was also conditioned to install traffic signals at the CapitolioBroad and
Prado/Broad intersections if warranted. The developer will be submitting a traffic signal warrant
analysis annually on May 30. If the signals are warranted, the developer will be required to
install them. If, after a period of 5 years, the signal(s) are not warranted, the developer will be
released of the condition.
With the exception of the traffic signals, the public and private subdivision improvements have
been completed to the satisfaction of the City.
The subdivider has requested final acceptance of the public improvements by the City and release
of the respective sureties. Included with the final map approval was a subdivision agreement that
allowed the Subdivision Labor and Materials and the Faithful Performance bonds to be released
upon the Council's acceptance of the subdivision improvements and receipt of a guarantee of ten
percent of the cost of the public improvements. The cost of the public improvements was
estimated to be $2,850,000. When the proposed resolution is approved and the subdivider has

provided a replacement security in the amount of $285,000, the Public Works Director will
authorize the City Clerk to release the $2,850,000 Faithful Performance security. The release of
the $1,425,000 Labor and Materials security may be processed after the 90-day waiting period
referenced in Section 66499.7(h) of the Government Code of the State of California.
The replacement security of $285,000, or ten percent of the estimated construction cost, is to
insure that the subdivider will remedy any defects in the improvements arising from faulty
workmanship or materials or defective construction of said improvements occurring within
twelve (12) months after subdivision acceptance, in accordance with Sections 66499.7 and
66499.9 of the Government Code of the State of California. Prior to releasing the $285,000
security, the developer shall submit an additional security to guarantee completion of the annual
traffic signal warrant analysis for the CapitolioBroad and Prado/Broad intersections for a period
of 5 years.
The $4,000 monumentation bond was released by the Public Works Director on March 27, 2008.
The $226,875 security for installation of traffic signals at the CapitolioBroad and Prado/Broad
intersections shall be released after a period of 5 years, unless installation of the signals is
warranted.
FISCAL UYIPACT
Typical maintenance and operation of public facilities will be required for the street improvements
and storm drain along Sacramento, the bus shelter, and the on-site water main. Caltrans will be
responsible for the street improvements along Broad Street (State Route 227) with the exception of
street lights and sidewalk. If the traffic signals at CapitolioBroad and Prado/Broad are installed,
Caltrans and the City will share in the cost of maintenance of those signals.
CONCURRENCES
The Community Development Director and Utilities Director concur with the recommended action.

RESOLUTION NO. (2008 SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS
OBISPO ACCEPTING THE PUBLIC IMPROVEMENTS AND CERTIFYING
THE COMPLETION OF THE PRIVATE IMPROVEMENTS FOR
TRACT NO. 2534 (3592 BROAD STREET)
WHEREAS, the City Council made certain findings concerning Tract 2534, as
prescribed in Resolution No. 9594 (2004 Series); and
WHEREAS,the City Council approved the final map for Tract 2534 per
Resolution No. 9792 (2006 Series); and
WHEREAS, the subdivider has satisfactorily completed the public improvements
for Tract 2534, in accordance with City standards, specifications and the subdivision
agreement, and has requested acceptance of the public improvements for maintenance
and operation by the City; and
WHEREAS, the subdivider has satisfactorily completed the private
improvements for Tract 2534, in accordance with City standards, specifications and the
approved plans, and has requested that the city certify completion of these private
improvements.
NOW THEREFORE,BE IT RESOLVED:
1. The City Council hereby accepts the public improvements and certifies
completion of the private improvements for Tract No. 253;
2. The current Faithful Performance surety may be released upon submittal of
a replacement surety guaranteeing the workmanship and materials for a period of 12
months.
3. The Labor & Materials surety may be released after 90 days from this date
of acceptance of the improvements in accordance with Section 66499.7(h) of the
California Government Code.
4. The surety guaranteeing the workmanship and materials may be released
upon the successful completion of the 12 month time period and upon submittal of an
additional surety guaranteeing completion of the annual traffic signal warrant analysis for
the CapitolioBroad and Prado/Broad intersections for a period of 5 years.
5. The Director of Public Works is hereby authorized to release the surety for
the traffic signals and the surety for the traffic signal warrant analysis after installation of
the signals, or after a period of 5 years from this date of acceptance, whichever comes
first.
