CAO RECOMMENDATION
Take action on the Senior Center Parking Lot construction contract, if bids opened on November
13, 2008 exceed the engineer's estimate of$220,000.
DISCUSSION
On September 16, 2008, the City Council approved plans and specifications and authorized
advertisement for bids for the construction of the Senior Center Parking Lot in Mitchell Park.
The Council also authorized the City Administrative Officer to award the contract if the lowest
responsible bid is less than or equal to the Engineer's Estimate of$220,000. Construction bids are
to be opened on Thursday, November 13, 2008. Because the bid opening falls between the date
when the November 18, 2008 agenda will be distributed and the date of the actual meeting, this
agenda report "holds a place" for Council action, should bids be higher than the authorized
amount.
FISCAL EVIPACT
If bids are within the engineers estimate, there will be no added fiscal impact to the City, and no
action required by Council. The bid climate is quite favorable at this time, so staff is hopeful that
Council will not need to consider an added appropriation. However, if bids are higher than the
estimate, then there will be some added cost to the City, necessitating an additional action by the
Council. Staff.will inform the Council of the outcome of the bids once they are received and
confirmed.

Since I might not be able to attend the meeting slated for November 18th, 2008,to voice an opinion about the
Senior Center Parking Lot proposal, I'd like to express my thoughts in this e-mail.
The Senior Center parking space situation has been an issue for a long time. It has been in front of the City
Council many times and has finally sifted down to its present concept. Much effort has gone into trying to find a
workable, needed solution. That solution is now on the table for final approval and should probably go forth as
presented. To continue fussing with alternatives, delays, or fantasies of building another Senior Center seem
counterproductive.
Delaying the approval for the project until the new Council Elect Members are seated means back to the
drawing board for more rounds of bickering over the same ground.
I note in an e-mail from Council Member-Elect Jan Marx that she would make "planning"for a new Senior
Center"one" of her priorities "when it comes to budget goal setting."That statement is quite different than
saying a new Senior Center is anywhere near a top priority.
The estimated cost noted in the e-mail of$221,000 for 11 parking spaces would seem reasonable as I've heard
that it runs about$18,000 to$19,000 to create one parking space these days.
I have talked with several of the folks who live in the area around Mitchell Park and many would welcome
having more available parking in front of their homes, places that have been used by folks attending various
activities at the Senior Center consistently over the years.

All — I realize there is a parking lot Consent Item, but there will be individuals in
opposition to this good and need project. As in the past vote, my quick comments are.
as follows: .
1 . The Heritage Tree will be damaged. The city Arborist has taken this into
consideration. No problem with the.tree.
2. The curved exit driveway places youngsters at risk—This discussion is normally
addressed with the engineers as the divider is placed between the youth area and the
driveway. A medical doctor always makes this statement, and says nothing about the
fact the new wide play area is adjacent to two busy streets and no fence to keep the
kids out of accidental wandering into the street.
3. Trees will be cut down—Trees will be added.
4. Seniors should take the bus to the Senior Center, because there is a bus stop in
front of the center. Who is going to pick up the seniors and transport them to the bus
stop in their home neighborhood to start the trip?
5. The addition of a BBQ pit removes from the value of the Park. The park is
extremely underutilized and this addition brings this park into a more family oriented
park.
6. Many talk about a public garden being taken out of existence. No public garden
was planned for this location.
7. There is street parking around the park during the day. Correct, on most days
there are spaces in the sides of the park as local residents drive to work. However, this
does not provide a solution to the few who need immediate access to the building.
8. Several of those opposed to the lot admitted that they thought this area to be not
useable because of the partial fence and unused concrete. The specific place for the
parking lot location has been completely unused.
9. A similar park with a parking lot currently exists—at the Parks and Recreation office,
and there is no challenge with the use or youngsters in the park.
10. The focus group opposed to the parking lot is a very small entity. They have
generated a"broad"support for"no paving over the park" simply because this
misstatement has generated an "apple pie, America"type of support. This focus
group states that the wishes of a small group is trying to push over a large group.
This is exactly what is happening. The focus group is small. An example - Since
this item has been in the press; I have visited and talked with people in the park. On
two different occasions, I talked with mothers in the play area. They had very little or
no knowledge about the parking lot! I talked with a person sitting in the open area
reading a book. Completely no knowledge about the parking lot.
11. At one time, it was expected that the Ludwick Center would be for Seniors. That did
not happen for several reasons. Now, the center is well used by the City of SLO for
its own purposes. Thus, the seniors either need another center or assistance at the
current center until a new center is created. The assistance is the parking lot.

SUBJECT: Senior Center Parking Lot Bid Opening Results
On November 13, 2008 City staff opened bids for the Senior Center Parking Lot project, Spec
No. 90803. Staff received 15 sealed bids, and the apparent low bidder was Spiess Construction of
Santa Maria, with a bid of$194,328. Ten out of the 15 bids were below the Engineer's Estimate
of$235,000 (which is up from the $220,000 estimate included in the earlier bid advertisement
staff report due to fencing changes directed by Council).
It typically takes staff approximately 10 business days from bid opening to ready a contract for
fmal execution. Staff would ordinarily process the approval of the award through the City
Manager, since the low bid is below the Engineer's Estimate and within the budget authorized by
Council. Given the Thanksgiving holiday, this means that the contract should be ready for
execution no later than December 1, 2008. Therefore, if we are to depart from the usual process,
direction to do so should be given on November 18`n

I am writing to you because I believe that you share my concern about paving over part of
Mitchell Park. All is not lost!
Many of you were/are very upset about paving part of the park, altering the historical
design, and impacting 30% of the Modesto Ash Heritage tree's root area. Like you, I
would rather see the curbs in the area restriped and a vanpool for Seniors, instead of
creating private parking for the group using the old kindergarten at this time.
The 9/16 staff report outlined a variety of alternatives to provide better access to the
senior center for seniors. These alternatives are ALL a lot cheaper than the parking lot,
which will cost around $221,000 or more for a net gain of 11 new spaces. They are also
all more sustainable, since providing inner city green space as the city becomes more
dense is a key component to Smart Growth.
On November 18, the item is on the City Council agenda(Consent Item#10). It will be
heard early in the evening. Bids are due from contractors November 13. Right now, Ken
Hampian could sign a contract, if the lowest bid comes in under the cap of$220,000. But,
the issue has been placed on the 11/18 agenda, which means that residents and newly
elected Council members will have the opportunity to articulate their positions before any
contract is signed. In my opinion, it would be best all around, if the project were slowed
down at this point, so that the new Council will decide it. It is very important that as many
people as possible turn out on 11/18 to speak up on this issue.
Once sworn in, I plan to move that Council reconsider and reverse the parking lot
decision. I also would like to see the Master Plan returned to its prior state with a garden
in back of the old kindergarten building. If there are three votes on the new Council in
favor of reversal, Mitchell Park and the Heritage Tree will be saved. Your attendance,

I will make planning for a new Senior Center one of my priorities when it comes to

Dear Mayor and City Council Members,
I'm glad the Mitchell Park parking lot is still open for discussion. I will come to the Council meeting on the 18th
to speak on the issue of preserving intact this beautiful, most essential park in our downtown. We took our
children there often as they grew up, and we continue to enjoy the many civic events in the park.
I, and many others, hope we can find a better location for our senior center with parking.This is a vital need
too, but it should not be in conflict with our citizens' need for green spaces within the city.
