CAO RECOMMENDATION
Adopt a resolution amending the 2007-2012 Memorandum of Agreement with the San Luis
Obispo Police Staff Officers' Association.
DISCUSSION
Background
The San Luis Obispo Police Staff Officers' Association (SLOPSOA) represents 18 employees in
police management classifications: sergeant, lieutenant, captain, communication supervisor,
records supervisor, and communication and records manager. The term for the current
SLOPSOA Memorandum of Agreement(MOA) is July 1, 2007 through June 30, 2012.
At the time staff negotiated the SLOPSOA MOA, the City and the Police Officers Association
(POA) had exhausted mediation efforts and were preparing for binding arbitration hearings. The
City and SLOPSOA were discussing a long-term contract, but SLOPSOA representatives were
specifically concerned about the potential impact a binding arbitration award could have on
compaction. Compaction is the difference between the top salary step of management
classifications and highest rate being paid to the classifications they supervise. The highest rate
paid to subordinates includes the average educational incentive for POA employees and excludes
overtime. Staff has found that the average differential for comparable cities ranges from 20% to
25%.
In exchange for a longer-term MOA the following language was included: "The City strives to
maintain a reasonable difference in compensation between top step police staff officers'
classifications and top step of the classifications supervised. The difference between top steps of
these classifications is targeted at a minimum of 15%. If during the term of this contract, the
differentiation goes below the 15% target, the City agrees to re-open negotiations on this topic. "
The June 4, 2008, binding arbitration decision awarded significant salary increases to POA
employees. As a result of the award, in July 2007 the differentiation between Police Officers and
Police Sergeants was less than 1%. By January of 2008, salaries for Sergeants were 1.6% less
than the employees they supervise. During that same time frame, Communications Supervisors
were earning 3.7% less than the employees they supervise.

City staff and the SLOPSOA bargaining team have met on several occasions over the past few
months. As is typical with this group, the discussions have been open and professional. The
SLOPSOA bargaining team has been extremely reasonable and sensitive to the financial impact
of the binding arbitration award, as well as this "re-opener", on the City.
Proposed Resolution
For the 2007-08 fiscal year, SLOPSOA requested an adjustment to bring Sergeants and
Communications Supervisors' salaries to 5% above the highest rate paid to employees they
supervise. This request is modest given the 15% targeted differential and SLOPSOA was further
willing to accept a lump sum payment which is simpler for the City to administer.
SLOPSOA requested adjustments in July 2008 that would achieve the target 15% differential no
later than January 2009. Staff was concerned that cost of living and market equity increases
already in the MOA, combined with requested adjustments in July 2008, could potentially take
the differential above the 15% target. In order to meet both interests, a portion of future
scheduled salary increases was applied to the salary adjustments necessary to achieve the 15%
target. This approach minimizes the risk of exceeding the targeted 15% differential through the
course of the MOA.
The adjustments are phased in over a six-month period effective July 2008 and January 2009.
The shaded boxes in the following chart show the revised salary increases from July 2008
through the end of the contract:

In addition to these modifications, SLOPSOA also agreed to language that clarifies the MOA
will not be re-opened unless the differential drops to 10% or below and is expected to stay at or
below that level for at least six months. This language clarifies the spirit of the "re-opener" and
demonstrates SLOPSOA's understanding of the City's current financial position. The POA
MOA ends in December 2009. Salary increases in the successor agreement with the POA would
have to exceed 10% per year in order to trigger further salary discussions with SLOPSOA
through the duration of their MOA (2012).
FISCAL IMPACT
The cost of the lump-sum payments is approximately $60,000. The fiscal year 2008-09 cost of
the tentative agreement outlined above is approximately $327,000. Adequate funding is
available in the MOA adjustment account as a result of short-term budget balancing
recommendations approved by the Council on September 30. As a result of moving some of the
scheduled salary increases ahead of schedule in order to achieve the targeted differential, there is
the potential that future costs could be lower than otherwise anticipated by$41,000 per year.
ALTERNATIVES
Do not approve the resolution and direct staff to negotiate a different amendment to the agreement.
This alternative is not recommended as the agreement is consistent with the Council's previous
direction and language in the current MOA.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AMENDING THE 2007-2012 MEMORANDUM OF AGREEMENT WITH
THE SAN LUIS OBISPO POLICE STAFF OFFICERS' ASSOCIATION
WHEREAS, Section 8.1 of the 2001-12 Memorandum of Agreement contained a
provision to re-open negotiations if the difference in compensation between top step police staff
officers' classifications and top step of the classifications supervised went below the stated 15%
target; and
WHEREAS, the parties have met and conferred on this topic and have agreed to an
amendment to the 2007-12 Memorandum of Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The Amendment to the 2007-12 Memorandum of Agreement between the
City of San Luis Obispo and the San Luis Obispo Police Staff Officers' Association
(SLOPSOA), attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby
adopted and ratified.
SECTION 2. The Finance and Information Technology Director shall adjust the
Personnel Services appropriation accounts to reflect the negotiated compensation changes.
SECTION 3. The City Clerk shall furnish a copy of this resolution and a copy of the
executed Memorandum of Agreement approved by it to: Chris Staley, SLOPSOA President and
Monica Irons, Director of Human Resources.

AMENDMENT
TO THE 2007-12 MEMORANDUM OF AGREEMENT
BETWEEN
THE CITY OF SAN LUIS OBISPO
AND
THE SAN LUIS OBISPO POLICE STAFF OFFICERS' ASSOCIATION
I. PURPOSE OF THIS AMENDMENT
Article 8 of the 2007-12 Memorandum of Agreement (MOA) allowed negotiations to be re-
opened if the difference in compensation between top step police staff officers'
classifications and top step of the classifications supervised fell below the stated target of
15%. The June 4, 2008,binding arbitration award to the San Luis Obispo Police Officers'
Association caused the differential to become less than 15%. This amendment confirms the
agreement of the parties to modify the MOA. Except as modified below, all other terms and
conditions shall remain in full force and effect.
II. MODIFICATION OF SALARY INCREASES FOR TERM OF AGREEMENT
Article 8, Section 8.1, is modified as follows:
8.1 SALARY PROVISION FOR THE TERM OF AGREEMENT
The City strives to maintain a reasonable difference in compensation between top step
police staff officers' classifications and top step of the classifications supervised. The
difference between top steps of these classifications is targeted at a minimum of 15%. If
during the term of this contract, the differentiation goes below the 15% target, the City
agrees to re-open negotiations on this topic. Effective January 1, 2010, through the end
of the current MOA, the City and Association agree not to re-open negotiations on this
topic unless the differential is 10.0% or less and is expected to remain at or below that
level for more than six months.
The parties agree to salary increases as set forth below to be effective on the first day of
the first full payroll period in the month listed below, for all employees in the Association
employed by the City on the date this agreement is formally approved by the City
Council:

In addition to the above-listed salary increases, the following classifications shall receive
equity salary increases effective on the first day of the first full payroll period in the
month listed below:

Effective the first pay period following ratification by the City Council, employees in the
following classifications during fiscal year 2007-08 shall receive a lump sum payment in
addition to the above increases to the salary schedule, as follows:
Communications Supervisor $6,366
Police Sergeant $6,069
These lump sum payments are intended to compensate the above classifications for periods of
time during this Memorandum of Agreement when top step of these classifications was less than
5% above the classifications they supervise. Incumbents who were appointed to these
classifications after July 1, 2007, shall receive a pro-rated amount based on the time in the
classification during fiscal year 2007-08. The parties acknowledge that these lump-sum
payments are not reportable to the California Public Employees' Retirement System as
compensation.
