DISCUSSION Section 408 of the City's Charter requires that the Council elect one of its members to serve in the position of Vice Mayor. Section 3.2 of the Council Policies and Procedures provides that the appointment of the Vice Mayor shall be for a one-year term, that the appointment shall be made on a rotational basis, and that the appointment shall go to the next senior member. This practice ensures that each Council Member will have an opportunity to serve as Vice Mayor during his or her term. Following current Council policy of rotating the Vice Mayor position, and consistent with Council practice over the past six years, Council Member Settle is next in line for the opportunity to serve as Vice Mayor. Vice Mayor appointments for the prior six years have been as follows: Council Member Mulholland - 2003 Council Member Schwartz - 2004 Council Member Ewan - 2005 Council Member Settle- 2006 Council Member Mulholland—2007 Council Member Brown- 2008 Looking to the future, the process for rotation dictates that Council Member Carter would serve in 2010. However, because Council Member Ashbaugh and Council Member Marx are both newly elected and their terms will expire in 2012, there is no precedent as to which of the two will serve as Vice Mayor in 2011 and which will serve.as Vice Mayor in 2012. Should Council want to address this issue at this time, they may want to direct the Mayor to draw names to determine which year each will serve as Vice Mayor. They may also choose to defer this matter until Vice Mayor Appointments are made in 2009 or 2010 for the following years. Also I hope these early start meeting will not become as regular as they were a couple of years ago as they inhibit participation of the general public. In regards to Consent agenda item 2 concerning the lease agreement with Union Pacific Railroad, I hope you will consider combining the funding for the Graffiti Enforcement Officers position with the railroad maintenance position. As I was informed by Lt. Polling the graffiti officer was a part time position to be paid some $20,000 annually. He envisioned someone to collect and compile evidence to prosecute graffiti taggers while also coordinating volunteer citizens to paint over the graffiti. The former duty should be the job of the police. I recommend using allotted funds from both the graffiti and maintenance positions and hiring a full time city employee. Hopefully someone who lives in the city that will take pride in keeping the railroad corridor clean and debris free, as well as coordinating the volunteers to eliminate the graffiti in a matter of days not weeks. Contractors might be less expensive in the short term but generally you get what you pay for. Whatever happened to the county prisoners that used to fix the fencing along the Railroad Bicycle Trail?
