HomeMy WebLinkAbout12/01/2008, C1 - RESULTS OF THE NOVEMBER 4, 2008, GENERAL MUNICIPAL ELECTION court It Shia , b j acEnba Report c C I T Y OF SAN L UI S OBISPO FROM: Audrey Hooper, City Clerk SUBJECT: RESULTS OF THE NOVEMBER 4,2008, GENERAL MUNICIPAL ELECTION CAO RECOMMENDATION Adopt a resolution declaring the results of the November 4, 2008, General Municipal Election. DISCUSSION The canvassing of the returns for the November 4, 2008, .General Municipal Election is performed by the County Clerk-Recorder in accordance with Resolution No. 9995 (2008 Series). The County Clerk-Recorder has indicated that this canvass will not be complete until Wednesday, November 26, 2008. Preliminary results indicate that:. 1) Dave Romero received the highest number of votes and was the candidate elected to the office of Mayor, 2) Jan Howell Marx and John Ashbaugh received the highest number of votes and were elected to the offices of Council Member, and 3) MeasureAl-08, Charter Amendment, received a majority of votes in favor of the Measure and was ratified. A� In accordance with California Elections Code section 10262, Council will be requested to adopt a resolution declaring the results of the General Municipal Election and the final Certificate of the Canvass, included as an exhibit to the resolution. A draft resolution containing the preliminary results is provided with the agenda report. The final resolution and certification of the results will be provided prior to the December 1, 2008; Council meeting. FISCAL IMPACT There are no costs associated with the adoption of this resolution. An invoice describing the costs to conduct the election has not yet been received by the City Clerk; however, anticipated .expenses are accounted for and included in the City Clerk Elections budget. (2008 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD TUESDAY,NOVEMBER 4,2008 WHEREAS, a General Municipal Election was held in the City of San Luis Obispo on Tuesday, November 4, 2008, as required by State Law and the Charter of the City of San Luis Obispo, for the purpose of electing one Mayor and two Members of the City Council; and WHEREAS,one ballot measure proposing a Charter Amendment (Measure E-08), was submitted to the voters on Tuesday,November 4,2008; and WHEREAS,the Results of the Canvass of All Votes Cast at the Consolidated General Election held on November 4, 2008, has been certified by the County Clerk-Recorder and is attached and made a part hereof as and are hereby entered by the City Clerk in the official records of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Luis Obispo that: SECTION 1. The whole number of votes cast in said election within the City of San Luis Obispo is reflected in the attached Canvass of All Votes Cast. SECTION 2. The names of the persons voted for at the election for Mayor were: Dave Romero Terry Mohan SECTION 3. Dave Romero,the candidate receiving the highest number of votes cast at said election for the Office of Mayor, is hereby declared elected to such office for a term ending December 1, 2010. SECTION 4. The names of the persons voted for at the election for Council Member were: Arnold Ruiz Jan Marx John B. Ashbaugh Dan Carpenter Marcia Nelson Paul Brown Ci-a �f ATTACHMENT Resolution No. (2008 Series) Page 2 SECTION 5. John B. Ashbaugh and Jan Marx, the two candidates receiving the highest number of votes cast at said election for the Office of City Council Member, are hereby declared elected to such office each for terms ending December 1, 2012. SECTION 6. That the ballot measure submitted to the voters was as follows: Shall sections 201 (and related references throughout the Charter), 407, 410, 505, 601, 701, 709, 901, 906, 1001, 1006, 1202, and 1205 of the Yes Charter of the City of San Luis Obispo be amended to make technical, non-substantive revisions, as set forth in City Council Resolution No. 10007 (2008 Series)? ` No SECTION 7. MEASURE E-08 did receive a majority vote in favor and is hereby declared ratified. SECTION 8. The City Clerk shall sign and deliver to each duly elected officer a Certificate of Election certifying to his/her election, and further, the City Clerk is directed to certify to the passage and adoption of this resolution and enter it into the book of original resolutions. SECTION 9. Pursuant to Section 9269 of the California Elections Code, the City Clerk is hereby directed to forward to tI 9F Secretary of State a certified copy of the affidavit of publication in connection with MeasureQ8, a copy of all ballot arguments relating to Measuroe08 and a certified copy of this resolution declaring the results of the election.
