SUBJECT: APPOINTMENT TO THE BICYCLE ADVISORY COMMITTEE
RECOMMENDATION
Appoint Cheryl Lenhardt to the Bicycle Advisory Committee (BAC) to serve an unexpired term
ending on March 31, 2010.
DISCUSSION
Staff was advised at the end of September that Trevor Keith had resigned from the BAC. Mr.
Keith vacated a position with a term expiring on March 31, 2010. Staff advertised Mr. Keith's
vacancy in accordance with statutory requirements and the City's own process. The required
notice was posted immediately after staff learned of Mr. Keith's resignation and the legal
advertisement was published on September 27. Staff also contacted prior applicants to determine
their interest in activating their applications for the current vacancy.
No new applications were received during this recruitment period. However, five applicants had
submitted applications during the past year and they agreed to reactivate their applications.
Following the recruitment period, staff contacted the Council Liaison Subcommittee, former
Council Members Paul Brown and Christine Mulholland, and interviews with the five applicants
were scheduled for November 3, 2008. The Council Liaison Subcommittee interviewed four of
the five applicants. The fifth applicant was unable to attend at the last minute. Following the
interviews, the former Council Liaison Subcommittee recommended the appointment of Cheryl
Lenhardt to the position vacated by Mr. Keith.
Shortly after Mr. Keith's resignation was received, staff was notified that Tom Nuckols was also
resigning from the BAC. Mr. Nuckols' resignation was effective following the November 20
BAC meeting. Although staff had received advance notice of Mr. Nuckols' resignation, because
of statutory requirements (e.g., notices may be posted no earlier than 20 days prior to the
effective date of the vacancy or appointments made for at least 10 days after the posting of the
notice), staff was unable to advertise or schedule interviews for Mr. Nuckol's vacancy
simultaneously with the vacancy created by Mr. Keith's resignation. Staff has since been able to
advertise and recruit for Mr. Nuckols' position. Interviews will be scheduled with the new
Council Liaison Subcommittee following its appointment on December 16. The new
subcommittee will be required to interview applicants who have submitted applications during
this recruitment period. They will also be asked to either re-interview or, based on the
recommendation of the former Council Liaison Subcommittee, consider for appointment those
candidates who qualified during the recruitment period for Mr. Keith's vacant position.

Although former Council Members Brown and Mulholland are no longer on the City Council,
because they conducted the interviews for Mr. Keith's vacant position and highly recommended
the appointment of Ms. Lenhardt to his position prior to the expiration of their City Council
terms, staff recommends that Council consider honoring their recommendation and making the
appointment at this time.
