AGREEMENT APPLICATIONS
RECOMMENDATION
Adopt a resolution amending the Master Fee Schedule to establish a planning services fee for the
processing of Development Agreements associated with a planning application.
DISCUSSION
Background
In order to facilitate its development of the Tank Farm property and implement the City's
infrastructure and environmental preservation goals expressed in the Airport Area Specific Plan,
Chevron has requested the City consider entering into a Development Agreement. In reviewing
Chevron's request for such an agreement, staff discovered that Council had not previously
established a fee schedule to cover the City's costs of processing applications as required by San
Luis Obispo Municipal Code section 17.94.050 (Development Agreement Fees).
As a practice, the City has been charging for staff time based on the rates established in the
City's Cost Allocation Plan, whenever the City did not have a set fee for a particular service.
This approach is commonly referred to as "Time and Materials" cost recovery and is particularly
applicable to review processes that vary greatly depending on scope and complexity.
Development Agreements fall into this project category. An up-front deposit based on the
anticipated scope of the project is required to begin review of the application.
Chevron filed for a Development Agreement application on August 4, 2010. Since the
application fee had not yet been formally established, staff is working now to provide Chevron
with the breakdown of staff costs associated with the review and proceed on that basis. A
deposit based on that scope will then be requested from Chevron to start processing the
application. Changes to the City's fee schedule formally take effect 60 days after amendment.
Although Development Agreement applications are somewhat rare, staff has recently received
another request for the Taylor property in the Orcutt Area. This Development Agreement would
implement the Orcutt Area Specific Plan's development, phasing, infrastructure, open space, and
affordable housing goals.

FISCAL IMPACT
There are no direct fiscal impacts in establishing a fee for Development Agreements. Adoption
of the resolution will result in full cost recovery for staff time and materials associated with City
review of a Development Agreement application.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ESTABLISHING A FEE FOR THE PROCESSING OF DEVELOPMENT AGREEMENT
APPLICATIONS
WHEREAS, it is the policy of the City of San Luis Obispo to review service charges on
an ongoing basis and to adjust them as required to ensure that they remain adequate to achieve
adopted cost recovery goals; and
WHEREAS, the City maintains and regularly updates its Master Fee Schedule; and
WHEREAS, the City of San Luis Obispo Municipal Code, Section 17.94.050 (Fees),
provides that "the Council shall establish, and from time to time may amend, a schedule of fees
to cover the City's costs of processing applications for Development Agreements."
WHEREAS, the Director of Community Development has determined that the adoption
of the proposed development fee is statutorily exempt from the provisions of the California
Environmental Quality Act (CEQA) under Section 15273 of the Stat_e_CEQA_Guidelines as the
purpose of these charges is to meet operating expenses; and
WHEREAS, the Council considered amendments to the master fee schedule at a public
hearing on April 21, 2009 based on a detailed analysis of costs and funding requirements to meet
cost recovery goals for development review activities.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo that
the City's master fee schedule is hereby amended to include a Development Agreement Fee as
shown in Exhibit A, effective November 7, 2010.
