RECOMMENDATION
As amended by the City Council on June 2, 2009:
Re-introduce Ordinance No. 1529 (2010 Series) to relinquish the plan line setback on both sides
of Broad Street, from Higuera Street to Marsh Street(Municipal Code Section 17.74.130).
DISCUSSION
Previous Review
On June 2, 2009, Council introduced Ordinance No. 1529 (Attachment 1, Meeting Minutes). The
ordinance would have approved a relinquishment of the plan line setback for a portion of Broad
Street. Council's action differed from the staff recommendation made at that time. As a result,
the ordinance was not immediately brought back for final adoption to provide staff with time to
update related documents and revise its recommendation, consistent with the Council's direction.
Staff decided that it would be appropriate to re-introduce this ordinance because of the long time
that has elapsed since the introduction of the ordinance, and the fairly significant change from
the plan line revisions that were originally proposed by staff for the entire Broad Street corridor.
Amended Ordinance
This current action re-introduces the ordinance to relinquish the Broad Street plan line setback,
which was approved by the City Council for the block between Higuera Street and Marsh Street.
The current plan line calls for an 80' wide right-of-way along this block..Based on the Counci's
previous decision, the final right-of-way width for this block will be 55' as shown in attachment
3. The Garden Street Terraces project is designed consistent with the previously approved 55'
right-of-way.
Summary of Approved Plan Line
The revised plan line on Broad Street would only relinquish that section between Higuera Street
and Marsh Street. The existing plan line for the remaining areas of Broad Street will be retained
for street, pedestrian and landscape improvements. These improvements may include potential
turn lanes, intersection upgrades, traffic signal and/or equipment upgrades, or pedestrian and
landscape enhancements.
Relinquishment of the unneeded portion of the plan line setback is consistent with the General
Plan and applicable roadway standards. Furthermore, it will allow for orderly development
without undue hardship to adjacent property owners.

CONCURRENCES
The Public Works, Transportation, and Utilities Departments all participated in identifying
future infrastructure needs along the Broad Street corridor and provided direction on the
minimum rights-of-way needed to satisfy anticipated future improvements. This decision
reflects the current built-out street and public infrastructure improvements and thereby provides
an adequate right-of-way width to accommodate anticipated future improvements.
FISCAL IMPACT
When the General Plan was prepared it was accompanied by a fiscal impact analysis, which
found that overall the General Plan was fiscally balanced. Accordingly, since the proposed
project is consistent with the General Plan, it has a neutral fiscal impact.
ALTERNATIVES
1. The Council may continue review of the project. An action to continue discussion of the
plan line should include a detailed list of additional information or project modifications
required. This continued review could include but is not limited to the analysis of retaining
the previously proposed plan line comer cuts and a plan line setback beyond the current right-
of-way width of 55'.

3. REVISED PLAN LINE SETBACK ON BROAD STREET, FROM HIGUERA
STREET TO PISMO STREET(O 132-08).
Deputy Public Works Director Bochum introduced this item, following which Planner
Jamie-Hill, PMC Consulting, presented the agenda report. They responded to Council's
questions.
Mayor Romero opened the public hearing.
Carol Florence, Oasis.Associates representing the Garden Street Terraces project,
displayed drawings of the existing setback plan line and of the first floor of the proposed
Garden Street Terraces project. She explained that the revised plan line would eliminate
a substantial portion of the project. She asked, therefore, that the portion of the plan line
between Marsh and Higuera Streets be relinquished.
Mayor Romero closed the public hearing.

needed in relieving future traffic congestion. He recommended that this area be
removed from the revised plan line setback.
During Council discussion regarding Mayor Romero's suggestion, Council Member
Marx noted the three General Plan policies referenced in the agenda report and
explained why she would be supporting the staff recommendation.
ACTION: Moved by Romero/Carter to introduce Ordinance No. 1529(2009 Series)with
a revision to solely relinquish the plan line on Broad Street between Marsh and Higuera
Streets, thereby leaving in place the remaining plan line setback on Broad Street
specified in Municipal Code Section 17.74.130; motion carried 4:1 (Marc opposed).
Council Member Marx stated for the record that she supported narrowing Broad Street,
but did not believe any of the proposed area should have been excluded from the
proposed revised plan line setback as recommended by staff.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
RELINQUISHING THE PLAN LINE SETBACK ON BROAD STREET BETWEEN
HIGUERA AND.MARSH STREETS
WHEREAS, the Planning Commission of the City of San Luis Obispo conducted a
public hearing in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo,
California, on April 8, 2009, for the purpose of considering application O 132-08, a request to
repeal the plan line on Broad Street from Higuera Street to the southeasterly city limit line, and
adopt a revised plan line for a portion thereof; and
WHEREAS, the City Council of the City of San Luis Obispo conducted a public hearing
in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on June 2,
2009, for the purpose of considering the project; and
WHEREAS, the Council has duly considered all evidence, including the
recommendation of the Planning Commission, testimony of interested parties, and the evaluation
and recommendations by staff, presented at said hearing.
WHEREAS, the Council finds that the relinquishment of the Plan Line is exempt from
CEQA review under the Categorical Exemption for Existing Facilities (15301) because it does
not involve any expansion of the public facilities; and
WHEREAS, the Council has determined that allowing the existing plan line to remain in
its present configuration will unduly restrict the use of properties bordering the street; and
WHEREAS, the. Council finds that widening Broad Street will result in unnecessary
disruption to the established commercial and residential uses.
The City Council of the City of San Luis Obispo hereby ordains as follows:
SECTION 1. The City Council approves the relinquishment of the plan line on Broad
Street between Higuera and Marsh Streets.
SECTION 2. Section 17.74.130 of Chapter 17.74 (Building Setback Line) of Title 17
(Zoning) of the San Luis Obispo Municipal Code is hereby amended to read as follows:
17.74.130 Broad Street (Marsh to SE City Limits).
An official building line is established on both sides of Broad Street, from Marsh Street to
the southeasterly city limit line excepting therefrom that portion from Pismo Street to High
Street,for forty (40) feet from the existing centerline of said portion of Broad Street.

SECTION 3. The official building setback map is hereby amended to eliminate the
plan line on both sides of Broad Street between Higuera and Marsh Streets. Upon final passage
and adoption, the revised map will be placed on file with the City of San Luis Obispo in
accordance with Municipal Code Chapter 17.74.
SECTION 4. A summary of this ordinance, together with the names of Council members
voting for and against, shall be published at least five (5) days prior to its final passage in the
Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect at
the expiration of thirty(30) days after its final passage.

I'll let the folks know that this is coming, but I do need to know how long you expect
this to run as there are already 4 public hearings scheduled on September 7th. Also, I
can't tell from your form what you want me for noticing. I can send a legal ad, but am
not sure about signs, postcards, etc. Same old question on this one, I guess. Plus, the
joker in the mix is that I will be going in from my 2nd chemo on the day all the noticing
