SUBJECT: ADOPTION OF AN ORDINANCE PRE-ZONING THE ORCUTT
AREA (R 81-10)
RECOMMENDATION
Adopt Ordinance No. 1554 to Pre-Zone the Orcutt Area consistent with the adopted
Orcutt Area Specific Plan
DISCUSSION
Background
On September 21, 2010, the City Council voted 5:0 to introduce Ordinance No. 1554 to
print, thereby pre-zoning the Orcutt area in anticipation of annexation, consistent with the
Orcutt Area Specific Plan. Ordinance No. 1554 is now ready for adoption. The new
Ordinance will become effective 30 days after its adoption. The City Council approved a
Negative Declaration for the project that determined that the changes associated with the
pre-zoning would not have environmental impacts.
ALTERNATIVE
If the Council does not adopt the ordinance, the pre-zoning will not take effect. The pre-
zoning ordinance is a necessary component of the annexation application to LAFCO. The
Council may choose alternative pre-zoning scenarios, however this would result in the
need for amendments to the approved specific plan.

AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO ESTABLISHING
PRE-ZONING FOR LAND WITHIN THE ORCUTT AREA, CONSISTENT
WITH THE ORCUTT AREA SPECIFIC PLAN
ANNX/ER 81-10 (Citywide)
WHEREAS, the City Council of the City of San Luis Obispo conducted a public hearing
in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on
September 21, 2010, for the purpose of considering Planning Application ANNX/ER 81-10, a
project to annex and pre-zone the Orcutt Area,consistent with the Orcutt Area Specific Plan; and
WHEREAS, the City Council of the City of San Luis Obispo conducted a public hearing
in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California; on October
19, 2010, to consider a second reading of the Pre Zoning ordinance; and
WHEREAS, pre-zoning this land is a necessary component of the annexation process;
and
WHEREAS, the General Plan designations and anticipated development in the area were
reviewed with the Orcutt Area Specific Plan and the specific plan EIR, which were approved by
Council on March 2,2010; and
WHEREAS, the City Council considered the Initial Study and Negative Declaration of
Environmental Impact (ER 81-10) for the annexation and pre-zoning project, and determined
that the document adequately addresses the potential environmental effects of the proposed
project; and
WHEREAS, the City Council has duly considered all evidence, including the testimony
of the applicant, interested parties, and the evaluation and recommendations by staff,presented at
said hearing.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of San Luis
Obispo as follows:
Section 1. Environmental Review. The City Council does hereby adopt a Negative
Declaration for the project.
Section 2. Action. The City Council does hereby approve pre-zoning to apply to land
within the Orcutt Area as shown in Exhibit A.
Section 3. Summary. A summary of this ordinance, approved by the City Attorney,
together with the names of the Council members voting for and against it, shall be published at
least five days prior to its final passage, in the Tribune, a newspaper published and circulated in

this City. This ordinance will go into effect at the expiration of thirty (30) days after its final
passage.
