SUBJECT: PARK RESTROOM REPLACEMENT PROJECT — LAGUNA :LAKE ,
PARK RESTROOMS; SPECIFICATION NO. 90755A
RECOMMENDATION
1. Approve the plans and specifications for "Laguna Lake Park Restrooms, Specification No.
90755A," authorize staff to solicit bids and authorize the City Manager to award a contract if
the lowest responsible bid is less than or equal to the Engineer's Estimate of$490,000.
2. Approve the transfer of up to $47,433 from the completed projects account, if needed to fund
the estimated increase in the construction costs.
DISCUSSION
In December 2004, the City entered into an agreement with the Department of Justice to bring
various City facilities into compliance with federal ADA regulations. The two Laguna Lake Park
restrooms and the Santa Rosa Park restroom were among the various facilities targeted for
compliance upgrades. Given the condition and age of these restrooms and the extent of the
remodeling required to bring them into compliance, it was determined that these structures were not
suitable for remodeling and should be replaced. Replacement of these three restrooms was
approved as part of the 2007-09 Financial Plan.
In January 2008, BFGC Architects, one of the City's on-call architects, was hired to provide
preliminary design and cost estimates for the two restrooms at Laguna Lake Park. The preliminary
estimates received from the architect indicated costs considerably higher than the project budget -
likely due to the significant cost increases that occurred in the market-since the project budgets were
generated several years earlier. The current budget would support two of the restrooms slated for
replacement but not all three.
Council, at its July 1, 2008 meeting, approved staffs recommendation to move forward with the
design and construction of the two Laguna Lake Park restrooms, to also move forward with the
design of Santa Rosa Park restroom but to defer the construction on Santa Rosa restroom until
additional funds were secured. Subsequently, at its September 16, 2008 meeting, Council
authorized the transfer of a majority of the Community Development Block Grant (CDBG) funds
allocated to Santa Rosa project to the Laguna Lake project holding back only enough to fund the
Santa Rosa design phase. Staff has since submitted a new application for CDBG funds as well as a
new CEP request for the Santa Rosa project. If the application and request are approved, funds will
be available to use for construction next fall.

The construction documents for Laguna Lake Park restrooms are complete and the project is ready
for bidding. Staff recommends moving forward with soliciting bids for the Laguna Lake Park
restrooms to take advantage of the current market and favorable bidding climate.
CONCURRENCES
1. The Community Development Department has reviewed and approved this project as a
minor/incidental project and has granted this project a Categorical Exemption in accordance
with the California Environmental Quality Act(CEQA)
2. Parks and Recreation Commission reviewed and approved this project at its August 6, 2008
meeting.
3. Federal National Environmental Policy Act (NEPA) clearances are currently being processed
through the County Environmental Coordinator who oversees the CDBG program. The
project may move forward with advertising but the contract for construction can be awarded
only upon completion of the environmental process. It is expected that NEPA clearances will
be obtained before bid opening. However,if necessary, award of the contract will be delayed
until the NEPA clearances have been completed.
FISCAL IMPACT
The Park Restroom Replacements Project is identified in the 2007-09 Financial Plan on pages 3-
390 through 3-393 of Appendix B. Funding for this project comes from a combination of
General Funds, Community Development Block Grant allocations for the years 2005 and 2007
and a State Workforce Housing Reward Program grant. The following table represents the
current construction and construction management budgets and updated construction phase cost
estimates for the two Laguna Lake Park restrooms.

As shown above, the estimated construction phase costs of $612,500 is over the current
construction and construction management budgets of $565,057. Some additional funding may

be required to cover construction costs, based on the Engineer's Estimate. However, given the
favorable bid environment, the bids may come in less than the estimate. Therefore, staff
recommends authorizing the CAO to allocate up to $47,443 from the CEP Completed Projects
account, if necessary. There is approximately $91,416 available in this account that could be
used to support this project, and if the $47,443 is needed, there will be a remaining balance of
$43,973.

Does anyone think that spending $306,250 for one bathroom just a little bit
outrageous?. Anybody?. It's more than just shameful, it shows a complete
lack of regard for taxpayers money. And I know staff will say that the money
really isn't coming from the City.but is CDBG monies, as though that money
really doesn't matter- I guess. Plus there will be some argument that the
City may not actually spend the budgeted amount, although the city is
certainly prepared to spend the $612,500. BED FILE
I don't want to spend a bunch of space discussing CDBG grant monies but the MEETING AGENDA
money is really meant to be spent on housing opportunities for low and DATE ITEDA ,;`•_ C//
moderate income families. And yes, I understand that.the City fall under a
different set of guidelines and can use the monies for a much broader set of
goals. But the money should be being used for housing which of course isn't
happening with this project or the sidewalk programs which is another$500k.
So back to the bathrooms, which cost a whopping $750 a square foot to build. #4tz

get it, I mean I really don't. I guess it's easy to spend money like a a f�AY- �ia D I R
drunken sailor when its not really your money. Only problem is that I don't
think any of the staff sails (Bob Newman retired so he's out) and I won't

Second, there should be a bit more discussion about the ultimate number and
placement of bathrooms at the park vis a vis the Laguna Lake Park Master
Plan. Anyone look at that lately?. Somebody should take a look at that plan,
because I believe it shows at least three bathrooms and the two that are
being replaced look to be in a different location.
As Council Members you folks need to take.a step back and have a bit more of
a discussion about staffs proposal. I wonder how this would play out in
the National spotlight?. I'm wondering if at the next conference you folks
attend how you'll react when a keynote speaker instead of making fun of an
underground frog tunnel points out that City of San Luis Obispo spent $750
sq. ft. for public bathrooms that didn't even include gold plated toilet
seats.
