Repeal the plan line setback on Broad Street, from Higuera Street to the southeasterly city limit line. 2. Introduce an ordinance adopting a revised plan line setback on both sides of Broad Street, from Higuera to Pismo Street; excluding the area from Pismo Street to High Street which was previously repealed (Municipal Code Section 17.74.130). DISCUSSION Background Adopted in 1961, the original plan line setback on Broad Street included an 80-foot wide right- of-way from Monterey Street to the southeasterly City limits. The plan line was established asa means of ensuring orderly planning and improvement of the community street system,. particularly on major arterials such as Broad Street. At the time of adoption, this segment of Broad Street was designated as a State Highway. Under that designation, Caltrans retained the authority to widen the street should they determine it necessary. Since that time the State Highway has been rerouted to South Street. In 1986 the Council approved a revised plan line which retained the plan line from Higuera to Pismo Street, and from High Street to the southeasterly City limits, and deleted the plan line from Monterey Street to Higuera Street, and from Pismo Street to High Street. The Council did this in recognition of the interrelationship between roadways, and impacts that changes to Broad Street would have on intersecting streets and adjacent properties. The Council was also addressing the immediate concerns of residents living along Broad Street, and circulation from the downtown to the southern end of town. The City Council is now being asked to consider a revised plan line on Broad Street that would keep future improvements contained in existing right-of-way for much of Broad Street and only maintain the setback line at critical locations that may need future widening. Site Description The project is considered to be Broad Street, between Higuera and the southeasterly City limit line, excepting there from that portion from Pismo Street to High Street which was previously repealed. The established plan line is 80 feet wide, but the right-of-way has not been widened to that width, excepting those portions of Broad Street south of Chorro Street. The remaining City 7 F1 Council Agenda Report—O 13_ e8 June 2,2009 Page 2 right-of-way along Broad Street varies from fifty-five to sixty feet, except in a few locations where property has been previously dedicated to the City. Broad Street travels through the downtown to the southerly side of town, passing through residential, office, and commercial zones. At the northernmost end of the project area are the City's Downtown and Old Town Historic Districts, which consist primarily of historically significant commercial and residential structures. Significant vegetation along Broad Street includes several large trees within the area currently designated for future widening. These would all require removal if the street were widened to the full width allowed for with the current plan line. What Happens south of Pismo Street? The plan line section of Broad Street between Pismo Street and High Street was previously repealed in 1986. The section of Broad Street south of High Street is primarily under the jurisdiction of the State of California Department of Transportation (Caltrans) and is a mixture of built out areas as well as areas that have been master planned as part of separate planning documents. Most of this section has currently been improved in excess of 80' in width with a transition from the narrower road at High Street that will not need modification in the future. Thus staff considers the plan line moot for much of this section. The section from South Street to just south of Orcutt Road is being reviewed by the South Broad Street Corridor Plan (Council review in summer 2009)to determine what, if any, additional widenings need to happen to mitigate future traffic: The..section from Orcutt Road to the southern City limits was included in the Airport Area Specific Plan, the Broad Street Annexation Plan, and the City-Caltrans joint Broad Street Corridor Task Force Plan. All.of these documents provide guidance and recommendations for widening and improvements along this section of Broad Street that negate the need for the overriding plan line that was established in the 1960's. Staff therefore believes that deleting this section from the City's building setback regulations at this point is moot in that sufficient other authority exists to provide guidance on building setbacks and street right of way dedication requirements, i.e. the plans noted above. Project Description General Plan Policy CE 9.0.7, directs the City to reserve rights-of-way through the building setback line process or through other mechanisms to ensure that options for making transportation improvements are preserved. At the time that the current plan line for Broad Street was adopted, Broad Street through the downtown was a major cross-town connector, and was envisioned as a four lane thoroughfare connecting Downtown to the southerly side of town. Since that time, the designation of Broad Street as a State Highway has been relocated to South Street and the emphasis of maintaining Broad Street (in the Downtown area) as a multilane thoroughfare has diminished. It is no longer considered desirable or necessary to widen Broad Street through the downtown beyond the two existing through lanes. The proposal considered at this time is for a revised plan line on Broad Street which would retain only that right-of-way necessary for pedestrian and landscape improvements, and potential turn lanes. Council Agenda Report—O 11..-e8 June 2,2009 Page The revised plan line setback on both sides of Broad Street, from Higuera to Chorro/Sandercock Streets, excepting therefrom that portion from Pismo Street to High Street which was previously repealed, would establish the following: 1. Previously Dedicated Right-of-Way to Be Retained. All previously dedicated right-of- way along the corridor will be retained for future use by the City so enhancement to the street infrastructure can be done if necessary within the areas. Some potential uses for these areas include increased parkways and sidewalk areas, pedestrian enhancements and potential street widening for transit, parking, or loading enhancements. 2. Parkway/Pedestrian Width Retention. In the remaining plan line area of the Broad Street corridor a minimum street width of 64-feet should be maintained (Plan Line reduction from 80-feet to 64-feet), including 8-foot minimum width sidewalks and 4-foot wide parkway/tree wells on both sides of the street, and a goal of 40-feet curb to curb. This 64-foot right-of-way would allow the City to preserve the ability to enhance the minimum level of pedestrian walkways to a minimum of 8-foot "clear" width in unobstructed pedestrian passage along the corridor, particularly between Higuera and Pacific Streets. This 8-foot width for passage could be accomplished in two ways; 1) as additional right-of-way(standard), or 2) incorporated into the design of buildings fronting the Broad Street corridor (subject to Public Works Director's approval). Futureprojects opting to accommodate part of the 8-foot clear area on private property would be able to do so with recordation of a public pedestrian easement or other mechanisms that maintains the clear area for public use. 3. Corner Cut-Offs. To allow additional pedestrian passage and adequate area to place above-ground public infrastructure all intersections should have a minimum additional dedication of 10' corner cut-off of right-of-way. 4. Broad: Marsh to Pacific (both sides of street). The plan line setback across the parcels immediately south of Marsh Street should be maintained at 80-feet to allow for the future enhancement of the intersection at Marsh Street to accommodate turn lanes and larger vehicles. 5. Broad: Pacific to Pismo (northbound side of the street). The plan line setback across the parcels on the northbound side of the street, 150-feet south of the intersection should be maintained at 80-feet to allow for the future enhancement of the intersection at Marsh Street to accommodate turn lanes and larger vehicles. The discussion below addresses the rationale for modifying and in part, eliminating the 80-foot plan line from Higuera to Pismo Street, and conformance with applicable General Plan policies: P�3 - 3 Council Agenda Report—O 1:>_a8 June 2,2009 Page 4 Transportation and Circulation This segment of Broad Street is somewhat unique in that it transitions from an Arterial in the downtown core, to a Residential Arterial fronted by single family homes with minimal setbacks, to Highway 227, a major Regional Route, all within a few blocks. The City's transportation objectives established in the Circulation Element of the General Plan include goals to protect the quality of residential areas by reducing or controlling traffic routing, volumes, and speeds and limiting street widenings to locations where there is a demonstrated need. Given projected traffic volumes staff has determined widening for the purposes of traffic operations is unnecessary. Widening Broad Street to the full 80-feet now allowed for with the plan line setback would increase both traffic volumes and speeds through this residential segment, concentrating traffic which is now dispersed among parallel streets in the area. Neighborhood Compatibility The General Plan Land Use Element expands on the relationship between roadways and neighborhoods, stating that neighborhood streets and circulation patterns should favor the pedestrian and local traffic; that traffic lanes should be narrow, speeds slow, and parkways, sidewalks and crosswalks enhanced. Expanding the right-of-way to the full 80-foot width would require encroaching into what are now private front yards, reducing the separation from single- family homes to Broad Street. This would result in higher noise levels within the homes, and reduced separation and screening opportunities. Land Use The plan line along Broad Street effectively reduces the size of all parcels fronting the street. Because new construction is required to be setback from the plan line, even if the roadway is .:never built-out the development potential of all these lots is still affected,.and property owners unnecessarily restricted from the full use of their property. This is contrary to Land Use and Housing Element policies which encourage compact development and the efficient use of land which is close to existing services. Conclusion The revised plan line on Broad Street would retain only that right-of-way necessary for pedestrian and landscape improvements, and potential turn lanes. Relinquishing unneeded portions of the plan line setback is consistent with the General Plan and applicable roadway standards, as it will assure orderly development without undue hardship to adjacent property owners. CONCURRENCES The Public Works, Transportation, and Utilities Departments all participated in identifying future infrastructure needs along the Broad Street corridor and provided direction on the minimum right-of-ways needed to satisfy anticipated future improvements. On February 11, 2009 and then again on April 8, 2009 the Planning Commission reviewed staff recommendations regarding the revised setback plan line. Attachment 3 contains the minutes and Council Agenda Report—O f. S J June 2,2009 Page 5 staff report of the April 8, 2009 meeting. Planning Commission recommended Council approval of the proposed revision to the setback ordinance 6-0. FISCAL IMPACT When the General Plan was prepared it was accompanied by a fiscal impact analysis, which found that overall the General Plan was fiscally balanced. Accordingly, since the proposed project is consistent with the General Plan, it has a neutral fiscal impact. ALTERNATIVES 1. The Council may continue review of the project. An action to continue discussion of the plan line should include a detailed list of additional information or project modifications required. 2. The Council may adopt a resolution maintaining the existing plan line based on findings of inconsistency with the General Plan Policies as specified by the City Council. Mr. Bochum noted there will be a delay in service recommendations due to the City's transit financial situation which has had significant operational funding reductions in the last year. Mr. Multari stated that Cal Poly had scheduled project funding for University construction for 2009 Summer and Fall sessions. Vice-Chair Multari requested clarification on the Cal Poly ridership and percentage received toward the fare box contribution. Tim Bochum replied Cal Poly ridership and contribution to the fare box was roughly a 60/40 split. Commr. Boswell requested clarification of the contribution for evening services funded by University. This 64400t right-of-way would allow the City to preserve the ability to enhance the minimum level of pedestrian walkways to a minimum of 8-foot "clear" width in unobstructed pedestrian passage along the corridor, particularly between Higuera and Pacific Streets. This 8-foot width for passage could be accomplished in two ways; 1) as additional right-of-way (standard), or 2) incorporated into the design of buildings fronting the Broad Street corridor (subject to Public Works Director's approval). Future projects opting to accommodate part of the 8-foot clear area on private property would be able to do so with recordation of a public pedestrian easement or other mechanisms that maintains the clear area for public use. 3. Corner Cut-Offs. To allow additional pedestrian passage and adequate area to place above-ground public infrastructure all intersections should have a minimum additional dedication of 10' comer cut-off of right-of-way. 4. Broad: Marsh to Pacific (both sides of streets The plan line setback across the parcels immediately south of Marsh Street should be maintained at 80-feet to allow for the future enhancement of the intersection at Marsh Street to accommodate tum lanes and larger vehicles. 5. Broad: Pacde to Pismo (northbound side of the street). The plan line setback across the parcels on the northbound side of the street, 150-feet south of the intersection should be maintained at 80-feet to allow for the future enhancement of the intersection at Marsh Street to accommodate tum lanes and larger vehicles. The discussion below addresses the rationale for eliminating the 80-foot plan line from Higuera to Chorro/Sandercock Streets, and conformance with applicable General Plan policies: I. Transportation and-Circulation. This segment of Broad Street is somewhat unique in that it transitions from an Arterial in the downtown core, to a Residential Arterial fronted by single family homes with minimal setbacks, to Idrghway 227, a major Regional Route, all within a few blocks. The City's transportation objectives established in the Circulation Element of the General Plan include goals to protect the quality of residential areas by reducing or controlling traffic routing, volumes, and speeds and limiting street widenings to locations where there is a demonstrated need. Given projected traffic volumes staff has determined widening for the purposes of traffic operations is unnecessary. Widening Broad Street to the full 80-feet now allowed for with the plan line setback would increase both traffic volumes and speeds through this P03 -)Y 123-08 (Broad Street Plan'Lin'e Setback) Attachment 3 Page 4 residential segment, concentrating traffic which is now dispersed among parallel streets in the area. 2. Neighborhood Compatibility. The General Plan Land Use Element expands on the relationship between roadways and neighborhoods, stating that neighborhood streets and circulation patterns should favor the pedestrian and local traffic; that traffic lanes should be narrow, speeds slow, and parkways, sidewalks and crosswalks enhanced. Expanding the right-of-way to the full 80-foot width would require encroaching into what are now private front yards, reducing the separation from single-family homes to Broad Street. This would result in higher noise levels within the homes, and reduced separation and screening opportunities. 3. Land Use. The plan line along Broad Street effectively reduces the size of all parcels fronting the street. Because new construction is required to be setback from the plan line, even if the roadway is never built-out the development potential of all these lots is still affected, and property owners unnecessarily restricted from the full use of their property. This is contrary to Land Use and Housing Element policies which encourage compact development and the efficient use of land which is close to existing services. The plan line setback south of Chonro/Sandercock Streets and extending to the southeasterly City limits would be maintained at the existing 80-feet in recognition of the existing roadway width, and to insure that frontage improvements will be properly installed in the future. OTHER DEPARTMENT COMM EM Divisions of Public Works and Utilities Departments all participated in identifying future infrastructure needs along the Broad Street corridor and provided direction on the minimum right- of-ways needed to satisfy anticipated finure improvements. ALTERNATIVES 1. Continue the item. An action to continue discussion of the plan line should include a detailed list of additional information or project modifications required. 2. Recommend that the plan line be maintained as currently required. An action to retain the existing plan line should include rationale for why this additional right-of-way should be preserved.
