SUBJECT: ADOPTION OF ORDINANCE NO. 1532 AMENDING PARIQNG
METER RATES AND THE DEPOSIT OF PARKING FINES AND
FORFEITURES
RECOMMENDATIONS
Adopt Ordinance No. 1532 amending:
a. San Luis Obispo Municipal Code Section 10.52.010 to reflect Council changes to
parking meter rates.
b. San Luis Obispo Municipal Code Section 10.64.040 to reflect Council changes to
the deposit of collected parking fines and forfeitures.
DISCUSSION
On July 7, 2009, The Council voted 4:1 to introduce Ordinance No. 1532 to print. This ordinance
amends San Luis Obispo Municipal Code Sections 10.52.0 10 and 10.64.040.
San Luis Obispo Municipal Code Section 10.52.010 is amended to reflect Council changes to
parking meter rates in the ten-hour zone, increasing from $0.75 an hour to $1.00 an hour, effective
July 1,2010.
San Luis Obispo Municipal Code Section 10.64.040 is amended to reflect Council changes to the
deposit of collected parking fines and forfeitures,transferring net parking fines to the General Fund
for Police Department parking citations. This section takes effect thirty days after the date of final
passage of Ordinance No. 1532.
Ordinance No. 1532 is now ready for final passage.

ORDINANCE NO.1532 (2009 Series)
AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AMENDING SECTION 10.52.010 (PARKING METER ZONE-RATES) OF CHAPTER
10.52 (PARKING METERS) OF TITLE 10 (VEHICLES AND TRAFFIC) OF THE SAN
LUIS OBISPO MUNICIPAL CODE
WHEREAS, State law provides, in Vehicle Code Section 22508, that cities must
establish parking meter rates by ordinance; and
WHEREAS, the parking program needs to continue to be self-sufficient for its financial
commitments; and
WHEREAS, the City needs to financially support the operation and debt service of the
next City parking structure; and
WHEREAS, the Council has considered the staff report and considered the proposed
changes to the parking meter rates at a public meeting.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Sub parts B and D of Existing Section 10.52.010 (Parking meter zone —
rates) of the San Luis Obispo Municipal Code are hereby repealed.
SECTION 2. New subparts Band D of Section 10.52.010 (Parking meter zone —rates)
are hereby added to Chapter 10.52 (Parking Meters) of Title 10 (Vehicles and Traffic) of the San
Luis Obispo Municipal Code to read as follows:
B. Unless established otherwise below, the parking meter rate on streets or in municipal
parking lots in the lower-rate zone shall be seventy-five cents ($0.75) per hour, and these parking
meter rates shall be increased to one dollar per hour effective July 1, 2010.
D. Within the shaded area on the map entitled Slack Street Meter Zone Map (Exhibit B), the
parking of vehicles on streets may be controlled and regulated with the aid of parking meters.
The parking meter rate shall be seventy-five cents ($0.75) per hour if controlled by meter.
SECTION 3. Sub part D of Existing Section 10.64.040 (Disposition of fine and
forfeitures) of the San Luis Obispo Municipal Code is hereby repealed.
SECTION 4. New Section 10.64.040 (Disposition of fine and forfeitures) is hereby
added to Section 10.64 (Parking Revenues, Fines And Forfeitures) of Title 10 (Vehicles and
Traffic) of the San Luis Obispo Municipal Code to read as follows:

Disposition of fine and forfeitures. All fines and forfeitures collected upon conviction or upon
forfeiture of bail of any person charged with a violation of any of the provisions of this title,
shall be paid into the city treasury and one hundred percent shall be deposited into the "parking
fund" except that the "net" bail amount received for citations generated by the Police
Department may be allocated to the General Fund. For the purposes of this section the "net" bail
shall be determined by Council or by subtracting the total collected bail generated by Police
Services and then subtracting the overhead costs for Parking Services including: citation
processing, program administration and maintenance. All remaining "Parking Fund" moneys
shall be distributed for the purposes described in Section 10.64.010.
SECTION 5. A summary of this ordinance, together with the names of the Council
members voting for and against it, shall be published at least five (5) days prior to its final
passage, in the Telegram-Tribune, a newspaper published and circulated in this City. This
ordinance will go into effect at the expiration of thirty (30) days after its final passage.
INTRODUCED on the 7th day of July 2009, AND FINALLY ADOPTED by the
Council of the City of San Luis Obispo on the 4th day of August 2009, on the following role call
