counat j ac Enaa nEpmt ]�N.6.g CITY O F SAN LUIS OBISPO FROM: Shelly Stanwyck, Assistant City Administrative Officer Prepared By: Brigitte Elke, Principal Administrative Analyst SUBJECT: AMENDMENT TO THE CITY'S SMOKING PROHIBITIONS RECOMMENDATION As recommended by the Parks and Recreation Commission amend Chapter 8.16 of the City's Municipal Code to ban smoking and all forms of tobacco products from city-owned outdoor recreation areas, including Mission Plaza and its adjacent creekwalk. DISCUSSION Background In 1985, the City of San Luis Obispo was the first City in the world to ban smoking from indoor areas, restaurants, and bars. Since that time, State law has"caught up" and Chapter 8.16 of the City's Municipal Code which currently regulates smoking in the City of San Luis Obispo finds itself on par with State law and regulations. Both now regulate workplaces, health care facilities, government buildings, entertainment places, and food related indoor spaces. However, neither State nor City code currently regulate outdoor recreational areas, sport facilities, or Open Space. Current State law only prohibits public school students from smoking or using tobacco products while on campus or while attending school-sponsored activities. Statewide, many jurisdictions have expanded their smoking ordinances to go above and beyond current State law reacting to new information about secondhand smoke and its impact on people's health. In California, over 100 cities have adopted more stringent ordinances prohibiting smoking from outdoor recreation areas. 24 communities have banned smoking from all areas frequented by the public including multi-unit residences. In San Luis Obispo County, Morro Bay, Pismo Beach, Atascadero and Arroyo Grande have banned smoking from their public parks, beaches, open space, sports facilities, skate parks, biking trails, and dog parks. During the communication portion of the agenda on the December 15, 2008 Council meeting, Council directed staff to return with recommendations for possible amendment of Chapter 8.16 of the Municipal Code in Fall 2009. Chapter 8.16 of the City's Municipal Code entitled "Smoking prohibited in certain areas" sets forth the City's current smoking regulations. Council direction was based on numerous complaints received pertaining to smoking and secondhand smoke exposure mainly in Downtown San Luis Obispo and the City's outdoor recreation areas. Staff started its review concentrating on four main areas namely the danger of secondhand smoke, littering as it pertains to smoking, fire danger,,and citizen complaints. B & Amendment to Municipal Code Chapter 8.16—Non-smoking law Page 2 Areas of concentrated staff review Dangers of Second Hand Smoke - The 2006 U.S. Surgeon General's Report concludes there is scientific evidence showing that there is no "safe" level of exposure to secondhand smoke. Secondhand smoke causes premature death and disease in children and adults who do not smoke. In the United States alone, secondhand smoke is responsible for an estimated 46,000 deaths from heart disease in non-smoking adults, and up to 300,000 lung infections in children annually. The California Air Resources Board declared secondhand smoke a toxic air contaminant in January 2006. Researchers with Stanford University found that levels of exposure to secondhand smoke outdoors can be comparable to secondhand smoke exposure indoors. In addition, when individuals are near a smoker outdoors, they are exposed to air pollution levels significantly higher than normal background air pollution levels. Several studies from Tobacco Control indicate that San Luis Obispo County residents are supportive of more stringent smoking laws: 87%of San Luis Obispo County residents do not smoke. 60%of San Luis Obispo County residents support smoke-free outdoor areas such as parks,beaches, golf courses, zoos, and sports fields. (California Department of Health Services:Tobacco Control Section 2007 C-Stats website"County snapshot—Sa Luis Obispo"and 2004'The Survey of California Adults on Secondhand Smoke.") Furthermore, smoking in picnic areas where people are eating, near the playgrounds where children are playing, chewing of tobacco products at baseball games by those who mentor the City's youth, and smoking in general in any part of the City's outdoor recreation areas seems philosophically incongruent with the core mission of the City's Parks and Recreation program and activities. In its mission statement, the Parks and Recreation department commits to providing quality parks, open space, recreation, cultural and educational services essential to the enhancement and promotion of personal well being, safety, and a sense of community. Smoking Related Litter-The disposal of cigarette butts and other materials associated with smoking and tobacco products in public areas throughout the City creates unsightly conditions and poses possible hazards to children, animals, and the riparian corridor with its aquatic wildlife. Cigarette filters and plastic wrappers from cigarette packages are not biodegradable and cigarette related waste discarded in parks, along sidewalks, and in street gutters make their way through storm drains into creeks and rivers leaking dangerous chemicals into the City's watershed. The City of San Luis Obispo is subject to regulations issued by the Stormwater Management Program and is mandated by the California Regional Water Quality Control Board to reduce the environmental impact from stormwater run-off and human activities in the local creek systems. The City is also subject to regulation under the California Endangered Species Act and the Federal Endangered Species Act of 1973, as two federally protected species under the Federal Act, Steelhead trout (Oncorhynchus mykiss) and California Red-legged frogs (Rana aurora), have both been found within San Luis Obispo city limits. Cigarette filters have been found in the -9 L, � J Amendment to Municipal Code Chapter 8.16—Non-smoking law Page 3 stomachs of fish, birds, and other animals that mistake them for food, thus swallowing harmful plastic and toxic chemicals. The cleaning of tobacco related debris in parks, open space, and the City's storm water system amounts to substantial cost to taxpayers. Fire Danger- Cigarettes, cigars, and other forms of burning tobacco present a fire danger when discarded in the City's Open Spaces. Especially during drought years, it is a concern shared by citizens and the City's Fire Department alike. The California Fire Code, which was adopted by Council, already deals with prohibitions on smoking. Under Section 310.8, the fire code official (the City's Fire Chief)is authorized to determine an area as sufficiently hazardous that smoking needs to be prohibited. Citizen Complaints -The review of the City's current ordinance was largely based on complaints received by citizens. Local tobacco control program officials verified that the same complaints are received at their offices. Most of the complaints come from the City's Downtown where people smoke on benches, next to business and restaurant entrances, and business alcoves where smoke drifts into adjacent businesses, offices, and dining areas. Staff frequently receives phone calls inquiring about the State law prohibiting smoking within 20 feet of a main exit, entrance, or operable window of a public building. However, "public building" in the California Government Code, Sections 7596—7598 is defined as owned and occupied or leased and occupied by the state, a county, a city, or a California Community College district. It does not pertain to private business entrances frequented by the public. Parks& Recreation Commission Based on the mentioned findings, staff took a recommendation to the Parks and Recreation Commission on November 4, 2009 to consider the ban of smoking in city-owned outdoor recreation areas including Mission Plaza and its adjacent creek walk. Five members of the public commented on the considered action and spoke in favour of it. After deliberation, the commission moved to support the recommended action. However, the commission also discussed tobacco products in general and how they pertain to Parks and Recreation programs and activities. It therefore voted to change the recommendation to include not only smoking,but all tobacco products. The commission furthermore discussed the downtown area as most complaints come from business owners and downtown patrons that are exposed to secondhand smoke drifting into the business and office spaces. The commission felt that, in addition to the recommendation in the outdoor recreation areas, the Council strongly consider expanding the ban to include the entire downtown core(Attachment 2—Draft Minutes). Outreach to Business Community Given the large number of complaints originating in the Downtown area, staff reached out to the Downtown Association and the Chamber of Commerce to gauge current perception and possible readiness for an expansion of a smoking ban in all public areas downtown as recommended by the Parks and Recreation Commission. This ban would include sidewalks, parking areas, and passage ways. The Downtown Association presented the issue to its Executive Committee and to its board on November 3'd and l0a' respectively. During the board meeting, the officers voted to support the B' . 2 i Amendment to Municipal Code Chapter 8.16—Non-smoking law Page 4 ban in city-owned outdoor recreation areas including Mission Plaza and its adjacent creek walk. However, the board believed that a smoking ban in any other area in the Downtown corridor should be dealt with at a later date. (Attachment 3 —Correspondence from Deborah Cash).. The Chamber of Commerce brought the issue to its Issues Committee, Sustainability and Resources Committee, and its board. It also sent a survey to all its members and received over 500 responses with a majority of votes supporting the ban from outdoor recreation areas. The board voted to support the ban of smoking and tobacco products in city-owned outdoor recreation areas including Mission Plaza and its adjacent creek walk. They felt that a more encompassing ban spanning the entire Downtown area would not be appropriate at this time. Public Education and Enforcement Given the experience in other jurisdictions, compliance with a new smoking ban will best be achieved through strong signage referencing the governing law with the intent to encourage self- regulation in the area. Public outreach and information will further encourage acceptance and nurture compliance with anew non-smoking law. Police will not actively patrol areas for smoking related offenses, but enforce when encountered or called upon. In Mission Plaza, outreach, education, and enforcement are facilitated by the presence of the Downtown officers and the Downtown's security service. In the City's outdoor recreational areas, the Rangers will assist in outreach and education to further ensure compliance with the ordinance. Violations of non-smoking areas would be considered either infractions or misdemeanors. However, staff recommends that violations of this proposed ordinance be handled through the City's administrative code enforcement procedures as the criminal justice system and the courts are not involved. Since the introduction of Chapter 1.12—General Penalty, the City has added the administrative citation process to deal with minor infractions such as smoking violations (Chapter 1.24 of the Municipal Code). Currently noise violations, urinating in public, and open containers are regulated through this process. It should be noted that the City has and continues to employ the philosophy of voluntary compliance with the administrative citation code. Prior to the implementation of penalties, voluntary compliance approaches will be used (when practical) in order to educate the public concerning the requirements of the code and compliance with its requirements. Summary Given complaints, community readiness, and the City's mission for its parks and recreational areas, staff recommends prohibiting smoking in all City outdoor recreation areas. This would include City parks, dedicated Open Space, sport facilities, trails, and skate and dog parks. Staff also recommends including Mission Plaza in this definition, since it is the most frequented City outdoor area with a multitude of events and gatherings happening year round. Bb 4 1 Amendment to Municipal Code Chapter 8.16—Non-smoking law Page 5 CONCURRENCES The Downtown Association and the Chamber of Commerce support the recommended amendments for a ban of smoking and all tobacco products in city-owned outdoor recreation areas including Mission Plaza and its adjacent creek walk. FISCAL IMPACT There will be initial cost for signage, outreach, and education. Staff estimates a cost of$10,000 to equip all necessary spaces with signage and to produce the educational material. The local Tobacco Control office will assist this effort with a 25% ($2,500) contribution in addition to assistance with outreach and education in form of"Thank-you" ads, brochures and leaflets. The remaining $7,500 estimated, would have to be appropriated from the General Fund unreserved fund balance. ALTERNATIVES 1. Council could consider the Parks and Recreation Commission's suggestion to broaden the ban to all public areas in the Downtown in addition to the outdoor recreation areas including Mission plaza and the creek walk. The Downtown Association, as well as the Chamber of Commerce felt that such a step was not yet warranted. 2. Council could consider leaving the City's current smoking prohibition as is. This is not recommended given the health and litter implications and the Parks and Recreation Commission, the Chamber of Commerce, and the Downtown Association endorsement of the recommended action. Ordinance Amendments Chapter 8.16 SMOKING PROHIBITED IN CERTAIN AREAS* Page I of 4 ATTACHMENT 1 Chapter 8.16 SMOKING PROHIBITED IN CERTAIN AREAS* Sections: 8.16.010 Purpose. 8.16.020 Definitions. 8.16.030 Prohibition in certain public places. 8.16.040 Regulation of smoking in the workplace. 8.16.050 Posting of signs. 8.16.060 Compliance. 8.16.070 Violation—Penalty. 8.16.080 Where smoking not regulated. 8.16.090 Severability. *Prior history: Ord. 1048 § 1, 1985: prior code §§ 5400-5405. 8.16.010 Purpose. Because smoking of tobacco or any other weed or plant is a positive danger to health and a cause of material discomfort and a health hazard to those who are present in confined places, and in order to serve public health, safety and welfare, the declared purpose of this chapter is to prohibit the smoking of tobacco or any other weed or plant in certain areas which are used by or open to the public. (Ord. 1172 § 1, 1990) 8.16.020 Definitions. For the purpose of this chapter, the following words shall have the following meanings: A. "Bar" means an area which is devoted to the serving of alcoholic beverages for con- sumption by guests on the premises and in which the serving of food is only incidental to the consumption of such beverages. B. "Employee" means any individual who receives remuneration for services performed within the city. C. "Employer" means any person, partnership or corporation who employs the services of an individual person or persons. D. "Smoke" or"smoking" means and includes the carrying of a pipe, cigar or cigarette of any kind which is burning, or the igniting of a pipe, cigar or cigarette of any kind which is burning. E.'"Service line" means an indoor line or area where persons await service of any kind, regardless of whether or not such service involves exchange of money. Such service shall include, but is not limited to, sales, giving of information, directions or advice, and transfers of money or goods. R "Restaurant" means any coffee shop, cafeteria, luncheonette, tavern, cocktail lounge, sandwich stand, soda fountain, private and public school cafeteria or eating establishment, and any other eating establishment, organization, club, including veterans' club, boardinghouse or guesthouse, which gives or offers for sale food to the public, guests, patrons or employees as well as kitchens in which food is prepared on the premises for serving elsewhere, including catering facilities. G. "Retail tobacco store" means a retail store utilized primarily for the sale of tobacco products and accessories and in which the sale of other products is merely incidental. H. "Workplace" means any interior space under the control of a public or private employer which employees normally frequent during the course of employment, including, but not limited to, work areas, employee lounges, conference rooms, and employee cafeterias. A private residence is not a workplace under this section. (Ord. 1172 § 1, 1990) Chapter 8.16 SMOKING PROHIBITED IN CERTAIN AREAS* Page 2 of 4 ATTACHMENT 1 8.16.030 Prohibition in certain public places. Smoking shall be prohibited in the following places: A. Elevators, museums, libraries, galleries, public transportation facilities open to the public and service lines of establishments doing business with the general public; B. Waiting rooms, sleeping rooms or public hallways of every private or public health care facility, including, but not limited to, hospitals, clinics, physical therapy facilities, doctors' offices, and dentists' offices; provided further, that this prohibition shall not prevent the establishment of a separate waiting room in which smoking is permitted, as long as there also exists a waiting room in the same facility in which smoking is prohibited. In bed space areas of health facilities used for two or more patients, smoking shall be prohibited unless all patients within the room are smokers and request in writing upon the health care facility's admission forms to be placed in a room where smoking is permitted. C. All buildings, vehicles, or other enclosed areas occupied by city staff, owned or leased by the city, or otherwise operated by the city, except in areas which the city administrator may designate as smoking areas. The city administrator may designate a smoking area only if the area involved: 1. Is not regularly open to the public; and 2. Does not require major room or building modifications; and 3. Is not regularly occupied by nonsmokers. In any dispute arising under the smoking area designations made by the city administrator under this chapter, the rights of the nonsmoker shall be given precedence. D.0ithid;any building not open to the sky which is primarily used for or designated for the purposes of exhibiting any motion picture, stage drama, lecture, musical recital or other similar performance whenever open to the public, except smoking which is a part of a stage performance, including all restrooms, and any area commonly referred to as a lobby. E. Within all public areas in every retail store, including, but not limited to, retail service establishments, retail food production and marketing establishments, retail, grocery, and drug stores. F. All restrooms open for public use. G.,Withimevery restaurant and bar. H. All areas in a laundromat open to and available for use by the public. I: Within all areas available to and customarily used by the general public in all businesses and nonprofit entities patronized by the public, including, but not limited to, professional offices and other offices, banks, hotels and motels. J. Notwithstanding any other provision of this section, any owner, operator, manager or other person who controls any establishment or facility described in this section may declare that entire establishment or facility as a nonsmoking establishment. (Ord. 1172 § 1, 1990) X 8.16.040 Regulation of smoking in the workplace. Each employer who operates a workplace in the city shall, within sixty days of the effective date of the ordinance codified in this section, adopt, implement and maintain a written smoking policy which shall contain, at a minimum, the following provisions and requirements: A. Any nonsmoking employee may object to his or her employer about smoke in his or her workplace. Using already available means of ventilation or separation or partition of office space, the employer shall attempt to reach a reasonable accommodation, insofar as possible, between the preferences of nonsmoking employees and smoking employees. However, an employer is not required by this section to make any expenditures or structural changes to accommodate the preferences of nonsmoking or smoking employees. B. If an accommodation which is satisfactory to all affected nonsmoking employees cannot be reached in any given workplace, the preferences of nonsmoking employees shall prevail and the employer shall prohibit smoking in that workplace. Where the employer prohibits smoking in a workplace, the area in which smoking is prohibited shall be clearly marked with signs. C. The smoking policy required by this section shall be announced within three weeks of 86� � Chapter 8.16 SMOKING PROHIBITED IN CERTAIN AREAS* Page 3 of 4 - ATTACHMENT 9 adoption to all employees working in workplaces in the city and posted conspicuously in all workplaces in the city under the employer's jurisdiction. D. This section is not intended to regulate smoking in the following places and under the following conditions within the city: 1. A private home which may serve as a workplace; 2. Any property owned or leased by a state or federal governmental agency. E. Notwithstanding any other provision of this section, every employer shall have the right to designate any place of employment, or any portion thereof, as a nonsmoking area. F. Notwithstanding any other provision of this section, if any provision of this section conflicts with, or differs from, the standards established by Labor Code Section 6404.5, as it may from time to time be amended, then the most restrictive standard, whether from this section or Labor Code Section 6404.5, shall apply. It is the intent of the council that this section be interpreted and applied in such a manner as to prohibit the smoking of tobacco products in all enclosed places of employment to the fullest extent permissible by law. (Ord. 1274 § 1, 1994; Ord. 1172 § 1, 1990) 8.16.050 Posting of signs. Signs which designate smoking or nonsmoking areas established by this chapter shall be conspicuously posted in every room, building or other place so covered by this chapter. The manner of such posting shall be at the discretion of the owner, operator, manager or other person having control of such room, building or other place so long as clarity, sufficiency and conspicuousness are apparent in communicating the intent of this chapter. (Ord. 1172 § 1, 1990) 8.16.060 Compliance. A. The city administrative officer or his or her designated representative shall be responsible for compliance with this chapter as to facilities which are owned, operated or leased by the city. The finance director shall provide each business license applicant with a copy of this chapter. B. The owner, operator or manager of any facility, business or agency within the purview of this chapter shall comply with the provisions of this chapter. Notice of these regulations shall be given to all applicants for a business license. Such owner, operator or manager shall post or cause to be posted all no-smoking signs required by this chapter and shall not allow service to any person who violates this chapter by smoking in a posted no-smoking area. C. Any place of employment conducted or operated without compliance with the provisions of Section 8.16.040 of this chapter applicable thereto shall be and the same is declared to be a public nuisance. Whenever there is reason to believe such public nuisance exists, any affected employee or any resident of the city, in his or her own name, may maintain an action in equity to abate and prevent such nuisance and to perpetually enjoin the employer from maintaining or permitting it. Upon the granting of equitable relief, in whole or in part, by a court of competent jurisdiction, an employer determined to be in violation of Section 8.16.040 of this chapter shall be liable for the attorney's fees, as may be determined by the court, incurred by the party bringing the action. D. The city administrative officer or his or her designee may enforce Section 8_16.040 of this chapter by either of the following actions: 1.Serving notice requiring the correction of any violation of that section; or 2. Requesting the city attorney to maintain an action for injunction to enforce the provisions of Section 8.16.040 of this chapter, to cause the correction of any such violation, and for assessment and recovery of a civil penalty of such violation, including attorney's fees. E. Any employer who violates Section 8.16.040 of this chapter may be liable for a civil penalty, not to exceed five hundred dollars, which penalty shall be assessed and recovered in a civil action brought in the name of the people of the city. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such. Any penalty assessed and recovered in an action brought pursuant to this subsection shall be paid to the finance director of the city. Chapter 8.16 SMOKING PROHIBITED IN CERTAIN AREAS* - ATTACHMENT 1 Page 4 of 4 F. In undertaking the enforcement of Section 8.16.040 of this chapter, the city is assuming an undertaking only to promote the general welfare. It is not assuming any duty or obligation, nor is it imposing any duty or obligation on its officers and employees, nor is it liable in money damages or otherwise to any person who claims that(1)the city or one of its officers or employees breached any such obligation, and (2)the breach proximately caused injury. (Ord. 1172 § 1, 1990) 8.16.070 Violation—Penalty. Any person who violates any provision of Section 8.16.030 or 8.16.040 of this chapter by smoking in a posted no-smoking area, or by failing to post or cause to be posted a no smoking sign required by this chapter, or by serving or accommodating any person who violates this chapter by smoking in a posted no-smoking area, or by knowingly or intentionally permitting any person to violate this chapter by smoking in a posted no-smoking area, is guilty of an infraction, and is subject to punishment as provided for in Chapter 1.12 of this code. (Ord. 1274 § 2, 1994; Ord. 1172 § 1, 1990) 8.16.080 Where smoking not regulated. . Notwithstanding any other provision of this chapter to the contrary, the following areas shall not be subject to the smoking restrictions of this chapter: 1. Private residences, except when used as a child care or health care facility. 2. Hotel and motel rooms rented to guests. 3. Retail tobacco stores. 4. A private enclosed office workplace occupied exclusively by smokers, even though such an office workplace may be visited by nonsmokers. 5. Any area exterior to the building in which the establishment or facility is located. 6. Any enclosed rooms in an establishment or facility which are being used entirely for private functions. (Ord. 1172 § 1, 1990) 8.16.090 Severability. If any provision, clause, sentence or paragraph of this chapter or the application thereof to any person or circumstances shall be held invalid, such invalidity shall not affect the other provisions of this chapter which can be given effect without the invalid provision or application, and to this end the provisions of this chapter are declared to be severable. Amendment to Municipal Code Chapter 8.16 — Smoking Prohibited in Certain Areas — Elke Principal Administrative Analyst Brigitte Elke gave a PowerPoint presentation to Commissioners outlining the background of the smoking prohibition request and the dangers of secondhand smoke. Staff and Council members recently received numerous complaints regarding smoking or secondhand smoke mainly in outside areas downtown. Council directed staff to review the current city ordinance on smoking and return with recommendation for possible amendments. Chapter 8.16 of the City's Municipal Code currently regulates smoking in the City of San Luis Obispo. The regulation is based on current state law and prohibits smoking in certain public places. It regulates workplaces,health care facilities, government buildings, entertainment places, and food- related indoor spaces. However, it does not regulate the City's outdoor recreational areas, sport facilities or Open Space. Allowing smoking in outdoor areas does not correlate with the mission of Parks and Recreation. Disposal of cigarette butts and other materials associated with smoking and tobacco products creates unsightly conditions and possible hazards to children, animals and the riparian corridor and its creek aquatic life. Significant time is spent cleaning smoking and tobacco related waste. Aside from second-hand smoke and waste related issues, there is also the concern for possible fire in the City's Open Space areas. Given complaints, community readiness, and the City's mission for its parks and recreational areas, staff recommends prohibiting smoking in all City outdoor recreation areas. This would include City parks, dedicated Open Space; sport facilities,hiking and biking trails, the City's golf course,aquatic facilities, and skate and dog parks. Staff also recommends including Mission Plaza and the creek walkway in this definition since it is the most frequented City outdoor area with a multitude of events and gatherings happening all year round. Pismo Beach,Arroyo Grande and Atascadero have already passed similar ordinances. (A letter from the Director of the City of Arroyo Grande was distributed to Commissioners as well as two other letters of comment from the public). Principal Administrative Analyst Elke informed Commissioners that if the motion is passed,the next step will be community outreach and education,new strongly-worded signage and enforcement. Chair Lemieux opened the floor to Public Comment. Dr. Steve Hansen, Tobacco Control Program, County of San Luis Obispo. Supports smoking ban. Stated the Surgeon General indicates there is no safe level of drifting tobacco smoke. Explained physical effects of nitrous oxide in smoke,particularly in those with heart conditions. Informed that smokers are not considered a special class by the court systems, discussed taxes (Prop 99), and pointed out much of the tobacco product (such as the filter) does not degrade for decades. Stated California has already banned smoking in bars (1998), prisons and mental health facilities (2005) without large public complaint and that, in that time, two new drugs have been developed to help smokers to quit. These allergic reactions require I decrease my level of physical activity, increase my asthma medication and at times, I have to start a medical regimen of prednisone. In 1990 the City of SLO made a historic move to protect the health of its citizens by prohibiting smoking in most public places, including bars and restaurants, making it the first in the world to do so. Since then other cities, counties, states and countries have followed its example. Now, close to 20 years later, many cities have gone on to bypass our example. The community of SLO has a unique opportunity to be a leader once again in protecting its community against the harmful effects of secondhand smoke outdoors and decrease the impact of tobacco litter on the environment. As a downtown worker and resident, I have frequent negative encounters with secondhand smoke at public events and locations. Particularly, at Farmer's Market, Concert in the Plaza, and outdoor dining areas like Black Sheep or Novo. Black Sheep allows smoking at tables on the patio,where food is also served, and the Novo dining area is adjacent to a bar patio where smoking is allowed. Consequently, I avoid many downtown areas and events, as the exposure to second hand smoke is annoying and harmful. Accordingly, the City enjoys less tax revenue as a result. A simple walk down downtown is often degraded by groups of smokers in front of establishments (Bulls Tavern, Frog and Peach), or simply by a fellow pedestrian in front.....smoking. Among the many reasons to support a comprehensive ban on tobacco products, I am concerned about the issue of social norms regarding youth and smoking. -Every day in America,4,000 children will begin smoking. In fact, 90% of all adult smokers started while in their teens or earlier, and two thirds become daily smokers before they're 19 years. -In our county, I I% adults smoke, 19% of I Ith graders smoke. -There is significant research that shows that adult smoking behavior greatly influences youth smoking behavior. -When young people see adults smoking and chewing tobacco in family areas, like our parks and playgrounds (such as Mitchell Park), our downtown, and events (such as Farmer's Market and Mission Plaza celebrations), the message is sent that the use of tobacco products is an acceptable and popular practice. -Research repeatedly finds that an overwhelming number of smokers wish that they did not smoke, and it is easier to prevent people from starting to smoke than to quit the addiction. -Bans can reduce youth tobacco use by up to 40% In light of these findings, it is incumbent upon us as community health advocates to change social norms so that our children do not recognize tobacco use as an acceptable behavior. Tobacco-use outdoors in places such as parks, recreational areas, Mission Plaza, the creek walkway, outdoor dining, bus stops, service areas, sidewalks, worksites and public events, like Farmer's Market, is a major public health problem. As a resident of San Luis Obispo County, who works in the City of San Luis Obispo I have stopped frequenting restaurants and businesses in downtown San Luis Obispo due to the amount of second hand smoke encountered in virtually every public outdoor place in the City. I have even stopped visiting Mitchell Park and Mission Plaza on my breaks because of the smoke. I am allergic to cigarette smoke, which causes me to have sinus congestion, headaches and respiratory difficulties. I cannot even walk into my place of employment with out walking through plumes of smoke. In 1990 the City of SLO made a historic move to protect the health of its citizens by prohibiting smoking in most public places, including bars and restaurants, making it the first in the world to do so. Since then other cities, counties, states and countries have followed its example. Now, close to 20 years later, many cities have gone on to bypass our example. The community of SLO has a unique opportunity to be a leader once again in protecting its community against the harmful effects of secondhand smoke outdoors and decrease the impact of tobacco litter on the environment: If passed a strong tobacco-free outdoor areas and events policy will send a clear message that we care about the health of our residents, and visitors, and ensure that our city with its many natural attractions, remain wonderful places that all in our community can enjoy for generations to come. In Good Health, Deborah McNeil Amorteguy, DDS SLO C.71Y CLERK November 25, 2009 San Luis Obispo City Council 990 Palm San Luis Obispo, CA 93401 Dear City Council, At its November 12, 2008 meeting the Arroyo Grande Parks and Recreation Commission unanimously recommended the City Council introduce an Ordinance amending the City of Arroyo Grande Municipal Code to ban smoking at City parks, athletic facilities, paths, trails and open spaces. The Commission believes that banning smoking may encourage healthier lifestyles, reduce litter, reduce staff time cleaning up after smokers, and reduce fire hazard. At its January 13;2009 meeting the City Council unanimously approved adoption of the amended Ordinance and expanded the ban to include pedestrian bridges to include the swinging bridge. It is well documented that cigarette, cigar and pipe smoking, and the associated second-hand smoke, are detrimental to human health. Statistics provided by the San Luis Obispo County Public Health Department's Tobacco Control Program indicate that 40,000 Californians die each year from smoking related diseases, including heart disease and lung cancer. In California, 400 lung cancer deaths are attributed to second hand smoke annually. In Arroyo Grande the disposal of cigarette butts and other materials associated with smoking in City parks, on ball fields, and other locations, lead to unsightly and unsanitary conditions and possible hazards to young children, animals, aquatic life and birds. Significant staff time was spent cleaning cigarette butts from group picnic areas, ball field dugouts and other City recreation areas. In addition to the hazards of second hand smoke and time spent cleaning cigarette litter, staff and the Commission were concerned about the possibility of fire in open space areas, such as the James Way Oak Habitat. As Director Recreation and Maintenance Services I am grateful and proud that the City of Arroyo Grande's City Council and its Parks and Recreation Commission voted unanimously to ban smoking at City Parks, athletic facilities, paths, trails and open spaces. I hope the ban will lead to a healthier constituency and reduce staff time spent cleaning up after smokers. The outdoors should be a place where all people are free to go,whether they bathe or not and whether they smoke or not. If I am at Santa Rosa Park and someone's odor or actions offend me,I move. I don't make them move. However,in today's political and social climate I don't see inaction on this item as being an option for the Council. Instead I make the following requests and recommendations regarding the proposed sections 8.16.020 and 8.16.035. 1. Section 8.16.020. Omit public plazas and open space. Discussion follows. 2. Section 8.16.035. a. In paragraphs A, B and E,omit all references to parking areas,sidewalks and bus stops. Each of these items was added to the language of the ordinance without having been discussed,or even mentioned,in the body of the Staff Report. Discussion follows. b. Omit paragraph B and renumber subsequent paragraphs. Leave in place the current procedures found in the California Fre Code. I know of three fires that occurred in the last few years. Two were caused by power lines and one was caused by equipment striking a rock. Although brush fires canbestarted by cigarettes,I know of none in this area that were. c. Omit Mission Plaza from paragraph F. Mission Plaza has several nice places to sit,relax and absorb the beauty and serenity of the area when there is no function occurring and few people are around. Also;this is one of the few places where sufficient receptacles are present in which to put those pesky cigarette butts. (I wish the creek walk could be omitted,also,but that would entail placement of trash receptacles at various locations along both sides of the creek,and I doubt this would be funded.) It seems incongruous and even discriminatory to disallow smoking in parking areas--where vehicles start,idle and drive,all the while generating exhaust gasses and fumes. Since the Staff Report does mention the toxicity of fumes from vehicles,the prohibition against smoking in parking areas seems punitive and more about social engineering than about health. The same can be said with regard to sidewalks and bus stops. The Staff Report states that 87 percent of the population of the county are non-smokers;thus, 13 percent are smokers. Using these percentages to gauge non-smokers and smokers within the city,I estimate there are in excess of 38,000 non-smokers and approximately 5700 smokers. Parents concerned with teaching their children not to smoke should concentrate on the 38,000"good"role models in lieu of the 5700"bad"ones. Although we as a nation talk about the benefits of diversity,we seem to want cookie-cutter people who may look different,but make life choices with which the majority concurs. Tobacco litter, which is the most littered item in the world, is not only unsightly, but toxic to our environment. - Cigarette butts do not readily decompose, but take as much as 25 years to decompose. -Tobacco products leach toxic chemicals, like cadmium, lead, and arsenic, into our San Luis Creek and storm drains, and eventually to our beaches and watershed. - Alarming research has found that when a single cigarette butt is left in a gallon of freshwater, 80% of the aquatic life is killed within one day! The species that died were small but important creatures in the marine food chain. The residual from smokeless tobacco products contains similar harmful chemicals. - Cigarette filters have been found in the stomachs of fish, birds, and other animals. Among the animals of concern in our community is the steelhead trout, an endangered and federally protected species. Furthermore, the health of our environment often translates to the health of our community. - Second hand smoke is a pollutant, to our environment and our bodies. -The California Air Resources Board places environmental tobacco smoke in the same .category as asbestos and car exhaust. - Levels of air pollution due to second hand smoke can be as concentrated outdoors as indoors. Unless there is some sort of ban on the use of tobacco products in our outdoor areas, community members and tourists seeking"fresh air" cannot avoid with certainty this harmful pollutant. It is my hope that you will consider a ban on tobacco products in parts of our city where the health of others is at risk, a ban that would include city parks, events, Mission Plaza, the Creek Walk, and possibly our downtown core area. Because of the many problems of people smoking directly in front of stores (employees as well as visitors and many homeless) I avoid SLO downtown as much as possible. I do have a heart condition, so want to protect myself. Smokers don't seem to care about anyone else but their own desires. Even when I remember to carry a fan or hold my breath, I suffer from the second-hand smoke. A few years ago I even canceled my PO Box at the downtown PO because of those discourteous smokers. What about the effect of secondhand smoke on your children when smoking relatives come to visit? These instances of secondhand smoke present health hazards comparable to smoking. High in toxic chemicals, secondhand smoke plays a role in causing or contributing to a . number of health problems, from cardiovascular disease to cancer. The Surgeon General reported in 2006 that scientific evidence shows there is no safe level of exposure to secondhand smoke. But secondhand smoke is often avoidable. Take steps to protect yourself and those you care about from secondhand smoke. Toxins in secondhand smoke What exactly is secondhand smoke? It's two different forms of smoke from cigarettes, pipes or cigars: • Sidestream smoke comes directly from the burning tobacco product. • Mainstream smoke is smoke that the smoker exhales. Secondhand smoke is also known as environmental tobacco smoke, passive smoking, involuntary smoking and perhaps a more descriptive term, tobacco smoke pollution. Regardless of what you call it, both types of secondhand smoke contain harmful chemicals — and a lot of them. Tobacco smoke contains more than 4,000 chemical compounds, more than 250 of which are toxic. And more than 50 of the chemicals in cigarette smoke are known or suspected to cause cancer. Included in secondhand smoke are: • Formaldehyde • Arsenic • Cadmium • Benzene • Polonium Here are a few more chemicals in secondhand smoke that might sound familiar, along with their effects on health: •Ammonia — irritates your lungs • Carbon monoxide — reduces oxygen in your blood • Methanol — toxic when inhaled or swallowed • Hydrogen cyanide — a potent poison that interferes with respiratory function The dangerous particles in secondhand smoke can linger in the air for hours. Breathing them even for a short time — as little as 20 or 30 minutes — can harm you in a variety of ways. And breathing in secondhand smoke over years can be all the more dangerous. Health threats to adults from secondhand smoke Health experts have recognized the relationship between secondhand smoke and health risks for decades. Research exploring these connections continues. Experts believe that secondhand smoke is to blame for about 3,400 deaths from lung cancer in adult nonsmokers each year in the United States. Secondhand smoke is also linked to cancer of the nasal sinuses. Heart disease Secondhand smoke harms the cardiovascular system of nonsmokers in many ways. For one thing, it causes heart disease, such as a heart attack. It also damages blood vessels, interferes with circulation and increases the risk of blood clots. It's estimated that some 35,000 nonsmokers die of secondhand smoke-related heart disease in the United States every year. Lung disease Chronic lung ailments, such as bronchitis and asthma, have been associated with secondhand smoke. Exposure to secondhand smoke is also associated with chest tightness at night and feelings of breathlessness after physical activity. Health threats to children from secondhand smoke Secondhand smoke has a marked effect on the health of infants and children. They're more vulnerable than adults are because they're still developing physically and generally have higher breathing rates, which means they may inhale greater quantities of secondhand smoke than adults do. For children who live in households where someone smokes, the effects are worst during the child's first five years, since the child may spend the bulk of that time with a smoking parent or guardian. Ironically, infants are at the highest risk of secondhand smoke from their own mothers. A child who spends just one hour in a very smoky room is inhaling as many dangerous chemicals as if he or she smoked 10 or more cigarettes. And even when parents don't smoke at home or in the car, there can still be negative effects when children are exposed to the tobacco smoke pollution released from the clothing and hair of smoking parents. Here's a look at some of the main health problems in infants and children associated with secondhand smoke. Growth and development Women who are exposed to secondhand smoke during pregnancy are at higher risk of having babies of slightly lower birth weight. This can cause a host of health problems for the baby, such as cerebral palsy or learning disabilities. Women who actively smoke during pregnancy expose their developing baby to passive smoke — the chemicals may pass through the placenta — and put the baby at risk of lower birth weight. An infant who was exposed to secondhand smoke as a developing fetus may be at increased risk of sudden infant death syndrome (SIDS). Post-birth exposure to secondhand smoke from the mother, father or others in the household also increases the risk of SIDS. Asthma and other respiratory problems Secondhand smoke may cause asthma in children. In children who already have asthma, secondhand smoke can make episodes more frequent and more severe. Page 2 . Middle ear conditions Children living in households with smokers are more likely to develop middle ear infections (otitis media). Other health problems related to secondhand smoke For both adults and children, secondhand smoke is linked to a variety of other health problems, including: • Chronic coughing, phlegm and wheezing • Eye and nose irritation • Reduced lung function • Irritability • Dental cavities How to avoid secondhand smoke Limiting exposure to secondhand smoke takes planning. Here are some ways you can reduce or eliminate secondhand smoke in your life. • Don't allow smoking in your home. If family members or guests want to smoke, ask them to step outside. Don't rely on an air conditioner or an open window to clear the air. Running the air conditioner may remove the visible smoke, but it doesn't remove the dangerous particles from circulation. An open window doesn't provide adequate ventilation, either. • Insist that smoking restrictions be enforced in your workplace. The Environmental Protection Agency (EPA) has classified secondhand smoke as a Group A carcinogen, which means it's known to cause cancer in humans. The only way to fully protect nonsmokers from exposure to secondhand smoke is to prevent all smoking in the building. Even powerful ventilation fans don't effectively remove secondhand smoke from the work environment. • Choose smoke-free care facilities. If you take your children to a child care provider, choose one with a no-smoking policy. The same goes for aging relatives. If they live in a long term care facility, make sure it's smoke-free. • Don't allow smoking in your vehicle. If someone must smoke on the road, stop at a rest stop for a smoke break outside the car. • Patronize businesses with no-smoking policies and tell the management that you appreciate the healthy air. Many restaurants and other establishments are entirely smoke-free. • When you absolutely must share a room with people who are smoking, sit as far away from them as possible.. • If your spouse or partner smokes, have him or her refrain from smoking indoors, just as you would with houseguests. I would like to expand it a bit, however. I understand why the Downtown Association and SLO Chamber do not wish to include the whole Downtown as a smoking prohibition area. However, over the years I have heard many business owners complain about smoking right outside their entrances. I propose that we empower business owners to control whether or not smoking is allowed within 20 feet of their doors, by posting a city approved sign to that effect if they so choose. This could be accomplished, I think,by making changes to the present ordinance in two places. (Changes in bold) 8.16.030 (J) Notwithstanding any other provision of this section, any owner, operator,manager or other person who controls any establishment or facility described in this section may declare that entire establishment or facility and/or twenty(20) feet from the entrance thereto as a nonsmoking area by posting a city approved sign so stating. 8.16.080 (5) Any area exterior to the building in which the establishment or facility is located, unless the management of said establishment or facility has posted a city approved sign as provided in section 8.16.030 (,n herein. These signs should be uniform and attractive, and provided by the city. By requesting a sign, the business would alert the city to its decision. If another business rented the building and did not want to protect its customers from smoking just outside its doors, it could so inform the city. On the other hand, I'm song to dredge all this up again—the many decades of illnesses, jobs I've had to quit because I've gotten very sick with cigarette smoke and the fivstration, anxiety and anger I've been experiencing. My first reaction to smoke about 35 years ago was a very sore throat. It advanced into a post-nasal drip and years later I'd start getting sinusitis requiring antihistamines and anti- biotics. Years later it became bronchitis requiring a lot of medication and I'd lose time from school and work. I became and still become exhausted ending up on the couch with no desire to walk,do any housework,not want to cook or go anywhere. My very patient husband has always pulled up the slack that I've left. Often when I'm like this I cry a lot for unknown reasons. I came to San Luis a couple months ago to look for a new bathing suit. The store that I was trying them on in was on Higuera St. As I was in the dressing room I got assaulted by cigarette smoke that was apparently coming in the back door. I got dressed quickly(I did buy the suit)but the damage was already done. I did develop the post nasal drip and a lot of chest pain and since I was ah-eady being seen by a chest doctor,I had an inhaler to help a little but I was on the couch for a couple of weeks. When I fust came back to this area 20 years ago,this town was a sparkling jewel. If I saw 5 people smoking in the whole area of Arroyo Grande, Pismo and SLO for a whole day that was a lot. The sidewalks were clean,the town was bright and the stores were great. For along time now,the sidewalks m and I ha a walk O t to sta out o oke jaywalk, have to walk the other way around the block to eet out of smoke,hold my breath aid way and mantimes don't bother oin into a store at . started staying away from Rudolph s coffee shop many years ago because people would sit right outside the door smoking with the door open and I couldn't take it. I had a recent similar experience with another coffee shop here on Higuera that recently closed. Farmer's market used to be my big night out. I'd brag about this town to everyone but that is history. I don't come to farmer's market anymore or even shop Barnes&Noble. The area outside B&N is usually populated by smokers and it's just not worth it. I don't walk mission plaza or the creek area I feel really sad about this. I still have a lot of anxiety--whenever I go out anywhere I have to watch what other people are doing. If they are smoking I have to `get out' or get away. My husband also has to `watch' out for me. Many times people walk with their ciggies cupped in their hand and bring them up to smoke and blow it in my face and I am unprepared. What I end up with is chest pain and chest involvement and more time on the couch. I've been a Registered Nurse for 43 years taking care of babies,kids and all ages of adults. One of the first really bad experiences I had as a nurse came when I was working the night shift in NJ about 33 years ago. It was a small nursing home and they let the patients smoke. One night I was walking down the hallway with an old stand-up metal BP machine and I realized that I was dizzy and walking crooked; I'd already had the sore throat so I knew why I was reacting that way. I had to quit that job! That was one of the first jobs I quit because of second-hand smoke. I worked at the State Hospital in Atascadero twice—once as a nurse and the second-time as a patient's rights advocate. I had to quit both times because I got very ill from the smoke. Just a couple more things. 16 years ago it took several anti-biotics to help me get rid of the bronchitis from a smoke reaction and I got severe GI problems that still affect me now. Having tried to help other people with their illnesses for so long, I feel really down that my health is given little or no consideration by many people,businesses and towns. People sit or stand outside supermarket doors and smoke and I have to run in and hold my breath. There area lot of people smoking in this area now. There are still a great majority of people in this state that don't smoke and don't want to have to breathe it. I've been testifying against the effects of second-hand smoke for 30 years now. The first time was at the NJ State Health Dept. in Trenton. As I left the room I had to go down the escalator behind a cigar smoker. I've testified also in many towns in this area;I believe I've testified in San Luis before and also in Grover City before it became Grover Beach, Morro Bay and Atascadero where they have recently posted NO SMOKING signs in the park. Many other areas in the nation are banning outdoor smoking and many areas are considering it. Please make some wise decisions. Please help us all. I especially enjoy shopping downtown,just walking in and out of the shops. On recent visits, I have noticed many people outside these shops smoking, which needless-to-say,bothers me. Statistics show that there are no safe levels to exposure to second-hand smoke. Even outside, I can still smell the side smoke from the smokers. And,the sidewalks are littered with cigarette butts! I would like to continue to visit and shop in downtown SLO especially to help out the "mom's&pop's"which own small businesses. However,I know that the chain stores have smoke-free environments, and I may end up going there instead of downtown. And I have head that there are proposals in front of the City Council to look at banning smoking outside of businesses. We also support-no, implore you to ban smoking in outside eating areas. In the downtown creek area alone there are 5 to 6 restaurants and/or bars with seating areas abutting the walkways next to the creek.The tobacco stench is overwhelming.As in the otherareas,the smoke is a toxic health hazard. Businesses have reportedly complained that banning smoking downtown will add to the effects of the current recession. We doubt this. There are many like ourselves who do 1195 patronize restaurants with outside smoking and eating areas.We'd definitely be customers rather than"avoiders"if the air were healthy and fresh. We encourage the Council to take a walk down the 600,700,800 and 900 blocks of Higuera Street,the heart of our downtown. Inhale the smoke that is present. Do you encounter shoppers on the sidewalk benches,or people who appear to be passing through?Walk by the bar on Chorro between Higuera and Monterey to enhance your tour.You may have to excuse yourself to get through the group of smokers.Then go to Mission Plaza and walk by the eating and drinking establishments that are next to the creek.
