CASH — 30 MINUTES) PUBLIC COMMENT PERIOD FOR ITEMS NOT ON THE AGENDA(not to exceed 15 minutes total) The Council welcomes your input. You may address the Council by completing a speaker slip and giving it to the City Clerk prior to the meeting. At this time,you may address the Council on items that are not on the agenda or items on the consent.Agenda. Time limit is three minutes. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code Sec. 54954.2). Staff may be asked to follow up on such items. Staff reports and other written documentation relating to each item referred to on this agenda are on file in the City Clerk's Office in Room 4 of City Hall. CONSENT AGENDA The Consent Agenda is approved on one motion. Council Members may pull consent items to be considered after Business items. Y Council Agenda Tuesday, February 2, 2010 C1. MINUTES. (STANWYCK/CANO) RECOMMENDATION: Waive oral reading and approve as presented. C2. CHAPTER 5.5 OF THE MUNICIPAL CODE RELATING TO SIDEWALK CAFES (TA 52-08 . (MAN DEVILLE/DUNSMORE) RECOMMENDATION: Adopt Ordinance No. 1539 (2010 Series) amending section 5.5 of the San Luis Obispo Municipal Code. C3. MUNICIPAL CODE CHAPTER 9.12—NOISE REGULATIONS. (LINDEN) RECOMMENDATION: Adopt Ordinance No. 1540 (201.0 Series) amending section 9.12.110 of the San Luis Obispo Municipal Code (Residential Noise Regulations). C4. PARK MAINTENANCE AND OUTDOOR DINING AGREEMENT WITH VILLAGE HOST PIZZA AND GRILL, SLO, LLC. (KISER/FITZGERALD) RECOMMENDATION: Approve an agreement with Village Host Pizza and Grill, SLO, LLC for park maintenance and outdoor dining on City-owned property, located at 2163 Santa Barbara Street. C5. STATE ENERGY PROGRAM.GRANT FOR ENERGY EFFICIENCIES. (STATLER/MALICOAT) RECOMMENDATION: Adopt a resolution authorizing Sacramento County, as the lead collaborative entity, to apply for funds on behalf of the City of San Luis Obispo for energy efficiency and conservation activities. C6. 2009-11 COST ALLOCATION PLAN. (STATLER/MCANDREW) RECOMMENDATION: Approve the 2009-11 Cost Allocation Plan. C7. LOCAL TAXPAYER, PUBLIC SAFETY AND TRANSPORTATION PROTECTION ACT OF 2010. (DIETRICK) RECOMMENDATION: Adopt a resolution supporting the League of California Cities' sponsored Local Taxpayer, Public Safety and Transportation Protection Act of 2010. C8. STATEWIDE PARK DEVELOPMENT AND COMMUNITY REVITALIZATION PROGRAM OF 2008 (PROP 84). (KISER/FITZGERALD) RECOMMENDATION: Adopt a resolution to approve the City's application to the Statewide Park Development and Community Revitalization Grant Program (Prop 84) for the Santa Rosa Park Skate Park. 2 Council Agenda Tuesday, February 2, 2010 PUBLIC HEARING 1. RIPARIAN HABITAT AND WATER QUALITY IN SAN LUIS OBISPO. (STANWYCK/HAVLIK/OTTE — 30 MINUTES) RECOMMENDATION: Introduce an ordinance establishing rules governing the use of creek, creekside, and riparian areas with the City of San Luis Obispo, for the purpose of protecting riparian habitat and water quality. BUSINESS ITEM 2. FEE REVISION FOR PLANTING TREES IN THE COMMEMORATIVE GROVE. (WALTER/PELLEMEIER— 30 MINUTES) RECOMMENDATION: Adopt a resolution revising the current fee for planting a Commemorative tree at the Laguna Lake Commemorative Tree Grove from $2,080 to $410. STUDY SESSION 3. AIRPORT AREA WASTEWATER MASTER PLAN UPDATE. RECOMMENDATION: Receive and file the Airport Area Wastewater Master Plan Update and consider specific projects as they come forward in future financial plans. COUNCIL LIAISON REPORTS (not to exceed 1.5 minutes) Council Members report on conferences or other City activities. Time limit-3 minutes. COMMUNICATIONS (not to exceed 15 minutes) At this time, any Council Member or the City Manager may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council Policies and Procedures, they may provide a reference to staff or other resources for factual information, request staff to report back to the Council at a subsequent meeting concerning any matter, or take action to direct staff to place a matter of business on a future agenda.
