SUBJECT: 2010-11 DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL
GRANT APPLICATION
RECOMMENDATION
1. Authorize staff to submit a grant application to the California Department of Alcoholic
Beverage Control for FY 2010-11 not to exceed$50,000.
2. If a grant is awarded, authorize the City Manager to execute the necessary grant documents.
3. Adopt a resolution authorizing the City Manager to enter into a contract with the State if
awarded funding.
DISCUSSION
In prior years, the Police Department has been awarded grant funds from the California Department
of Alcoholic Beverage Control (ABC)to conduct education and compliance activities related to
businesses that hold alcohol licenses. On January 7`s, 2010, staff received notification that the ABC
had opened its FY 2010-11 grant solicitation to local governments. ABC will award grants of up to
$100,000 to local law enforcement agencies effective July 1, 2010 for a twelve-month period. The
purpose of the grant funding is to enable agencies to expand their present efforts in addressing
alcohol related problems through a comprehensive ABC program that encompasses various
strategies.
The goals of the ABC grant program include:
1. Achieving the goals and objectives of the local enforcement agency's grant agreements.
2. Establishing a close working relationship between ABC district offices and the grant
agencies.
3. Prioritizing law enforcement efforts and targeting those licensed outlets that cause alcohol-
related crimes.
4. Developing records management systems to ensure police reports are systematically sent to
the ABC district offices as required by law.
5. Assisting in the training of local law enforcement.
In keeping with prior Council_direction to reduce alcohol-related crime, staff is seeking
authorization to submit a grant application that focuses efforts on reducing underage access and
consumption of alcohol and taking enforcement action against individuals and businesses that

provide alcohol to minors. Grant activities,if approved, would include:
1. Off-Sale Surveillance/Minor Decoy Operations: During the 12-month grant period,
licensed off-sale establishments will be randomly checked for compliance of lawful
sales through the use of undercover"decoys."
2. Shoulder Tap Operations: Officers will conduct enforcement activities focused on the
purchase of alcohol by adults for underage minors.
3. Trap Door Operations: Undercover officers, with cooperation from licensed
establishments, will pose as employees in order to intercept minors who attempt to
gain access with fake ID's.
4. IMPACT Education Activities: Officers will conduct prevention and education
programs for employees of on-sale licensed establishments that tend to generate the
most alcohol- related police responses.
The City's application will seek funding for overtime for existing officers to conduct the grant-
related activities; staff is not seeking to add any new positions through this grant. The grant
application requires the Council adopt a resolution memorializing its action and authorizing the
City Manager to execute the appropriate contract and other grant-related documents. The State
requires that the grant funding be used for activities above and beyond those currently funded
through the City budget. Supplanting general fund allocations with grant funds is strictly
prohibited.
FISCAL IMPACT
There is no impact to the City's general fund associated. with this action. City matching funds are
not required by this grant and all grant-related activities will be conducted using existing officers on
overtime. Grant management and accounting will be done by existing staff in the Police and
Finance/TT Departments. Department staff is working to calculate exact costs associated with the
objectives of the grant; however, the requested funds will not exceed$50,000.
ALTERNATIVES
Council may direct staff to not submit an application for ABC grant funding. Staff does not
recommend this alternative as the funding will enhance the Police Department's efforts in
addressing alcohol-related problems and reducing underage and high-risk drinking.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO TO
INCREASE EDUCATION AND ENFORCEMENT PROGRAMS FOCUSING ON
REGULATING RETAIL ALCOHOL OUTLETS WITH GRANT FUNDING PROVIDED
THROUGH THE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL
WHEREAS, the San Luis Obispo Police Department through the City of San Luis
Obispo desires to undertake programs to increase education and enforcement to focus on
regulating retail alcohol outlets in the community; and
WHEREAS, grant funds are available through the Grant Assistance Program (GAP)
administered by the Department of Alcoholic Beverage Control (ABC).
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo that the City Manager of the City of San Luis Obispo is authorized to execute all grant
related documents including the State of California Standard Agreement contract, any extensions
or amendments thereof, and any subsequent contract with the State in relation thereto.
IT IS AGREED that any liability arising out of the performance of this contract,
including civil court actions for damages, shall be the responsibility of the grant recipient and the
authorizing agency. The State of California and ABC disclaim responsibility for any such
liability.
BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to
supplant expenditures controlled by this body.
IT IS ALSO AGREED that this award is not subject to local hiring freezes.
