SUBJECT: FINAL ACCEPTANCE OF A PORTION OF SUBDIVISION
IMPROVEMENTS (CREEKSTON FRONTAGE, M07-009, 791 ORCUTT)
FOR TRACT 2707—A RESIDENTIAL CONDOMINIUM SUBDIVISION AT
953 ORCUTT ROAD (CITYVIEW LAUREL CREEK, AKA WATT
COMMUNITIES)
RECOMMENDATION
Adopt a resolution accepting the public .improvements for the Creekston frontage portion at
791 Orcutt Road (M07-009) for Tract 2707 and releasing the corresponding sureties.
DISCUSSION
The tentative subdivision map for Tract 2707 (TR 151-03) was approved by City Council on
November 15, 2005, by Resolution No. 9748 (2005 Series), which authorized creation of a 23-lot
subdivision for the purpose of creating 178 residential condominium units. (See Attachment I
for vicinity map.) The final map was approved by City Council on September 18, 2007, by
Resolution No. 9928 (2007 Series).
Mitigation Measure TR/mm-4 in the Four Creeks Environmental Impact Report, of which Tract
2707 is a part of, required widening of Orcutt Road to four lanes from Broad Street to the Union
Pacific Railroad tracks. Most of the widening occurred along the frontage of Tract 2707, but a
portion of it occurred along the frontage of a piece of property to the west referred to as the
Creekston property. (See Attachment 2 for Creekston frontage site plan.). The subdivider of
Tract 2707 entered into a reimbursement agreement approved by Council on October 2, 2007, to
do the widening along the Creekston frontage, and the subdivider has since completed the work.
The public improvements along the Creekston frontage include widening Orcutt Road to four
lanes with curb, gutter, sidewalk and street lights on the south side; installing a raised median
with water service; extending a reclaimed water line and gas line along the frontage; installing a
fire hydrant; and installing improvements for the future development of the Creekston property
including water services, a sewer lateral, and a driveway.
The total estimated cost of the Creekston frontage improvements is $279,721.41, and the City is
holding a faithful performance bond in that amount. The Creekston frontage improvements have
been completed to the satisfaction of the City. Once Council has approved acceptance of the
Creekston frontage improvements, the subdivider will reduce their surety to $28,000, or 10
percent of the estimated construction cost, to guarantee that the subdivider will remedy any

defects in the improvements arising from faulty workmanship or materials or defective
construction of said improvements occurring within 12 months after acceptance of the Creekston
frontage improvements, in accordance with Sections 66499.7 and 66499.9 of the Government
Code of the State of California. The 12-month warranty period shall begin on the date of
Council approval of the resolution accepting the public improvements (Attachment 3).
FISCAL IMPACT
Typical maintenance and operation of public facilities will be required for the improvements within
the public right-of-way.
CONCURRENCES
The Community Development Director and Utilities Director concur with the recommended action.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ACCEPTING THE PUBLIC IMPROVEMENTS FOR THE CREEKSTON FRONTAGE
PORTION AT 791 ORCUTT (M07-009) FOR TRACT 2707
(953 ORCUTT ROAD)
WHEREAS, the City Council made certain findings concerning Tract 2707, as
prescribed in Resolution No. 9748 (2005 Series); and
WHEREAS,the City Council approved the final map for Tract 2707 per
Resolution No. 9928 (2007 Series); and
WHEREAS, the subdivider has satisfactorily completed the portion of public
improvements known as the Creekston frontage (M07-009, 791 Orcutt) for Tract 2707, in
accordance with City standards, specifications, and the subdivision agreement, and has requested
acceptance of the public improvements for maintenance and operation by the City.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The City Council hereby accepts the public improvements known as the
Creekston frontage (M07-009, 791 Orcutt) for Tract 2707.
SECTION 2. The current Faithful Performance surety may be released upon submittal
of a replacement surety guaranteeing the workmanship and materials for a period of 12 months.
SECTION 3. The Labor& Materials surety may be released after 90 days from this date
of acceptance of the improvements in accordance with Section 66499.7(h) of the California
Government Code.
SECTION 4. The surety guaranteeing the workmanship and materials may be released
by the Public Works Director upon the successful completion of the 12 month warranty time
period from this date of acceptance.
