RECOMMENDATION Receive staff presentation on project redesign, Final EIR and Planning Commission recommendation. REPORT-IN-BRIEF In 2006 the City and WestPac entered into a Memorandum of Understanding (MOU) intended to facilitate the development of a significant downtown mixed use project utilizing both private and public property. Consistent with that MOU Garden Street SLO Partners, LP has submitted applications to the City to develop a downtown mixed-use center including retail, residential units and a hotel known as the Garden Street Terraces Project. The project site is located within the City's Downtown Core and Downtown Historic District and consists of six parcels, including . City Parking Lot No. 2,bordered by Broad Street, Garden Alley, Garden Street and Marsh Street. The project has substantially evolved through two complete redesigns since it was originally submitted in August of 2006. The first redesign occurred prior to work commencing on the Draft EIR. The second redesign occurred subsequent to completion of the Draft EIR, and was initiated by the applicant to eliminate the Verizon Parcel (742 Marsh Street) from the project boundary and to respond to impacts and mitigation measures contained in the environmental document. Since revisions to the project occurred after circulation of the Draft EIR, the Final EIR has been updated to reflect the revised project description and address impacts and mitigation measures associated with the revised project. Changes have also occurred to the alternatives section between the Draft and Final EIR versions. Among the alternatives evaluated by the EIR were the Reduced Development Alternative and the Project Without Public Parking Alternative, the former being the environmentally superior alternative and the latter evaluating General Plan consistency and circulation concerns associated with incorporation of publicly operated parking spaces into the project. On February 24, 2010, the Planning Commission unanimously voted to recommend the City Council certify the Final EIR; approve the Reduced Development(environmentally superior) and Project Without Public Parking Spaces alternatives as the required project; approve a use permit to allow a-building height of 74 feet; and approve a vesting tentative tract map for an airspace subdivision (Attachment 2). The project would include all components of the Reduced Development Alternative with the basement parking levels operated solely as a private facility. 5's l - 1 pp�-�� Attachment 9 Council Agenda Report—ER/U/TR 124-06 April 20,2010 Page 2 The Commission recommended several changes to the mitigation measures in the EIR relative to noise, upper floor building setbacks, Bubblegum Alley, parking requirements and energy efficiency. The purpose of this presentation is to inform the Council and community on the project redesign, Final EIR and Planning Commission recommendation. Council will not be taking any formal action on the project. The project is scheduled to return to Council on June 1, 2010 for review and consideration of the Final EIR as well as other project entitlements and the report for that meeting will include a formal staff recommendation. DISCUSSION The discussion below describes and compares the evolvement of the project over three main stages of design: 1) The project as presented in the Draft EIR. 2) The project as redesigned in the Final EIR subsequent to the circulation of the Draft EIR. 3) The project alternatives as recommended by the Planning Commission. Revised Project Description evaluated in Final EIR The proposed project consists of demolition and modification of existing structures on 1.11 acres, and construction of a 212,607 square-foot mixed-use development. The proposed project would include a total of eight levels, including two basement levels and a rooftop pool terrace level. Average building height would generally range from four to five stories (approximately 36 to 51 feet) above ground level, with maximum elevations up to approximately 74 feet at the top of the elevator shaft. Proposed uses include 34 residential units (including two split-level townhomes and three low- income affordable housing units), a 95-room hotel, and 27,589 square feet of ground-floor retail space. Retail space would include a 13,248 square-foot neighborhood market. Retail, hotel, and market space would generally occupy the first floor ground level street frontages along Marsh, Garden, and Broad Streets, with the upper stories comprising a mix of hotel uses and residential condominiums. A two-level subterranean parking garage would be accessed from Marsh Street. The first basement level of the parking garage would consist of 60 City-owned, metered public parking spaces and two handicap-accessible spaces, while the second basement level would contain City-owned spaces leased for hotel/valet and privately-owned spaces for residential users. The project site area includes parking lot#2,which currently has 62 public parking spaces and the closed restroom facility. The development would include pedestrian access between the subterranean public parking garage and the comer of Broad Street and Garden Alley, including an elevator, stairwell, and escalator with the ability to transport shopping carts. A pedestrian walkway would also be provided between Garden Alley and Marsh Street, with a connection through to Garden Street SSS �a Attachment 9 Council Agenda Report—ER/tJfrR 124-06 April 20,2010 Page 3 adjacent to the proposed hotel lobby. Public viewing terraces are proposed on the second and fifth floors with stairwell access from Broad Street and elevator access only from the hotel lobby off Garden Street, respectively. The project would also include improvements to Garden Street, between Higuera and Marsh Streets, which are generally consistent with the City-approved Garden Street Improvement Plan. Garden Alley would also receive paving improvements, urban design features, and traffic control (e.g., bollards). The project would reconfigure private and public parcels and lead to the demolition and modification to both private and public structures and surface parking. The Final EIR Changes from Draft EIR to Final EIR The Final EIR reflects a redesign of the project subsequent to circulation of the Draft EIR. In general, changes reflected in the revised project include an increase in the number of hotel rooms and the amount of commercial development; a reduction in residential development; inclusion of an additional level of subterranean parking; increased retention and partial rehabilitation of historic resources; and use of setback and fagade changes to address visual concerns. In general, the changes to the project description would reduce or avoid a number of impacts, including the project's impacts to Aesthetics and Visual Resources, Cultural Resources, Land Use and Planning Policies and Transportation and Traffic. Significant&Unavoidable Impacts The Final EIR concludes that the proposed project will result in significant and unavoidable Class I environmental impacts to: • Aesthetics and Visual Resources—visual impacts to the character of Garden Street. • Air quality — short and long-term construction emissions of Reactive Organic Gases (ROG) and Nitrogen Oxides (NOx), and operational air pollutant emissions associated with vehicle trips from the project. • Cultural Resources —potential to impact human burials; impacts to the Downtown Historic District; and the demolition and modification of significant historical buildings. • Noise—short-term construction noise. • Cumulative Impacts —relative to Air Quality (long-term operational emissions of ROG and NOx and emissions associated with vehicle trips), Cultural Resources (loss of historic resources in the Downtown Historic District) and Noise (increase in vehicle traffic). P4� -70 Attachment 9 Council Agenda Report—ER/U/TR 124-06 April 20,2010 Page 5 The City would be required to adopt a statement of overriding considerations if it were to accept the project as submitted or the revised project. The EIR also finds that there will be significant impacts that can be mitigated to less than significant in the categories of aesthetics and visual resources, air quality, cultural resources, geologic resources, hazards and hazardous materials, hydrology and water quality, land use and planning policies, noise, energy, transportation and traffic, and utilities and service systems. Table ES-1 at the beginning of the EIR summarizes the project's impacts and mitigation measures. Planning Commission Recommendation On February 24, 2010, a public hearing was held before the Planning Commission (PC) to consider the Final EIR, use permit and vesting tentative tract map for the project. Consistent with the staff recommendation, the Commission unanimously voted to recommend the City Council certify the Final EIR; approve the Reduced Development (environmentally superior) and Project Without Public Parking alternatives as the required project; approve a use permit to allow a building height of 74 feet; and approve a vesting tentative tract map for an airspace subdivision (Attachment 2; PC minutes). Specifically, the project would include all components of the Reduced Development Alternative with the basement parking levels operated solely as a private facility. The Commission recommended several changes to the mitigation measures in the EIR relative to noise, upper floor building setbacks, Bubblegum Alley, parking requirements and energy efficiency. A comparison between the revised project evaluated in the Final EIR and the staff and PC recommended project are summarized below. In general, changes from the "Revised Project (Final EIR)" to the "Staff & PC Recommended Project" include a reduction in the amount of proposed development; avoidance of some of the project's most visually intrusive elements; increase in protection of historic resources; and elimination of public parking. '� Project statistics for the "Staff & PC Recommended Project" are assumptions based on the A`tachmerlt 9 Council Agenda Report—ER/U/tR 124-06 April 20,2010 Page 6 requirements for the recommended combination of alternatives included in the EIR. Accurate project details will not be available until the applicant submits a redesign. As is true for the overall project, accurate project details regarding construction above the historic structures will be available when the applicant submits a final design for the project. Reduced Development Alternative The Reduced Development Alternative is considered to be the environmentally superior alternative since impacts would be reduced for most issue areas, including significant unavoidable long-term impacts to historic resources (e.g., loss of historic structures). In addition, all project objectives would be met. This alternative would reduce the amount of proposed development, avoid some of the project's most visually intrusive elements, increase protection of historic resources, and better maintain the existing historic and aesthetic character of Garden Street. Specifically, this alternative would require all historic structures be rehabilitated in conformance with the Secretary of the Interior's Standards for Treatment of Historic Properties and provide for 15-foot building setbacks above the 2nd floor level for the Broad and Marsh Street facades. It should be noted that the EIR discusses the potential to construct an additional floor level above the historic buildings in accordance with the Secretary Standards for rehabilitation. This may not be financially or structurally feasible, or consistent with the rehabilitation standards given the condition, size and dimensions of the project's historic buildings. Project Without Public.Parking Spaces Alternative The recommended alternative would eliminate the designation of 62 parking spaces on-site as public parking. Parking demand generated by private uses under this alternative would be accommodated within the subterranean parking structure. The public parking spaces were initially proposed to be within the new building at grade with Marsh Street; however the revised project (studied as part of the EIR) proposed to construct these spaces in the first basement level of the underground parking structure with access coming from a long speed ramp located at the rear of the new building. The recommended alternative does not include any change to the project's proposed 85 private parking spaces in the second basement level for hotel valet and residential uses but does allow flexibility to the project to better meet its private parking demand on site. The original project as envisioned by the MOU between the City and the developer was predicted on a project that maintained public parking on the site. As the project has proceeded through the environmental review process a more comprehensive picture of policy consistency and operational impacts has emerged and is discussed in the EIR. The developer has revised the project to address some issues and partially mitigate some potential impacts. The retention of public parking on site creates operational issues that staff believes do not best serve the public parking needs, drive undesirable internal circulation design and create enforcement difficulties. Moreover, City policies, including General Plan policy, encourage the location of public parking outside the downtown core. Thus, staff ultimately recommended the Project With No Public SS/ —b �N6r�� 1 Attachment 9 Council Agenda Report—MUM 124-06 April 20,2010 Page 7 Parking alternative because, in conjunction with the reduced development alternative, it best implements policy and addresses operational concerns. Further, the Project Without Public Parking Spaces Alternative balances the various needs and impacts of the project and allows flexibility in final building design; reduces costs and impacts to both the project and the City; and eliminates operational issues for Parking Services. The proposed subterranean parking creates operational concerns not inherent in the original project proposal and result in efficiency issues that can not be addressed through simple redesign.of the building. Under this alternative, impacts to traffic and circulation would be reduced to less-than-significant levels. This is also supported by the Conceptual Physical Plan for the City's Center ("Downtown Concept Plan,") which promotes parking on the perimeter of downtown, not in the core. The Downtown Concept Plan also outlines a primary goal of improving access between the Downtown core and peripheral areas by increasing parking spaces available to the public at strategic locations direct through traffic around the Downtown. Safety and Functionality Issues The location of the public parking spaces has substantially changed in the project revisions. The initial project included public parking at grade with Marsh Street that was easily accessible and / Attachment 9 Council Agenda Report—ER/U rR 124-06 April 20,2010 Page 8 open to the general public. The revised project had more spaces, but had public parking in the basement level of the project with less direct access locations. The proposed mix of public and private uses in the parking structure had the potential to create user conflicts and delays, especially during peak hour or hotel events (e.g., vehicles circulating to hunt or stopping to wait for parking spaces, valets rushing cars to storage on the Second Basement Level, and residents accessing Second Basement Level parking). Due to internal circulation constraints of the project with public parking, City parking enforcement and maintenance personnel may have been required to perform their duties on foot rather than by vehicle to avoid adding to potential congestion within the parking structure. This created safety concerns. Circulating in and out of the proposed location when the parking is fully occupied is problematic in comparison to the surface lot design that was a quicker"in and out" if the lot is full. Additionally, due to the subterranean location, enforcement, even by scooter, is much more resource intensive than what was originally anticipated with the at-grade public parking version of the project. In turn, this may contribute to off-site parking Q- D��-�y� Attachment 9 Council Agenda Report—ER/U/TR 12406 April 20,2010 Page 9 facilities/projects, such as at the proposed Palm/Nipomo Street Parking Structure or other parking supply additions. It is worth noting that those seeking parking for this development would most likely park on adjacent streets or at the existing Marsh Street structure, which is located a block away on Marsh Street and has a current occupancy rate of 55%. Thus, existing structure capacity could accommodate public parking displacement as well and demand of the project if needed. Because the existing MOU between the City and developer contemplates on site parking replacement, Council's certification of the EIR with the No Public Parking Alternative as part of the required project would drive the need for renegotiation of the terms of the MOU. This process is underway and staff is attempting to have major terms renegotiated by the time this project is considered for final hearing by Council scheduled for June 1,2010. Figure 3—Proposed Project: Subterranean (basement) Public Parking Once the project is operational, transportation and circulation impacts under the Project Without Public Parking Spaces Alternative would be similar to those described for the Proposed Project, though internal circulation would be improved. This alternative would result in better functionality and fewer user conflicts and delayssince the mix of public and private uses in the subterranean parking structure would not occur. In addition, City parking enforcement, collection, and maintenance personnel would not be required and would not increase potential T 1-E6-�S Attachment 9 Council Agenda Report—ER/U/TR 12406 April 20,2010 Page 10 congestion within the parking structure. Parking demand generated by private uses under this alternative would be accommodated within the subterranean parking structure. Next Steps The purpose of this meeting is to receive a presentation on the project redesign, Final EIR and Planning Commission recommendation. The project is scheduled to return to Council on June 1, 2010 for review and consideration of the Final EIR as well as other project entitlements and will include a formal staff recommendation. Following Council certification of the EIR, and use permit and subdivision approval, the project will then return to the CHC and ARC for final design review. The project would include the following order of meetings: 1) Council review and action June 1,2010 on Final EIR, use permit and subdivision; 2) CHC final review and recommendation to ARC on project design(date TBD); and 3) ARC final review and action on project design (date TBD). It is understood that the City has well illustrated the challenges of operating a public parking enterprise in a private structure and, further, that the City's parking management practices have historically been carefully assessed to meet the parking demand created by any new situation where parking is lost. The Downtown Association is also supportive of the continuing momentum of the Palm Nipomo parking structure and while the Parking and Access committee and Board do not necessarily feel that particular structure should be "tied"to the Garden Street Terraces projects, its presence will provide a critical piece to the eventual parking management plan for all of Downtown. Lastly, the Board also notes that the developer and his team continue to be responsive to the needs and desires of the community, particularly the Downtown neighbors; showing good faith efforts to address and find solutions to concerns as they are raised. Therefore, the Board encourages the Architectural Review Commission to adopt the Planning Commission's recommendation and support the project, without the public parking component. XXXX-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO CERTIFYING THE FINAL EIR FOR THE GARDEN STREET TERRACES PROJECT AND APPROVING THE REDUCED DEVELOPMENT AND PROJECT WITHOUT PUBLIC PARKING SPACES ALTERNATIVES AS THE REQUIRED PROJECT (ER 124-06) WHEREAS, the Planning Commission of the City of San Luis Obispo conducted a public hearing in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on February 24, 2010, for the purpose of considering the Final EIR for the Garden Street Terraces Project(ER 124-06); and WHEREAS, said public hearing was for the purpose of formulating and forwarding recommendations to the City Council of the City of San Luis Obispo regarding the Final EIR; and WHEREAS, the City Council of the City of San Luis Obispo conducted a public hearing in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on June 1,. 2010, for the purpose of considering Application ER 124-06; and WHEREAS, notices of said public hearing were made at the time and in the manner required by law; and WHEREAS, the Final EIR was reviewed and considered by the City Council after extensive review by City staff and other agencies, and with the comments of the concerned public; and WHEREAS, the potential environmental impacts of the project have been evaluated in accordance with the California Environmental Quality Act and the City's Environmental Guidelines; and WHEREAS, the City Council has duly considered all evidence, including the testimony of the applicant, interested parties, and the evaluation and recommendations by staff, presented at said hearing. BE IT RESOLVED, by the City Council of the City of San Luis Obispo as follows: Section 1. Findings. Based upon all the evidence, the Council. has concluded that the Final EIR (ER 124-06) for the Garden Street Terraces Project adequately identifies the project's potentially significant impacts, alternatives to the proposed action, and recommended mitigation measures, based on the following findings: 1. For each significant effect identified in the Final EIR under the categories of Aesthetics and Visual Resources, Air Quality, Cultural Resources, Geologic Resources, Hazards and Hazardous Materials, Hydrology and Water Quality, Land Use and Planning Policies, Noise, Energy, Transportation and Traffic, Utilities and Public Services, and Cumulative Impacts the approved mitigation measures contained in the Final EIR will avoid or substantially lessen the identified adverse environmental impacts of the project to a level of insignificance and have been incorporated into the project. 4. The significant effects identified in the Aesthetics and Visual Resources, Air Quality, Cultural Resources, Short-term Construction Noise, and Cumulative Impacts sections of the EIR will not be fully mitigated to a degree of insignificance with the incorporation of all of the identified mitigation measures included in the EIR. 5. The City Council finds that the unavoidable and significant adverse environmental effects of the project as proposed are unacceptable, but may be addressed and reduced to acceptable levels through project redesign that more closely adheres to the design features outlined in the Reduced Development Alternative and the Project without Public Parking Spaces Alternative. Although redesign to reflect these alternatives would not mitigate all significant Aesthetics and Visual Resources, Air Quality, Cultural Resource, Short-term Construction Noise, and Cumulative Impacts to a level of insignificance, the Council finds that these impacts would be reduced to acceptable levels and makes a statement of overriding considerations for those significant and unavoidable environmental impacts because: a. Mitigation measures are identified in the Final EIR Reduced Development Alternative that would apply to help reduce project impacts to the historic and visual resources of Garden Street and their contribution to the character of the Downtown Core and Downtown Historic District, particularly through the rehabilitation of all on-site historic buildings consistent with the Secretary of the Interior's Standards for the Treatment of Historic Resources and greater upper story building setbacks. b. Mitigation strategies are identified in the Final EIR to help reduce project emissions and ultimately put the air basin in closer compliance with established State and federal standards. c. Mitigation strategies are in place in the event that Mission-era burials are encountered as a result of subsurface grading and excavation that are consistent with State law and have been reviewed and endorsed by the Cultural Heritage Committee. d. The unavoidable adverse impacts associated with the loss of historical structures have been reviewed by the Cultural Heritage Committee and their specific recommendations regarding proposed demolitions and incorporation of appropriate and feasible mitigations has been reviewed and considered. e. The unavoidable adverse impact of construction noise is temporary in nature and P14b-- ,I J Attachment 11 Resolution No. (2010 Series) Page 3 can be substantially mitigated by implementation of a construction management plan that regulates the hours of construction, noise reduction measures, and a complaint resolution process, consistent with recommended mitigation measures. f. The unacceptable mixing of public and private parking and the long-tern management problems that could arise would be addressed through a redesign that would make proposed parking exclusively private and the replacement of lost public spaces through the payment of parking fees. g. The cumulative impacts addressed in the EIR may result in significant impacts to Air Quality and Noise. A series of mitigation measures to reduce these impacts have been included in the EIR, and future projects that may add to the cumulative impacts will provide additional mitigation. 6. The City Council has identified the following overriding economic, social, and other public benefits of the project, which are additional reasons that the significant and unavoidable impacts identified in the Final EIR for approval of a combination of the Reduced Development and Project without Public Parking Spaces Alternatives can be found acceptable; these are: a. In conformance with the City's General Plan policies and community goals, maintain and enhance the Downtown area as the commercial and social center of the City by converting surface parking lots to more economically productive uses which would not be achievable without private capital and investment; b. Provide expansion space for existing businesses and opportunities for new businesses to locate in the Downtown area by creating new retail, restaurant and hotel space which produce further tax dollars to keep the Downtown vital and the center of the community; c. Include an on-site, private parking structure and/or payment of in-lieu parking fees to provide adequate off-street parking to meet the demand of on-site uses; d. Provide housing Downtown interspersed with commercial uses to help balance jobs and housing in the community; e. Provide for improved pedestrian amenities via the project's pedestrian streets and paseos; f. Improve business synergy by creating incentives for other property owners to seek improvements to their own sites and increased revenues and foot traffic; and g. Rehabilitate all on-site historic buildings consistent with the Secretary of the Interior's Standards for the Treatment of Historic Resources. The data to support these overriding factors are found in the following sections of the record including: 1.) The Final Environmental Impact Report; 2.) Letters submitted by the public contained in the project files; 3.) Public testimony provided at this and previous project hearings;and 4.) The applicant's presentation. XXXX-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING A MODIFIED USE PERMIT AND VESTING TENTATIVE TRACT MAP FOR THE GARDEN STREET TERRACES PROJECT (U/TR 124-06) WHEREAS, the Planning Commission of the City of San Luis Obispo conducted a public hearing in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on February 24, 2010, for the purpose of considering Application U/TR 124-06, a use permit to allow a maximum building height of 74 feet and vesting tentative tract map for the Garden Street Terraces Project; and WHEREAS, said public hearing was for the purpose of formulating and forwarding recommendations to the City Council of the City of San Luis Obispo regarding the requested entitlements; and WHEREAS, the City Council of the City of San Luis Obispo conducted a public hearing in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo, California, on June 1, 2010, for the purpose of considering Application U/TR 124-06; and WHEREAS, notices of said public hearing were made at the time and in the manner required by law; and WHEREAS, the City Council has reviewed and considered the Final EIR prepared for the project; and WHEREAS, the City Council has duly considered all evidence, including the testimony of the applicant, interested parties, and the evaluation and recommendations by staff, presented at said hearing. BE IT RESOLVED, by the City Council of the City of San Luis Obispo as follows: Section 1. Use Permit Findings. Based upon all the evidence, the City Council makes the following findings in support of the use permit to allow a maximum building height of 74 feet: 1. With implementation of conditions of approval and mitigation measures contained in the EIR, the public benefits associated with the project significantly outweigh any detrimental impacts from the additional height because the project meets or exceeds all established performance standards for buildings taller than 50 feet and at least two required policy objectives, including the following: a. Historic preservation (rehabilitation of all on-site historic buildings consistent with the Secretary of the Interior's Standards for the Treatment of Historic Resources). 2. The mixed-use project is consistent with the General Plan and community goals for the following reasons: a. Maintains and enhances the downtown area as the commercial and social center of the City by converting surface parking lots to more economically productive uses. b. Expands space for existing businesses and opportunities for new businesses to locate in the downtown area by creating new hotel, retail and restaurant space. c. Provides housing downtown interspersed with commercial uses to help balance jobs and housing in the community. d. Provides for improved pedestrian amenities via the project's pedestrian streets and paseos. e. Rehabilitates all on-site historic buildings consistent with the Secretary Standards for Treatment of Historic Resources. Section 2. Subdivision Findings. Based upon all the evidence, the City Council makes the following findings in support of the airspace subdivision: 1. The design of the vesting tentative tract map is consistent with the General Plan because the project will incrementally add to the City's housing inventory, conforms to the site's allowable density, provides for three low-income housing units, and does not change allowable land uses or modify the intent or design of the project. 2. The site is physically suited for the type and density of development allowed in the CD- H zone because the site is located adjacent to existing street right-of-ways with complete City services and the airspace subdivision will simply allow for separate ownerships of the various project components. 3. The design of the subdivision, or the type of improvements, is not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat because the site does not have any creeks or other potentially significant habitat areas for fish and wildlife, is surrounded by urban development and has already been developed with commercial buildings and surface parking. 4. The design of the subdivision, or the type of improvements, will not conflict with easements, acquired by the public at large, for access through or use of, property within -PH AItachment 12 Resolution No. (2010 Series) Page 3 the proposed subdivision because no such easements exist. 5. The design of the subdivision, or type of improvements, is not likely to cause serious public health problems because the development will be designed to meet all existing building and safety codes. Section 3. Action. The City Council does hereby approve application U/TR 124-06 with incorporation of the following conditions and code requirements: Conditions: 1. The project shall be revised consistent with the Reduced Development and Project without Public Parking Spaces alternatives. Revised plans shall incorporate all applicable EIR mitigation measures and use permit and subdivision conditions, subject to review by the Architectural Review Commission and final design approval by the City Council. 2. Minor variations to the Reduced Development alternative setback requirement of 15 feet above the 2nd floor level along Marsh and Broad Streets should be considered to achieve architectural benefits, subject to review by the Architectural Review Commission and final design approval by City Council. 3. If the revised project continues to exceed 50 feet in height, it shall be designed to comply with all applicable performance standards and policy objectives required in Chapter 17.42 (C) of the Zoning Regulations for buildings taller than 50 feet, subject to the approval of the Community Development Director. 4. The use permit shall be effective for a period of five years from the date of approval. 5. All applicable mitigation measures contained in the Final EIR shall be included as conditions of approval, and are incorporated herein by reference. 6. Pursuant to Government Code Section 66474.9(b), the subdivider shall defend, indemnify and hold harmless the City and/or its agents, officers and employees from any claim, action or proceeding against the City and/or its agents, officers or employees to attack, set aside, void or annul, the approval by the City of this subdivision, and all actions relating thereto, including but not limited to environmental review. 7. The project shall provide a minimum 8-foot clear sidewalk width on all project street frontages where existing buildings are not retained. To accommodate this requirement, building entries may need to be recessed or street furniture relocated. Project plans indicate that this required clearance is not provided at the corner of Broad and Marsh and along the Broad Street frontage. 8. Garden Street Improvement Plan: The final design of Garden Street shall be reviewed and approved by the Public Works Director and Fire Chief. Revisions to the plans shall Attachment 12 Resolution No. (2010 Series) Page 4 include parallel parking, in-ground pavement lights across Higuera Street at Garden Street, dimensioned plans that identify a minimum 20-foot wide curb-to-curb clear area between Marsh and Higuera Streets for emergency vehicle access, a minimum clearance of 4 feet behind a parked bicycle in Peak Racks for users to access the bike rack, dimensions from street furniture to building face with the goal of providing an 8-foot clear width, the location of utility boxes or other sidewalk features that would limit the placement of street furniture, and retention of the existing truck turning radius onto Garden Alley to allow continued use by service vehicles. 9. Any City street furniture (ie. bike racks, parking meters, trash cans, etc.) not utilized in the project shall be offered to the City for reuse at another location. 10. Building plans shall include City standard tree grates and pedestrian lighting for the downtown. 11. The parking structure shall be developed as a private parking structure. If the parking structure is approved for public parking, the circulation flow shall be reversed so the in- bound lane is on the right and adequate line of sight provided. This revision will provide adequate sight visibility and reduce confusion to those using a public parking garage. 12. Building plans submitted for public improvements shall include truck turning template diagrams illustrating truck turning movements at all street corners. A 35-foot long ladder truck (12 feet wide) with a 44 foot turning radius shall maneuver the left hand turn from Garden Street onto Higuera Street. Plans shall be revised as needed to comply. 13. Bollards proposed for Garden Alley shall be relocated as close to the alley entry toward Garden Street as feasible so unauthorized vehicles will not have to back out of the alley. 14. Building plans .shall include long and short-term bicycle parking dimensions per the manufacturer to illustrate adequate space and clearances are provided with a bicycle parked in each space. 15. A minimum of 3 short-term bicycle parking spaces shall be provided near the Broad Street entry to the neighborhood market for use by customers, subject to the approval of the Public Works Director. 16. Building plans shall identify bicycle parking required for commercial uses, the path of travel to these spaces and how these spaces will be easily accessed for use by employees and customers (ie. directional signage and lighting). 17. A minimum 6-foot wide lighted pedestrian walkway shall be maintained (via an easement) through the building at street level to allow public access from the interior of the building to Garden Alley, Garden Street, and Marsh Street. -P�c � -lad Attachment 12 Resolution No. (2010 Series) Page 5 18. To reduce vehicle conflicts in the parking structure street level driveway and allow for 6- foot clear pedestrian circulation, the proposed handicapped parking behind the hotel shall be relocated to the lower level. 19. The section of the City owned parcel located within "Garden Alley" and labeled as "Remainder' on the tentative map shall be incorporated into the public alley to remain. The process to achieve this alley continuity shall be resolved prior to map recordation. The final map shall be revised if necessary to reflect any offer of dedication, prior deed, or revised tract boundary reflecting any final project development conditions or provisions of the MOU. 20. The final map shall correctly define and describe all lots including but not limited to the lot(s) used for parking purposes. The final map shall comply with final project actions regarding the use(s) of the parking garage as public, private, or common areas. 21. The final lot configurations including upper and lower limits shall be based on the final construction requirements. 22. A separate exhibit documenting zoning and building code compliance shall be approved to the satisfaction of the Community Development Department prior to recordation of the map. 23. The final map shall show any existing or proposed offers of dedication and pedestrian easements as conditioned with all applicable agreements, discretionary approvals and/or building permit and public improvement plan approvals. 24. Public pedestrian easements may be necessary to accommodate improvements required for Americans with Disabilities Act (ADA) compliance or for circulation clearances around obstructions to satisfy conditioned access width requirements. If required, these easements shall be shown on the map to the approval of the Public Works Director. 25. The subdivider shall dedicate any private or public utility easements determined necessary to serve or accommodate the development of this project. The necessity of said easements will be determined in conjunction with the review of the public improvement plans, utility company plans, and building plans for the development. 26. The final map shall reserve and delineate certain applicable horizontal and vertical private easements including but not limited to drainage, utilities, vehicular and pedestrian ingress & egress for the benefit of the lots affected by such easements. 27. Prior to the issuance of a building permit, the applicant shall receive Utilities Department approval of an interim garbage storage and pick up plan for businesses currently utilizing Garden Alley for trash pick up and storage. .. _ Attachment 12 Resolution No. (2010 Series) Page 6 28. The proposed project includes replacement of the existing six-inch sewer line in Garden Street with a new eight-inch sewer line due to its age, grade defects, and poor condition in order to accommodate the additional wastewater flows from the proposed project. Should the City replace the sewer line prior to the project, the applicant shall reimburse the City for the cost of upsizing the sewer line from six to eight inches to accommodate the wastewater flows associated with the project. Staff wanted to respond by way of a red file to ensure that the other Council members received the same information. Councilman Ashbaugh's Questions 1. Garden Alley: How important is it that we maintain this alley for through access for our patrol vehicles during nighttime hours? If we dedicated the central part of the alley to a taxi stand, it would impede such access (unless we also built in a waiting area into the current parking lot– something that I'm reluctant to propose at this time). BTW, I'll be asking the same question of Jay Walter&Tim Bochum. 2. Public restrooms: I think reserving an area for well-lit, well-maintained public restrooms within this project site–particularly as part of the current city parking lot–would be a great boon to the downtown nighttime entertainment scene. Logically, such restrooms should be placed in proximity to the taxi stand. To get an idea of the dimensions of the problem that this would address, could we obtain from your staff the number of public urination offenses in the downtown area over the last, say 6 months or year? Can that data be obtained without a great deal of staff effort? If it is too difficult to break this down only for the downtown, I'd be happy with a citywide total and an"educated guess" as to the proportion that occur within the downtown area. 3. Taxi Stand: Would a taxi-stand with public restrooms, properly sited and patrolled, be of significant benefit to the downtown? You might not be prepared to address that question now, but please be prepared for it should the Council find it in our wisdom to ask it–particularly in the context of this project. Thanks! Staff Response Garden Alley as a Taxi Stand (from Deb Linden, Police Chief): From a public safety perspective, I have several concerns about dedicating this alley as a taxi stand area at night. First, we frequently use the alley as a throughway for patrol vehicles, especially when traffic is congested on Higuera, and we would want to maintain this access. The alley also affords us a rear point of access to the businesses facing Higuera which is important for emergency response. Second, r activity associated with the use of the alley as a taxi stand would be essentially hidden from easy view and access, especially once the Garden Street Terraces buildings are in place. This is not. desirable for public safety, especially when vehicles and intoxicated people are mixing in a very narrow and enclosed area, or when pedestrians are waiting for taxis when none are present. Finally, the alley space itself is quite narrow and it would be difficult to maintain safe separation between pedestrians waiting for taxis and the vehicles themselves. Ideally, taxi stands should be located in well-lit locations that can be easily monitored by police, with safe places for pedestrians to wait and quick and easy access for taxis to pick up and drop off fares. The City currently has areas in the downtown designated as after-hour taxi pick up points; however the taxi cabs don't always choose to use them. Restrooms Downtown (from Deb Linden, Police Chief): In general, easy access to restrooms, whether public or private, for patrons of late-night establishments is effective in reducing incidents of public urination. There are different ways of providing restrooms to the public ranging from dedicated restroom buildings to strategic areas that house portable toilets. There are also ways of locating and designing restroom facilities, including portable toilets, which limit misuse and criminal behavior. The type, location, design, and funding of restrooms would all need further study. In calendar year 2009, officers wrote 276 citations for urinating in public in the downtown zone. Restrooms Downtown (from Jay Walter, Public Works Director): Public restrooms could be a useful amenity if constructed properly so that they would take the abuse we know they'll get and could be maintained for use throughout the day. PW's biggest concerns have always been our ability to keep them in presentable enough condition for the average tourist to use every day,but when the abuse got too bad, we asked to close them because we could not keep up. Once we open the door to restrooms again, the City has to be ready to bear the maintenance burden. General Comments/Suseestion for Council Direction (from Doug Davidson, John Mandeville, Community Development Department): Public restrooms are indeed recognized in the planning profession as an amenity in a pedestrian oriented downtown. However,this would be a new requirement that has not been part of the project through the Advisory Body hearing process. Public restrooms could be incorporated into the project if there is square footage that can be taken out of the project for a public purpose while the project remains financially viable. The applicants will not have that information until they are in the design process for the next iteration of the project. Perhaps the direction the Council could give, if they want to pursue the idea, is to have the applicant address including public restroom/taxi-stand areas in the final project design. This would give the applicants the flexibility to incorporate them into the project or to document why they are not feasible. CDD staff would present this information as part of its presentation on the project final design and the applicants could respond in their presentation as well. Staff will be ready to discuss these issues in more detail if the Council desires on Tuesday night. It is my understanding that they are asking for approvals of a project without producing drawings or a model of their latest concepts. Mr. Marshall complains that he has spent "a bloody fortune" on drawings and schemes. The problem with that is, his earlier plans were totally insensitive to cultural heritage concerns and the like. Now that he has seen the EIR and heard the concerns of people like Save Our Downtown group, he ought to be able to create a visual representation of the current plans for development based on EIR and citizen concerns. Without visual representations, it is difficult for citizens or the council to understand what is being proposed.
