DISCUSSION Background On June 1st, the City Council officially called a General Municipal Election to be held on November 2,2010. A Notice of Intention to Circulate a Petition was filed by the proponents on February 18, 2010. The proposed ballot measure, if passed, will amend various chapters of the Margarita Specific Plan for the primary purpose of eliminating a portion of the Prado Road extension currently planned to cross the boundaries of the City-owned Damon-Garcia property and extend across Acacia Creek. The initiative would preclude the area of any street, roadway, or highway, within any portion of the city-owned Damon-Garcia property or the adjacent South Hills open space. The Notice of Intention, along with the City Attorney's ballot title and summary, were published in accordance with State law on March 11`s and the petition was circulated over the next few weeks. The petition, which consisted of 164 sections and a "raw" count of 3,751 signatures, was filed with the City Clerk on May 14th. A random sampling of 500 signatures was completed pursuant to Elections Code Sections 9115 and 9211. Of the 500 signatures checked, 82% were determined to be valid. When this percentage was applied to the 3,751 signatures presented,the total was statistically more than the 2,676 signatures required to qualify the petition based on the random sampling verification. The Clerk's Certificate of Results of Examination of Initiative Petition is attached(Attachment 1). General Municipal Election-November 2,2010 2 Upon presentation of an initiative petition certified as sufficient by the City Clerk,the Council must either adopt the proposed measure without alteration or submit the proposed measure to the registered electors of the City by resolution(Attachment 4). Analysis,Arguments and Rebuttals Pursuant to Elections Code Section 9280,the City Council may direct the City Clerk to provide a copy of the proposed measure to the City Attorney for the purpose of preparing an impartial analysis. It is recommended that the Council provide this direction so that an impartial analysis may be prepared (Attachment 5). The impartial analysis shall be submitted no later than the date set by the Clerk to receive primary arguments. The Elections Code establishes a 300-word limit for primary arguments and also establishes priorities for selecting arguments. The Elections Code allows the City Council to set priorities for filling written arguments regarding a City measure (Attachment 5)and adopt provisions to permit rebuttal arguments to be filed (Attachment 6). These provisions must be adopted at the same meeting at which the initiative is certified. Public Review Period and Deadlines Election Code Section 9295 provides that the Election Official shall allow a 10-calendar day public examination period immediately following the filing deadline for submission of specified official election materials (i.e., arguments, rebuttals, analyses). During that 10-calendar day period, any voter of the City or the Election Official may seek court action to require any or all such materials be amended or deleted. Deadlines for Filing the Impartial Analysis and Arguments: The following deadlines have been established by the City Clerk for the submission of the impartial analysis,primary arguments in favor and against,and rebuttal arguments: August 3,2010—5:00 p.m. Last day to file Impartial Analysis and Primary Arguments For or Against the Measure August 13,2010—5:00 p.m. Last day to file Rebuttal Arguments For or Against a Measure August 4,2010—August 14, 2010 10-day public examination period for the Impartial Analysis and Primary Arguments For or Against a Measure August 14,2010—August 24, 2010 10-day public examination period for Rebuttal Arguments Only. r General Municipal Election-November 2,2010 3 ALTERNATIVE Adopt an ordinance,without alteration, amending the Margarita Area Specific Plan(Please refer to Attachment F in Attachment 2). FISCAL BIPACT This petition is part of the General Municipal Election called by Council on June 1,2010. The total cost of the election will be influenced by the number of candidates filing for elected office and the printing expenses relating to Candidate Statements, the text of the Ballot Measure(s), the City Attorney's Impartial Analysis, Primary Arguments and Rebuttal Arguments. It is estimated that the election will cost $35,000. Approximately, $4,000 of the total cost of the election is anticipated to cover the direct costs of the ballot measure. That the affiant stated that he or she had solicited the signatures upon that section,and that all of the signatures were made in his or her presence,and that to the best of his or her knowledge and belief each signature to that section was the genuine signature of the person whose name it purports to be. That after the proponents filed this petition and based on the County of San Luis Obispo Registrar of Voters' Signature Verification Certificate and the application of the random sampling for verification of signatures formula, I have determined the following facts regarding this petition: Page 1 ATTACHMENT 1 I. A statement of the reasons for the proposed action as contemplated in the petition is as follows: Reasons for the petition When the City proposed putting a major highway(Prado Road northern alignment)through the Damon-Garcia Sports Fields,many people opposed it,because the City had identified various other feasible road alignments which avoided this intrusion into the Sports Fields. People were upset because part of the 23.5 acre Damon-Garcia Sports Fields site would be used for an elevated truck- route highway(with up to 4 lanes),rather than for recreational uses. The Prado Road northern alignment(February 2000)replaced the earlier "Industrial Way" alignment for Prado Road. The City had also considered various other Prado Road alignments, such as a connection to Tank Farm Road. By this Initiative,the portion of Damon-Garcia Sports Fields presently designated for roadway use shall be changed to recreational use, and also to open space use at Acacia Creek. This initiative also ensures that the South Hills Open Space area adjacent to the Damon-Garcia Sports Fields site will remain protected in a natural state without development or streets or roads or highways. This initiative provides significant benefits to the City. It will provide: (A) MORE AREA AVAILABLE FOR RECREATIONAL USES AT DAMON-GARCIA SPORTS FIELDS SITE More space(about 4 acres total)would be available for additional smaller athletic fields, and/or for similar recreational uses such as sports courts or other appropriate recreational uses. This goal is consistent with General Plan Parks and Recreation Element part 3.12, "Unmet needs," which notes that the number one unmet need for parks and recreation is athletic fields. This goal is also consistent with General Plan Parks and Recreation Element Policy 3.14.2 Sports Fields, which states, "The demand for additional athletic fields will be met FIRST by developing facilities on land owned by,or dedicated to the City;and second, by developing facilities on land to be acquired by the City, or on privately-owned land." The City's plan for this area calls for a truck-route highway(up to 4 lanes wide)right through the Damon-Garcia Sports Fields site. This initiative will prohibit that. This will protect the existing open, tranquil,park-like setting of the area. The natural transition from Sports Fields to South Hills Open Space area will be preserved,without the large "wall" which would be created by the proposed elevated highway running through the Sports Fields area. (C) AN IMPROVED DESIGN OF THE DAMON-GARCIA SPORTS FIELDS SITE WHICH PROTECTS HEALTH,SAFETY,AND ENJOYMENT OF USERS OF THE SPORTS FIELDS AND THE ADJACENT OPEN SPACE AREA Without a busy truck-route highway running through the Damon-Garcia Sports Fields site, recreational users in the Sports Fields area and in the adjacent South Hills Open Space area will avoid the visual blight, loud traffic noise, and harmful vehicle furnes from the highway. The below information pertains to Primary Amendments of text and maps and to the Conforming Amendments of text and maps. Definitions 1. "Damon-Garcia Sports Fields .site" is the City-owned property known as Assessor's Parcel Number 053-231-038 of San Luis Obispo County, California,as shown in Attachment A. 2. 'Damon-Garcia Sports Fields site" may also be referred to as Sports Fields(capitalized). 3. "western boundary of Damon-Garcia Sports Field site" is the western-most boundary line (running in a generally north-south direction)of Assessor's Parcel Number 053-231-038,of San Luis Obispo County. 4. "South Hills Open Space area" or"South Hills open space area " refers to the"South.Hills" area on the map titled "Margarita Area Specific Plan" at page 89 (which is the inside back cover of the Margarita Area Specific Plan of Oct. 2004). This is the area which has a designated land use of"Open Space- Hills" as shown on that map. 5. The term "sports fields" in the context of this initiative measure is meant to be synonymous with "athletic fields." 6. "Nov. 2010 initiative measure amending Margarita Area Specific Plan" is this initiative measure herein. 7. "Prado Road interim eastern-most terminus" or "interim eastern-most terminus of Prado Road" or "interim eastern-most terminus of Prado Road established by the Nov. 2010 initiative measure amending Margarita Area Specific Plan" refers to the western boundary of Damon- Garcia Sports Fields site (Assessor's Parcel Number 053-231-038 of San Luis Obispo County). 8. The phrase "or an alternate Prado Road eastern-most terminus consistent with Nov. 2010 initiative measure amending Margarita Area Specific Plan" means some other eastern-most terminus of Prado Road other than the location at the western boundary of Damon-Garcia Sports Fields site, provided that such an alternate eastern-most Prado Road terminus is consistent with the Purpose and Intent and the Primary Amendments (i.e. those amending Margarita Area Specific Plan sections 1.1 Hills and 1.6.4 Sports Fields and amending the Margarita Area Specific Plan map) of the Nov. 2010 initiative measure amending Margarita Area Specific Plan in City of San Luis Obispo. For reference,Exhibit 02 below shows the City's concept of the Prado Road northern alignment passing through the Damon-Garcia Sports Fields site. The ordinance adopting this concept as an official part of the General Plan was adopted by the City on 01 Feb 2000. Intent The "primary amendments"of this initiative measure will allow two main goals to be achieved,and these will both be significant public benefits: 1) Additional area will become available at Damon-Garcia Sports Fields to be used for recreational uses. The initiative measure ensures that the entire 23.5 acre Sports Fields site is used for recreational purposes and not for a roadway or street or highway, thereby making available about 4 additional acres for recreational use at the Sports Fields site. (See Exhibit 03 below.) 2) The adjacent South Hills open space area will be preserved in an open, park-like, scenic, peaceful, and safe setting which will enhance the public enjoyment and use of each of these two adjacent recreational areas and will have environmental benefits. Public Benefits Protection of the Damon-Garcia Sports Fields and the South Hills Open Space Area will provide important public benefits including the following: 1) Pedestrian and bicyclist access between the Sports Fields and the South Hills open space will not require passageways beneath the proposed roadway,which could be unsafe-- especially for children. 2) The scenic beauty and tranquil, "non-urban" setting will be preserved. 3) The natural transition between the two recreation areas will be preserved to allow wildlife corridors, scenic rock outcrops, known archaeological sites, and creeks to remain undisturbed within that area 4) Users of the two adjacent recreation areas will avoid the loud traffic noise and the harmful vehicle exhaust fumes of the proposed busy truck-route highway. 5- 13 TEXT OF INITIATIVE MEASURE Page 5 of 27 'ATTACHMENT 2 5) This initiative measure helps fulfill the City's General Plan Parks and Recreation goals and policies by making available about 4 acres of space for recreational uses to replace the proposed roadway at Damon-Garcia Sports Fields. We,the people of the City of San Luis Obispo,find and declare that it is a public benefit to amend the Margarita Area Specific Plan previously adopted by the City on 12 October 2004 by City Council Resolution Number 9615, in order to prohibit the encroachment.of any street,roadway,or highway into the Damon-Garcia Sports Fields site(Sports Fields)or into the adjacent South Hills open space area north and northwest of the Sports Fields. 2. We,the people of the City of San Luis Obispo, find and declare that the existing Prado Road northern alignment(i.e.through Damon-Garcia Sports Fields site)is not necessary or advisable because: (a) Various alternative Prado Road alignments are feasible(e.g.via Industrial Way alignment, or via a southern alignment(Prado Road connecting to Tank Farm Road),or other alignments as discussed by City Council(e.g. in hearings of 01 Feb 2000, 16 Jan 2001, etc.). (b) The Prado Road northern alignment adds a new signalized intersection at junction of Broad Street and Prado Road,very close to the existing signalized intersection at Broad Street and Tank Farm Road,thereby potentially creating traffic jams along Broad Street due to the close signal spacing and also due to left turns from Broad Street onto Prado Road. Margarita Area Specific Plan section"12 Creek Q ��v f ATTACOMENT a INITIATIVE MEASURE TO BE SUBMITTED DIRECTLY TO THS VOTERS The San Luis Obispo City Attorney has prepared the following title and summary of the chief purpose and points of the proposed initiative measure. j TITLE AN INITIATIVE AMENDING THE MARGARITA AREA SPECIFIC PLANT TO ELIMINATE A PORTION OF THE PRADO ROAD EXTENSION CURRENTLY PLANNED TO CROSS THE BOUNDARIES OF THE CITY-OWNED DAMON- GARCIA PROPERTY, AND TO PROHIBIT ANY ENCROACHOF DEVELOPMENT OR STREETS INTO THE SOUTH HILLS OPEN SP CE AND THE DAMON-GARCIA PROPERTY,AND AMENDING OTHER CITY LAND USE AND PLANNING DOCUMENTS TO CONFORM TO THE MARGARITA AR. EA SP�CIFIC PLAN AMENDMENTS. i SUMMARY The San Luis Obispo City Council adopted the Margarita Area Specific Man in October 2004. The Plan sets forth the goals and parameters for development of the Margarita Area, including an alignment for the planned Prado Road Extension. A pprtion othat extension is currently planned to cross the northwest corner of the Damon-Garcia property and extend across Acacia Creek. This initiative would amend various chapters of the Margarita Area SpecMe Plan for the primary purpose of eliminating that portion of the Prado Road Extension purrently planned to cross the boundaries of the Damon-Garcia Property and eaten#across Acacia Creek. The initiative would preclude the location of any development, asi well as any street,roadway,or highway, within any portion of the Damon-Garciaproperty or the adjacent South Hills open space. More specifically, Chapter 1 (Open Space and Parks) would be amended as follows: 1. Section 1.1 (Hills)would be amended to add a paragraph prohibiting encroachment of any development, street,roadway or highway into the South Hills open space area designated as C/OS-40-SP on the City's:May 2009 Zoning Map. 2. Section 1.6.4 (Sports Fields)would be amended to add a paragraph dedicating the entire 23.5 acre Damon-Garcia property to recreational use and prghibiting encroachment of any public street, roadway,highway or other,development into the property. To conform other portions of the Margarita Area Specific Plan to these*endmeuU,this initiative would also amend sections of Chapter 5 (Circulation), Chapter 7 (Utilities), and Chapter 9 (Public Facilities Financing),as well as various Tables(Tabled 1, 10, aid 13) ATTACH SENT 3 to eliminate references to the above portion of the Prado Road Extension and as fated infrastructure improvements and/or to insert notes or references to this initiativeeasure. I Also for conformity,this initiative would amend specified provisions of t e Airport Area Specific Plan(AASP) and the General Plan Land Use Element and Circulation Element, as well as numerous maps in the MASP, AASP,Land Use Element and gtrculatio� Element,to eliminate references to that portion of the planned Prado Rowl Extension and associated infrastructure improvements that are eliminated by this initiative. Finally, this initiative would amend the City's May 2009 Zoning Map to iliminate that portion of the currently planned Prado Road alignment that crosses over the boundaries of the Damon-Garcia property and Acacia Creek. This initiative would require the City Council to use best efforts to cure and re-enict any portion of the initiative found invalid and would prohibit amendment or repeal ex�ept by a vote of the people. X30M (2010 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ORDERING THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY A CERTAIN MEASURE RELATING TO THE AMENDMENT OF THE MARGARITA AREA SPECIFIC PLAN AT THE GENERAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 2,20109 AS CALLED BY RESOLUTION NO. 10177(2010 SERIES) WHEREAS,a General election on Tuesday,November 2,2010, has been called by Resolution No. 10177(2010 Series),adopted on June 1,2010; and WHEREAS, the City of San Luis Obispo, with the participation of property owners, citizens, public agencies and other interested parties prepared a specific plan for the Margarita Area pursuant to the General Plan and the State Goverment Code; and WHEREAS, the Council of the City of San Luis Obispo on October 12, 2004, adopted Resolution No. 9615 (2004 Series) certifying a final program EIR for the Margarita and Airport Area Specific Plans and related facilities Master Plans, approving the Margarita Area Specific Plan, and approving General Plan amendments(ER, SP, GP/R 73-00); and WHEREAS,pursuant to authority provided by Division 9,Chapter 3,Article 1 (commencing at section 9200)of the Election Code of the State of California,petitions have been filed with the legislative body of the City of San Luis Obispo signed by more than 10 percent of the registered voters of the City to repeal portions of Resolution No. 9615 (2004 Series)pertaining to the Prado Road Extension,or submit these to a vote of the voters;and WHEREAS, the City Clerk examined the records of registration and ascertained that the petitions were signed by the requisite number of voters,and has so certified;and WHEREAS, the City of San Luis Obispo, California desires to submit to the voters at the General Municipal Election a measure relating to Resolution No. 9615 (2004 Series); and WHEREAS,the City Council has not voted in favor of the repeal of the resolution; and WHEREAS, the City Council is authorized and directed by statute to submit the resolution to the voters. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. (2010 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO PROVIDING FOR THE FILING OF REBUTTAL ARGUMENTS FOR CITY MEASURES SUBMITTED AT MUNICIPAL ELECTIONS. WHEREAS, Section 9285 of the Elections Code of the State of California authorizes the City Council,by majority vote,to adopt provisions to provide for the filing of rebuttal arguments for City measures submitted at municipal elections. NOW,THEREFORE,The City Council of the City of San Luis Obispo, California, does resolve, declare, determine and order as follows: SECTION 1. That pursuant to Sections 9285 of the Elections Code of the State of California,when the Elections Official has selected the arguments for and against the measure which will be printed and distributed to the voters,the Elections Official shall send copies of the argument in favor of the measure to the authors of the argument against,and copies of the argument against to the authors of the argument in favor. The author or a majority of the authors of an argument related to a City measure may prepare and submit a rebuttal argument not exceeding 250 words. A rebuttal argument may not be signed by more than five authors. The rebuttal arguments shall be filed with the City Clerk not more than 10 days after the final date for filing direct arguments. Rebuttal arguments shall be printed in the same manner as the direct arguments. Each rebuttal argument shall immediately follow the direct argument which is seeks to rebut. SECTION 2. That all previous resolutions providing for the filing of rebuttal arguments for city measures are repealed. SECTION 3. That the provisions of Section 1 shall apply at the next ensuing municipal election and at each municipal election after that time. SECTION 4. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
