SUBJECT: County Referral: abandonment of interior road right-of-ways in Tract 681
-- the ICuden Tract.
THE SITUATION
On February 7, 1989 the Board of Supervisors will consider a request to approve the
partial abandonment of street right-of-ways in Tract 681, located adjacent tot he city
and east of Orcutt Road. The purpose of the partial abandonment is to allow several
property owners to construct large homes at preferred locations on their lots. (The
preferred locations conflict with the right-of-ways of future roads planned for the
area.)
The city staff has prepared a response to the county concerning this proposal (see
attached). The purpose of this memorandum is to brief the council on what is happening
with the planning of this area.
BACKGROUND
1. Previous County Action on Tract 681
Tract 681 lies within the city's urban reserve and is earmarked by the city's general
plan as a future residential expansion area. Lots within the tract are generally five
acres in area and are being developed with large estate homes. Streets and utilities
have been installed to county standards.
The county approved Tract 681 in 1979. At that time the city objected to the fracturing
the the area into five acre parcels because it would complicate or preclude the future
development of urban-density housing in the area. This is the "Orcutt Expansion Area" of
the general plan and the city felt that it needed to retain it among the land resources
in its urban reserve that would serve future housing needs. The city was concerned that
approval of the tract might significantly diminish those resources, force residential
development to less-suitable areas beyond the urban reserve, and thereby promote urban
sprawl.
2. Establishing Interior Street Right-of-Ways
In response to the city's concerns, the county required the subdivider to submit a
schematic plan that showed how the area might be subdivided into city-size lots. To
enable this further subdivision to occur, the county required the subdivider to offer to
dedicate right-of-way for future interior streets (see attached map).

3. Area Property Owner Reauest
The area property owners first requested that the county abandon all the right-of-ways
for the tract's interior future streets. However, after consultation with county and
city staffs, an alternative scheme to abandon only some of the right-of-ways and
establish alternative locations for others was developed.
The partial abandonments affect four lots within the tract. Two cul-de-sacs would
replace the previous loop street proposal affecting lots 2 and 4 (see attached map).
The Board of Supervisors initiated action on the request for partial abandonment at their
January 3, 1989 meeting. City staff has met with Supervisor Blakely (at his request) to
review city concerns about past actions and with future planning of this area.
4. Other Staff Comments
The proposal to abandon the streets has been reviewed by the City Public Works
Department. The attached memorandum from Dave Romero indicates that the right-of-ways
are not critical to our circulation system and therefore can be abandoned.
5. Property Owner Interest In Annexation
The Community Development Department has received a letter from a representative of the
area property owners indicating interest in annexing Tract 681 to the city. The staff
will be meeting with the representative subsequent to the preparation of this memorandum.
We can orally report on our discussions to the council at your January 31st meeting.
STAFF RECOMMENDATIONS
The Planning staff supports the partial abandonment of offered street right-of-ways
within Tract 681. However, we are not supportive of a wholesale abandonment at this time
since it would reduce or eliminate this area's ability to function as a future
urban-intensity housing area, which is what our current general plan envisions for this
area.
The city may want to consider alternatives for planning this area. The staff wants to
consider these options as part of the city's update of it Land Use Element. At that time
the potential for future urban housing will again be considered along with other options
and the planning of a circulation system to serve the area.
Unless the council indicates otherwise, the staff will send the attached letter to the
Board of Supervisors and attend the Board's February 14, 1989 meeting.

Subject: Vacation of Interior Street Right-of-Ways in Tract 681.
Dear Mr. Crawford:
On February 7, 1989 the Board of Supervisors is scheduled to act on a request to approve
a resolution of intention vacating a portion of interior roads located in Tract 681, 5th
District. This item was initiated at the Board's meeting of January 3, 1989.
The city and county staffs and representatives of the area property owners have worked on
this proposal and have considered alternatives to it. The city staff supports a partial
vacation so long as right-of-way at alternative locations will be offered to serve lots 2
and 4 within the tract.
City staff's preference would be to retain all existing offers of dedications until the
city updates its Land Use Element and reevaluates the future development and annexation
of this area. However, it will take the city a year or more to complete its general plan
studies. Therefore, a partial vacation affecting only the four lots is a reasonable
compromise.
This item is scheduled to be a "consent" item on the Board's February 14, 1989 meeting.
However, I will be attending the meeting and will be available to answer questions if
they arise.

MEMORANDUM

SUBJECT: Vacation of Interior Roads Located in Tract 681
Fifth District
These streets have access off ofOrcutt Road, immediately southeast
of the city, beyond the P.G.&E. substation and south of Ann Arbor
Estates. When the subdivision was first developed, City staff felt
that this property would eventually develop to urban standards and
asked that it be designed so as to allow for smaller urban lots.
Numerous streets were offered for dedication but never developed.
The streets now proposed for abandonment (vacation) are not
critical to our circulation system, therefore, the City has no
objection to action proposed. I do not believe there is a need for
a City representative to be present at the Board hearing, however,
I would be glad to send someone on behalf of the City if you so
desire.
