SUBJECT: APPOINTMENT TO THE BICYCLE ADVISORY COMMITTEE
RECOMMENDATION
Appoint Christopher Black to the Bicycle Advisory Committee (BAC) to serve an unexpired
term ending on March 31, 2010.
DISCUSSION
Staff was advised at the end of September that Tom Nuckols was resigning from the Bicycle
Advisory Committee effective November 20, 2008. Mr. Nuckols vacated a position with a term
expiring on March 31, 2010. Although staff had received advance notice of Mr. Nuckols'
resignation, because of statutory requirements (e.g., notices may be posted no earlier than 20 days
prior to the effective date of the vacancy or appointments made for at least 10 days after the
posting of the notice), staff was unable to advertise or fill this vacancy prior to the seating of the
newly elected Council members. In addition, Council concurred that interviews and an
appointment to this position should be delayed until the new Council Liaison Subcommittee
members (Council Members Ashbaugh and Marx) were appointed in December.
The statutory notice was subsequently posted and a legal advertisement was published on
November 8, 2008. In addition, staff also contacted applicants who qualified during a prior
recruitment to determine their interest in activating their applications for the current vacancy.
Council Liaison Subcommittee Members John Ashbaugh and Jan Howell Marx conducted
interviews with seven applicants on January 26, 2009. The Subcommittee interviewed five of the
seven applicants. Two applicants were unable to attend at the last minute. Following the
interviews, the Council Liaison Subcommittee recommended the appointment of Christopher
Black to the position vacated by Mr. Nuckols.
