DISCUSSION The tentative subdivision map for Tract 2570 (TR/ER 95-03) was approved by City Council on November 16, 2004, by Resolution No. 9622 (2004 Series), authorizing the creation of 13 residential lots. (See Attachment 1 for vicinity map and Attachment 2 for site plan.) The final map was approved by City.Council on September 4, 2007,by Resolution No. 9925 (2007 Series). The project's public improvements include frontage and street improvements along Johnson Ave, the extension of Fixlini St. with appurtenant public utilities, and off-site public drainage improvements near the intersection of Ella St. and Sierra Way. The remaining subdivision improvements are private improvements including but not limited to surface and subsurface storm drain systems, detention basins, and landscape improvements. With the recent replanting of trees .and plants in areas of private maintenance and some final private drainage improvements, the public and private subdivision improvements have been completed to the satisfaction of the City. The subdivider has requested final acceptance of the public improvements by the City and release of the respective sureties. Included with the final map approval was a subdivision agreement that allowed the Subdivision Labor and Materials and the Faithful Performance sureties to be released upon the Council's acceptance of the subdivision improvements and receipt of a guarantee of ten percent of the cost of the public improvements. The surety received in conjunction with the subdivision agreement totaled $75,500. The subdivision improvements were substantially complete at the time of map recordation. Because the most significant public improvements have stood the test of time over the last couple of years, it would be reasonable to reduce the required guarantee amount to five percent of the improvement value. The cost of the public improvements was initially estimated to be $400,000. When the proposed resolution is approved Council Agenda Report—Acc..Otance of Public Improvements-Tract 2r.a Page 2 and the subdivider has provided a replacement security in the amount of $20,000, the Public Works Director will authorize the release of the $75,500 Faithful Performance and Labor & Material security. The release of the security may be processed after the 90-day waiting period referenced in Section 66499.7(h) of the Government Code of the State of California. The replacement security of $20,000, or five percent of the estimated construction cost, is to insure that the subdivider will remedy any defects in the improvements arising from faulty workmanship or materials or defective construction of said improvements occurring within twelve (12) months after subdivision acceptance, in accordance with Sections 66499.7 and 66499.9 of the Government Code of the State of California. FISCAL I1YIPACT Typical maintenance and operation of public facilities will be required for the street improvements, public water main,public sewer main, the sections of public storm drain, and street lighting. (2009 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ACCEPTING THE PUBLIC IMPROVEMENTS AND CERTIFYING COMPLETION OF THE PRIVATE IMPROVEMENTS FOR TRACT NO. 2570 (2070 FIXLINI STREET) WHEREAS, the City Council made certain findings concerning Tract 2570, as prescribed in Resolution No. 9622 (2004 Series); and WHEREAS, the City Council approved the final map for Tract 2570 per Resolution No. 9925 (2007 Series); and WHEREAS, the subdivider has satisfactorily completed the public improvements for Tract 2570, in accordance with City standards, specifications and the subdivision agreement, and has requested acceptance of the public improvements for maintenance and operation by the City; and WHEREAS, the subdivider has satisfactorily completed the private improvements for Tract 2570, in accordance with City standards, specifications and the approved plans, and has requested that the city certify completion of these private improvements. . NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The City Council hereby accepts the public improvements and certifies completion of the private improvements for Tract No. 2570. SECTION 2. The current Faithful Performance and Labor & Materials surety may be released upon submittal of a replacement surety guaranteeing the workmanship and materials for a period of 12 months. The surety may be released after 90 days from this date of acceptance of the improvements in accordance with Section 66499.7(h) of the California Government Code. SECTION 4. The Director of Public Works is hereby authorized to release the current surety upon receipt of the above mentioned replacement surety.
