(COUNCIL SUBCOMMITTEES — 5 MINUTES) RECOMMENDATION: By motion, make appointments to the City's advisory bodies effective April 1, 2009, in accordance with the recommendations of the Council Subcommittees. MEETINGS. (HOOPER) RECOMMENDATION: Waive oral reading and approve as presented. C2. HERITAGE OAKS BANK SPONSORSHIP FOR THE SAN LUIS OBISPO TRIATHLON. (KISER/OGDEN) RECOMMENDATION: As recommended by the Parks and Recreation Commission, authorize the Mayor, on behalf of the City, to enter into an agreement with Heritage Oaks Bank for sponsorship of the San Luis Obispo Triathlon in exchange for a $5,000 monetary contribution and other in-kind services of approximately $2,000. C3. FINAL ACCEPTANCE OF SUBDIVISION IMPROVEMENTS FOR TRACT 2865=A 16 UNIT RESIDENTIAL CONDOMINIUM CONVERSION SUBDIVISION.AT_1043.ELLA STREET(ADELAIDA PROPERTIES, L.P.). (WALTER/HANNULA) RECOMMENDATION: Adopt a resolution accepting the public improvements, certifying completion of the required private improvements, and releasing/reducing the outstanding sureties for Tract 2865. BUSINESS ITEM 1. AD HOC PARKING FUND REVIEW COMMITTEE FINDINGS AND RECOMMENDATIONS. (WALTER/HORCH—45 MINUTES) RECOMMENDATION: As recommended by the Ad.Hoc Parking Fund Review Committee, move forward with advance development of the Monterey Street parking structure (previously referred to as the Palm Nipomo parking structure) by taking the next steps of environmental review, completion of design, and preparation of plans and specifications. 2 Council Agenda Tuesgay, March 17, 2009 7:00 P.M. — REGULAR MEETING PUBLIC COMMENT PERIOD FOR ITEMS NOT ON THE AGENDA(not to exceed 15 minutes total) The Council welcomes your input. You may address the Council by completing a speaker slip and giving it to the City Clerk prior to the meeting. At this time,you may address the Council on items that are not on the agenda or items on the Consent Agenda. Time limit is three minutes. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. REVIEW OF A HOUSING DEVELOPMENT CONSISTING OF 81_RESIDENTIAL. DWELLINGS AND 1,000 SQUARE FEET OF COMMERCIAL SPACE,_AND. ASSOCIATED ENTITLEMENTS, (851 AND 860 HUMBERT AVENUE AND UNADDRESSED VACANT LOT: 004-951-009,_GPA(R/PDLTR/ANAN/A 27-06 AND ER. 123-08. (MAN DEVIL.LE/HILL — 1 HOUR) RECOMMENDATION: As recommended by the Planning Commission: 1. Adopt a resolution amending the General Plan Land Use Element Map to change the land use designation of the unaddressed parcel (004-951-009) from Services & Manufacturing to Medium-High Density Residential and approving a Mitigated Negative Declaration (ER 123-08), Vesting Tentative Tract Map, Purchase of Surplus Property, and Use Permit for development of a sensitive site. 2. Adopt a resolution of intention to abandon portions of Frederick Street and Humbert and set a public hearing for April 21, 2009. 3. Introduce an ordinance amending the zoning of the unaddressed parcel (004-951-009) from Manufacturing (M) to Medium-High Density Residential with the Special Considerations overlay (R-3-S) and covering the entire site with the Planned Development (PD) Overlay. 4. Provide direction to the Architectural Review Commission on modifications to the project to improve site planning. 3. DETERMINATION_OF NEED FOR ADDITIONAL TAXI SERVICES. (WALTERIWEBSTER-30 MINUTES) RECOMMENDATION: 1. Adopt a resolution, declaring the need for operation of three taxi operators in the City of San Luis Obispo. 2. Authorize the City Manager or his designee to process the Certificate of Public Convenience and Necessity and Taxi Permit to Green-Go Taxi L.L.C. on a one year trial basis. BUSINESS ITEM 4. ORDINANCE AMENDING TAXICAB AND TAXI DRIVER PERMIT REGULATIONS. (LINDEN — 15 MINUTES) 3 Council Agenda Tuesuay, March 17, 2009 RECOMMENDATION: Introduce an ordinance amending sections 5.20.020, 5.20.050, 5.20.080, 5.20.110, 5.20.170, 5.20.180, 5.20.210 and 5.20.230 of the San Luis Obispo Municipal Code to modify the processes for obtaining a certificate of public convenience and necessity for the operation of a taxicab business, applying for additional or replacement taxicab permits, filing notices of rate changes, approving taxicab color schemes and insignia, and denying or revoking a taxi driver permit. 5. ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 9.05 — UNDERAGE PERSONS AND ALCOHOL (SOCIAL HOST ORDINANCE). (LINDEN/STALEY— 30 . MINUTES) RECOMMENDATION: Introduce an ordinance modifying section 9.05.010 of the San Luis Obispo Municipal Code (social host ordinance) to reduce the number of minors-required to be present and consuming alcohol at a gathering, and to reclassify a violation from an infraction to a misdemeanor. COUNCIL LIAISON REPORTS (not to exceed 15 minutes) Council Members report on conferences or other City activities. Time limit-3 minutes. COMMUNICATIONS (not to exceed 15 minutes) At this time, any Council Member or the City.Administrative Officer may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council Policies and Procedures, they may provide a reference to staff or other resources for factual information, request staff to report back to the Council at a subsequent meeting concerning any matter, or take action to direct staff to place a matter of business on a future agenda.
