Walter,PE-Director of Public Wore Prepared by: Hal Hannula, Senior Civil Eng r SUBJECT: FINAL ACCEPTANCE OF SUBDIVISION EvIPROVEMENTS FOR TRACT 2865 — A 16 UNIT RESIDENTIAL CONDOMINIUM CONVERSION SUBDIVISION AT 1043 ELLA STREET (ADELAIDA PROPERTIES, L.P.) CAO RECOMMENDATION Adopt a resolution accepting the public improvements, certifying completion of the required private improvements, and releasingtreducing the outstanding sureties for Tract 2865. DISCUSSION The tentative subdivision map for Tract 2865 (TR/CON 21-06) was approved by City Council on February 20, 2007, by Resolution No. 9867 (2007 Series), authorizing the condominium conversion for 16 apartment units. (See Attachment 1 for vicinity map and Attachment 2 for site plan.) The final map was approved by City Council on March 18, 2008, by Resolution No. 9962 (2008 Series). The project's public improvements include appurtenant utilities, frontage and street improvements along Ella Street, Jennifer Street, and Rachel Street. The remaining subdivision improvements are private improvements including but not limited to site improvements, a pedestrian pathway, surface and subsurface storm drain systems, and landscape improvements. The subdivision improvements have been completed and inspected under separate building permits and an encroachment permit for the private and public improvements respectively. The public and private subdivision improvements have been completed to the satisfaction of the City. The subdivider has requested final acceptance of the public improvements by the City and release of the respective sureties. Included with the final map approval was a subdivision agreement that allowed the Subdivision Labor and Materials and the Faithful Performance sureties to be released upon the Council's acceptance of the subdivision improvements and receipt of a guarantee of ten percent of the cost of the subdivision improvements. The cost of the public improvements was estimated to be $52,987. When the proposed resolution is approved and the subdivider has provided a replacement security in the amount of $5,299, the Public Works Director will authorize the release of the $52,987 Faithful Performance security. The release of the $26,494 Labor and Materials security may be processed after the 90-day waiting period referenced in Section 66499.7(h) of the Government Code of the State of California. The replacement security of$5,299, or ten percent of the estimated construction cost, is to insure C3 ' I C.A.R. —Acceptance of Subdivision Improvements-Tract 2865 - Page 2 that the subdivider will remedy any defects in the improvements arising from faulty workmanship or materials or defective construction of said improvements occurring within twelve (12) months after subdivision acceptance, in accordance with Sections 66499.7 and 66499.9 of the Government Code of the State of California. FISCAL FYIPACT Typical maintenance and operation of public facilities will be required for the street improvements. (2009 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ACCEPTING THE PUBLIC IMPROVEMENTS AND CERTIFYING COMPLETION OF THE PRIVATE IMPROVEMENTS FOR TRACT NO.2865 (1043 ELLA STREET) WHEREAS, the City Council made certain findings concerning Tract 2865, as prescribed in Resolution No. 9867 (2007 Series); and WHEREAS,the City Council approved the final map for Tract 2865 per Resolution No. 9962 (2008 Series); and WHEREAS, the subdivider has satisfactorily completed the public improvements for Tract 2865, in accordance with City standards, specifications and the subdivision agreement, and has requested acceptance of the public improvements for maintenance and operation by the City; and WHEREAS, the subdivider has satisfactorily completed the private improvements for Tract 2865, in accordance with City standards, specifications and the approved plans, and has requested that the city certify completion of these private improvements. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The City Council hereby accepts the public improvements and'certifies completion of the private improvements for Tract No. 2865. SECTION 2. The current Faithful Performance surety may be released upon submittal of a replacement surety guaranteeing the workmanship and materials for a period of 12 months. SECTION 3. The Labor& Materials surety may be released after 90 days from this date of acceptance of the improvements in accordance with Section 66499.7(h) of the California Government Code. SECTION 4. The surety guaranteeing the workmanship and materials may be released by the Public Works Director upon the successful completion of the 12 month warranty time period from this date of acceptance.
