SUBJECT: CITY COUNCIL WORK PROGRAMS FOR 2009-11 CONTINUED
RECOMMENDATION
Continue review and conceptual approval of City Council Work Programs for "Other Important
Goals," including that $80,000 for Phase II of the Historic Preservation goal is reconsidered in
June 2010.
DISCUSSION
At the April 14, 2009 City Council meeting, Council completed its review and direction on the
following four Major City Goals:
■ Infrastructure Maintenance
■ Traffic Congestion Relief
■ Economic Development
■ Preservation of Critical Services and Fiscal Health
Staff will summarize the direction provided by Council on April 14 with respect to these four
goals in a brief introductory presentation on April 21". Following this presentation, Council will ;
continue its review of these remaining five Other Important Goals:
■ Land Use and Circulation Elements
■ Open Space and Agricultural Land
■ Green House Gas Reduction and Energy Conservation
■ Downtown Maintenance and Beautification
■ Historic Preservation
As noted in the April 14 report, Council's conceptual approval of the work programs does not
represent final approval of either the goal or the related funding allocations. Those final
approvals will occur when the Council approves the 2009-11 Financial Plan in June 2009, after
additional workshops and public hearings.

Honorable Mayor and Members of the City Council.
Pursuant to the proposed work program for Open Space Preservation, we have the C�2�
following questions, comments and concerns.
As stated by Dr. Havlik in a recent Planning Commission meeting, the Bishop's Peak
natural open space is being degraded by overuse. What is in the work program to
specifically address this?Is there funding for the Conservation Corps to work
specifically in the Bishop's Peak Open Space to address this?
The staff report refers to increased duties of the Natural Resource Program. These
include the city's mitigation programs, formerly handled by other departments, the
Tank Fame force main project, the i3OV R interchange project, and continued
monitoring of completed projects such as the Damon-Garcia sports fields and Calle
Joaquin realignment and the new stormwater management plan. We are concerned that
these increased duties may pull limited resources away from the primary mission of
protecting the city's natural resources and open space.
The staff report notes the adoption by the Council in 2002 of a set of conservation
guidelines for open space lands in the City of San Luiis Obispo,and rive Conservation
Plans. It omits to mention the adoption of the Conservation and Open Space Element in
2006, and the Open Space Ordinance of the City of San Luis Obispo. Both documents
are more relevant than the 2002 "Guidelines" in forming the basis for the proposed
work program, particularly in the matter of determining allowable uses of open space.
The COSE incorporates the principal of allowing only passive recreation in open space:
"The City will consider allowing passive recreation where it will not degrade or
significantly impact upon open space resources....Passive recreation activities may
include:
hiking, nature study,bicycle use, rock climbing, horseback riding,or other passive
recreational activities as permitted and regulated in the Open Space ordinance." (2006
LOSE, pp. 51-52)
The Open Space Ordinance states: "The use of bicycles on city open space lands is
restricted to areas and trails designated for bicycle use." It allows for"Equine animals
being led or ridden under reasonable control upon an), bridle paths or trails; prvided
that they are designated and identified for such purposes"(Open Space Ordinance of
the City of San Luis Obispo, 1998).

The 2002 Conservation Guidelines should be amended to eliminate references to active
recreation as an allowed use in the City's open space,thereby assurini conformance
with the Ordinance and the COSE. is a necessary work program for the goal of Open
Space Preservation.
Amend the 2002 Conservation Guidelines at pg. R, 16. and the glossary to change the
definition of mountain biking and equestrian activities from "active" to "passive"
recreation and to remove the implication that active recreation is permitted in open
spncc areas.
I:inatly, the staff report states that a task force lbr developing a Master Plan for City-
owned agricultural land is not necessary. We strongly recommend the formation of'a
task Fore0committec to give iitpttt on the master plan. The City Itas convened
committees/task foo-ees to give input on a parking structure. The history ofthe LYtlidio
issue underscores how important the issue ofaslricultural land is to city residents. The
failure to convene a task force for the 2006 update of the COSE.against the
recotnmendarion of the Planning Commission. cost the City considerable time. money
and ill will. One hopes that history was instructive.
As an organization with a 40-year history in the cunmmunity of preservation of natural
resources and agricultural land,the Sierra Club is surprised to see that we are not
considered a stakeholder on this issue, according to the stafrreport, which states that
"Stakeholders include the citizens of San Luis Obispo, property owners. the tourism
industry, interested agricultural parties.and Cal Poly."
All local conservation organizations should be considered stakeholders in development
of the master plan for city owned agriculmral land.
