SUBJECT: Modification Of Compensation For Mayor Jan Marx For Her Current Term
Of Office
RECOMMENDATION
Adopt a resolution reducing the monthly compensation of the Mayor from $1,200 per month to
$1,100 per month, effective January 6, 2011 through the remainder of the term of office of newly
elected Mayor Jan Marx.
DISCUSSION
Council compensation and benefits are established every other year by Council action after the
Council Compensation Committee conducts a biennial review and makes a recommendation.
Council compensation was increased most recently by Resolution 9990 (2008 Series) in June of
2008. However, by action taken at its September 30, 2008 special meeting, Council subsequently
rescinded that increase, returning compensation for the Mayor to $1,200 per month, consistent with
prior compensation established in 2006 by Resolution number 9794.
Upon election as Mayor, Jan Marx advised staff that she would like to waive$100 per month of her
compensation as Mayor in recognition of the difficult fiscal situation the City is facing. Mayor
Marx does not wish to reduce the established compensation permanently in a manner that would
affect future elected officials, but does wish to reduce the compensation for the entirety of her own
current term. Thus, staff recommends that Council adopt a Resolution reducing Mayor Marx's
compensation, as requested, with an automatic return to the previously established compensation
upon the expiration of Mayor Marx's current elected term of office.
FISCAL IMPACT
This action will result in a savings of$100 per month to the City's General Fund from January 6,
2011 through the conclusion of Mayor Marx's current term of office. A total of$2;300 will be
saved through December 1, 2012.
ALTERNATIVES
Do not approve the salary reduction, in which the compensation to Mayor Marx would remain at
the currently established level of$1,200 per month.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
REDUCING THE COMPENSATION FOR THE OFFICE OF MAYOR FOR THE 2010-
2010 TERM OF MAYOR JAN MARX
WHEREAS, Charter Section 410 provides for compensation and reimbursement of
expenses for the Mayor and Council Members; and
WHEREAS, Compensation for the office of Mayor was set at $1,200 per month by
Resolution Number 9794 (2006) Series and remains at that level, as reflected in Section 2.1 of
the Council ; and
WHEREAS, Mayor Jan Marx wishes to waive $100 per month of the established
compensation for the term of her office in recognition of the difficult economic challenges facing
the City;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Effective the first full payroll period in January 2011, beginning January 6,
2011, Mayor Jan Marx shall be paid a monthly salary of $1,100 as compensation for services
rendered in her official capacity.
SECTION 2. Upon the conclusion of Mayor Marx's current term of office (2010-2012),
compensation for the office of Mayor shall automatically be adjusted consistent with the then
applicable Council compensation resolution and the Council Policies and Procedures Manual.

Council Member Andrew Carter asked for a brief history regarding the increase to the Mayor
and Council Members pay. It is summarized as follows:
1998 —The Council Compensation Committee recommended increasing the Council's pay
from $800 to $1000 per month and the Mayor's pay from $1000 to $1200 per month. This
recommendation was not adopted.
2000 —The City Council approved a pay increase for Council Members from $800 to $900
_ and a pay increase for the Mayor from $1000 to $1100.
2002 — Council approved waiving the Council Compensation process.
2004 — Council approved no increase to Council Member or Mayor pay.
2006 — Council approved (3-2 Mulholland/Brown opposed) an increase to Council Members
pay from $900 to $1000 and an increase to the Mayor's pay from $1100 to 1200 effective
January 1st 2007.
2008 — In June; Council approved a 6% increase and then rescinded this action in September
2008.
2009 — Council approved deferring the 2010 Council Compensation process.

On December 28, 2010 Council Member Dan Carpenter requested that the compensation for his
term in office be modified to $8,600 annually. The current compensation for a council member is
$12,000 annually. Council Member Carpenter indicated that he was requesting this change to
reflect his personal circumstances. The attached resolution is required to implement this change
for both Mayor Marx and Council Member Carpenter.

COUNCILMEMBER DAN CARPENTER FOR THE 2010-2012 UNEXPIRED COUNCIL
TERM OF OFFICE

expenses for the Mayor and Council Members; and
WHEREAS, Compensation for the office of Mayor was set at $1,200 per month and the
compensation for the office of City Council Member was set at $1,000 per month by Resolution
Number 9794 (2006 Series) and compensation remains at those levels, as reflected in Section 2.1
of the Council Policies and Procedures; and
WHEREAS, Mayor Jan Marx wishes to reduce her annual compensation from $14,400
to $13,200 and Council Member Dan Carpenter wishes to reduce his annual compensation from
$12,000 to $8,600 for the terms of their respective offices;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Effective the first full payroll period in January 2011, beginning January 6,
2011,. Mayor Jan Marx shall be paid a monthly salary of $1,100 as compensation for services
rendered in her official capacity.
SECTION 2. Effective the first full payroll period in January 2011, beginning January 6,
2011, Council Member Dan Carpenter shall be paid a monthly salary of $716.67 (equivalent to
an annual salary of$8,600) as compensation for services rendered in his official capacity.
SECTION 3. Upon the conclusion of Mayor Marx's and Council Member Carpenter's
current terms of office (2010-2012), compensation for the office of Mayor and for the Council
seat currently filled by Council Member Carpenter shall automatically be adjusted consistent
with the then applicable Council compensation resolution and the Council Policies and
Procedures Manual.
