PUBLIC HEARING 2. CONSIDERATION OF A GENERAL PLAN AMENDMENT AND REZONING FOR THREE PROPERTIES LOCATED ON THE NORTH SIDE OF CALLE JOAQUIN, BETWEEN LOS OSOS VALLEY ROAD AND HIGHWAY 101 (GP/R ER 70-10; 1445, 1443 AND 1433 CALLE JOAQUIN). (MAN DEVILLE/RICCI — 30 MINUTES) RECOMMENDATION: 1) Adopt a resolution approving a Mitigated Negative Declaration (ER 70-10) and an amendment to the General Plan Land Use Element map to change the land use designation of 1445, 1443 and 1433 Calle Joaquin from Tourist Commercial to Services and Manufacturing, based on findings, and subject to mitigation measures; 2) Introduce an ordinance approving an amendment to the Zoning Map for 1445, 1443 and 1433 Calle Joaquin from Tourist-Commercial (C-T) to Service- Commercial with Special Considerations overlay zone (C-S-S), based on findings and subject to mitigation measures and conditions. BUSINESS ITEMS 3. INTRODUCTION OF NIGHTTIME CURFEW ORDINANCE. (LINDEN/GILLHAM —45 MINUTES) RECOMMENDATION: Introduce an ordinance adding Chapter 9.50 to the San Luis Obispo Municipal Code prohibiting minors under 18 years of age from being in public places from 11:00 p.m. to 5:00 a.m. daily unless engaged in certain types of activities (Nighttime Curfew). 4. RAILROAD SAFETY TRAIL AND PREFUMO CREEK BRIDGE PROJECT UPDATES. (WALTER/MANDEVILLE/VAN BEVEREN — 45 MINUTES) 4 Council Agenda Tuesday; April 19, 2011 RECOMMENDATION: 1) Direct staff to continue its efforts on the alternative alignment designs for the Railroad Safety Trail, pursing approval from the State of California and utilizing City right-of-way where possible; 2) Direct staff to begin preparation of plans and specifications for the Los Osos Valley Road alternative for the Prefumo Creek Bridge Safe Route to School project.
