SPECIFICATION NO. 90961
RECOMMENDATIONS
1. Award a contract to D-KAL Engineering, Inc. in the amount of$158,985 for the Parking Lot
Slurry Seal Various Locations Project, Specification No. 90961.
2. Approve a transfer of$62,000 from the Parking Fund Capital Improvement Plan completed
projects account to this project's construction account.
3. Approve a transfer of$22,485 from the Parking Fund Capital Improvement Plan Lot Reseal
and Restriping account to this project's construction account.
DISCUSSION
On April 5, 2011, the City Council authorized the invitation of construction bids for the Parking
Lot Slurry Seal Various Locations project, Specification No. 90961 and authorized the City
Manager to award the project if the lowest responsible bid was within the Engineer's Estimate of
$115,000. Two bids were received and opened on April 28, 2011, both of which were over the
Engineer's Estimate. D-KAL Engineering, Inc. of San Luis Obispo submitted the lowest bid of
$158,985.
Both of the bids for this project exceeded the Engineer's Estimate of$115,000. This increase in
costs can be attributed to the rising price of asphalt-based products. Staff recommends awarding
this contract to D-Kal Engineering, Inc., the lowest responsible bidder, in the amount of$158,985.
FISCAL IMPACT
This project is identified in the 2009-11 Financial Plan, pages 3-272 to 3-274, and is proposed to
be funded by the Parking Enterprise Fund. The existing project account (Specification No.
90961) currently has a balance of $122,000 to support this request. An additional $62,000 is
available in the Parking Fund Capital Improvement Plan (CIP) Completed Projects account to
support this request. Another source of available funding to support this project is from the
Parking Fund ClP Lot Reseal and Restriping account which currently has a balance of$42,189.

ALTERNATIVE
Reject all bids and direct staff to re-advertise the project. The City Council may choose to reject
all bids and direct staff to re-bid the project. However,staff does not recommend this alternative
because this will delay the project without any guarantee of reduced bid amounts. Oil based
product prices are continuing to increase at this current time. Pavement conditions will
deteriorate and require more expensive treatments for repair in the future.

RECOMMENDATION
1. Approve plans and specifications for the Parking Lot Slurry Seal Various Locations Project,
Specification No. 90961.
2. Authorize staff to advertise for bids and authorize the City Manager to award the contract if the
lowest responsible bid is within the Engineer's Estimate of$115,000.00
DISCUSSION
The 2009-11 Financial Plan identified several public parking areas in and around the downtown
which are in need of resurfacing. This project will slurry seal parking lots 14, 15, Amtrak, the
driveway approaches to the Marsh Street Parking Structure, and the exterior parking area on the
north side of 842 Palm Street parking structure. This project will also mill and overlay the
parking area of 955 Morro Street with a new asphalt surface.
The existing asphalt of the 955 Morro Street parking area is in such poor condition that a slurry
seal is not a viable alternative to extend the existing asphalts useful life. The 955 Morro parking
lot is slated to be part of the Chinatown redevelopment project; however, with the recent
economic recession the start of construction for this private project is unknown. This parking lot
is a common pedestrian route between Morro St and lots 3 and 11, so staff determined it was
advisable to maintain it in a reasonable condition until it is ultimately closed to make way for the
new development. Work being done in the 955 Morro parking lot is minimal and will only
extend the useful life for another 4 or 5 years maximum.
All existing pavement marking and striping will also be removed and replaced. This project will
restripe all parking stalls and marking with thermoplastic which is more durable and visible than
regular paint.
Coordination efforts between the City, businesses, and Amtrak are ongoing. The parking area work
near the Amtrak facility will be phased into two days, and signs notifying users of the upcoming
work will be posted continuously for four weeks in advance so that public inconvenience is
minimized.

CONCURRENCE
This project is exempt from environmental review and a Notice of Exemption has been filed
through the Community Development Department.

FORM OF AGREEMENT
THIS AGREEMENT, made on this day of , 2011, by and between the
City of San Luis Obispo, a municipal corporation and charter city, San Luis Obispo County,
California (hereinafter called the Owner) and D-Kal Engineering, Inc. (hereinafter called
the Contractor).
WITNESSETH:
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1, SCOPE OF WORK: The Contractor shall perform everything required to
be performed, shall provide and furnish all of the labor, materials, necessary tools,
expendable equipment, and all utility and transportation services required to complete all
the work of construction of

in strict accordance with the plans and specifications therefore, including any and all
Addenda, adopted by the Owner, in strict compliance with the Contract Documents
hereinafter enumerated.
It is agreed that said labor, materials, tools, equipment, and services shall be furnished
and said work performed and completed under the direction and supervision and subject
to the approval of the Owner or its authorized representatives.
ARTICLE II, CONTRACT PRICE: The Owner shall pay the Contractor as full
consideration for the faithful performance of this Contract, subject to any additions or
deductions as provided in the Contract Documents,the contract prices as follows:

Payments are to be made to the Contractor in accordance with and subject to the

provisions embodied in the documents made a part of this Contract.
Should any dispute arise respecting the true value of any work omitted, or of any extra
work which the Contractor may be required to do, or respecting the size of any payment to
the Contractor, during the performance of this Contract, said dispute shall be decided by
the Owner and its decision shall be final, and conclusive.
ARTICLE III, COMPONENT PARTS OF THIS CONTRACT: The Contract consists of the
following documents, all of which are as fully a part thereof as if herein set out in full, and if
not attached, as if hereto attached:
1. Notice to Bidders and information for bidders.
2. Standard Specifications, Engineering Standards and Special Provisions.
2. Accepted Proposal.
4. Public Contract code Section 10285.1 Statement and 10162 Questionnaire.
5. Noncollusion Declaration.
6. Plans.
7. List of Subcontractors.
8. Agreement and Bonds.
9. Insurance Requirements and Forms.
ARTICLE IV. It is further expressly agreed by and between the parties hereto that should
there be any conflict between the terms of this instrument and the bid or proposal of said
Contractor, then this instrument shall control and nothing herein shall be considered as an
acceptance of the said terms of said proposal conflicting herewith.
IN WITNESS WHEREOF, the parties to these presents have hereunto set their hands this
year and date first above written.
