Walter, Director of Public Works Prepared By: Peggy Mandeville, Principal Transportation Planner rA SUBJECT: ORDINANCE AMENDING CHAPTER 10.52.030 (TIME OF OPERATION) OF THE SAN LUIS OBISPO MUNICIPAL CODE EXPANDING OPERATIONS TO INCLUDE SUNDAY RECOMMENDATION Introduce an ordinance amending Chapter 10.52.030(Time of operation)of the San Luis Obispo Municipal Code expanding operations to include Sunday. DISCUSSION Pursuant to the City Council's direction regarding parking revenue enhancements on April 5, 2011, and the 2011 Parking Fund review on June 14, 2011, staff is bringing forward recommended changes to Chapter 10.52.030 (Time of operation) of the San Luis Obispo Municipal Code to expand parking services to include Sunday from 1:00 pm to 6:00 pm. Expanding parking meter rates to include Sundays requires modification by ordinance pursuant to California Vehicle Code section 22508. Downtown parking has been free on Sundays. Downtown business hours have changed dramatically since parking meters were installed approximately 60 years ago when most businesses were closed on Sunday to most now remaining open. By expanding parking services to include Sunday, the fixed costs to operate and maintain these parking spaces are equitably paid for by all of the users. Currently these costs are covered by those paying for parking from Monday to Saturday; essentially subsidizing free Sunday use. CONCURRENCES Prior to the April 5, 2011 Council meeting, staff presented the staff recommendation to the Downtown Association Parking & Access Committee. The Committee and the Downtown Association Board of Directors voted to support Sunday parking. FISCAL IMPACT Staff estimates the following revenues and expenses associated with charging for parking on Sunday. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Section 10.52.030 (Time of Operation) of the San Luis Obispo Municipal Code is hereby amended as follows: The provisions of this chapter relating to the operation of parking meters shall be effective between the hours of nine am. and six p.m. every Monday to Saturday and one p.m. to six p.m. every Sunday;provided, that for good cause and upon a finding that such action will not jeopardize meter revenues as a necessary source of revenue for payment of outstanding bonded indebtedness, the council by resolution may temporarily suspend the parking meter operating provisions of this chapter for any or all of the city's parking meters. Once we know the date we will start charging for parking on Sundays, we will contact the downtown churches, the Downtown Association, and the Chamber as well as notify the media and post notices in an effort to get the word out.
